Minute of the Meeting of the Quarterly Board on 11th March, 1997

Apologies were submitted on behalf of Councillors D. Coffey, W. Doyle and A. McIntyre who were undable to attend the Board because of other commitments.

The Chairman welcomed everyone to the Quarterly Meeting of Licensing Board and advised that the Depute Clerk to the Licensing Board, Ms. Irene Townson, had attended a Seminar on underage drinking, designer drinks and alcopops, held in Kirkintilloch on 5th March, 1997. He expressed his concerns with regard to underage drinking and advised that the Board are intending to make representations to COSLA in this respect.

The Chairman introduced the items of business.

Item 1 The Minutes of the Meetings of East Ayrshire Licensing Board held on 14th January, 24th January and 10th February, 1997 were approved and noted.

Item 2 & 3 With regard to Guidelines on extended hours and Bye-Laws, the Clerk reported that copies of the proposals had been circulated within Local Committees and Community Councils for consultation. It is now intended to forward a copy of the proposals to Strathclyde Police, Statutory Consultees and the Licensed Trade Association for comment.

Councillor Boyd stated that there may be interest from other bodies and suggested that an advert be placed in a local newspaper to allow further comments to be received. The Board agreed and the Clerk undertook to place the advert.

Item 4 The Clerk advised that she had received a letter from the the Project Manager of S.I.P.S. seeking the support of the Board by the distribution of literature. She explained that S.I.P.S. is a national project managed by the Scottish Council on Alcohol aimed at setting professional, responsible standards for the licensed trade. S.I.P.S. are planning a pilot project for the Ayrshire area, the launch, to which the Chairman is invited, to take place on 17th April, 1997. The Board agreed to support the project.

Environmental Health expressed concern with regard to these premises in that various contraventions, mostly of a structural and cleaning nature, were noted, particularly in the public bar and kitchen area. The floor covering in the kitchen area is holed and requires to be replaced. Mr. Stafford advised that the licensee had been contacted and had advised his Department that the work would be carried out by 7th April, 1997.

The Chairman did not feel that it was acceptable to wait until 7th April and proposed that fourteen days be given for the work to be carried out. The Board agreed. ------

Environmental Health commented that these premises are in need of decoration in the public area and remedial works to eradicate sever condensation dampness in the toilet accommodation. A timetable for the proposed work has however been agreed with the licensee. The Board agreed to the timetable. ------

Building Control commented in respect of these premises that the escape door from the rear lounge requires to be made operationl, bolts require to be removed from the rear escape door and the emergency light at the rear lounge is in need of repair.

Environmental Health commented that these premises are in need of redecoration and refurbishment. Areas affected by burst pipe damage require repair, the gents toilet accomodation requires retiling and the extractor fan in the ladies toilet accomodation requires refixing. Plans have been approved but no work started as yet.

Mr. Calderwood appeared and explained that he is leasing the premises from Bass Taverns and at present a major refurbishment is in progress.

The Chairman asked the minimum work requried be to bring the premises to an acceptable standard. Mr. Stafford replied that repairs would require to be carried out to the toilet area and suggested that the applicant liaise with his department with a view to setting up a programme of work.

Councillor Taylor stated that in his opinion this was not acceptable and moved to refuse the licence.

The Chairman moved that a programme of work be set up to the satisfaction of the Environmental Health Department and the outcome reported to the June Quarterly Meeting of the Board. This was seconded by Councillor Boyd. ------

Environmental Health commented in respect of the overall condition of these premises. Mr. Stafford stated that the premises had been visited on a number of occasions and, although the premises have improved, an inspection was carried out on 6th March when it was found that there is no hot water. The premises are also in need of cleaning. The premises were inspected on 9th March, 1997. There was still no hot water.

Mr. MacIver, Solicitor, appeared on behalf of the applicant and agreed that the premises are not in a satisfactory condition. He explained it had also come as a shock to his clients to find their premises in such a state of disrepair. He stated that the management had failed, but had been replaced and action was now being taken to rectify the position, as could be confirmed by the improvement to the premises since the first visit from Environmental Health. With regard to the hot water in the premsies, Mr. MacIver advised that it was only the Soul Room that had no hot water supply.

Various questions were asked by the Board with regard to the condition of the premises.

The Chairman proposed that seven days be given to bring the premises to an acceptable standard and that the Soul Room be closed until hot water is installed. The Board agreed. ------

On the Board enquiring as to what was meant by “any other sound reproductive method whatsoever” as appears in the application, Mr. Williams asked that this be deleted. He also asked that dancing be deleted from the application.

Councillor Boyd expressed concern regarding 2am extensions for function suites and enquired as to whether it is a suite or a function that is licensed. The Clerk advised that in the former Kilmarnock and Loudoun area the licence was attached to the suite and not the function, however this is a matter to considered in the new guidelines.

Councillor Kelly also expressed concerns that a licensed premises be open at 8am.

The Board adjourned to consider the application.

The Board returned after ten minutes. As extended hours are to be addressed in the new guidelines which will not be produced until the June Board, the Chairman moved to grant the extension. Agreed.

He stated that the extension would be used for shift workers and that at present two fishing clubs use the premises and had enquired as to the possibility of opening earlier on Saturdays.

Councillor Kelly stressed that he did not feel that there was sufficient demand for a 9am extension and moved that the extension be refused.

The Chairman moved to grant the extension. This was seconded by Councillor Campbell. Granted. ------

He explained that there had been some misunderstanding at the January Board Meeting and that planning permission had been obtained some time ago for the site. He had received a Section 14 Direction allowing him to re-apply and provide further details of the application.

PROVISIONAL GRANT OF LICENCE

The Clerk advised that twenty nine letters of objection had been received in respect of this application.

Mr. MacIver appeared on behalf of the applicant and confirmed that all but one of the letters had been properly served.

The twenty eight competent letters of objection were circulated (two of these were duplicates).

The Clerk indicated that the Hearing Procedure would be following and that the Board would have regard to the plan of Kilmarnock showing licensed premises, produced and exhibited at the Board meeting.

The Clerk advised that comments had been received from Strathclyde Fire Brigade that the means of escape from the first floor plant room does not comply with the Technical Standards for compliance with the Building Standards (Scotland) Regulations 1990.

Mr. MacIver stated that all Fire Regulations and Building standards will be complied with. He explained that it is intended to open the premises at 50 Bank Street, presently Wisharts furniture shop, as O’Neils Authentic Irish Bar with the emphasis on a warm, friendly atmosphere. He stated that a Brand Manual is available should the Board wish to view it, and he outlined the facilities to be provided.

In respect of over provision, Mr. McIver advised that this would not be a “mega pub” as feared by locals, but a mid sized development of about a three hundred patrons maximum. He stated that only a portion of the premises would be used as a public house and that time would be spent on the training of staff. He proceded to outline the facilities to be provided and reserved the right to return on the question of over provision.

Mr. Lorimer Headley spoke first on behalf of the objectors and stated that he thinks there is over provision in Kilmarnock town centre since the volume of sales has dropped in the last few years and in fact are continuing to drop. In respect of the size of the development, Mr. Headley suggested that a medium sized development to a company such as Bass Taverns, would be considered a large development to another licensee. He stressed that most of the licensed premises in the Kilmarnock area are run by local people, with the closest only some forty to forty five yards from the proposed development.

Mr. Headley stated that approximately thirty jobs may be created by the development but that this would be at a cost of other premises closing and moved that the licence be refused.

Mr. David Little, Chairman of the Scottish Licensed Trade Association, spoke on behalf of the objectors. He stated that at present the licensed trade is stagnant and is taking a downturn and feared that if this licence is granted then other premises would close.

Mr. Eric Brown, licensee of the Goldberry, Public House, spoke on behalf of the objectors and advised that he had prepared plans showing the proposed development and the licensed premises in the locality, the locality in his view being 550 yards either side of the proposed development. With Mr. MacIver’s agreement the plans were circulated.

Referring to the plan Mr. Brown stated that there are fifty six licensed premises, inclusing clubs, in the locality, forty six of these being on-sales, and this, he feels, constitutes provision. Mr. Brown advised that he presently has plans to re- develop the whole of the Goldberry, which he fears would be affected if this licence is granted.

Councillor Brailsford enquired as to whether the applicant had considered any other premises for the development. Mr. MacIver replied that other premises were looked at but were not appropriate for this type of development.

Councillor Smith asked the Clerk to the Board if Registered Clubs should be taken into account when considering over provision. The Clerk replied that Registered Clubs cannot be taken into account and that it was for the Board to decide on the appropriate locality when considering over provision.

Councillor Macrae asked for clarification of the size of the development. Mr. MacIver stated that plans, with sizes, had been submitted with the application. The plans were circulated. Mr. MacIver continued that when O’Neils opened in Paisley, a small project, which is approximately 3,300 square feet, the local trade expressed fears, however trade had increased as a result of the spin off.

Both parties were asked to sum up.

Mr. Brown stated that, as President of the Strathclyde Licensed Trade Association, he knew that since O’Neils in Paisley had opened trade was suffering.

Mr. MacIver submitted that of the four grounds of objection, over provision is the principal objection and stated that Registered Clubs, Entertainment Licences and Off-Sales should not be taken into account when considering the question of over provision.

Mr. MacIver concluded that with the proposal of £800,000-00 being spent on the development, Kilmarnock was being offered a high quality premises with approximately thirty jobs being created locally. He could however understand the fears of locals for their livelihood but stressed that the Paisley development shows that there is sufficient trade for all.

The Board adjourned to consider the application.

Upon returning after fifteen minutes, the Chairman moved to refuse the licence on the grounds of over provision. The Board agreed unanimously.

Mr. McIver asked that a Section 14 Direction be granted, which was refused. He asked for a Statement of Reasons and the Clerk undertook to forward this to him.
