CHAPTER 43 ELECTORAL STATISTICS 43.1 India is a constitutional democracy with a parliamentary system of government, and at the heart of the system is a commitment to hold regular, free and fair elections. These elections determine the composition of the Government, the membership of the two houses of parliament, the state and union territory legislative assemblies, and the Presidency and vice-presidency. Elections are conducted according to the constitutional provisions, supplemented by laws made by Parliament. The major laws are Representation of the People Act, 1950, which mainly deals with the preparation and revision of electoral rolls, the Representation of the People Act, 1951 which deals, in detail, with all aspects of conduct of elections and post election disputes. 43.2 The Election Commission of India is an autonomous, quasi-judiciary constitutional body of India. Its mission is to conduct free and fair elections in India. It was established on 25 January, 1950 under Article 324 of the Constitution of India. Since establishment of Election Commission of India, free and fair elections have been held at regular intervals as per the principles enshrined in the Constitution, Electoral Laws and System. The Constitution of India has vested in the Election Commission of India the superintendence, direction and control of the entire process for conduct of elections to Parliament and Legislature of every State and to the offices of President and Vice- President of India. The Election Commission is headed by the Chief Election Commissioner and other Election Commissioners. There was just one Chief Election Commissioner till October, 1989. In 1989, two Election Commissioners were appointed, but were removed again in January 1990.

Dissolution of the Lok Sabha
DISSOLUTION OF THE LOK SABHA Tanusri Prasanna* Introduction The dissolution of the twelfth Lok Sabha on the twenty sixth day of April, 1999, by the President Mr. K.R. Narayanan, and the role of the latter in the intense political decision making preceding the same, have thrown open afresh the debate as to the exact role of the President as envisaged in the Constitution in the matter of dissolution. This paper attempts to analyse this issue in light of various controversial views on the subject. Pre-independence constitutional debates in India were influenced by two models of democratic government: the British Parliamentary system, and the Presidential system of the United States. In the final analysis the British model being closer home, "every instalment of constitutional reform was regarded as a step towards the establishment of a democratic and responsible government as it functioned in Britain."' Thus, it is widely accepted by various scholars that the founding fathers of the Constitution had opted for the parliamentary system of government. Working on this premise, the concepts such as executive decision making as well as delineating limits and laying a system of checks and balances on the different wings of the government as provided by the inherent federal structure, have been debated over and over again. However, when the Constitution actually came into force, a reading of its provisions sparked off a new line of thought as to the very nature of government, and the Presidential model of the United States which had been earlier rejected was now compared and contrasted.2 These discussions and debates were mainly concerned with the respective powers of the President and the Prime minister in the Constitution and in cases where both entities were strong the clash of opinions was soon recognised.

If one conceives of India, as many Indians would, in terms of a trinity of attributes – democratic in government, secular in outlook, and united by geography and a sense of nationhood – then, in terms of the first of these, it would appear to have succeeded handsomely. Since, the Parliamentary General Election of 1951, which elected the first cohort of members to its lower house of Parliament (the Lok Sabha), India has proceeded to elect, in unbroken sequence, another 15 such cohorts so that the most recent Lok Sabha elections of 2014 gave to the country a government drawn from members to the 16th Lok Sabha. Given the fractured and fraught experiences with democracy of India’s immediate neighbours (Pakistan, Bangladesh, Sri Lanka, Nepal, Myanmar) and of a substantial number of countries which gained independence from colonial rule, it is indeed remarkable that independent India has known no other form of governmental authority save through elections. Elections (which represent ‘formal democracy’), are a necessary, but not a sufficient, condition for ‘substantive democracy’.

To illustrate this, I suggest that engagement with the state can be efficacious in certain instances (violence against women) but that in those cases where women face structural constraints (women’s political representation), where the challenges are powerful, opportunity to have an impact is limited. Examining the extent to which the state has been an arena where women’s groups have been able to demand and achieve change provides significant insights into political environments that shape women’s agency and advocacy within that region. My doctoral thesis takes a multi-level approach in order to understand the impact of women’s movements on the state and its institutions. I maintain that women’s movement activity elicits state responsiveness and I analyze three factors to support my claim. First, I consider what government is in power and how open it is to engagement. Secondly, I consider how cohesive the women’s movement is on a particular issue and thirdly, I iii maintain that women’s national machinery can be an effective channel for implementing women’s interests.

DEEPIKA GAHATRAJ MODULE: VIII, INDIAN PARLIAMENT AND STATE LEGISLATURE REVISION ON LOK SABHA AND RAJYA SABHA In a parliamentary form of government the Parliament is the most important organ. It is the people who elect their representatives to be members of the Parliament and these representatives legislate and control the executive on behalf of the people. The Prime Minister and his Council of Ministers remain at the helm of affairs so long as they enjoy the confidence of Lok Sabha. The Parliament (Lok Sabha) may dislodge them from power by expressing a no confidence against the Prime Minister and his Council of Ministers. Thus the Parliament occupies a central position in our parliamentary system. The Parliament has two Houses–Rajya Sabha and Lok Sabha. Rajya Sabha is upper House and represents the States of India while the Lok Sabha is lower House. It is also called popular House because it represents the people of India. The President is an integral part of the Parliament though he is not a member of the either House. As an integral part of the Parliament, the President has been assigned certain powers and functions, which you have read in the last lesson. In this lesson you will study about the two Houses in details. Rajya Sabha - Membership and Election Rajya Sabha or the Upper House of the Parliament is a permanent body as it cannot be dissolved. The membership of the Rajya Sabha cannot exceed 250. Out of these, the President nominates 12 members on the basis of their excellence in literature, science, art and social service and the rest are elected.

Introduction
Introduction On 4th April, 1980 the National Executive of the Janata Party adopted a resolution prohibiting members of RSS to continue in the Janata Party. This resolution was sequel to the fears entertained by Chandrashekhar’s Group and a few Socialists who had not left the Janata Party when the split caused by Ch. Charan Singh took place and others that the erstwhile Jana Sangh would capture the party on account its mass base and large army of dedicated workers. This development was anticipated by leaders and workers of the Jana Sangh and RSS background in Janata Party. So they had asked Jana Sangh workers from all over the country to assemble at Delhi before the meeting of the National Executive of Janata Party and to be prepared for all eventualities. The resolution adopted by the National Executive of Janata Party was not acceptable to erstwhile Jana Sangh constituent and to several other leaders and persons in Janata Party who had no RSS background. The Jana Sangh constituent had sincerely worked towards the strengthening and smooth working of the Janata Party. Even though it constituted the largest single constituent of the Janata Party and had a larger popular base in the country it did not ask for proportionate share either in Janata Government or in Janata Party and was content with whatever was given to it. The Jana Sangh constituent wanted Janata Party to succeed and emerge as an alternative to Congress which had ruled the country for three decades prior to 1977. In this background, there was a feeling of regret and unhappiness as well as of good riddance and relief in the Jana Sangh 2 • Party Document Vol-10 workers.
