NOTICE

OF INTENTION TO MAKE A GATING ORDER SECTION 129A HIGHWAYS ACT 1980

The County Council (Manor Estate, Woodhouse) Gating Order 2008

NOTICE IS HEREBY GIVEN that the Nottinghamshire County Council proposes to make an Order under Section 129A (1) of the Highways Act 1980 (for the purposes of reducing crime and antisocial behaviour) the effects of which in respect of highways at in the District of Mansfield will be:-

All pedestrians, equestrians and vehicles, other than those specified in the Order, will be prohibited from using the alleyways below at Mansfield Woodhouse (“the Highways”). The Highways are also shown by bold black lines on the attached plans. The prohibition will apply at all times.

The Order will exempt from the prohibition, any person who lives in premises adjoining the Highways, emergency services personnel, statutory undertakers and utility providers. Alternative routes for pedestrians, equestrians and vehicles are available by using the following nearby roads:- Park Hall Road; Worcester Avenue; Hereford Avenue; Tewkesbury Avenue; Ley Lane; Kingsley Avenue; Riverside Way; Riverside Close. These roads are shown on the Order plan.

A draft of the proposed Order is set out in the Schedule to this notice.

A copy of the Council’s statement of reasons for making the Order, a plan and other associated papers are available for inspection at:-

Written objections (stating grounds and quoting ref. : MM/22634) must be received by me by the 23rd day of May 2008.

Section 129A Highways Act 1980

The Nottinghamshire County Council (Manor Estate, Mansfield Woodhouse) Gating Order 2008

The Council of the County of Nottinghamshire in exercise of its power under Section 129A (1) of the Highways Act 1980 (“the Act”) and of all other enabling powers being satisfied that the conditions set out in Section 129A (3) of the Act have been met hereby makes the following Order:

1. Save as provided in Article 3 to this Order no person shall proceed on foot, cause any horse to proceed, cause any animal to proceed or cause any vehicle to proceed in the following alleyways at Mansfield Woodhouse in the District of Mansfield (“the Highways”) at any time:-

(a) Hereford Avenue, between nos. 6 and 8; (b) Hereford Avenue, rear of nos. 10 to 34 (even nos. only); (c) Kingsley Avenue, side of no. 31; (d) Kingsley Close, between nos. 8 and 10; (e) Park Hall Road, between nos. 74 and 76 being that section from a point 30 metres from its junction with the back of the footway of Park Hall Road to its junction with the western boundary of the rear of no. 2 Worcester Avenue; (f) Riverside Way, between nos. 9 and 24; (g) Riverside Way, rear of nos. 3 to 9 (odd nos. only); (h) Riverside Way, rear of nos. 10 to 24 (even nos. only); (i) Wells Close, between nos. 10 and 12; (j) Wells Close, rear of nos. 2 to 10 (even nos. only); (k) Worcester Avenue, between nos. 163 and 165; (l) Worcester Avenue, rear of nos. 2 to 48 (even nos. only).

2. The Highways are shown by bold black lines on the plans annexed to this Order.

3. Nothing in Article 1 shall apply to any person proceeding or causing to proceed in respect of the following:-

(a) Ambulance, Fire Brigade or Police purposes;

(c) Any of the following operations if the vehicle cannot conveniently be used for such purpose in any other highway,

i. Building, industrial or demolition.

ii. The maintenance, improvement or reconstruction of any of the Highways.

iii. The laying, erection, alteration or repair in, or land adjacent to any of the Highways, of any sewer, main, pipe, or apparatus and the supply of gas, water or electricity or of any electronic telecommunications apparatus as defined in Schedule 3 of the Communications Act 2003.

(d) The service of a local authority for the collection of refuse from premises adjacent to any of the Highways.

4. A barrier may be installed, operated and maintained at each of the respective ends of the Highways. The Technical Assistant, Engineering Unit (Operational Services), Council (whose telephone number is: 01623 463 463) is responsible for maintaining and operating the barriers.

5. The alternative routes for pedestrians, equestrians and vehicles which are available for use during the period the use of the Highways is prohibited are via the following roads:- Park Hall Road; Worcester Avenue; Hereford Avenue; Tewkesbury Avenue; Ley Lane; Kingsley Avenue; Riverside Way; Riverside Close.

6. This Order shall take effect on the #### day of ######### 2008.
