No. 5200. An Act to authorize the Raising of Money for Irrigation Works, Water Supply Works, Drainage and Flood Protection Works in Country Districts and Works under the River Murray Waters Acts, and to sanction the Issue and Application of the Money so raised and of other Money available for such purposes under Loan Acts or in the State Loans Repayment Fund, and for other purposes. [24th December, 1946.] E it enacted by the King's Most Excellent Majesty by B and with the advice and consent of the Legislative Council and the Legislative Assembly of in this present Parliament assembled and by the authority of the same as follows (that is to say):— 1. This Act may be cited as the Water Supply Loans short titio. and Application Act 1946. 2. (1) For the purposes of this Act the Governor in Power to raise ..v ' x x moneys. under the authority of the Victorian Government Stock Act 1896 by an additional amount not exceeding in the whole Two million eight hundred and sixty-seven thousand pounds ; or (b) may issue debentures for the whole or any portion of such sum in lieu of increasing stock as aforesaid-— all of which stock and debentures and interest thereon respectively at such rate or rates as the Governor in Council may fix shall be chargeable upon the consolidated revenue of Victoria.

Application of (2) All provisions of the Victorian Government Stock Victorian Government Acts with regard to the inscription issue management Stock Acts NOB. 1408, redemption payment of interest on and transfer of stock 2403, 30515, 3297, 3544. issued under the authority of the Victorian Government Stock Act 1896, and generally with regard to such stock, shall so far as the same are not inconsistent with this Act apply to the stock issued under the authority and for the purposes of this Act.

Application of (3) All provisions of the Victorian Government Victorian Government Debentures Regulation Acts with regard to the issue Debentures Regulation management redemption and payment of interest on ActH NOK. 2404, 3054, debentures, and generally with regard to such debentures, 3513 B. 3. shall so far as the same are not inconsistent with this Act apply to the debentures issued under the authority and for the purposes of this Act. Construction (4) This section shall be read and construed as subject subject to provisions of to the provisions of the Commonwealth and States Financial Nos. 3554 Ac. Agreements Acts.

Proceeds of 3. The proceeds of the sale of the said stock or of the sale of stock and debentures. said debentures shall be issued and applied only for irrigation works water supply works drainage and flood protection works in country districts and works under the River Murray Waters Acts in such manner as is provided in this Act or as Parliament may by any Act hereafter direct.

Issue- and 4. There may be issued and applied— application of £2,867,000 out of (a) out of the proceeds of the sale of the said stock moneys raised under this Act, or of the said debentures ; or Loan Funds and the State Loans (b) out of any other loan authorized by Parliament Repayment Fund. and appropriated by Parliament for irrigation works il GEO. works water supply works drainage and flood protection works in country districts or works under the River Murray Waters Acts; or (c) out of any moneys in the State Loans Repayment Fund- any sums of money specified in the Schedule to this Act schedule. in the column headed " Proposed Provision " not exceeding in the whole Two million eight hundred and sixty-seven thousand pounds.

5. (1) Pursuant to the provisions of Part. VII. of the Loans^o Water Ad 1928 the Governor in Council may advance on frusta. account of any loan to each waterworks trust named in S'VII.1 the First Part of the Schedule to this Act any sum or sums l^t part of not exceeding the amount specified in such Part in the Sclleclule• column headed " Proposed Provision" opposite to the name of such trust. (2) Notwithstanding anything in the last preceding sub-section the Governor in Council within six months after the date on which any such advance is made may on the recommendation of the Minister of Water Supply determine what part, if any, of such advance shall be charged to the Capital Expenditure Borne by the State Account and the liability for that part shall be borne by the State accordingly and shall not be deemed to be advanced pursuant to the provisions of Part VII. of the Water Act 1928.

State Account and the liability for that part shall be borne by the State accordingly and shall not be deemed to be advanced pursuant to the provisions of Part III. of the Mildura Irrigation, and Water Trusts Act 1928.

Loans to local 7. Loaim to 8. (1) Notwithstanding anything in the Geelong Water- Uoeloiig and Sale. ivorks and Sewerage Act 1928 or in the Local Government Noa. 3092, 3720 Ac. Acts the Governor in Council may advance on account fourth Part of Schedule. of any loan to each authority named in the Fourth Part of the Schedule to this Act any sum or sums not exceeding the amount specified in such Part in the column headed " Proposed Provision " opposite to the name of such authority in all respects as if each such authority were an authority within the meaning of the Water Act 1928. (2) Any sum so advanced to either such authority shall be expended on the improvement and extension of water supply works within the urban centre of such authority. (3) Any sum so advanced to either such authority shall be charged to the Capital Expenditure Borne by the State Account and the liability therefor shall be borne by the State accordingly and shall not be deemed to be a liability of such authority. 9. 9. The sum specified in the Fifth Part of the Schedule Expendlturr to this Act in the column headed " Proposed Provision " Se?"™'1 may be expended by the State Rivers and Water Supply of Schedule. Commission for the purposes mentioned in the said Fifth Part.

10. (1) The sum specified in the Sixth Part of the Expenditure Schedule to this Act in the column headed " Proposed under Sixth Provision " may be expended under and pursuant to the SiA. River Murray Waters Acts. Nos-2m &0- (2) Any sum so expended shall be charged to the Capital Expenditure Borne by the State Account and the liability therefor shall be borne by the State accordingly.

11. (1) The sums specified in the Seventh Part of the Expenditure Schedule to this Act in the column headed " Proposed under1-seventh Piirt nf Provision" may be respectively expended by the State Schedule. Rivers and Water Supply Commission for the purposes mentioned in the said Seventh Part. (2) Any sum so expended shall be charged to the Capital Expenditure Borne by the State Account and the liability therefor shall be borne by the State accordingly and shall not be deemed to be a liability of any authority. (3) Notwithstanding anything in the last preceding sub-section the Governor in Council on the recommendation of the Minister of Water Supply may from time to time by Order adjust any expenditure made under sub-section (1) of this section by transferring from the State to any district or division concerned the liability for such amount of any such expenditure as the Governor in Council considers reasonable having regard to the development of such district or division ; and thereupon the liability for any amount so transferred shall be transferred out of the Capital Expenditure Borne by the State Account and he charged in the books of the State Rivers and Water Supply Commission to such district or division and be a liability of the appropriate authority accordingly. the consolidated revenue (which is hereby to the necessary extent appropriated accordingly) to the National Debt Sinking Fund in each and every financial year for a period sufficient to provide for the redemption of such amount of loan liability as aforesaid shall be Fifteen shillings per centum of such amount of loan liability.

Limitation of 13. Notwithstanding anything contained in any Water expenditure from loans for Supply Loans Application Act in force before the water supply &c. commencement of this Act no money shall by virtue of any such Water Supply Loans Application Act be expended out of any loan funds for loans to waterworks trusts or local governing bodies or for or towards any irrigation works or water supply works or for drainage or flood protection works or for the purchase or acquisition of plant or NOS. 2506 &c. machinery or for works under the River Murray Waters Acts other than such as are specified respectively in the schedule.
