CONSTITUTION OF THE GURUNG (TAMU) CULTURE FORUM-UK - TRILINGUAL BOOK PROJECT MILLENNIUM – 13 MAY 2018

1. PREAMBLE

1.1 The Gurung (Tamu) Culture Forum-UK was founded in 2012 to preserve the heritage of the Gurung (Tamu) people. We, the Gurung (Tamu) people are a prominent and proud race from the slopes of the Annapurna Himalayan Range in Central . The ancestors of the Gurungs (Tamus) migrated out from the Gandaki Basin (Lamjung, Manang, Kaski, Parbat, Syangja, Tanahun, Baglung, Gulmi, Dolpa, Gorkha, Dhading, Khotang, Solokhumbu, Bhojpur, Shankhuwa Sabha, Taplejung and Tehrathum), in search of better fertile farming lands, better education and job prospects and settled all over Nepal. Many have since moved to and settled in India, Hong Kong, United Kingdom (UK), America, Australia, Canada, Japan, Malaysia, Europe and other countries. Despite this, the Gurung (Tamu) Diaspora is closely-knit by family and kinship ties, as communities and association work to preserve its indigenous heritage and culture. Because they have come from various parts of Nepal, where the culture and customs of the Gurung (Tamu) people vary from place to place, there is a need to bring them together under one common Tamu identity. These differences come to the fore mainly when international Gurung (Tamu) communities from various regions and villages gather together in their country of residence. The Gurung (Tamu) people mark births, marriages, deaths as well as festivals such as Gurung (Tamu) Lhochhar/Lhosar, Pitri Puja, Tohte, Dashain and Tihar with various customs.

1.2 In orders to forge unity through this diversity, the Gurung (Tamu) Cultural Forum-UK, Tamu Dhee Association UK (TDUK) and Tamu Pye Lhu Sangh UK (TPLS UK) are working Together to set a more standard set of cultural norms, customs and traditions that accommodates all 74 Gurung (Tamu) organisations in the UK. This is to unify and preserve a more appropriate and pragmatic approach to these practices in the UK and globally. The Gurung (Tamu) organisations in the UK understand that while trying to standardize and build a more flexible set of culture and customs, it is also important to preserve them and to stem the erosion of this culture.

2. AIM

2.1 The primary aim of Gurung (Tamu) Culture and Customs Forum-UK is to produce a Trilingual Book entitled ‘‘Tamu Heritage Trilingual Book’’ – the History, Culture, Language and Civilisation of the Gurung (Tamu) people.

3. THE PROJECT

3.1 The Trilingual Book shall be in Nepali, English language and in Gurung (Tamu) dialect (with only the most essential words, phrases and sentences of everyday use), to help Tamu people worldwide to understand and identify the Gurung (Tamu) history and culture, and work towards its conservation so that posterity can benefit from it.

3.2 It is the intention of the Executive Committee to complete the Tamu Heritage Trilingual book by December 2020.

4. OBJECTIVES

4.1 To promote, foster and maintain the bonds of friendship amongst all Gurung (Tamu) Member of the 74 Gurung (Tamu) organisations in UK as well as those living in other parts of the world by coalescing to support the Gurung (Tamu) Culture Forum-UK Trilingual Book Project Millennium with the following objectives:

4.1.1 To maintain links with and support from Gurung (Tamu) Organisations in UK and around the globe.

4.1.2 To promote and maintain conservation and consolidation of the ancestral and Inherited culture of the Gurungs (Tamus) for posterity.

4.1.3 To organise sponsorships and charitable programs to raise funds for the Trilingual Book project and also to foster working relationship with foreign institutions and local authorities.

4.1.4 Not to promote the Forum for any political and religious ideologies or for personal gain.

5. DEFINITIONS

5.1 If not interpreted otherwise by context and reference:-

5.1.1 The term 'Forum' refers to Gurung (Tamu) Culture Forum-UK - 2012.

5.1.2 ‘Constitution’ refers to the Constitution of the Gurung (Tamu) Culture Forum-UK - December 2017.

5.1.3 ‘Rules' denote the rules drafted by the Forum Executive Committee and approved by the Forum General Assembly of 3 Dec 2017 and implemented thereafter. 5.1.4 ‘Forum Board of Council’ (FBC) refers to the council approved by the Forum General Assembly of 3 Dec 2017 and implemented thereafter. 5.1.5 'Forum Executive Committee' (FEC) refers to that empowered Committee that is formed for the term until the end of project, through election or overall consensus from the Forum General Assembly.

5.1.6 'Forum Annual General Meeting' (FAGM) refers to the meeting held at least once a year in May including all Forum members.

5.1.7 ‘Forum General Assembly’ (FGA) refers to the meeting held at least once a year in Dec that is open not only to Forum members but also to any other (non- member) Gurungs (Tamus).

5.1.8 ‘Gurung (Tamu)' refers to the indigenous Gurung (Tamu) communities of Nepal and around the globe.

5.1.9 'Forum Sub-Committee' (FSC) refers to the committee with some or all of the powers delegated by the Project Director and the FEC.

5.1.10 'Forum Board Member' (FBM) refers to the two nominated representatives from each of the 74 Gurung (Tamu) Samaj of the Forum.

5.1.11 'Patron' refers to the person nominated by the FEC/FBC and approved by the FAGM.

7. SEAL AND EMBLEM/LOGO OF THE TAMU FORUM – UK

7.1 The organization shall have a distinct seal and logo with the badge of the Gurung (Tamu) Culture Forum-UK as shown below:

8. GURUNG (TAMU) FORUM LIFE MEMBERSHIP

8.1 Membership of the Gurung (Tamu) Forum-UK shall be open to all Gurungs (Tamus) residing in the UK and around the globe. The Forum one-off Life Membership (FLM) fee shall be £10 for single and £20 for the couple. For those who have already sponsored/donated £100 the requested amount for the Forum Trilingual Book project, they shall not be obliged to pay the FLM as it shall be automatically included within their sponsored/donated amount. The rate of sponsorship/donated for each Gurung (Tamu) household (family members living under one roof irrespective of dependants being single or married) shall be £100 and each household shall receive a Trilingual Tamu Heritage Book. Names of all sponsors shall be published in the book. The following rules shall apply for FLM:

8.1.1 Registered records of all members shall be updated and maintained on a regular basis.

8.1.2 Any Forum member wishing to resign may do so by giving a written notice to the FEC. In doing so, they shall lose their eligibility to vote.

8.1.3 The FLM fee or sponsored/donated amount shall not be refundable.

8.1.4. The FLM shall not be transferable.

8.1.5 FEC members shall be able to nominate any willing and able FBM for any existing vacant post at the FAGM and shall determine the term of the post.

8.1.6 Upon recommendation from FEC and FBC, any Forum member shall be appointed to the post of Co-Director(s).

9. THE FORUM PRIVACY POLICY AND CODE OF CONDUCT – this is given at Annex A and Annex A to Appendix 1 below.

10. FEC AND FSCs ROLES AND RESPONSIBILITIES

10.1 The FEC shall control the affairs of the Forum in accordance with the power conferred to them and ensure that the FEC when complete consists of at least six and not more than twelve members, all of whom being unpaid FLM. Their composition (See Annex D) shall be: 10.1.1 Project Director – shall: 10.1.1a Have overall authority for the successful commencement, planning, design, execution, monitoring, controlling and completion of the Trilingual Book.

10.11.b Remain fully focused on the project to ensure it stays on track as planned and to prevent any derailment.

10.1.1c Chair all committee meetings and supervise the project accounts.

10.1.1d Delegate responsibilities to FEC as required.

10.1.1e Authorise project expenses in accordance with the account rules.

10.1.1f Cast the deciding vote in case of 50/50 vote dilemma. 10.1.1g Ensure a Co-Director takes his place in his absence for any FAGM and FGA.

10.1.1h Ensure FAGM and FGA reports are promulgated to FLMs.

10.1.1i Update the project progress in liaison with the Gurung (Tamu) organizations.

10.1.1j Ensure all vacant posts are duly filled.

10.1.1k Ensure every FLM has an opportunity to express their opinions and concerns on issues that have not been already resolved before. 10.1.2 Project Co-Directors – shall:

10.1.2a In the absence of the Project Director, carry out all the duties listed above in sub-paragraphs of 10.1.1.

10.1.2b Record minutes of all decisions taken at the FAGM and FGA.

10.1.2c Promulgate decisions taken by the FEC to FBMs.

10.1.2d Carry out administrative work for the FEC and FSCs as required.

10.1.2e Supervise project accounts of the Forum.

10.1.2f Act as moderator for ‘Viber Forum’ to ensure it is conducted in a fair and organised way.

10.1.3 The Treasurer – shall:

10.1.3a Maintain the project accounts of the Forum.

10.1.3b Ensure that expenditure and income are recorded and supported by invoices and also give financial report succinctly in meetings where required.

10.1.3c Carry out as accurate a sponsorship record and budgetary forecast as possible by the end October of each year to enable the FEC to establish the budget requirements for the project as given below:

i. Balance remaining from previous year. ii. Sponsorship received and approved by the FEC. iii. Venue charges. iv. Food costs. v. PA systems cost/Security costs. for the FAGM and FGA

10.1.4 Assistant Treasurer 1 and 2 – shall:

10.1.4a In the absence of the Treasurer, carry out the responsibilities of the Treasurer as listed in sub-paragraphs of 10.1.3.

10.1.5 Forum Board of Council – shall:

10.1.5a Have an overview of the project and supervise and rectify any discrepancies occurring.

10.1.5b Record minutes of all decisions taken at FAGM and FGA and advise the FEC accordingly.

10.1.5c Promulgate decisions taken by the FEC to FLMs.

10.1.6 Forum Finance Sponsorship Sub-Committee - shall:

10.1.6a Coordinate any ‘Financial Sponsorship Campaigns’ in conjunction with the Forum Gurung (Tamu) organisations.

10.1.6b Record and collect all sponsorship funding from relevant organisations.

10.1.6c Promulgate decisions taken by the FEC to FLMs.

10.1.6d Supervise project accounts of the Forum.

10.1.7 FSC One - Coordinator of Gurung (Tamu) Customs and Rituals – shall:

10.1.7a Write Gurung (Tamu) customs and rituals in Nepali language by October 2019.

10.1.7b Record minutes of all decisions taken at their FSC meetings.

10.1.7c Once approved by the FEC/FBC, promulgate decisions taken by the FEC to FLMs.

10.1.8 FSC Two - Coordinator of Gurung (Tamu) Bhasa, Bhesbhusaa and Literature – shall:

10.1.8a Write Gurung (Tamu) Bhasa, Bhesbhusaa and Literature in Gurung (Tamu) and Nepali language by October 2019.

10.1.8b Record minutes of all decisions taken at their FSC meetings.

10.1.8c Once approved by the FEC/FBC, promulgate decisions taken by the FEC to FLMs.

10.1.9 FSC Three – Coordinator of Gurung (Tamu) Cultural Festivals, Gurung (Tamu) Bhajan Songs, Films and Media – shall:

10.1.9a Write about Gurung (Tamu) cultural festivals, Gurung (Tamu) bhajan songs, film and media by October 2019.

10.1.9b Record minutes of all decisions taken at their FSC meetings.

10.1.9c Once approved by the FEC/FBC, promulgate decisions taken by the FEC to all FLMs.

10.1.9d Carry out administrative work for the FEC and its project.

10.1.10 FSC Four – Coordinator of Roman Gurkhali Translation - shall:

10.1.10a Translate only the very essential parts of Trilingual Book from Nepali into Roman Gurkhali.

10.1.10b Record minutes of all decisions taken at their FSC meetings.

10.1.10c Once approved by the FEC/FBC, promulgate decisions taken by the FEC to FLMs.

10.1.11 FSC Five – Coordinator of English Translation – shall:

10.1.11a Translate all Nepali version of the Trilingual Book into English.

10.1.11b Consult with FEC/FBC on any parts of the book that may be of concern and only make amendments on their approval.

10.2 The FEC and FBC members shall have the right to be re-elected on a simple majority at the FAGM for a further term of 3 years provided the existing FEC members endorse their nominations.

10.3 FEC as well as FSC members shall automatically cease to be a member if they:

10.3.1 Are incapable, whether mentally or physically, of managing their own affair.

10.3.2 Are absent from two consecutive meetings of FEC and FSC unless their absence can be truly validated.

10.3.3 Cease to be a member of the Forum if their membership has been annulled by joint consent of FEC/FBC and FLM for gross misconduct.

10.3.4 Resigns by written notice to the FEC.

10.4 A technical defect in the appointment of a committee member of which the committee is unaware of at the time shall not invalidate decisions taken at the meeting.

11. RESPONSIBILITES OF THE FEC

11.1 It shall have the following responsibilities in the administration of the Forum:

11.1a To identify, approach and recommend prospective FBM for any vacant position within the FEC and FSC.

11.2b To delegate any of their functions to FSC consisting of five or more members appointed by them. All proceedings of FSCs shall be reported to the FEC.

11.3c To produce Forum constitution to help govern proceedings at FAGM and FGA in a fair, controlled and coordinated manner.

11.4d To resolve or to establish procedures to assist the resolution of disputes within the Forum.

12. GURUNG (TAMU) CULTURE FORUM ANNUAL GENERAL ASSEMBLY

12.1 The FEC shall hold at least two meetings annually – FAGM preferably in Sunday early May and FGA in Sunday early December.

12.2 All Gurung (Tamu) members and Gurung (Tamu) non-members shall be entitled to attend the FGA.

12.3 FAGM/FGA shall be called upon by 45 clear days’ through written or electronic notice or through Viber message to all members specifying the reason for the meeting/assembly.

12.4 The quorum required to commence the FAGM shall be the presence of forty five (45) members consisting of FEC and FLMs.

12.5 The Project Director shall chair all FAGM/FGAs. In his absence, the first or second Co-Director shall chair the FAGM/FGA.

12.6 Except where otherwise provided in this Constitution, every issue at a FAGM shall be determined by a simple majority of the votes taken by FLMs in person. There shall be no postal voting.

12.7 At an FAGM, the FLMs shall:

12.7a Receive the accounts of the Forum for the previous Financial Year from the Treasurer.

12.7b Receive the update progress report of FEC and FSC on the Forum’s activities.

12.7c Elect new committee member(s) to replace those retiring from the incumbent post(s)

12.7d Appoint an auditor or independent examiner for the Forum when required.

12.7e Discuss and determine any issues of the Forum with FEC and FBC before them.

12.7f As and when required, an Extraordinary General Meeting (EGM) shall be called upon at any time by the FEC in consultation with FBC within 14 days.

13. SPONSORS/DONATION FUNDS AND PROPERTY

13.1 The bank account has already been set up with the Lloyds Bank at the Farnborough Branch. The name of the account shall be: Gurung (Tamu) Culture Forum-UK. Minimum of two authorised signatory members shall be required to draw the fund from the bank. They shall be two of the nominated members of the FEC (see Annex D).

13.2 The funds of the Forum shall only be used for promoting the Forum objectives. It shall not belong to any FLM.

13.3 No Forum committee member shall receive any payment of money or other material (whether direct or indirect) from the Forum except for:

13.3a Reimbursement of reasonable out-of-pocket expenses (including hotel and travel costs) actually incurred in the administration of the Forum. However, it has to be approved and granted by the FEC upon receipt of the travel expenses.

13.3b A reasonable hiring fee for venues for FAGM/FGA only if approved and granted by the FEC and/or there is sufficient fund in the account that can be dispensed solely for the benefit of the Forum project.

13.3c An indemnity in respect of any liabilities properly incurred in the running of the Forum (including the costs of a successful defence to criminal proceedings). It has to be approved and granted by the FEC and FBC.

13.3d Any FLM who possesses specialist skills or knowledge, and any firm or company of which such a person is employee of, may charge and be paid reasonable fees for project work carried out for the Forum but only if approved and granted by the FEC and FBC and/or there is sufficient fund in the account that can be utilized for the benefit of the project.

13.4 Association Property – intentionally left blank.

13.5 RECORDS & ACCOUNTS – the FEC shall keep proper records of:

13.1 All proceedings at FAGM and FGA.

13.2 All proceedings and reports of FSC meetings

13.3 Any professional advice taken on board.

14. AUDITING OF ACCOUNTS

14.1 The FEC shall prepare the statement of accounts covering the financial period (01 Apr – 31 Mar) each year.

14.2 The FEC shall ensure that arrangement of auditing of Gurung (Tamu) Forum-UK accounts be carried out each year.

14.3 The auditing period shall be arranged in such a way so that the Treasurer may be able to submit the financial report for that financial year at the FAGM.

14.4 The FEC shall also ensure that authority/approval from FAGM be received before appointing. Auditors shall do the audit check for that financial period. . 15. DISTRIBUTION OF NOTICES

15.1 Notices under this Constitution shall be sent by hand, by post or by any suitable electronic means to FLMs or may be published in any suitable journal (or Newspaper) or in any Newsletter distributed by the Forum.

15.2 The address at which FLM is entitled to receive notices shall be the address noted in the register of members (or, if none, the last known address).

15.3 Any notice given in accordance with the Constitution shall be treated for all purposes as having been received:

15.3a 24 hours after being sent by electronic means or delivered by hand to the relevant address.

15.3b Two clear days after being sent by first class post to that address.

15.3c Three clear days after being sent by second class post or overseas post to that address.

15.3d On the date of publication of a journal or newspaper containing the notice.

15.3e On being handed to the FLM (or his authorised representative) personally.

15.3f As soon as the FLM acknowledges receipt.

15.4 A technical defect in the giving of the notice of which Forum members of the FEC and FSCs are unaware at the time shall not invalidate decisions taken at the FAGM and FGA.

16. AMENDMENTS

16.1 The Constitution shall be amended at the FAGM on general consensus from 2/3 majority of those present at that particular meeting but:

16.2 The FLM shall be given 21 clear days’ notice of the proposed amendments.

16.3 No amendment shall be valid if it would cause a fundamental change to the Objectives.

17. ANTI – HARASSMENT POLICY – this is given at Annex B below.

18. OATH OF OFFICE – this is given at Annex C below.

19. COMPOSITION OF FEC/FBC/FSC – this is given at Annex D below.

20. DISSOLUTION

20.1. If the project is to be dissolved for any valid reasons, the decision shall be taken by the FEC in consultation with FBC at the FAGM. The incumbent FEC members shall continue to hold their post until such time the Forum has been completely dissolved. Any assets or remaining funds, after debts have been paid, shall be granted to any nominated charity(s) or Forum Life Member (FLM) organisation on the general consensus from 2/3 majority from those present at that particular FAGM.

21. ADOPTED AT A MEETING HELD

Annex A to Appendix 1 Tamu Culture Forum-UK Dated: 13 May 2018

GURUNG (TAMU) CULTURAL FORUM-UK – CODE OF CONDUCT 1. The Constitution of Tamu Culture Forum-UK has been drafted based mainly on the Law of the Land, the Charity Commission and Cyber Law. Therefore, any Member or Participant violating the Code of Conduct and any other matters related to the Constitution, shall be liable to appropriate disciplinary action. The Director along with his Council Board shall be responsible for taking the necessary and appropriate disciplinary action. To date, Members’ and/or Participants’ comments have mainly been shared on Viber, public meetings, E-mails, websites, telephones and private correspondences. 2. To ensure all members/participants are treated equally and no irrelevant matters are shared on devices mentioned in the aforementioned paragraph that may cause any unnecessary disruption or controversy, the following Code of Conduct has been created for the benefit of all members and participants. All concerned shall stringently comply with it as follows: 1. Any comments, suggestions and opinions or new materials presented that challenges any validity of issues and contents of the Trilingual Tamu Heritage Book shall be substantiated by bona fide evidences and/or proofs. Otherwise, it shall be deemed invalid.

2. Any evidences/proofs so presented shall be stated firmly but politely in a civilized manner without intending to offend others.

3. Any abusive, derogatory and defamatory comments made against any other member or participant without any valid reasons shall not be tolerated. Immediate appropriate actions shall be taken against the individual to preclude the situation from exacerbating.

4. Any member/participant wishing to comment must firstly introduce themselves by stating their name and Samaj (Nameless Parsad Gurung, Danda Samaj UK) for the benefit of all members and participants. Comments shall only be of matters that directly relate to the Forum subject.

5. No derogatory comments shall be made against anybody using pseudonyms and/or false names. The Director along with his Council Board and IT expert shall in all their capacity do everything they can to catch the perpetrator and take appropriate action against that individual in accordance with the Law of the Land. In addition, no comments shall be made about religion, politics, ethnic caste and sub-caste (16/4 jate) and human rights.

6. Only relevant matters that help to enhance the value of the Trilingual Tamu Heritage Book shall be posted for discussion on Viber and any other such devices and nothing else. If in doubt, individuals shall consult the relevant matter with the Director, before posting it for discussion.

7. Before making any comments and/or asking questions during Tamu Forum meetings and/or on the Viber Group, individuals are advised to do a thorough background search of the subject matter to prevent repetition of the same subject or question that have already been discussed, actioned and resolved by the Director and his Council Board. This is to preclude unnecessary waste of time and to maintain the flow of the Forum.

ANTI - HARASSMENT POLICY

1. Harassment includes offensive verbal comments related to gender, age, sexual orientation, disability, physical appearance, body size, race, religion, sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention.

2. Participants asked to stop any harassing behaviour are expected to comply immediately. Sponsors are also subject to the anti-harassment policy. In particular, sponsors should not use sexualized images, activities, or other offensive materials. If a participant engages in harassing behaviour, the organizers may take any action they deem appropriate, including warning the offender or expulsion from the event.

3. If you are being harassed, notice that someone else is being harassed, or have any other concerns, please follow the directions in the "If You Need Help" section, directly below this policy. Organizers will be happy to help Forum participants contact security or local law enforcement, provide escorts to an alternate location, or otherwise assist those experiencing harassment to feel safe for the duration of the meeting. We value your attendance.

4.
