Convene as Board of Canvassers and Declare a Quorum Present

Mr. Shalleck called the Board Meeting to order and declared a quorum present at 4:00 p.m.

1 Certification and Audit of Election

Ms. Jurgensen presented five copies of the certification documents prepared for the State Board of Elections. The certification documents reflect votes cast for the respective candidates. Once signed by the Board President and Secretary, copies will be provided to the State Board of Elections, Montgomery County Clerk of the Court, and a copy will be kept on site. Ms. Jurgensen briefly reported on Voting System Operations, Voter Registration Operations, Polling Place Operations, the Canvass, and Audit (See Attachment A).

Ms. Jurgensen provided Audit reports of Election Day Precinct voting and the number of Absentee and Provisional ballots issued and received. Ms. Keeffe asked why precinct 13-46 reflects two more ballots cast than Voter Authority Cards issued. Ms. Jurgensen responded that staff investigates all issues, and it was concluded to be an election judge error. Ms. Jurgensen stated that due to several errors on behalf of the judges, a new process will be implemented at the polling places to easily distinguish provisional tables for those voters. Ms. Phillips thanked Ms. Jurgensen for doing this. Ms. Jurgensen stated that further reports will be provided at the June Board meeting.

Ms. Keeffe was pleased that 98.4% of the results were completed by 11:00 p.m. She noted that there was a delay in reported results due to Baltimore City's hour extension to close the polls.

Ms. Jurgensen stated that at the May 16 Board meeting she would further discuss her recommendation to have two scanners at each polling place.

Ms. Keeffe inquired what the overall turnout was and Ms. Jurgensen provided her the information. Mr. Shalleck inquired if the turnout information is provided on the Board of Elections' website; Ms. Jurgensen confirmed that it is.

Ms. Keeffe questioned whether a May 16 Board meeting is needed. Ms. Jurgensen said she would not have a lot to report to the Board, but would be asking the Board for permission to send a letter to the County Executive and the County Council to request 170 additional scanners. Ms. Phillips asked if the letter could be discussed by email instead of having a meeting.

Mr. Shalleck stated that the Board of Elections is in compliance with the State Board of Elections in terms of certifying the Primary Election and, in his opinion, the Board of Elections has met the requirements and all documents have been signed and certified. (See Attachment B for draft copies of the documents that were signed at this meeting, and Attachment C for copies of the revised documents signed on May 13, 2016.)

Ms. Keeffe moved to adjourn the Board of Canvassers. The motion was seconded by Ms. Phillips and carried unanimously. The Board of canvassers meeting adjourned at 4:20 p.m.

Voting System Operations

A. Logic and Accuracy Testing Conducted and testing materials submitted to the Maryland State Board of Elections (SSE) on April 8, 2016.

8 Voting Unit/Poll Book Allocation Submitted March 28, 2016; planning of the allocation began on November 11; 2015.

C. On Time Opening All Early Voting Centers opened on time each day.

All polling places opened on time except for Precinct 09-18, Fox Chapel ES which opened at 7:03 a.m. Chief Judges have been contacted, no problems reported the night before.

D. Voting System Verification The 100% verification test was conducted on April 27, 2016, as required and was submitted to the SSE that day.

E. Offline Provisional Ballots Issued Montgomery County acknowledges that off-line provisional ballots were issued to voters who were clearly in the poll book and who should have been issued a standard ballot. Provisional ballot instructions will be reviewed with elections during training for the General Election.

Voter Registration Operations

A. Comprehensive monthly audit of the voter files was conducted and submitted monthly as required by the SBE and Legislative Audit Services.

Polling Place Operations

A. Election Judge Training was conducted in accordance to the training materials and software provided by the SSE. Training commenced on January 18, 2016, with poll book software/training materials arriving on February 23, 2016. Training materials for Same Day Voter Registration were provided on April 1, 2016.

8. Polling Place Evaluations Conducted during Early Voting and on Election Day and will be submitted to the SBE within 30 days of the election.

C. Accessibility All polling places met accessibility requirements in accordance to COMAR.

D. Ballot Accounting Not due until 30 days following completion of certification.

Canvass Audit

A. Precinct Audit - Completed

B. Absentee Audit - Completed

C. Provisional Audit - Completed

D. Election Results Reporting Election results were 98.4% complete by 11 :00 p.m., on April 26, 2016. Three precincts had corrupted flash drives that required Board staff to wait for the back-up memory stick to arrive with the Election Judges and Precinct 13-05 was delayed because they needed to scan the ballots from the early morning issue.
