Blind Persons Act 1920 (10 & 11 Geo. 5 c. 49) remains in force, though functions in relation to it were re-transferred by Health Act 1970 (1/1970), s. 6. Local Authorities (Officers and Employees) Acts 1926 and 1940 remain in force, and the position of functions in relation to them was set out for ease of reference by Local Government Act 2001, s. 63 and sch. 12, thus superseding the relevant provisions in this SI. In relation to the First Schedule Part 2, Public Health (Ireland) Act 1878 (41 & 42 Vict. c. 52) and Milk and Dairies Act 1935 (22/1935), ss. 11, 14 and 15 remain in force and the SI remains in force in relation to them. Schedule, Milk and Dairies Act 1935 (22/1935) remains in force, s. 51 of that Act was substituted and no longer refers to a Minister; Local Authorities (Miscellaneous Provisions) Act 1936 (55/1936), s. 3 was repealed, the construction of Local Government Act 1941 (23/1941), s. 83(6) appears to be superseded by S.I. No. 256 of 1949, transferring the function from Local Government to Health; ss. 84 and 85 of that Act were repealed; Local Government Act 1946 (24/1946), s. 88 was repealed, but the SI still appears to have effect in relation to s. 92. In summary, some provisions of this SI remain in effect. 18 This SI transfers functions under the Statistics Acts 1926 and 1946, both of which were repealed by Statistics Act 1993 (21/1993), s. 7(1). This SI is therefore obsolete and should be revoked. 19 Later developments in relation to arts. 5-7 and sch. parts I-III make the transfer of functions provided in these articles obsolete. In relation to art. 5(a) and (b), the Minister's functions under Public Health (Ireland) Act 1878, Local Government Act 1925 (5/1925), in relation to the compulsory acquisition of land by a local authority were transferred to an Bord Pleanála by Planning and Development Act 2000 (30/2000), s. 214. The provisions in paras. (c) and (d) are repealed. In relation to para. (e) and (f), Local Government Act 1941 (23/1941), ss. 83 and 86 are repealed, and the transfer of ministerial functions in Part IV of that Act was superseded by Health Authorities Act 1960 (9/1960), s. 8(3). In relation to the transfer of functions provided by art. 6, Local Government Act 1941 (23/1941), ss. 83 and 84 are repealed, as are Local Government Act 1946 (24/1946), ss. 89-91. In relation to the transfer of power in art. 7, Local Government (Ireland) Act 1898 (61 & 62 Vict. c. 37), s. 51 was repealed, various subsections at a time and Local Government (Ireland) Act 1902 (2 Edw. 7 c. 38), s. 4 was repealed by Local Government Act 1955 (9/1955), s. 5 and sch. 1. Local Government Act 1941 (23/1941), ss. 70 and 71 were deleted by Local Government Reform Act 2014 (1/2014), s. 5(2) and sch. 1 part 2. This SI is therefore obsolete and should be revoked. 20 This SI transfers functions to the Minister for Health in relation to Pharmacy Act (Ireland) 1875 and Dangerous Drugs Act 1934 (1/1934), both repealed. This SI is therefore obsolete and should be revoked. 21 This SI appears to be superseded by Wheat (Transfer of Ministerial Functions) Order 1961 (S.I. No. 158 of 1961) and the functions transferred appear to be obsolete.
