Final Remarks 233 Abstract The COVID-19 pandemic has posed an unprecedented challenge, with governments resorting to different legal strategies to respond to the health emergency. This article offers a cross-cuting comparative analysis of measures taken during the first six months of the pandemic (the “first wave”) in four European jurisdictions with significantly different constitutional settlements – namely France, Germany, Italy, and the United Kingdom. It explores the influence of specific constitutional features on the legal responses to the pandemic and how, in turn, these responses have the potential to reconfigure the institutional frameworks in place. Aims The measures adopted by most governments in the first half of 2020 to tackle the spread of the novel coronavirus greatly restricted a vast array of fundamental rights. From freedom of movement and assembly to religious rights, family rights, rights to privacy, free speech, and economic initiative, few domains were left untouched. What is more, many adopted measures were exceptional from at least two points of view: first, several governments resorted to novel or rarely-used legal instruments; secondly, these measures have (or have had) the potential to induce broader institutional change, including as regards constitutional arrangements. The legal responses to the pandemic varied significantly across countries, a fact which has prompted numerous analyses. DOI 10.17104/0044-2348-2021-1-147 ZaöRV 81 (2021) https://doi.org/10.17104/0044-2348-2021-1-147, am 29.09.2021, 01:48:49 Open Access - http://www.nomos-elibrary.de/agb 150 Golia/Hering/Moser/Sparks comparative legal studies dealing with the legal repercussions of the pan- demic.2 Further, several international bodies have compiled sets of principles or best-practice documents to protect fundamental rights amid the pan- demic.3 As yet, however, few contributions have conducted cross-cutting com- parative analyses of the impact of emergency measures on the structures and functioning of the systems involved.4 In particular, three interrelated ques- tions remain underexplored: 1) To what extent have constitutional features shaped the legal responses of governments to the pandemic? 2) Which constitu- tional features have impacted significantly on the responses to the pandemic, and how important were rule of law considerations in this context? 3) And which of these features are likely to produce long-lasting institutional effects?5 To respond to these questions we develop a comparative analysis of trends within four European constitutional systems, namely France, Germany, Italy, and the United Kingdom (UK).     THE BULLETIN The Venice Commission was requested by the Constitutional Court of Romania, currently holding the presidency of the Conference of European Constitutional Courts (CECC), to produce a working document on the topic chosen by its Circle of Presidents at the preparatory meeting in Bucharest in October 2009 for the XV th Congress of the CECC. The topic was the following: “The relations of the Constitutional Court with other state authorities. Sub-topic 1: relations between the Constitutional Court and parliament. Sub-topic 2: conflicts of competence. Sub-topic 3: the execution of judgments.” The present working document is a contribution by the Venice Commission to the success of the Congress. Constitutional courts are the independent guarantors of the constitution and their main task is to protect the supremacy of the constitution over ordinary law. Over time, however, these courts have taken on further tasks, such as safeguarding the individual against the excess of the executive or providing a safeguard against judicial errors. Another very important role of these courts is to act as a neutral arbiter in cases of conflict between state bodies. Parties to such a conflict know that they can turn to the Constitutional Court for a decision that will help them in resolving their conflict based on the constitution. The possibility of turning to the court in itself sometimes incites them to settle their disputes before they even reach the court. In order to function correctly as an effective institution that stands above the parties in such a dispute, Constitutional Courts need to be independent and need to be seen as being independent.

Among these is the work known from the Arabic version of its title as the Almagest, which catalogues over a thousand stars, defining the position of each and explaining how to construct a celestial globe. His Geographia can be seen as a logical sequel. It gives the latitude and longitude of places, ideally from astronomical observation, as a basis for drawing maps of individual regions and of the whole world, and discusses possible ways of projecting the curved surface of the world on to the flat surface of a map. Ptolemy saw the world as a complete sphere, but the inhabited area as only a part of it, stretching south some 16 degrees beyond the Equator, north to about the Arctic Circle, east a little beyond Malaya, and bounded on the west by the Atlantic. Although his lists locate places by their geographical coordinates it is clear that these did not all come from immediate observation but were worked out from whatever information was available, such as accounts of journeys giving distances from one place to another; this means that their appearance of great accuracy is often spurious. The oldest surviving manuscript of Ptolemy’s Greek text was copied more than a thousand years after he wrote; it dates from the late 12th or early 13th century.

The Federal Republic of Germany and International Security1 Two years ago, when I first proposed this topic, I had some trepidation about its relevance to current NATO policy. Forty-eight months of work on the topic and the rush of events especially in Central and East Europe since that time have convinced me both of its timeliness and of its relevance. Germany's role in SFOR in Bosnia since 1996, the very positive deployment of the German Army (Bundeswehr) in flood-relief work along the Oder River on the German- Polish border in the summer of 1997, and even the most recent revelations of neo-Nazi activity within the ranks of the Bundeswehr, have served only to whet my appetite for the project. For, I remain convinced that the German armed forces, more than any other, can be understood only in terms of Germany's recent past and the special military culture out of which the Bundeswehr was forged. Introduction The original proposal began with a scenario that had taken place in Paris in 1994. On that 14 July, the day that France annually sets aside as a national holiday to mark its 1789 Revolution, 189 German soldiers of the 294th Tank-Grenadier Battalion along with their twenty- four iron-crossed armoured personnel carriers for the first time since 1940 had marched down the Champs-Elysées in Paris.
