1. Background

1. The Government of Cambodia has requested assistance from Asian Development Bank (ADB) with improving road asset management and road safety. The Road Network Improvement Project (RNIP) was included in the Country Operations Business Plan, 2017– 2019. The RNIP was approved on 28 September 2017 to be financed from concessional loan equivalent to $70million; and the loan agreement was signed on 19 January 2018, two months behind the appraisal schedule due to the government reached the borrowing capacity for 2017. The loan became effective on 20 March 2018. The RNIP includes four outputs: (i) safer and climate-resilient national roads delivered, ii) axle load control enhanced, (iii) quality assurance for civil works in MPWT strengthened and (iv) road safety enforcement in project communes improved.

2. The project aims to provide efficient transportation on the Greater Mekong Subregion (GMS) Southern Economic Corridors (SECs) passing through Cambodia and connecting feeder roads to extend the benefits of GMS SECs to northwestern and southeastern provinces through the improvement of the national roads that are unsafe and prone to flooding.

3. All project roads, with a total length of about 147 km, are prone to climate change effects such as frequent flooding when the water level in Tonle Sap and Mekong rises. Thus, the project will provide the climate resiliency measures, such as reinforced embankment slope protection, increased drainage capacity, and additional urban drains and outlets. For the civil works, the project will use a hybrid performance-based contract (PBC), which includes major civil works and routine maintenance.

4. A Mission of the Asian Development Bank (ADB) visited Cambodia from 27 to 30 May 2019. The purposes of the mid-term review mission (the Mission) were: (i) assessment of proposed minor change in scope for a civil work package, equipment packages, and a consulting service package, including relevant safeguard impact screening, (ii) assessment of proposed reallocation and partial cancelation of the loan, (iii) assessment of civil works implementation period, (iv) confirmation on safeguards categorization and compliance of existing civil work packages, (v) procurement plan updates, and (vi) Gender Action Plan (GAP) implementation updates. The Mission met with Ministry of Public Works and Transport (MPWT-Executing Agency), Ministry of Economy and Finance (MEF), Authority for the Protection and Safeguarding of Angkor and the Region of Angkor (APSARA), Project Management Unit 3 (PMU3-Implementing Agency), and the Project Implementation and Construction Supervision Consultants (PICSC).The Mission also conducted site visits of National Road 1 (NR1) and NR6 including two (2) additional section (CW-A1: Siem Reap Downtown 5.8km length and CW-A2: from Kralanh to Serei Saophoan 48.4km length).

2. Objective of the Field Assessment

5. After receiving requests from relevant local authorities, DPWT and Authority for the Protection and Safeguarding of Angkor and the Region of Angkor (APSARA), MPWT/PMU3 assisted by the project consultants conducted due diligence to assess involuntary resettlement impact of the proposed new sections.

6. This due diligence report (DDR) on involuntary resettlement has been prepared to assess the project’s impacts in terms of land acquisition, resettlement and environmental impacts. The main objective is to confirm if the proposed change of scope of the Road Network Improvement Project (both downtown and rural sections) anticipates any involuntary resettlement and environmental impacts that may trigger the application of involuntary resettlement and environmental safeguards requirements in accordance with the ADB’s Safeguard Policy Statement (2009).

3. Project Description

7. The ADB Mission team reviewed and signed the MOU on 30 May 2019 the MPWT's proposal for rehabilitation of additional road sections under the project road NR6 through inclusion of (i) Siem Reap downtown section, and (ii) Kralanh–Serei Saophoan section.

8. The summary of proposed additional scope for RNIP is as follow table 1.

9. Based on the site survey, the status of existing road sections as follows:

(a) Siem Reap downtown section(5.8km): As a result of the field survey for the project section, (i) the starting 440m section out of total 5.8km section is operating two (2) lane and for the middle 185m section is six (6) lane as shown in below figure 2, and remaining 5.154km section is operating four (4) lane; particularly (ii) regarding the four (4) lane section, the barrier were installed in both side, and the main carriageway which installed in the central location is operating only two (2) lane as shown in below figure 3, so frequently traffic congestion occurred by inefficient operation system. In addition, the 1.5 km section out of 5.8km, existing road elevation is higher than the main carriageway in the central section for entering and exiting the commercial houses and hotels along the both side of road. And more, drainage facilities installed on the existing roads were found to be deteriorated and drainage function was degraded as shown in below figure 4. Therefore, the improvement of the existing facilities is necessary to increase the existing road traffic capacity and to enhance the function of the drainage facilities. However, no resettlement impact will be anticipated for the civil works.

(b) Kralanh–Serei Saophoan section(48.4km): This section is operating two (2) lane- two-way, and in the case of the 3km section from the starting point, the existing pavement was damaged and road stability is deteriorated. The market and town areas including the Chak Krey market located in the district have no drainage facility yet as shown in below figure 5, and the resident people have been suffering frequent flooding due to lack of drainage facilities during the rainy season. Therefore, it is necessary to improve the existing pavement and install the new drainage facilities in the related areas in order to provide the benefit for resident people and road users. For the cross through Kralanh section, from beginning point to about 3km, the pavement damage such as pothole and cracks has occurred. So in this section will be applied the Typical cross section Type 3 for the pavement strengthen. Therefore, the type to be applied according to the existing pavement condition and drainage facility is shown in below figure 7.

12. According to the site screening1 for involuntary resettlement impact, the project has been categorized as “C” for Involuntary Resettlement in accordance with 2009 ADB's Safeguard Policy Statement (SPS).

13. The project will rehabilitate the existing roads where social impacts are not expected to occur during and after execution of the project except some temporary and site- specific environment disturbance will be occurred which will be addressed through EMP of the project. The resettlement framework has been prepared in compliance with SPS to mitigate involuntary resettlement impacts in case they arise during construction.

14. The upgrading of NR6 from Siem Reap to Bantey Meanchey will benefit 108,976people including 54,208 (49.74%) women and 9.8% in Preah Netr Preh; Phniet is 14.1%; and 21.19% Serei Saophoan town (S/k Preah Ponlear; Kompong Svay and Phniet) of Bantey Meanchey province2.

15. The project will benefit at least 104,746 persons along BMC town and Preah Netr Preah district (50% are women) and 19,045 HHs in 5 Sangkat/communes and 1 district of a Banteay Meanchey province within the project area3.

11 16. MPWT/PMU3 has conducted Due Diligence to verify and confirm the land acquisition and/or involuntary resettlement impacts status due to the change of scope of works. The Due Diligence Report (DDR) has been prepared in compliance with the ADB's Safeguard Policy Statement and the laws and regulations of the Kingdom of Cambodia.

4. Information Disclosure, Consultation and Participation

17. Meeting with PIUs and Authorities prior to Public Consultation was carried out by MPWT’s consultants and ESO officers from 4-6 June 2019 as shown in below table 4. There have been three meeting held as shown on below table 4. During the meeting, the PMU3 and ESO from MPWT explained the purpose of the occasion, highlighting the proposed improvements and coverage area of services.

18. Public Consultation Consultation with people living along the project road was carried out by MPWT’s consultants, PMU3 and ESO officers from 19-20 June 2019. There are three consultation held as shown in below table 5 with the total of 241 participants of which 65 participants are female. The Public Information Booklets (PIB) were distributed to all participants and also reserved at all commune offices of Banteay Meanchey province.

The consultation meetings discussed the proposed project sections and the scope of works to the participants and also explained related policy lay down in the resettlement framework which was approved in June 2017 and disclose on the ADB website. After explanation of the project sections, the floor also opens to the public to express their concerns, suggestions and questions. Below table summarize the questions and answers during the consultation in the three locations.

5. Grievance Redress Mechanism (GRM)

20. The project section in Siem Reap will follow the GRM which already established for existing RNIP and similar GRM will be established in Banteay Meanchey (48.4km) for additional section in Preah Netr Preah district by General Department of Resettlement (GDR).

21. The MPWT/PMU3, through continuous consultations, discussions and interviews with villagers and sellers along NR6, will ensure that people along the roads are fully aware of their rights to complain and about the grievance redress mechanism (GRM) for both environmental performance and involuntary resettlement through EMP and this due diligence report. The details of the Grievance Redress Committee (GRC), including contacts of the members, the grievance redress mechanism will be displayed on the Project signboard during construction.

22. During consultation meetings, participants are informed that if affected persons do not have sufficient writing skills or are unable to express their grievances verbally, it is a common practice that they are allowed to seek assistance from any recognized local NGO or other family members, village heads or community chiefs to have their complaints or grievances written for them. GRM in Banteay Meanchey will be again informed to local residents and local authorities along the NR6 of Banteay Meanchey road section.

23. The GRM procedure for resettlement (agreed between IRC and ADB for Siem Reap section) includes four stages:

(i) First stage: Affected households will present their complaints and grievances verbally or in writing to the village chief, commune chief or IRC and Provincial Resettlement Sub-committee working groups. The receiving agent will be obliged to provide immediate written confirmation of receiving the complaint. If after 15 days the aggrieved affected household does not hear from the village and commune chiefs or the working groups, or if he/she is not satisfied with the decision taken in the first stage, the complaint may be brought to the District Office. (ii) Second stage: The District Office has 15 days within which to resolve the complaint to the satisfaction of all concerned. If the complaint cannot be solved at this stage, the District Office will bring the case to the Provincial Grievance Redress Committee. (iii) Third stage: The PGRC meets with the aggrieved party and tries to resolve the situation. The Committee may ask for a review of the detailed measurement survey (DMS) by the external monitor (EMA). Within 30 days of the submission of the grievance, the Committee must make a written decision and submit copies to the MPWT, DPWT, EMA, PRS/IRC and the affected household. (iv) Final stage: If the aggrieved affected household does not hear from the Provincial Grievance Redress Committee or is not satisfied, he or she can bring the case to Provincial Court. This is the final stage for adjudicating complaints. The Court will make a written decision and submit copies to the MPWT, PDPWT, EMO, PRS/IRC and the affected household. If any party is still unsatisfied with the Provincial Court judgment, he or she can bring the case to a higher-level court.

6. Conclusion and Recommendations

24. From the field visit, consultation meeting and verification of detail engineering design at the two additional road sections, followings are conclusions and recommendations for the purpose of involuntary resettlement impact mitigation and minimization during construction of civil works.

a. The site visit to these two additional road sections found no private land will be acquired for the project; only short time temporary disturbance may be expected, in Siem Reap downtown areas which will be addressed under the EMP of the project. b. According to consulation meeting with local authorities and PIUs, there is no

15 major impacts to the community and their livelihood. The project will create significant economic opportunities for the residents of both Siem Reap and Banteay Meanchey town. c. The access road improvement on the other hand, will provide huge benefits, in terms of safe travelling, fast and cost-efficient travel to commuters plying this route. None displaced person from subproject development and upgrading. d. MPWT should coordinate with GDR to ensure that the project-specific GRM is established in Banteay Meanchey province. And this project specific GRM will be disclosed to households and local authorities along the additional road section. e. SEO/MPWT shall strictly monitor enforcement of EMP implementation and report to MPWT and ADB in quarterly internal monitoring reports. SEO should ensure that a complaint log book is available at the site to register any complaint from the ground and resolve it according to the procedures depending on whether it is an environmental or social issue. f. A semi-annual integrated safeguards (social and environmental safeguards) monitoring report should be prepared and submit to MPWT and ADB for review and disclosure.

I would like to inform that, for the National Road No.6 is already compensate on 2005 and 2006 during the first national road construction with affected living along the road site. So, this stage the project needs only 11m from the COI only.

According to SPS, we try to avoid adverse impacts of project on the environment and affected people, where possible. The RNIP tries to minimize all impact as the project can. I would like to inform that, for the National Road No.6 is already compensate on 2005 and 2006 during the first national road construction with affected living along the road site. So, this stage the project needs only 11m from the COI only.

But if old drainages are broken, the project will be replacing new drainage. But some place is mostly urban areas, the project will be installing new drainages.

It will be affected with the project. If possible, please follow up with contractor and inform each other about where you water supply install un underground and main system. Because we can avoid any impact during construction by remove or need to do anything by discussion with contractor for finding the best solution each other.

The Chief of commune during conducted the public consult meeting was welcome with all of the participants jointed the meeting today. Great thanks for all of participants that gives me great pleasure to extend to you all very warm welcome on behalf of the provincial and district hall and to say how grateful we are to MPWT, DPWT and national consultants, local authority and other relevant of project component are joint our meeting and discussion today. The purpose to arrange the public consult meeting today is focus about the about new project proposed from Ministry of Public Work and Transport for improvement of our Nation Road No 6, as name of project is “Road Network Improvement project (RNIP)”. This project is support by Asian Development Bank (ADB).

Mr. Sambath, ESO, Explain about the additional section of RNIP

The Road Network Improvement Project – Additional section was may include additional works for the National Road No 6 separated with two section such as CW-A1(PK:311+851 to PK: 317+630) in Siem Reap Town and CW- fromA2 (PK: 367+510 to PK: 415+857) Banteay Meanchey provinces.

The COI for RNIP requirement is only 11m from central line. The additional works would build on the achievements of RNIP-AF to ensure the continued effective use of the rehabilitated national and provincial road network. For climate resilience, the works may include improvements in side drainage in flood prone areas along the roads. The envisaged works would also support the planning and development of the road maintenance program by

32 further enhancing the capacity of MPWT to carry out data collection, processing and analysis necessary for effective road of the national and provincial road networks. It would also provide ongoing support to the community-based road safety, prevention for HIV/AIDs, human trafficking, gender-based violence and violence against children.

Explain about Social Safeguard Policy Statement (SPS) • SPS – describes common objectives of ADB’s safeguards, lays out principles, outlines delivery process for ADB’s safeguard policy • A set of specific safeguard requirements that borrowers/clients are expected to meet when addressing social and environmental impacts and risks • A consolidated Operations Manual section that specifies ADB’s internal review procedures for due diligence and for supervision throughout the project cycle Goal: To promote the sustainability of project outcomes by protecting the environment and people from potential adverse impacts of projects

Objectives: • avoid adverse impacts of projects on the environment and affected people, where possible • minimize, mitigate and/or compensate for adverse project impacts on the environment and affected people when avoidance is impossible • help borrowers/clients to strengthen their safeguard systems and develop the capacity to manage environmental and social risks

A: Yes Great thanks for your question, in the rural is not yet sure with drainage proposing, but in urban areas mostly are proposed the drainage (u drain type). I will inform about this issue to the commune again after the final design drawing.

The project and MPWT always tries to advertise and advise more about this problem. Because is more affected with community and healthy. Please do not throw or disposal your garbage into the drainage.
