Syeda Sughra Imam. 26. *Senator Syeda Sughra Imam : Will the Minister Incharge of the Establishment Division be pleased to state whether the persons having dual nationality are eligible for Government Service? Minister Incharge of the Establishment Division: (i) Rule 13 of the Civil Servants (Appointment, Promotion & Transfer) Rules, 1973 provides that a candidate for appointment shall be a citizen of Pakistan, provided that this requirement may be relaxed with the approval of the Establishment Division, provided further that, in the case of candidates to be appointed on temporary basis to posts in the Pakistan Missions abroad, such relaxation shall not be accorded for a period exceeding one year at a time. (ii) Rule 6(iii) of Rules for Competitive Examination(CSS) 2009 lays down that a candidate having dual nationality must surrender his/her nationality and inform the government before joining Civil Services Academy. Mr. Chairman: Any supplementary? Senator Syeda Sughra Imam: Thank you Mr. Chairman. The question was regarding the eligibility of dual nationals for Government service in Pakistan. Sir, the answer that has been tabled is in two parts. 4 Polio free. The answer states that there had been no year in which the Pakistan was Polio free. I would like to ask the honourable minister that in what year there was the lowest number of Polio cases reported in Pakistan. Out of the 5 years that I had requested in question for the lowest case count is in year 2007, which is 32. Mir Hazar Khan Bajarani: Sir, it is a good suggestion and definitely we will consider this if this can help in overcoming the cases of Polio in Pakistan. Definitely we will explore all the avenues that are available to us. Mr. Chairman: Col. Tahir Hussain Mashhadi. Senator Col. (R) Syed Tahir Hussain Mashhadi : Thank you very much Mr. Chairman. Sir, I would like to ask the honourable Minister, he is a very learned Minister and a very fair one as well, he really answers in the House. Sir it is very strange that during the last dispensation of the Q-League government when the President Musharraf was around, the incidents of polio were much lower, they were in the 20ãs and the 30ãs and since this rainbow-coalition government has come, the situation should have improved, because we are a Government of the people, for the people but the situation has become very bad. So, what is his vision, what is his policy, what are his plans to ensure that we become polio free? Otherwise, only two or three countries in the world are left in this situation, Nigeria, Afghanistan and Pakistan and they are better than us. They are having less cases than us and if we donãt improve, we might become banned for international travel. No Pakistani will be allowed anywhere in world. We will be isolated. So, what is his planning? What steps on emergency basis is he taking to ensure that our children of tomorrow do not suffer from the dreaded disease? Thank you.

6 Mr. Chairman: Minister for IPC. Mir Hazar Khan Bajarani: Sir, first of all, I would like to assure the honourable Senator that we are trying our level best and whatever is within our powers, definitely we will use and whatever resources are available to us, we will use those resources and this is one thing that we are trying to achieve because Pakistan unfortunately is one of the three countries as rightly mentioned by the honourable Senator, where polio still exists but this has nothing to do with political set up. There were certain other reasons which are responsible for this increase in polio cases, the law and order situation and in certain cases refusals from the families but we have taken care of that. We have already involved the law enforcing agencies to provide cover and protection to the polio workers and we have already penetrated in those areas, where it was difficult to go in the previous years. So, that is a very positive development that has taken place recently and we also know the reservoirs. There are three reservoirs in Pakistan where this virus presently exists and we have been able to contain virus in those reservoirs so that the rest of the area of Pakistan should be free from that virus. So, with all that knowledge and with all that information that we have, hopefully, Insha Allah, we will be able to control this and make Pakistan polio free by the end of this year. Mr. Chairman: We move to the next Question No. 10, Syeda Sughra Imam. 10. *Senator Syeda Sughra Imam: Will the Minister for Finance, Revenue and Planning and Development be pleased to state:

7 (a) in which Financial Year was wealth tax abolished in Pakistan; (b) the annual tax to GDP ratio in the two Financial Years before wealth tax was abolished; (c) the tax to GDP ratio five years after the abolition of the wealth tax; and (d) current tax to GDP ratio? Senator Abdul Hafeez Shaikh: (a) Wealth Tax Act, 1963, was promulgated with the objectives of discouraging concentration of wealth in non-productive assets and to tax the wealthy persons. In the budget speech in June, 2000, the Finance Minister announced that the Wealth Tax Act has been held in abeyance/suspended for the assessment years commencing from 1st July, 2001 and thereafter. The Wealth Tax was finally abolished through the Finance Act, 2003. (b) The annual tax to GDP ratio in two years before abolition of wealth tax, is as under:ê Year Tax to GDP 1999-2000 10.09% 2000-2001 10.94%

(c) Tax to GDP ratio in five years after the abolition of wealth tax, is as under:ê Year Tax to GDP 2001-02 10.31% 2002-03 10.85% 2003-04 10.32% 2004-05 9.50% 2005-06 10.03%

(d) The current tax to GDP ratio for the Financial Year 2011-12 has substantially improved to 9.1% from the lowest level of 8.6% for 2010-11. Mr. Chairman: Any supplementary? Yes, Syeda Sughra Imam. Senator Syeda Sughra Imam: Sir, basically the question that I raised was that in which financial year was wealth tax abolished. In the reply that has been tabled and then that was discussed yesterday and as suggested by the Minister this question was deferred till today. The reply states that the Wealth Tax Act was promulgated in 1963 with the expressed purpose of discouraging concentration of wealth in non-productive assets and to tax wealthy people. We have been informed in the answer that in his budget speech in June, 2000, the Finance Minister announced that the Wealth Tax Act had been held in abeyance/suspended for the assessment years commencing from the 1st July, 2001. How could the Finance Minister in his budget speech, first of all, the question is that where was he making this budget speech and to whom in the absence of Parliament and how could he in his budget speech decide that wealthy people should be absolved of this tax. How was this decision taken and on what Constitutional grounds?

9 My second supplementary that comes out of this is that since this decision to hold Wealth Tax Act in abeyance or suspended the Wealth Tax Act was taken in June, 2000. Minister for State for Finance. Senator Saleem Mandviwalla (Minister for State for Finance): Sir, I will repeat the question again, can the Finance Minister, through a speech announce suspension of the wealth tax? This is the honourable Senatorãs question of yesterday. The Finance Minister, after the appraisal of a summary by the Cabinet for the budget proposal of 2000 and 2001 including abolition of wealth tax was on 7-6-2000, after the summary was approved by the Cabinet, he made the speech at that time and same day and that is how he held it in abeyance. After that the Presidential Ordinance was issued relating to abolition of the wealth tax. This was the first questionãs answer and the second question she asked what was the GDP ratio in 1998-99, it was 12.61 and the GDP ratio, I have brought it even for an earlier year for here, is 1997-98 was 12.57. These are the two replies sir.

Was the abolition of wealth tax then responsible for tax to GDP ratios falling or not? Mr. Chairman: Minister of Sate for Finance. Senator Saleem Mandviwalla: Sir, I would recommend this to be a new question because this again requires me to look into the history, what exactly happened. So, I will not be able to reply immediately. Mr. Chairman: Col. Tahir Hussain Mashhadi. Senator Col.(R)Syed Tahir Hussain Mashhadi: Mr. Chairman, I would like to bring to the attention of the honourable Minister and request him to answer. Is it a fact that the wealth tax was abolished to help the rich and the mighty to become richer and richer and their fortunes to be multiplied manifold. This causes a great loss to the Government of Pakistan. Now, if it was abolished and wealth tax is a means of balancing the distribution of wealth, why this Government has not re-imposed it? It is number one. The number 2, has the honourable Minister noticed the ever increasing decrease in tax to GDP ratio and now it went down to 8.6 and they are proud to say that it is 9.1 which is terrible, it is unacceptable in any democratic country in the world. It shows that the loss in the Federal Board of Revenue in addition to the corruption that goes on, the coalition that goes on, it is only to help the rich and the mighty and not to create a good middle class in

11 Pakistan. This seems to be a very well planned system of protecting the wealthy and giving more to them. Mr. Chairman: Col. sahib , please come to the question. Senator Col. (R) Syed Tahir Hussain Mashhadi: So, would he kindly tell me what they have planned, what is his vision and what are their actions that they are going to take, instead of rhetoric, to improve the GDP ratio. Mr. Chairman: Minister of State for Finance. Senator Saleem Mandviwala: Sir, first of all, I want to clarify that Wealth Tax was not abolished only to protect the wealthy. Basically, there was a double taxation problem that people were paying taxes on their income, on their wealth and then again paying Wealth Tax on the same thing. So, it was basically, abolished for that reason. But it was not to give protection to any wealthy people at least to my knowledge. The second question, as for as the tax to GDP ratio going down, there is no doubt that the GDP ratio over a period of last ten yearsã tax has gone down and we are taking some measures to improve the tax to GDP ratio. With due respect, I disagree with the honourable Minister saying that it was a double taxation. Actually the un-elected government has abolished this. But when the Parliament came, the Finance Ministry should have brought it to the elected government. Then the Musharrafãs regime was there, they should have brought it and got it passed. The Finance Bill is first passed by the National Assembly and then it comes to the Senate for recommendations.
