222. “That Dáil Éireann: notes: — the increasing importance of digital communications platforms such as Facebook and Google during national elections and referendum campaigns; — the Cambridge Analytica scandal which highlighted how outside interests can use online tracking and advertising tools to influence national elections; 1265

— that advertising on such platforms is not regulated under existing election advertising rules; — the work of the Transparent Referendum Initiative in recording the source and number of adverts carried on such platforms during the recent referendum campaign; — how both Facebook and Google decided, with just three weeks to go to polling day, to amend their own rules to restrict the carrying of advertising in relation to the referendum for the remainder of the campaign; — the need to understand whether the volume of advertising from overseas was a factor in those decisions; and — the opportunity that exists to set a precedent on the need for transparency surrounding such advertising; calls on the relevant social media companies to: — work with the Transparent Referendum Initiative to provide details on the volume and value of referendum advertising that was carried on their platforms during the recent referendum to repeal the Eighth Amendment of the Constitution of Ireland; and — publish such data in a prompt manner and in accordance with the provisions of the General Data Protection Regulation (GDPR) European Directive; and calls on the Government to commit to finalising the necessary legislation to ensure there is proper regulation of such online election advertising in the future, including mechanisms to provide full transparency on the level and source of such advertising expenditure.” — Eamon Ryan, Catherine Martin.

223. “That Dáil Éireann: notes that: — with 34.4 million air passengers in Ireland in 2017, there has been an increase in the use of air travel over many years; — there is a probable impact of increased traffic at Irish airports due to the United Kingdom’s decision to leave the European Union (EU); and — the Dublin Airport Authority (DAA) is now planning for up to 50 million plus passengers per annum at Dublin Airport alone; further notes that: — EU Directives, planning conditions and environmental impact studies have developed over the past 20-25 years, leading to stricter noise conditions being imposed on developments by airports; — Dublin Airport runway 10R 28L currently has night flights and with a planning condition for no night flights to take place on the new northern runway 10L 28R, all night flights would be directed onto the older runway; — over 250 European airports, including London Heathrow and Frankfurt, have longstanding restrictions on night flights; — homes recording noise levels of 63 decibels are to be offered insulation and those 1266

affected by 69 decibels are to be offered relocation via a voluntary buy-out scheme; — the community of St. Margaret’s The Ward and St. Margaret’s received a level of insulation for their homes and schools following a public period of negotiation with the then Aer Rianta, and this level of insulation has not been reviewed or upgraded since; — the new northern runway and indeed the existing runway have impacted and will impact further on the value of the properties within certain noise contours, and will also impact on the health of the residents and the environment of the local communities; and — local residents believe, however that the economic importance of Dublin Airport and the necessity for growth can co-exist with the local community, with proper insulation and sound barrier technologies installed, reasonable noise controls and a voluntary buy-out scheme for those who decide they need to leave; and calls on the Government to: — restrict air travel between the hours of 11.30 p.m. and 5 a.m. on all runways; — instruct the Environmental Protection Agency to carry out independent noise pollution investigations in a selection of homes affected by noise pollution from runway 10R 28L and the proposed new northern runway 10L 28R; — examine European best practice for insulation and ensure that all homes receive this level of support; — ensure that the homes affected by the older 10R 28L runway are provided with the same level of insulation as the homes affected by the new northern runway 10L 28R; — direct the DAA and other airport authorities to offer either improved insulation or a voluntary buy-out scheme to those homes affected, and for insulation and the voluntary buy-out option to be reviewed/upgraded every 5-7 years; and — bring forward the noise pollution legislation promised but never enacted by previous Governments.” — Thomas P. 224. “That Dáil Éireann: notes that the Health Service Executive (HSE) submitted an audit report to the Government on 11th June, 2018, confirming that, in general, Section 39 organisations had maintained alignment with HSE pay scales during the Financial Emergency Measures in the Public Interest (FEMPI) cuts and that pay cuts averaged around 4.66 per cent since 2010; further notes that: — a private members’ motion was agreed by Dáil Éireann in January 2018, calling on the Government to undertake such an audit and analysis, and to commit to reimbursement of any cuts found; — Section 39 organisations are in agreement with staff and unions that pay restoration is due to staff as per the Lansdowne Road Agreement (Public Sector Stability Agreement 2018-2020) but, in general, they are unable to meet these increased pay demands from their own restricted funds; — the Labour Court recommendation LCR21609 on 20th November, 2017, between the Irish Wheelchair Association (IWA) and the Services, Industrial, Professional and 1267

Technical Union (SIPTU) confirmed the alignment between the IWA pay scales and the HSE; — the Labour Court recommendation LCR21609 on 20th November, 2017, also criticised the HSE’s administrative requirement for the IWA and SIPTU to engage in the industrial relations process; — industrial action is due to take place across Section 39 services on 18th September, having been deferred since February to allow for talks; — funding has still not been provided to Section 39 organisations to restore pay in line with HSE pay rates; — delays are merely increasing the amounts due to staff incrementally and creating distress and unease for staff and services; — due to lack of pay restoration, Section 39 organisations find themselves under extreme pressure in relation to recruitment and retention of staff; and — the work of Section 39 organisations and their staff is of importance, and that industrial action for the large numbers of vulnerable service-users would be a catastrophe; and calls on the Government to: — immediately implement the motion as passed by Dáil Éireann on 17th January, 2018, calling for restoration of pay for staff of Section 39 organisations; and — instruct the HSE to immediately provide the additional funding to the Section 39 organisations found in the HSE report, of which a copy was submitted to the Government on 11th June, 2018, to meet pay restoration obligations to staff.” — Thomas P. 225. “That Dáil Éireann: recognises that: — post offices provide crucial economic, administrative and social services to communities all around Ireland, especially to those in rural and isolated areas; — many citizens depend on post offices in order to access basic State services, including social welfare payments and passport applications, as well as key financial services including insurance, banking and foreign exchange; — this Government and the previous Government have stripped vital State services away from rural communities, including rural transport links, support for small schools, and rural Garda stations; — previous post office closures took place as the result of population decline and not as the result of a pre-meditated programme to drastically reduce the number of post offices that are present in rural areas; — technological and societal changes have presented significant challenges to the existent post office business model, and that significant change is required in order to ensure the viability of the An Post network; 1268

229. “That Dáil Éireann: recognises that: — the State and the Government have a duty of care to members of the Defence Forces; — a number of former Air Corps personnel have taken legal action against the State as a result of illnesses believed to be caused by exposure to toxic chemicals during their employment; — hundreds and possibly thousands of current and former members of the Air Corps may be affected by exposure to chemicals during their employment; and — information provided by whistleblowers to the State outlines 73 deaths of serving and 1271

230. “That Dáil Éireann: notes that: — it is estimated that 90,000 to 180,000 people are affected by fibromyalgia in Ireland; — fibromyalgia is a debilitating condition, with chronic pain and fatigue being the primary features; — there are no nationwide specialist facilities or comprehensive treatments available; — those living with fibromyalgia have encountered difficulties when trying to access social welfare, and instead of getting vital support at a crucial juncture in their illness, they are being refused and stigmatised, and as a result experience stress; 1272

— the condition is significantly misunderstood; and — the majority of those affected by fibromyalgia are women, at a ratio of 6:1; agrees that: — a national registry of the chronic pain syndromes and clinical guidelines for different types of chronic pain, as per the International Classification of Diseases codes and International Association for the Study of Pain – World Health Organization (WHO) guidelines, be drawn up to assist medical practitioners to better understand different types of chronic pain syndromes and to be able to differentiate according to WHO international guidelines; — the delivery of care is limited by the lack of commitment to the diagnosis and treatment of fibromyalgia in addition to the deficiencies in resources currently available in community, primary and secondary care; — the delivery of care is also hampered by the absence of clear guidelines for management, and the lack of opportunity to develop integrated care pathways across primary and secondary care; — many people with fibromyalgia suffer from chronic pain; — access to psychological therapies is a paramount need in health service development, together with improved access to all multidisciplinary health treatments; — patient education and self-care is a vital aspect of management of fibromyalgia and optimal benefits are obtained when sufferers acquire skills in helping reregulation of the autonomic nervous system and other systems as well as pain and stress management skills; — access to a recognised pain programme and pain psychologist, autogenic training, mindfulness and yoga can be especially helpful as part of comprehensive cognitive behavioural therapies, as well as appropriate exercise to improve mobility and function together with dietary adjustment, and in some cases the person with fibromyalgia is able to return to work; — fibromyalgia should be recognised as a disability by the State for people with severe symptoms who have the condition on a long-term basis and which has proved unresponsive to interventions, and in these cases alternative treatments such as access to medicinal cannabis should be explored, and access to medicinal cannabis through the Cannabis Access Programme should be considered; and — reliance on opioid based medicines is not desirable; and calls on the Government to: — establish an effective and sustainable model of care to diagnose, manage and treat fibromyalgia; — bring an end to prescription charges; — reduce/remove the monthly limit on the cost of medications for non-medical card holders; — develop a model of care based on international best practice; — implement a strategy to set up a framework where those living with fibromyalgia and myalgic encephalomyelitis (ME) are clearly recognised; — conduct a review of the long-term illness scheme, as it has not been updated since 1970 (49 years ago); — carry out a dedicated and rigorous review of the underlying causes of the condition; 1273

231. “That Dáil Éireann: notes that there are approximately 70 people, including 26 children, in Ireland with Spinal Muscular Atrophy (SMA), which is a rare and life-limiting muscle-wasting condition; further notes that: — SMA is the number one genetic cause of death for infants worldwide; — SMA will affect around 1 in 11,000 babies born worldwide each year; — there are four different types of SMA, with Type 1 SMA being the most severe and most common; — Spinraza (Nusinersen), produced by Biogen, is the first treatment for SMA and is available in 25 of the 28 countries in the European Union; — in February 2019, the Health Service Executive (HSE) did not approve Spinraza (Nusinersen) for reimbursement and negotiations with Biogen are ongoing; — patients deteriorate when they stop taking Spinraza (Nusinersen) and real life testimony has been given to confirm the efficacy of the drug; — 25 of the 64 Health Technology Assessment (HTA) reports which were submitted in the period from 1st January, 2016 to 30th November, 2018 related to orphan medicines, with 12 of these having been approved at the beginning of January 2019, and ongoing deliberations or commercial negotiations are continuing for 13 of these medicines; — a 2017 Grant Thornton review of the National Centre for Pharmacoeconomics (NCPE), indicated that it was understaffed, at 8.5 whole-time equivalents, and that an additional 9 staff, including senior pharmacists, HTA assessors and statisticians, would be required to meet the additional workload; and — with revenue and profits often in the billions, pharmaceutical companies also have a moral obligation to enter into negotiations with fair pricing, so as not to prolong the reimbursement assessment and deliberation process; and calls on the Government to: — meet with adults and children with SMA, and their parents, to listen to their call for Spinraza (Nusinersen) to be approved for reimbursement; — urgently direct the HSE to speed up negotiations with Biogen, the pharmaceutical company producing Spinraza (Nusinersen), because time is of the essence for these patients; — increase the resources available to the NCPE and the HSE Corporate Pharmaceutical Unit to allow for a quicker assessment, negotiations and approval of new treatments; 1274

— reduce the time allowed under the Framework Agreement on the Supply and Pricing of Medicines, and in line with the Health (Pricing and Supply of Medical Goods) Act 2013, for a decision by the HSE from 180 days of receiving the application down to 90 days, with a maximum of 120 days if further information is needed from the company; — revise the National Rare Disease Plan for Ireland 2014-2018, and include greater input from patient advocacy groups and improve the remit of the Rare Diseases Medicinal Products/Technology Review Committee, to be in line with the Scottish Patient and Clinician Engagement model; — introduce an orphan drugs levy on pharmaceutical companies and create an orphan drugs fund; — provide a report to Dáil Éireann by the end of quarter 3, 2019, to outline the impact of our membership of the BeNeLuxa initiative; and — ensure that the review of the HSE reimbursement and pricing decision-making process is completed by the end of quarter 3, 2019.” — Thomas P.
