The Director of Development reported that the owner of this site had been unable to start work within the time stipulated in the Council's offer of financial assistance towards repairs, but following the conclusion of his negotiations with English Heritage, he now proposed to commence work not later than 22nd September 1986.

Resolved that the offer of financial assistance towards the repair of the listed buildings at Homer's Corner be reaffirmed, accepting the revised starting date of the 22nd September 1986. (10823) (DD)

405. ILLUMINATED FORECOURT SIGNJ ASHINGDON SERVICE STATION, ASHINGDON ROAD, ROCHPORD — APPLICATION FOR ADVERTISEMENT CONSENT ROC/39/85/AD

The Committee considered the report of the Director of Development on this application which had been allowed on appeal to the Department of the Environment, subject to the existing 7 metre sign being reduced in height to overcome its visual impact to the street scene. Members noted that consent was granted in accordance wtth the appeal decision, but the sign remained at its original height and the applicants had not been forthcoming with details of when it would be reduced. Resolved that the Secretary to the Council be authorised to take all necessary action, including the issue and service Qf Notices and action in the Courts to remedy the breach of planning control, including those under the Advertisement Regulations, now reported. 406. UNAUTIIORISED ADVERTISEMENTS AND OTHER DEVELOPMENT AT RAYLEIGH LANES, 89 HIGH STREET, RAYLEIGH

The Director of Development reported on a number of current contraventions at this site within the Rayleigh Town Centre, including the provision of various advertisements and illuminations without the benefit of consent under the Advertisement Regulations to the detriment of the street scene and the amenity of the area.

Being mindful of similar contraventions at this site previously, the Committee considered the advertisements and appearance of the building to be inappropriate in this part of the Town Centre and damaging to the Rayleigh Conservation Area in general.

Resolved that the Secretary to the Council be authorised to pursue all necessary action, including the issue and service of Notices and action in the Courts to secure the remedying of the breaches of planning contro], including those under the Advertisement Regulations, now reported. (12079) (SEC)

407. UNAUTHORISED DEVELOPMENT AT ROSEBUD COTTAGE, THE CHASE, ASHINGDON

The Committee had before them a report of the Director of Development concerning the unauthorised replacement of external walls and new foundations at this dwelling within the Metropolitan Green Belt.

It was noted that a planning application had now been received and that no further work would be carried out prior to its consideration by the Committee. In those circumstances, Members concurred with the suggestion that the question of enforcement action should be deferred to enable the application to come forward for determination. (4025) (SEC)

1000982 EEPORP: This site, currently used as a country club, is situated within an area allocated for residential development. Bearing in mind the proposed restrictions in the Local Plan for development along the river frontage i.e. low density development, it would seem appropriate to indicate to the applicants that the local planning authority would wish to see only low density housing on this site, and it is suggested that a letter accompanies any planning consent that Members decide to grant.

No details have been submitted to indicate the proposed layout or number or type of residential units and it is understood that outline permission is required to enable the land to be sold. Subject to the density being kept fally low, there are no town planning objections to residential development of the site and the suggested conditions provide the local planning authority with full control over the type of development which may be approved when details are eventually submitted.

Only fruit trees and a few small Willows, Hawthorns, etc. exist on the site, together with a pond and club buildings.

Anglian Water has no objections to the proposal. The Hullbridge Parish Council feels that no development should be permitted which has a higher density than that of the surrounding development. The County Surveyor has no objections subject to details of any roads and accesses being submitted in due course and subject to adequate sight splays and improvements to Pooles Lane where it abuts the site. The Director of Health and Housing has no adverse comments to make.

The normal parking standard for this form of development is one space for each practitioner - four in this case and a district nurse — and one space for every two members of staff present and two visitors' car parking spaces for each consulting room - four in this case. It will be apparent that the number of spaces is minimal, although the Agent has now increased the number to eight. Furthermore, the applicants have stated that :—' 1. there are never likely to be more than three doctors consulting at one time;

The nearby Castle Road Public Car Park could be used by patients and the Agent has stressed that the fears of the residents in Hilltop Close can be overcome as there will be no pedestrian or vehicular access to that road which might have encouraged on—' street parking of patients' cars. Members may be aware that double yellow lines are in existence up to a point adjacent to the site access.

Outline application to erect a detached bungalow. J.R., L.M. & R.D. Graham, do R.D. Graham, 32, Crown Hill, Rayleigh, Essex. S Frontage: 25m. Depth: 20m. approx. (width 7Th. approx.) Density: lOd.p.h.

RECOMt4ENDAT ION: REFUSAL, FOR THE FOLLOWING_REASONS:

1. The proposed development would appear unduly cramped and its proximity to existing curtilages in Mount Close would result in an unacceptable loss of amenity to the adjacent occupiers. This could be amplified by the difference in ground levels.

2. The erection of a bungalow would be out of keeping with the form and character of the existing dwelling in The Bailey.

S 3. The proposal is contrary to Policy LT.3. of the Rochford . Draft District Local Plan which states that the District Planning Authority will encourage the retention of existing private playing fields, sports grounds and open spaces. The Rochford District Local Plan Rayleigh Town Centre Inset shows that part of the site is within an area of private open space. Furthermore, the proposal is close to and will have an adverse effect on the setting of Rayleigh Castle Ancient Monument No. 39.

4. The site is an important foraging ground for badgers from setts on adjacent land and the loss of this foraging ground will be detrimental to the badger population.

5. The development of the site would require the removal of established hedgerows at the end of The Bailey which for!as an important visual feature in the setting of The Bailey.

REPORT:

The site is zoned residential within the Approved Review Development Plan biit the extreme north western corner falls within an area designated as Private Open Space in the Rochtord District Local Plan. It is within the Rayleigh Conservation Area as extended and the Scheduled Ancient Monument of Rayleigh Castle.

Three previous applications for residential development have been refused, one of which was dismissed on appeal. The most recent application (R0C/395/85) was for a detached house in a slightly different position and was refused on grounds of overlooking properties in Mount Close and removal of established hedgerows. At that time the Committee indicated that assistance would be given in an attempt to overcome the problems. The applicants now seek to overcome these objections by revising the siting, restricting the development to a bungalow and removing part of the hedgerow.

However, an earlier application (ROC/374/79) was for a split level bungalow sited in line with properties in The Bailey With detached garages near the turning head of The Bailey. Refusal on grounds of the restricted plot width making it incompatible with the form and character of The Bailey, overlooking of Mount Close dwellings and removal of established hedgerows was supported on appeal. The Inspector felt that the development proposed was not in harmony with existing properties in The Bailey and that an effort was being made to squeeze a dwelling onto a small site as an afterthought.

000989 Consultations: National Trust - object because the development is close to Ancient Monument No. 39, will have an adverse effect on the Trusts' nearby property and conflics with Rochford District Local Plan Policy LT4 (retention of prhkate open space). County Planner — development appears cramped. Essex Badger Control — object as site adjoins badger sett and foraging area. Local residents in The Bailey, Mount Close and Castle Drive have submitted representations against the proposal on grounds of intrusions, loss of privacy, detriment to existing enviroment, natural features and wildlife, adverse effect on Ancient Monument, undesirable traffic/parking implications. This is a very brief summary of the main heads of representation. 000990 REPORT: This application has generated strong objections from six residents in the area together with three letters of support. The objections raised support the recommended reasons for refusal. The Whitehouse Residents Association and the Rayleigh Civic Society express similar views. The County Surveyor has no objection to the enclosure subject to the fence being sited clear of a 2.lm. x 30m. vision splay and confirms that the site is not maintable highway. The original planning permission granted in 1957 (Ref. No. RAY/Si/Si) require areas to be laid out and maintained to ensure a satisfactory appearance to the estate. REPORT: "Foxhunters1' is a large detached dwelling in the Green Belt, at one time used as a country club, which would provide five double bedrooms and a single staff bedroom. No adverse comment has been received from either the Social Services Department or the Fire Officer. Representations have been received from the occupiers of 399 and 401, Rectory Road who are concerned that (a) the private foul sewerage system which runs across their property will become blocked more frequently as a result of the development and (b) the development will lead to pressure for further extensions to the property. The occupier of No. 401 is also concerned about the additional traffic using an access near to a hazardous junction and the lack of a footpath fronting the property.

The occupier of Potash Cottage opposite the site protests against the development because of traffic problems. Mr. Renouf of Renouf's Restaurant objects on the grounds of traffic hazard and • the need to prevent commercial development in this area. The County Surveyor has no objection but directs that adequate parking facilities are provided on the site.

In the opinion of the local planning authority, the proposal is for two dwelling units which exceeds the provisions of the aforementioned Policy.

REPOWP; Outline permission for a detached dwelling was granted on 20th 1985 with conditions restricting its use to holiday • December,accommodation and prohibiting the sub-division of the plot (R0C/821/85). a' This application is for a three storey dwelling and Rochford District Plan Policy H7 provides for full residential occupancy restricted to one dwelling per plot. The "dwelling" proposed is, in fact, a semi—detached pair because there are two self— contained units with separate entrances, living rooms, kitchens and bedrooms. The smaller unit is presumed to be a granny annexe, with only the larger unit having a dining room, but no information is given to this effect. Two units within this plot are contrary to the policy which is to be operated in this area. Whereas "granny annexes" are normally acceptable in residential areas, the unique policy applicable to the Kingsmans Farm Road area mitigates against this proposal.

REPORT: The appliccant has submitted this application, and the following three on this schedule, for development on both of his petrol and service stations in London Road. The two sites are opposite one another, that on the north side of the road being within the Metropolitan Green Belt, and that on the south side being situated within the area allocated for residential development. Both sites have permitted uses, the northern site comprising a petrol filling station, kiosk, car sales display area for six to eight cars and a chalet in which the applicant resides.

The southern site is larger with an M.O.T. workshop, service bay and shop, with ancillary offices and a large car park at the rear for at least 14 vehicles.

000996 The existing office accommodation and sales offices are very cramped and almost certainly constitutes a danger to occupants in case of a fire. The applications submitted are substantially to • correct these deficiencies. The first application, ROC/549/86, seeks to add a small single storey extension to the rear of the service bay an the southern site and to infill, by a flat roof at ground floor level only, the narrow gap between the M.0.T. and service bay buildings. This would permit the offices and sales area to be larger and inside toilets for the staff to be provided. The occupiers of properties in Little Wheatleys Chase have not objected and will not be affected by the small rear extension. However, the lower ground level of those dwellings makes their existing 6'O" rear boundary fence ineffective and the applicant is quite prepared to plant trees along his western boundary to improve the occupiers' outlook. The second application, ROC/379/S6, seeks to display six cars for a sale on part of the large forecourt abutting Louis Drive West. The County Surveyor has no objections and, again, the applicant has expressed his intention to plant extra shrubs or trees along the boundary to supplement the several mature chestnut trees. No car parking spaces will be lost. The third application, ROC/373/86, concerns the northern site, where permission is sought to extend the existing sales kiosk towards the London Road, again to improve the cramped conditions in the building and to convert the existing toilets to internal rather than external. Planning permission was granted in 1980 under ROC/523/B0 to use part of the forecourt for the display and sale of six to eight cars. The submitted drawing indicates that this area would be used for the parking of at least four customers and staff cars and would replace the two spaces lost by the erection of the kiosk extension. The applicant has verbally confirmed that he is willing to forego his existing approval for car sales/display on this site if permission is granted for the replacement sales area • on the southern site. The County Surveyor raises no objection to this application!. The fourth application, R0C/374/86/AD, seeks consent to relocate the approved circular illuminated logo sign at present on the wall of the southern site workshop to the new flank wall of the proposed extended kiosk on the northern site. The illumination of this sign is very small and the Count9' Surveyor has no objection subject to the usual standards of illumination laid down by the Association of Public Lighting Engineers not being exceeded.

REPORT: Planning permission was granted for the use of this small detached building as a doctors surgery in 1952 when the Molt Farm Estate was constructed. At first the surgery was used in conjunction with the house at 7, Molt Farm Way, but the house has since been sold oft separately to the surgery building. The local planning authority have recognised that the separate building has an approved use as a doctors surgery but have in recent years consistently resisted changes of use to offices, dental laboratory, etc. One of the reasons for refusal which have been made related to unsatisfactory parking within the forecourt, dangerous location for the vehicular crossing, etc. The surgery has now been acquired by a general practitioner who will continue to use it as a branch doctors surgery. Thus the building is being used for its approved use. The formation of a hardstanding for the doctors car and clients vehicles requires planning consent since the building is not within the curtilage of a dwelling house. The vehicular crossing therefore also needs planning consent. If the application is refused, then such vehicles will doubtless be parked on the highway and the level in the road at this point is particularly hazardous. To grant permission would relieve such on-street parking and would also ensure that at least a gap in any parked vehicles five metres in width would exist whereas at present there are no traffic restrictions on nose-to-tail parking.

The occupiers of Nos. 5, 7 and 2, Molt Farm Way were consulted but only one letter has been received from No. 7, Molt Farm Way which acknowledges receipt of the Council's communication only.

A similar application was favourably considered at the Planning Services Committee of 24th July, subject to the imposition of conditions. Members resolved that, further to the recommendation of the Director of Development, no trade or retail sales should be conducted on the site prior to 8.00 a.m. on any day and not at all on Sundays. The applicants by way of this application wish to remove the restriction over Sunday trading imposed by Condition 2. In a letter accompanying the application the applicants Agent states

"My clients are concerned with the wording of condition 2 on the Planning Decision Notice in particular relating to 'no trade or retail sales shall be conducted on the site prior to 8.00 a.m. on any day and not at all on Sundays". This sentence precludes retail trade being carried out on Sundays. My clients find this condition unacceptable for the following reasons. My clients are a well known Essex based firm of Agricultural Sales and Service Engineers providing an essential service for the sales, servicing and repairs of agricultural machinery, and spare part's service, to the agricultural community as and when needed and demanded by their farmer customers, to help provide an efficient and prosperous farming industry which is not only essential to the life of the countryside, it is also a vital national interest. For the majority of the year my clients work a normal five and a half day week providing sales of agricultural machinery and equipment, the supply of spare parts, equipment, tools and other articles required for agricultural, and comprehensive repair and servicing of agricultural machinery and equipment.

The current before-mentioned Detailed Planning Permission ("ROC/456/86)" allows that the Workshop and Service Engineer working on and from the proposed site can operate 7 days a week, but that the retail part of their business may not be conducted at all on Sundays. Your Council will realise that the work on farms at certain times of the year is in operation for 7 days of the week. It is during these busy times that should any breakdowns occur of machinery or equipment then i spare parts must be purchased immediately, for repairs to be' effected by farmers, or if tools or other articles are required by my clients customers they expect to be able to obtain retail service throughout their own working week.

001020 The times during the year when Sunday trading occurs and when the retail element of my clients business must be avaalable 7 days a week, is during the Spring planting period, and the later busy harvest period which takes place through the months of July to November. therefore, the retail element of the trade for 7 day a week working is an essential part of an Agricultural Service Company's business, brought about by the demand of their farmer customers. The number of customers that use the Sunday service is minimal, but the service must be provided during the before mentioned periods of the year. In view of the above submission, I therefore request that your Council favourably consider the attached Planning Application to vary the wording of condition 2 to read "Trade or retail sales from the premises shall be limited to those of agricultural machinery and directly allied parts and accessories only, unless otherwise agreed in writing by the local planning authority. REPORI': Proposal accords with policy in terms of plot frontages but there are two important considerations:-

1) There is a superb walnut tree within the site but to accommodate more than one dwelling on the land the tree must be removed. There are other trees on the land which can be retained. The recommendation is made on the basis that the land is within a residential area, and would produce an economic development of the available land in a manner which would be in character with existing development.

2. The site is affected by the current drainage restriction and, arising from this, the application proposes utilising cesspoools for two of the proposed dwellings. One dwelling would be a replacement for the existing dwelling on the land and would not be affected by the current drainage restriction. Cesspools in this built-up area location would be likely to give rise to environmental problems and possibly highway congestion by emptying vehicles and, for this reason, the recommendation is that only one dwelling is erected until such time as the sewage work is able to take additional flows. This item was deferred from the last Planning Services Meeting of 24th July, 1986 for further consideration of the highway safety aspects of the proposal, particularly with regard to the movement and manoeuvring of coaches onto and from the site. Discussions have taken place with the appliccant who has submitted written confirmation that "He never reverses his coaches out of the yard only into it" to enable clear vision of road traffic in both directions and exit from the site in forward gear. The site width and depth is too restricted to enable turning facilities to be provided within the site. q01933 The development of the area is based on the outline permission ROC/062/82 which provides for new housing linked with the preparation, planting and provision of an area of public open space to the east of the site. The site's primary access is an extension of the present Grested Court. The new road is known as t4illview Nleadows and it is supported by a series of short lateral culs—de—sac. Permission for the road pattern was granted — ROC/062/82/l. Since the consideration of the deferred appliccation, the Architect has submitted an application (ROC/062/82/5) for a further five units and has also shown, in sketch form, the expected layout for an additional area on the eastern side of the site together with outline plan generally describing the first phase of the frontage development on the western side of Millview Meadows. the details available now in regard to the eastern side of the site combine to show how the character of the area is proposed to evolve front East Street southwards to include the two culs—de-sac The Garners and The Trunnions. The concept pursued by the Architect aims to provide a mix of accommodation allied to varied and acceptable designs. Two, three and four bedroomed units are shown to relate satisfactorily to each other, to the older persons unit, Lucam Lodge, and to Grested Court which is to be used for municipal housing. The layout achieves, consistent with providing sufficient and convenient arrangements for access, motor vehicles and garden spaces, a reflection of the character of the core of the historic town. The inappropriate visual characteristics of a suburban housing estate are avoided by the varied siting and designs of buildings allowing for the enclosure of spaces to establish a visual interest without loss of privacy or unacceptable overlooking. The location of the site so close to the centre of Rochford and adjoining, as it does, the designated conservation area suggests that the design approach to development of the area should not be based on a philosophy of accepting a number of basic designs and arranging them into an estate layout. To attain the design suggested does mean the closure of spaces by the positioning of some buildings close to back of footpath and from the layout submitted this arrangement is shown at locations where otherwise there would be relatively open vistas not appropriate to the concept. The designs of the buildings are varied and include, on plot No. 9, ROC/062/82/5, a two bedroomed two storey octagonal house and a three bedroom house composed of one and two storey elements on the south side of the junction of The Trunnions. The Town ad Country Planning General Development Order provides that houses where erected may be extended, subject to certain constraints, without the need for planning permission. In the interests of appearance and impact on neighbours it would be preferable to restrict those rights to extend to requiring planning permission in regard to the 2 bedroomed houses on plots

Relevant Planning History A temporary planning permission was granted on 29th February, 1972 (ROC/676/71 refers) for the use of part of the existing barn (about 74m2/SoOsq.ft.) for the storage and drying (by natural evaporation) of white weed which expired on 31st December, 1972. The reason given for the temporary permission by the local planning authority at that time was "to enable the local planning authority to assess the effects the use may have on local residential amenaties". Notwithstanding the time limit the use continued without any complaints from local residents and the use was further regularised for a temporary period of three years on 22nd December, 1976 (ROC/855/76 refers) which expired on 31st December, 1979.

Present Application The applicant is seeking once more to regularise an existing low key use and states that the buildings have not been used for agricultural purposes since 1968 when serious illness caused him to finish as a market gardener. Since then his land has been worked by a contractor who harvests and transports the crops to his own storage units so the outbuildings are surplus to requirements. Phe business is run by one man who provides employment for local fishermen who collect the weed on a seasonal basis (six months per year on average in the winter) and is dyed with vegetable dyes for use in pet fish tanks and exported all over the world.

REPORT': The planning history of this bungalow situated within the Metropolitan Green Belt shows that various planning consents were issued, up to 1976, well before the local planning authority's developlment control policy in the Green Belt was adopted. In 1967, the bungalow was extended at the rear by 24sq.m. and in 1969 a large carport was permitted, being some 42sq.m. in area and extending down the side of the dwelling. In 1973 planning permission was granted for a front extension to the building. This permission was never implemented and had it not expired in 1978 and the extension subsequently built, a further 37 sq.m. of floor space would have been created. In 1976 planning permission was granted for a detached double garage some l.2m from the dwelling and this garage was built which, as far as the occupiers were concerned, made the carport redundant. The 1969 permission for the carport did not contain the conditions that are currently imposed and therefore there were no restrictions on its use. Consequently, the rear part was filled in with brickwork and used as a utility room. No increase in the overall height was made. The present occupiers need elderly parents to live with them and the parents' doctor has written confirming their frailness, that one of the elderly parents is deaf and the other has suffered a heart attack. It is proposed to close in the remainder of the carport to provide some 18 sq.xn. of extra floor space for the parents and planning consent is required only because the carport roof, of p.v.c. sheeting, needs to be slightly higher, and of solid construction to comply with Building Regulations.

001040 A further 18 sq.m. of living floorspace would then be created, a making a total of additional floorspace of 66sq.m. However, W against this must be balanced the 37 sq.m. of front extension which was previously permitted but not implemented. In addition, the overall size of the building would remain the same apart from a few inches attributable to the increased thickness of the flat roof over the carport. The overall appearance of the building would change only by the slight increase in carport height and the erection of walls at the front and side. Whilst it could be disputably argued that the Council's 35sq.m. rule may not be complied with in this case, on balance, Members may consider that exceptional circumstances exist to justify the granting of permission subject to conditions and a Legal Agreement to remove permitted development rights to erect further buildings within the curtilage.
