In accordance with Minute No. 299 (2001/2002), Ms. F. Redmore, on behalf of the applicant, addressed the meeting.

A. That the officer recommendation be upheld and consent be granted subject to the following conditions:-

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

2. The use and development hereby permitted shall only be occupied or used in connection with and ancillary to the occupation of the existing Fairplay Centre and shall at no time be severed and occupied as a separate independent planning unit.

3. Prior to development commencing following details of the following operational development shall be submitted to the Local Planning Authority in writing and plan form;

(i) Boundary fencing (size, appearance and siting);

(ii) Gazebo, footpaths, boardwalks, raised planting beds, polytunnel, greenhouse and sheds (appearance, siting and size);

(iii) Play equipment (appearance, siting and size);

(iv) Retaining walls (appearance including materials);

(v) Existing and proposed levels (cross sections);

Development shall only be carried out in accordance with the details approved in writing by the Local Planning Authority, and shall be retained thereafter.

4. Prior to the commencement of the development approved by this planning permission (or such other date or stage in development as may be approved in writing by the Local Planning Authority), the following components of a scheme to deal with the risks associated with contamination of the site shall be each be submitted to and approved in writing by the Local Planning Authority:

A) A preliminary risk assessment which has identified:

● All previous uses ● Potential contaminants associated with those uses ● A conceptual model of the site indicating sources, pathways and receptors ● Potentially unacceptable risks arising from contamination at the site

B) A site investigation scheme, based on (1) to provide information for a detailed assessment of the risk to all receptors that may be affected, including those off site.

C) The site investigation results and the detailed risk assessment (2) and, based on these, an options appraisal and remediation strategy giving full details of the remediation measures required and how they are to be undertaken.

D) A verification plan providing details of the data that will be collected in order to demonstrate that the works set out in (3) are complete and identifying any requirements for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action.

Any changes to these components require the express consent of the Local Planning Authority. The scheme shall be implemented as approved.

5. Prior to commencement of development, a verification report demonstrating completion of the works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to the Local Planning Authority for consideration and approval in writing. The report shall include results of sampling and monitoring carried out in accordance with the approved verification plan to demonstrate that the site remediation criteria have been met. It shall also include any plan ( a long term monitoring and maintenance plan) for longer term monitoring of pollutant linkages, maintenance and arrangements for contingency action, as identified in the verification plan, and the reporting of this to the Local Planning Authority.

6. If during development contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing by the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an amendment to the remediation strategy detailing how the unsuspected contamination shall be dealt with.

7. Prior to development commencing full details of a scheme of surface drainage incorporating sustainable drainage techniques shall be submitted in writing to the Local Planning Authority for its consideration. Development shall not be commenced until a drainage scheme has been approved in writing by the Local Planning Authority and shall be carried out in accordance with the approved scheme.

8. Within 2 months of commencement of development, unless otherwise agreed in writing by the Local Planning Authority, details of a soft landscaping scheme for the approved development shall be submitted to the Local Planning Authority for consideration. The required soft landscape scheme shall include planting plans; biodiversity enhancement scheme, written specifications (including cultivation and other operations associated with plant and grass establishment); schedules of plants, noting species, plant sizes and proposed numbers; densities where appropriate, an implementation programme and a schedule of landscape maintenance for a minimum period of five years. Those details, or any approved amendments to those details shall be carried out in accordance with the implementation programme and any diseased or dying vegetation within the first five years of their planting shall be replaced within the first available planting season.

9. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) 1995 Order as amended, or any Order revoking and re-enacting that Order, there shall be no additional hardsurfacing or erection of alteration of means of enclosures carried out on the site without the prior written agreement of the Local Planning Authority.

10. Prior to development commencing a land stability site investigation and assessment shall be carried out and the assessment submitted in report format including any necessary mitigation, to the Local Planning Authority for its consideration. Development shall not commence until the Local Planning Authority has approved the submitted information and any necessary mitigation in writing, and the development shall be carried out in accordance with the approved details.

11. All external dimensions and elevational treatments shall be as shown on the approved plans; with the exception of any approved non material amendment.

12. Prior to the installation of any external lighting, full details of such lighting including design, size, siting, lux contour maps, times of illumination and the angle of proposed lamps shall be submitted to the Local Planning Authority in writing for its consideration. Only those details approved by the Local Planning Authority in writing shall be implemented and the lighting shall be retained and operated in

accordance with those details thereafter.

B. That the Health and Safety Executive (HSE) be notified of the Borough Council’s intention to grant planning permission subject to conditions and seeking confirmation that the application is not to be called in for a determination by the Secretary of State.

C. That any objections received within the period for comment under the advertising of the proposal as a departure, and which are not already covered in this report, be reported back to Planning Committee.

REASONS FOR DECISION

1. The condition is imposed in accordance with section 51 of the Planning and Compensation Act 2004.

2. To prevent an undesirable intensification of activity including traffic in the interests of amenity and highway safety and to accord with policies GEN1 and TRS8 of the Replacement Chesterfield Borough Local Plan.

3. To ensure that the Local Planning Authority has control over the size, appearance and siting of operational development on the site in the interests of visual amenity and residential amenity and to accord with policy GEN1 of the Replacement Chesterfield Borough Local Plan.

4. In the interests of public safety and pollution control and to accord with policy EVR23 of the Replacement Chesterfield Borough Local Plan and PPS23.

5. In the interests of public safety and pollution control and to accord with policy EVR23 of the Replacement Chesterfield Borough Local Plan and PPS23.

6. In the interests of public safety and pollution control and to accord with policy EVR23 of the Replacement Chesterfield Borough Local Plan and PPS23.

CHE/10/00404/EOT - EXTENSION OF TIME FOR APPLICATION CHE/07/00478/FUL - PROPOSED DEVELOPMENT TO INCLUDE 2 NEW BUNGALOWS AND GARAGE TO REAR AND REMOVAL OF SHEDS AT 116 FOLJAMBE AVENUE FOR MR & MRS HUTCHINSON

That the officer recommendation be upheld and the proposed development be approved subject to the following conditions:-

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

2. The site shall be developed with separate systems of drainage for foul and surface water on and off site.

3. No development shall take place until details of the proposed means of disposal of foul and surface water drainage, including details of any balancing works and off-site works, have been submitted to and approved in writing by The Local Planning Authority.

4. Unless otherwise agreed in writing by The Local Planning Authority, there shall be no piped discharge of surface water from the development prior to the completion of the approved surface water drainage works and no buildings shall be occupied or brought into use prior to completion of the approved foul drainage works.

5. Before construction works commence or ordering of external materials takes place, precise specifications or samples of the walling and roofing materials to be used shall be submitted to the Local Planning Authority for consideration. Only those materials approved in writing by the Local Planning Authority shall be used as part of the development unless otherwise agreed by the Local Planning Authority in writing.

6. Prior to the commencement of the development, details of the existing and proposed land levels and the proposed floor levels of the dwelling hereby approved shall be submitted to the Local Planning Authority for consideration. The details submitted shall include sufficient cross sections to fully assess the relationship between the proposed levels and immediately adjacent land/dwellings. The dwelling shall be constructed at the levels approved under this condition unless otherwise agreed, in writing, by the Local Planning Authority.

7. A. Development shall not commence until details as specified in this condition have been submitted to the Local Planning Authority for

consideration and those details, or any amendments to those details as may be required, have received the written approval of the Local Planning Authority.

I. A desktop study/Phase 1 report documenting the previous land use history of the site.

II. A site investigation/Phase 2 report where the previous use of the site indicates contaminative use(s). The site investigation/Phase 2 report shall document the ground conditions of the site. The site investigation shall establish the full extent, depth and cross-section, nature and composition of the contamination. Ground gas, groundwater and chemical analysis, identified as being appropriate by the desktop study, shall be carried out in accordance with current guidance using UKAS accredited methods. All technical data must be submitted to the Local Planning Authority.

III. A detailed scheme of remedial works should the investigation reveal the presence of ground gas or other contamination. The scheme shall include a Remediation Method Statement and Risk Assessment Strategy to avoid any risk arising when the site is developed or occupied.

B. If, during remediation works any contamination is identified that has not been considered in the Remediation Method Statement, then additional remediation proposals for this material shall be submitted to the Local Planning Authority for written approval. Any approved proposals shall thereafter form part of the Remediation Method Statement.

C. The development hereby approved shall not be occupied until a written Validation Report (pursuant to A II and A III only) has been submitted to and approved in writing by the Local Planning Authority. A Validation Report is required to confirm that all remedial works have been completed and validated in accordance with the agreed Remediation Method Statement.

8. In the event it is proposed to import soil onto site in connection with the development the proposed soil shall be sampled at source and analysed in a MCERT certified laboratory, the results of which shall be submitted to the Local Planning Authority for consideration. Only the soil approved in writing by the Local Planning Authority shall be used on site.

9. Unless otherwise agreed in writing by the Local Planning Authority work shall only be carried out on site between 8:00am and 6:00pm Monday to Friday, 9:00am to 5:00pm on a Saturday and no work on a Sunday or Public Holiday. The term "work" will also apply to the operation of plant, machinery and equipment.

10. Within 2 months of commencement of development, unless otherwise agreed

in writing by the Local Planning Authority, details of a soft landscaping scheme for the approved development shall be submitted to the Local Planning Authority for consideration.

11. Upon commencement of development full details of all boundary treatments proposed for the development shall be submitted to the Local Planning Authority for consideration and approval in writing. Only the details approved in writing by the Local Planning Authority shall be implemented on site.

12. Before any other operations are commenced an access 4.1 metres in width comprising visibility sightlines of 2m x 70m and pedestrian intervisibility splays of 2m x 2m x 45 degree shall be created to Foljambe Avenue. This shall be used as the site access and prior to occupation of any dwelling shall be laid out and constructed in a solid bound material for at least the first 10 metres from the highway boundary.

13. Before any operations are commenced (excluding above) space shall be provided within the curtilage for site accommodation, storage of plant and materials, parking and manoeuvring of site operatives and visitors vehicles together with the loading/unloading and manoeuvring of goods vehicles, designed, laid out and constructed in advance of construction work commencing and maintained free from impediment throughout the duration of construction works.

14. Prior to occupation of either dwelling the parking and turning provision for the existing and new-build shall be provided as per the submitted drawings and shall be maintained thereafter free from impediment to its designated use.

15. There shall be no gates within 10 metres of the rear of the highway boundary and any such gates shall open inwards.

16. No development shall take place on the site until the applicant has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted to and approved in writing by the Local Planning Authority.

17. The developer shall afford access at all reasonable times to any archaeologist nominated by the Local Planning Authority and shall allow him/her to observe and record the demolitions/excavations and record items of interest and finds.

18. Notwithstanding the provisions of the Town and Country Planning (General

Permitted Development) Order 1995, or any Order revoking and re-enacting that Order, no windows or roof lights, other than those hereby permitted, shall be installed above ground floor ceiling height, without the prior express consent of the Local Planning Authority.

19. The dwellings shall be constructed to a minimum of Sustainable Homes Code Level 3 standard, unless otherwise agreed in writing by the Local Planning Authority. On completion of the development, and prior to first occupation, a copy of the certificate issues as evidence of compliance in this respect shall be submitted to the Local Planning Authority, unless otherwise agreed in writing by the Local Planning Authority.

REASON FOR DECISION

1. The proposal is considered to be acceptable in terms of its scale, massing, siting and design without detriment to the amenity of surrounding residents or highway safety. The proposal is considered to accord with Policies GEN10, HSN5 and HSN6 of the Replacement Chesterfield Borough Local Plan.

CHE/10/00518/CA - The felling of Agreement to the felling of one tree in the rear one Sycamore tree in the rear garden of 16 Devonshire Street. The felling of garden of 16 Devonshire Street the tree will have no adverse effect on the Brimington Chesterfield amenity value of the area.

The Sycamore tree is within the Brimington Conservation Area and the applicant wishes to remove the tree because it is allegedly diseased, infested with whitefly and causing extreme damage to a retaining wall.
