AN ORDINANCE REGULATING THE CONDUCT AND BEHAVIOUR OF PEDESTRIANS ALONG PUBLIC STREETS AND THOROUGHFARES AND PROVIDING PENALTIES FOR ANY VIOLATION THEREOF.

WHEREAS, the traffic situation in City of Santa Rosa today, has turned from bad to worse to the detriment of commuting public and useless waste of energy and resources;

WHEREAS, Section 458 (a) (1) (ii) OF REPUBLIC ACT NO.7160, otherwise known as the "Local Government Code of 1991". Empowers the Sangguniang Panlungsod to maintain the peace and order by enacting measures to prevent and suppress lawlessness and disorder, and impose penalties for the violation of said ordinances;

WHEREAS, some of the main contributory factors to this traffic problem are certain thoughtless acts or conduct of pedestrians along public streets and thoroughfares, such as, disregarding traffic signals, crossing the streets and thoroughfares at point not designated for the purpose etc.;

WHEREAS, said acts or conduct on the part of the pedestrians not only results in traffic congestions but also road accidents, where the vehicles involved are badly damaged and the victims are either seriously injured or killed;

WHEREAS, it is the duty of the Sangguniang Panlungsod to enact measures to protect the interest of both the commuting pedestrian as w ell as the driver/owner of private or public utility vehicles;

WHEREAS, it shall serve the best interest of public safety welfare, especially of residents of the City of Santa Rosa, if jaywalking along public streets and thoroughfare is eliminated or reduced to the barest minimum;

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF SANTA ROSA IN SESSION ASSEMBLED:

SECTION 1. This ordinance shall be known and cited as the "ANTI—JAYWALKING ORDINANCE OF CITY OF SANTA ROSA"

SECTION 2. Definition of Terms.

1. Pedestrian —a person who crosses or walks along public streets and thoroughfares.

2. Jaywalking — the unlawful conduct and behavior of a pedestrian in public streets and thoroughfares as enumerated in Section 3 hereof.

3. Public streets or thoroughfares — shall mean every public thoroughfare, public boulevard, driveway, avenue, park, alley and callejon, but shall not include roadway upon grounds owned by private persons, colleges, universities, or other similar institutions.

SECTION 3. Acts Constituting Javwalkinq. The following acts or conduct of pedestrians in public streets and thoroughfares are hereby prohibited to wit:

a) Crossing of streets outside the pedestrians lanes, where Pedestrian lane exist. b) Non-use of the pedestrian overpass in streets and highways where the same were constructed, when crossing the said streets and highways c) Riding and alighting from public utility buses and jeeps outside the bus stop and jeepney stop zone

SECTION 4. Strict enforcement of this ordinance shall be at the following places, to wit:

SECTION 5. Penalties - Any person is found jaywalking in public streets and thoroughfare as herein enumerated shall be immediately apprehended or brought to the nearest police precinct for finger printing, lecturing, and payment of the corresponding fine under the following schedule.

1. P100.00 —for the first offense or 3 hours of community service. 2. P500.00 —for the second offense or 3 hours of community service. 3. P1,000.00 —for the third offense 3 hours of community service.

APPREHENDED Jaywalking violator who fails to pay outright shall be given 7 days from the date of apprehension otherwise appropriate legal action shall be filed in proper court.

SECTION 6. Collection of Fine — All fines as provided under the preceding section shall be paid to and collected by authorized clerk collectors of the city Treasurer upon issuance of corresponding order of payment by the apprehending officer.

SECTION 7. Formation of anti-iavwalking taskforce — to ensure the strict implementation, a body is hereby formed to known as anti-jaywalking taskforce consisting of the following:

a. CTMEO b. Brgy. Tanod being deputized

SECTION 8. Implementing Rules and Regulations for this ordinance shall be drafted by a body composed by the following offices:

a. Committee Chair on Transportation — Sanggunian b. CTMEO c. City Treasurer d. Barangay

SECTION 9. Repealing Clause — All ordinances, rules or regulations or parts thereof which are inconsistent with any of the provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 10. Effectively. This Ordinance shall take effect immediately.
