The Secretary of State, in exercise of the powers conferred by section 150(3) and (4)(a), (b)(i) and (c) of the Welfare Reform Act 2012(a), makes the following Order:
Citation 1. This Order may be cited as the Welfare Reform Act 2012 (Commencement No. 9 and Transitional and Transitory Provisions and Commencement No. 8 and Savings and Transitional Provisions (Amendment)) Order 2013. Art. 2 has been amended by the following S.I.’s 2014/1452, 2014/1661, 2014/ 1923, 2014/3094 and 2014/3067. These amendments are subject to transitional provisions where a claim is made or treated as made, or, awarded, before 28.7.14. Refer to article 3 of the respective S.I.’s for when to apply.
Interpretation 2.—(1) In this Order– “the Act” means the Welfare Reform Act 2012 (apart from in Schedule 4); “the 1995 Act” means the Jobseekers Act 1995(b); “the 2007 Act” means the Welfare Reform Act 2007(c); “the amending provisions” means the provisions referred to in article 4(1)(a) to (c); 1“claimant”, in relation to an employment and support allowance or a jobseeker’s 1Defn. of “claimant” allowance, has the same meaning as in Part 1 of the 2007 Act and the 1995 Act (as inserted in art. 2(1) by it applies apart from the amendments made by Part 1 of Schedule 14 to the Act that art. 4(2)(a) of S.I. 2014/ 1452. (See art. 3 to this remove references to an income-based jobseeker’s allowance) respectively and, in S.I. for when to apply). relation to universal credit, has the same meaning as in Part 1 of the Act; “appointed day” means the day appointed for the coming into force of the amending provisions in accordance with article 4(3); “the Claims and Payments Regulations 1987” means the Social Security (Claims and Payments) Regulations 1987(d); “the Claims and Payments Regulations 2013” means the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Claims and Payments) Regulations 2013(e); “contribution-based jobseeker’s allowance” means a contribution-based allowance under the 1995 Act as it has effect apart from the amendments made by Part 1 of Schedule 14 to the Act that remove references to an income-based allowance;

“contributory employment and support allowance” means a contributory allowance under Part 1 of the 2007 Act as it has effect apart from the amendments made by Schedule 3, and Part 1 of Schedule 14, to the Act that remove references to an income-related allowance; 1Defn. of “conversion 1“conversion decision” has the meaning given by the 2010 Transitional decision” inserted in art. Regulations 2013(d); 4Defn. of “existing 4 ; benefit” omitted by art. 5 4(2) of S.I. 2014/1923. “First-tier Tribunal” has the same meaning as in the Social Security Act 1998; (See art. 3 of that S.I. 6 ; for when to apply). 5Defns. in art. 2(1) “housing benefit” means housing benefit under section 130 of the Social Security inserted & deleted by Contributions and Benefits Act 1992(e); art. 4(2)(a)-(i) of S.I. “income-based jobseeker’s allowance” means an income-based jobseeker’s 2014/1452. (See art. 3 of that “the JSA Regulations 2013” means the Jobseeker’s Allowance Regulations S.I. for when to apply). 2013(g); 5“new style ESA” means an employment and support allowance under Part 1 of the 2007 Act as amended by the provisions of Schedule 3, and Part 1 of Schedule 14, to the Act that remove references to an income-related allowance and “new style ESA award” shall be construed accordingly; “new style JSA” means a jobseeker’s allowance under the 1995 Act as amended by the provisions of Part 1 of Schedule 14 to the Act that remove references to an income-based allowance and “new style JSA award” shall be construed accordingly; “old style ESA” means an employment and support allowance under Part 1 of the 2007 Act as it has effect apart from the amendments made by the Schedule 3, and Part 1 of Schedule 14, to the Act that remove references to an income-related allowance and “old style ESA award” shall be construed accordingly; 3“personal independence payment” means an allowance under Part 4 of the Act;

(See art. 3 Act 2002(a); tof this S.I. for when to “tax credit” (including “child tax credit” and “working tax credit”) has the same apply). meaning as in the Tax Credits Act 2002(b); 1 “the 2010 Transitional Regulations” means the Employment and Support Allowance (Transitional Provisions, Housing Benefit and Council Tax Benefit)(Existing Awards) (No. 2) Regulations 2010(c). 1“the 2014 Transitional Regulations” means the Universal Credit (Transitional Provisions) Regulations 2014(d); “the Universal Credit Regulations” means the Universal Credit Regulations 2013(e); “Upper Tribunal” has the same meaning as in the Social Security Act 1998.
