ASSIGNMENT OF LESSEE'S RIGHTS

TIDS ASSIGNMENT OF LESSEE'S RIGHTS (the "Assign nent") is entered into as of the date of the final party's signature hereto by and among the YUKON MUNICIPAL AUIBORI1Y an Oklahoma Title 60 public trust ("Yukon" or "Assign1>r'') and ELI1E MEDIA GROUP, LLC, an Oklahoma limited liability company d/b/a Liudmark Outdoor Media ("Lindmark" or "Assignee") having a principal office address of '.~700 Technology Place, Norman, OK 73071, with WILLIAMS FAMILY INVES'IMENT~, LLC ("Williams" or "Lessor") joining herein for the sole purpose of consenting to this Assignment. WHEREAS, on the 1st day of May 2018 Williams, as lessor, entered into an Amended Sign Location Lease (the "Amended Lease") with Yukon as lessee; the Amended Lease allowed for the construction, repair, ancl location of an outdoor advertising billboard sign, including necessary structures, advertising devices, utility service, service poles, communication devices, and connections by Yukon on certain lands owned by Williams; and

WHEREAS, Section 8 of the Amended Lease states that Yukon may assign its interest in the Amended Lease and that the assignee will be fully obligated under th! terms of said Amended Lease and Yukon wilI no longer be bound by the Amended Lease. i\fter notice is given to Williams, it has a right of first refusal to purchase the assignment, which t has declined to do; and

WHEREAS, Lindmark has expressed an interest in erecting an off-premises outdoor advertising structure with at least one (1) digital face (the "Sign") on the: location covered by the Amended Lease and desires to accept an assignment of Yukon's rights in the Amended Lease, and Yukon desires to assign its rights under the Amended Lease to Lind mark.

THEREFORE, the parties hereto agree as follows:

1. For and in consideration of the payment of the sum cf FIF1Y TIIOUSAND DOLLARS ($50,000.00) from Assignee to Assignor and the inclusion Jf one (1) slot/flip on a digital face on the Sign, as more particularly described hereinbelow, Assig 1or hereby sells, assigns, and conveys unto Assignee, its successors and assigns {i) all of Assignor' ; right, title, and interest in and to the Amended Lease(excluding any obligations, responsibilities Jr liabilities of Assignor that became due prior to the date hereof), including without limitatior, the use of the leased premises during the term(s) of the Amended Lease, including any renewals or extensions thereof or any modifications thereto; (ii) all of Assignor's rights under the Amended Lease and at law or in equity to renew, extend, amend, or modify the Amended Lease or t::> give notice under the Amended Lease to not renew such Amended Lease; and (iii) all of Assignor's rights under and to that certain Permit for Sign Registration (the ''Permit") issued by the Oklahoma Department of Transportation to Assignee.

2. Upon completion of the construction of the Sign and installation of a digital face thereon such that the digital face is ready to display advertisements, Ass gnee hereby agrees that

Page I of5 Assignment of Lessee's Rights so long as Assignor, specifically excluding Assignor's successors and assigns in which Trent Lind mark owns no interest, owns the Sign, Assignor shall have the exclw ive right to one (I) digital advertising space/flip/spot on a digital face on the Sign. Assignor shall be responsible for providing such digital advertisement in the size and format reasonably required by Assignee, and Assignee shall upload such digital advertisement to a digital face on the Sign within two (2) business days of receiving same in such size and format.

l Assignor further grants to Assignee all rights necessary or appropriate to perform the responsibilities of Assignor under the Amended Lease and Permit. Assignee hereby accepts such assignment from Assignor but under no circumstances shall Assignee be deemed to have assumed any of the obligations of Assignor accruing under the Amended Lease or Permit prior to the date hereof. This Assignment is an outright assignment and not an a:;signment for security.

4, Assignee hereby assumes and agrees to discharge and perform any and all duties, obligations and liabilities arising on or after the date hereof and to be pert ormed and/or discharged by Assignor under the Amended Lease and Permit for the duration of the term(s) thereof.

5. Assignor hereby agrees to indemnify, save, and hold t armless Assignee from, against and in respect of (and shall on demand reimburse Assignee fo ·) any and all loss, cost, expense, liability, or damage arising with respect to the Amended Lease and Permit which is based upon a state of facts that occurred or existed before the date hereof.

6. Assignee hereby agrees to indemnify, save, and hold t armless Assignor from, against and in respect of (and shall on demand reimburse Assignor for) any and all loss, cost, expense, liability or damage arising with respect to the Amended Lease a 1d Permit which is based upon a state of facts occurring on or after the date hereof.

7. At any time and from time to time after the date hereof, at Assignee's request and without additional consideration, Assignor shall execute and deliver such nther instruments ofsale, transfer, conveyance, assignment, and confirmation and take such a ~tion as Assignee may reasonably deem necessary or desirable in order to more effectively transfer, convey, and .assign to Assignee and to confirm Assignee's title to the Amended Lease and/or Permit, to put Assignee in actual possession and operating control thereof, and to assist Assigne ! in exercising all rights with respect thereto.

8. All of the covenants, terms, and conditions set forth here n shall be binding upon and shall inure to the benefit of the parties and their respective successors and assigns, except as specifically excluded in paragraph 2 hereof.

9. This Assignment may be executed in one or more counterparts, all of which taken together shall be deemed one original. Execution and delivery of this Assignment by electronic copy via facsimile or email bearing the electronically reproduced sii~nature(s) of Assignor, Assignee, and/or Lessor shall constitute a valid and binding executic 1n and delivery of this Assignment by such party. Such electronic copies shall constitute enforce:1ble original documents.

2. The rent shall increase five percent (5%) annually. Should LESSEE fail to pay rent or perform any other obligation Jnder this lease within thirty (30) days after such performance is due. LESSEE will bt: in default under the lease. In the event of such default, LESSOR must give LESSEE written notice by certified mail and allow LESSEE thir1y 130} days thereafter to cu ·e any default.

3. LESSOR agrees not to erect or allow any other off-premise odvertising structure(s), other than LESSEE'S, on property owned or controlled by LESSOR within one thousand (1000) feet of LESSEE'S sign. The parties do not intend to lirr it or restrict accessory signs one hundred ( 100} feet or more from the interstate right-of way. LESSOR further agrees not to erect or allow any other obstruction of · ighway view or any vegetation that may obstruct the highway view of the 5ign. LESSEE is hereby authorized to remove any such other advertising structure, ot :;truction or vegetation at its option.

4. LESSEE may terminate this lease upon giving thirty {30) day' written notice in the event that the sign becomes entirely or partially obstructed in any way or in LESSEE'S opinion the location becomes economically or otherwise undesirable. If LESSEE is prevented from constructing or maintaining a sign at the premises by reason of my final governmental law, regulation, subdivision or building re5 friction, order or other action, LESSEE may elect to terminate this lease. In the evet1t of termination of this Lease prior to expiration, LESSOR will return to LESSEE any unE: :::Jrned rentals on a pro rota basis.

5. All structures, equipment and materials placed upon the pr:mises by the LESSEE or its predecessor shall remain the property of LESSEE and may be removed by LESSEE at any time prior to or within a reasonable time after expiratic n of the term hereof or any renewal. At the termination of this lease, LESSEE agrees io restore the surface of the premises to its original condition. The LESSEE shall have the right to make any necessary applications with, and obtain permits from, gove~1mental bodies for the construction and maintenance of LESSEE'S sign, at the sole :1iscretion of LESSEE and LESSSOR hereby appoints LESSEE its attorney-in-fact for s:, ch purposes. All such permits and any nonconforming rights pertaining to the premises shall be the property of LESSEE.

6. LESSOR represents that it is the owner or lessee under writte '"' lease of the premises and has the right to make this agreement and to grant LE!;sEE free access to the premises during normal business hours to perform all acts necessary to carry on LESSEE'S business activities related to the sign. LESSOR is not aware of any unrecorded rights, servitudes, easements, subdivision or bt 1ilding restrictions, or agreements affecting the premises that prohibit the erecti< >n, posting, painting, illumination or maintenance of the sign. LESSOR acknowledgBs that the terms and conditions of this agreement are confidential and propriet< lry and shall not be disclosed to any third-party without the written consent of LESSr:E.

7. In the event of any change of ownership of the property t erein leased, LESSOR agrees to notify LESSEE promptly of the name, address, and )hone number of the new owner, and LESSOR further agrees to give the new owne formal written notice of the existence of this lease and to deliver a copy thereof to >uch new owner at or before closing.

8. LESSEE may assign its interest in this lease, PROVIDED, that the LESSOR shall have the right of first refusal to purchase an assignment for $1.00 over the amount for which the LESSEE may have otherwise agreed to receive. In the ev· ~nt that LESSEE assigns this lease, the assignee will be fully obligated under the terms hereof and LESSEE will no longer be bound by the lease.

9. This lease is binding upon the personal representatives, heirs, executors, successors, and assigns of both LESSEE and LESSOR.

10. In the event of condemnation of the subject premises or any :>art thereof by proper authorities, or relocation of the highway, the LESSOR grants tc the LESSEE the right to relocate its sign on LESSOR'S remaining property adjoining thE· condemned property or the relocated highway. Any condemnation award for LESSEE'S property shall promptly paid to LESSEE.

11. LESSEE agrees to indemnify LESSOR from all claims of injury ar1:::. damages to LESSOR or third parties caused by the installation. operation, mainter(mce, or dismantling of LESSEE'S sign during the term of this lease. LESSEE further agrees to repair any damage to the premises or property at the premises resultir 1g from the installation, operation, maintenance, or dismantiing of the sign. less 01 jinary wear and tear. Prior to LESSEE removing its sign, and for two (2) years after such removal, LESSOR grants LESSEE a first right of refusal to match any bona fide c 1fer received by LESSOR from a third party for the purpose of permitting off-premisE outdoor advertising on any portion of the leased premises. 2. Reports of Boards, Commissions and City Officials – Ms. Kretchmar gave an update on the sales tax for Yukon. Sales tax is down by 8%, YTD it is up by 1.5%. She is encouraging citizens to shop within Yukon city limits.

Consider approving the purchase of 1,400 feet of 6-foot black vinyl coated chain link fencing, including all gates, rails, ties, fittings, removal of existing fencing, and leveling of soil, at the purchase price of $47,013.00, payable to Quality Fence Co., Inc., purchased via State Purchasing Contract #SW0704, to be installed at the Yukon Community Center Baseball Fields, as recommended by the Superintendent of Recreation

Council Member Gilliland had no comments.

Council Member Cacini talked about how if taxes go down, the employees are the ones that are impacted, so please shop in Yukon. Mr. Cacini also thanked Jan Scott for putting on the Senior Games. He gave a special acknowledgement to Carolyn Little of Yukon for donating and aiding a Veteran in need with giving him her lift chair.

Council Member Wootton suggested everybody bundle up because it’s cold outside.

Council Member Yanda remarked that she will join Rick at the Senior Games when she’s old enough.

Mayor Selby gave an upcoming events recap. The Mayor also advised the community of an upcoming COVID clinic that is going to be taking place this Thursday, April 22, 2021, from 3-6 P.M. at the West Metro Church, 601 W. Main St. This clinic will be open to the public and all that is required is to call 684-1381 and advise them you will be attending the clinic. The Mayor noted she was able to participate in the Veterans with Flagpoles program last Sunday. Also, she reminded all residents to shop local.

We have completed our investigation regarding the above referenced claim. It is our recommendation to the City of Yukon that this claim be denied. We find no liability on the City of Yukon’s part regarding this incident.

Under the Governmental Tort Claims Act, 51 Okla. Sec. 157(A), this claim will be deemed denied ninety (90) days after it was received by the City of Yukon. 51 Okla. Stat. Sec. 157 (B) requires any lawsuit under the Act to be commenced within one hundred eighty (180) days after denial of the claim.

On 01/06/21 at approximately 1136 hours I, Officer Lybrand, witnessed a silver 2010 GMC Terrain with a paper tag displaying 08/31/2019 on the inside of the rear window. The vehicle was traveling Northbound in the outside lane of the 900 block of S Cornwell Ave. The vehicle did not have a State issued tag displayed to confirm registration.

I conducted a traffic stop on the vehicle in the parking just North of the Taco Bell at 975 S Cornwell. I approached the vehicle and made contact with the driver, Anna Cunningham. Before I was able to speak Cunningham immediately asked the reason for the stop. Before I could answer Cunningham stated that its not illegal to drive without a tag in the state of Oklahoma. I told Cunningham the reason for the stop was that the paper tag she was displaying in her back window expired in 2019. Cunningham stated that is not a valid reason for a stop and stated that I illegally stopped her and was violating her constitutional rights. Ofc. Kovarik arrived on scene while I was attempting to speak with Cunningham. Due to Cunningham's attitude and verbal hostility I requested a supervisor.

Due to Cunningham's verbally hostile nature I believed that she was a possible risk to the safety of myself and other officers. In the interest of officer safety I asked Cunningham to step out of the vehicle three times. Cunningham refused to due so three times and stated that there were no legal requirements that she step out of the vehicle. I opened the drivers side door to the vehicle and again requested that Cunningham step out of the vehicle. Cunningham refused again and stated that I was not allowed to open her door. I attempted to escort Cunningham out of the vehicle by taking hold of her left wrist. Cunningham quickly snatched her left arm away and threw both of her arms and upper torso to the passenger side of her vehicle. Due to the fact that I did not know what was in the vehicle and that Cunningham was actively resisting a lawful order I initiated a use of force.

I grabbed Cunningham by her left arm and the hair tied up on the top of her head. I pulled Cunningham towards me and out of her seat. once Cunningham was out of the vehicle I turned to my left while maintaining my hold. I employed a controlled directional throw to escort Cunningham to the ground. Ofc. Kovarik assisted me in handcuffing Cunningham and placing her under arrest. I rolled Cunningham onto her right side into a recovery positioned once handcuffed.

Cunningham demanded I contact the Sheriff and then she informed me she was pregnant. I attempted to stand Cunningham up so she wasn't on the ground. Cunningham stated that she would not comply and would only speak to a the Sheriff. Ofc. Kovarik and myself lifted Cunningham to her feet and escorted her to my patrol unit. I opened the door and requested that Cunningham step inside and again she refused. Ofc. Kovarik stood with Cunningham and I went to the opposite side of the vehicle. I climbed in and pulled Cunningham into the vehicle.

Capt. Hofer arrived on scene and spoke with Cunningham while I found Cunningham's name information. Once I found the name information I transported Cunningham to the Yukon jail and Ofc. Kovarik stayed on scene to impound the vehicle. Upon my arrival to the Yukon Jail I escorted Cunningham inside and Cited her for the following charges:

Failure to Provide Valid Insurance, Tag - Expired New Dealer Tag/ Past 30 Days, Resisting Arrest, and Obstructing a Police Officer.

I released Cunningham into the custody of the jail administrator, Justin Smith.

On 01.06.2021 at about 1136, Officer Lybrand who had just initiated a traffic stop on a vehicle in the 900 block of S Cornwell Drive, more specifically in the parking lot of Arvest Plaza near Taco Bell, asked for a supervisor. While driving to where Officer Lybrand was located, Sgt Kovarik stopped to assist Officer Lybrand. When I arrived there was a hysterical dark complected woman in handcuffs in the back of Officer Lybrand's patrol vehicle. With the doors shut and windows rolled up I could hear the woman yelling and crying in the backseat. I opened the door to speak with the woman, who said her name was Anna. Anna yelled at me demanding that she speak to a supervisor. I identified myself as Capt Hofer the on duty supervisor. She then demanded that she speak to the sheriff. Numerous times I tried to talk with Anna but each time I started to talk, she would interrupt me and say things like, "I was stopped for no reason" and "the officer didnt identify himself' and "I'm in here for no reason" and "I demand to talk to the sheriff' Each time Anna would talk it was in a loud accusatory voice telling me that she wasn't going to listen to anything I had to say. When Anna asked for her glasses, I retrieved them from the van and gently placed them on her face. Sgt Kovarik inventoried Anna's vehicle while Officer Lybrand transported Anna to the Yukon Police Department for processing. Once at the Jail, I took Anna's hands out of handcuffs and asked to sit on the bench, which she did. Then the Jailer, Justin Smith started to fill out the appropriate paperwork necessary for booking. Anna was belligerent and used key sovereign citizen talking points to describe what was happening to her. Anna said she was "traveling" and that the constitution allows her to travel without a license plate. Anna stated that only the sheriff had the authority to arrest or detain her and that she was charging us for her time and was going to put leans on the officers homes. She refused to give her social security number and resisted to being photographed. Anna eventually did calm down and no longer gave Jailer Justin Smith a difficult time, allowing him to finish booking Anna. After Justin was finished booking Anna, I then authorized her OR release, and Anna was then booked out of the computer system and allowed to leave. Anna wanted to file a complaint against Officer Lybrand and so I assisted her with this process, giving her a complaint form and telling her how to fill out the form and how to turn it back in. I also assisted Anna in giving her information on how to get her car out of impound. Anna would need to get insurance and an updated license plate. At which point Anna, not having any more questions was allowed to exit the Police Department.

On 1/6/2021 at approximately 1138 hours, I (Sgt Kovarik) went to 975 S Cornwell Dr to assist Ofc Lybrand on a traffic stop. When I arrived Lybrand was talking with the driver, later identified as Anna Cunningham, of a silver 2010 GMC Terrain with a 30-day temporary tag displayed in the back window dated 8/31/2019.

I walked up and stood next to Lybrand. Lybrand was asking Cunningham to step out of the vehicle, Cunningham told him she knows her rights and she did not legally have to get out, and she told him that she would not get out of the vehicle. Lybrand told Cunningham there is case law from the Supreme Court and Cunningham replied she does not recognize case law and she knows her rights. Lybrand asked Cunningham two more times to step out of the vehicle and each time Cunningham said she was not legally required to get out and that should would not get out of the vehicle. Every time Lybrand tried to speak with Cunningham or answer a question she would interrupt him and say that he stopped her for no reason, that he did not identify himself and demanded that we call the sheriff because he is the law.

Lybrand opened the driver door and again asked Cunningham to step out of the vehicle, she told him he was not allowed to open her door and said she was not getting out. Lybrand reached to grab Cunningham's left wrist and she resisted by quickly pulling away and leaning her upper torso and both arms across the center console to the passenger side of the vehicle, away from him. Lybrand grabbed Cunningham's left arm with his left hand and grabbed her head with his right hand and used a controlled directional toss technique to remove Cunningham from the vehicle and placed her face down on the ground. I grabbed Cunningham's right wrist and helped Lybrand place handcuffs onto both of her wrist's. While on the ground Cunningham was screaming and said she was pregnant. Lybrand rolled her onto her side and placed her in the recovery position. I told Cunningham we were going to help her sit up and she said she would not sit up. Lybrand and I grabbed under Cunningham's shoulders and lifted her up onto her knees. I told Cunningham we were going to help her stand up and she again refused and said she was not going to stand up. Lybrand and I grabbed under Cunningham's shoulders and lifted her to a standing position and walked her to Lybrand's patrol vehicle. Cunningham refused to sit in the back seat of the patrol vehicle, Lybrand went to the driver's side and grabbed her shoulders and pulled her into the vehicle. The entire time we were getting Cunningham into the vehicle she kept repeating she was stopped for no reason and she demanded we get the sheriff. Capt Hofer arrived and spoke with Cunningham.

Lybrand transported Cunningham and I completed the inventory of the vehicle and filled out the impound sheet, X-Clusives arrived and took custody of the vehicle.

Sworn Statement: On January 6, 2021, at approximately 11 :50am, I, Anna-Faye:Cunningham was traveling in my private conveyance/ consumer good on Cornwell street when a emergency vehicle appeared behind me with its emergency lights flashing. I pulled into the parking plaza approximately located at [947 Cornwell Drive] right next to Taco Bell located at [975 S. Cornwell Drive]. The unidentified officer also known as Lybrand #558 got out of his vehicle and approached my private conveyance/ consumer good. I rolled the window down to my private conveyance/ consumer good and asked the unidentified officer "Why am I being pulled over?". The unidentified officer then said "because you have no tag". I replied "that is not a crime" he then replied" please step out of your vehicle". I replied "No I will not, I have not done anything wrong." The unidentified officer then reaches his right arm through the window of my private conveyance/ consumer good, and puts his left hand on the front left side door of my private conveyance/ consumer good. He then grabs my hair with his right hand and proceeds to use excessive force to remove me from my private conveyance/ consumer good & threw me to the ground. The unidentified officer then puts his knee onto my back and grabs my arms and puts them behind my back and proceeds to apprehend me without mirandizing. The unidentified officer [Lybrand #558] and his partner, whom is also unidentified physically picked me up and put me in the back of the emergency vehicle. I asked repeatedly for the unidentified officer's Commanding Officer, as well as requesting for the Canadian County Sheriff. The Commanding Officer also known as Matt Hofer arrived on the scene and the other unidentified officers began searching my vehicle without a search warrant. I requested that he call the Canadian County Sheriff and he replied" Why? The Sheriff has no jurisdiction here." After I repeated my request the Commanding Officer replied" just because you think it's a right doesn't me~m it is one". The Commanding Officer then asked "What can I do to help you" and I replied "Call the Sheriff out here but if you Page 4 of 6 will not then please give my glasses". The commanding Officer put my glasses on my face and :,hen shut the door.

None of the officers involved asked me for any of my personal identification or private conveyance/ consumer good information during any part of the encounter that lead to physical assault, kidnapping, and duress by the Officers of the Yukon Police Department. Under threat, duress, and coercion I, Anna-Faye:Cunningham a wombman, was forced to place my signature on fraudulent documents administered by the Yukon Police Department.

THIS AGREEMENT is made and entered into this __ day of ___~ 2021 by and between the City of Yukon, Oklahoma, hereinafter, referred to as "Yukon", and the City of Bethany, hereinafter referred to as "Bethany" the respective governing body of each such entity by appropriate action witnesseth:

WHEREAS, Yukon does have an adequate jail facility referred to as "jail facility", to be used as a jail for the safe and secure detention and care of prisoners taken into custody by law enforcement officers empowered to make lawful arrest for Bethany; and

WHEREAS, Bethany has a limited municipal jail facility; and

WHEREAS, the parties hereto desire the jail facility to be made available for the use of Bethany, pursuant to the terms set forth herein below, for safe and secure detention and care of persons placed under arrest and taken into custody by Bethany law enforcement officers, empowered to make lawful , and also held pursuant to lawful order(s) from the Municipal Court of the City of Bethany.

NOW, THEREFORE, for good and valuable consideration herein contained, IT IS AGREED AS FOLLOWS:

I. TERMS OF AGREEMENT

The terms of this agreement shall be from May 1st, 2021 to June 30, 2022 and renewable thereafter on a year-to year basis at the option of the parties. Either party may terminate this agreement upon thirty (30) days written notice to the other party. And, yearly during the month of June, the Chief of Police for the City of Yukon and the Chief of Police for the City of Bethany will meet to review the contract and the services and make those recommendations to their respective governing bodies concerning any revisions deemed necessary.

II. STATEMENT OF SERVICES

Yukon agrees to accept Bethany prisoners, defined as any person placed under lawful arrest by any Bethany law enforcement officer and taken into custody, in such numbers as can be accommodated at the said facility. This section is limited by the exceptions as noted within this agreement in Section V.

Ill. YUKON RESPONSIBLE FOR SAFE AND SECURE CUSTODY

Yukon agrees to be responsible for the safe and secure custody of said prisoners transported to the jail facility by Bethany law enforcement officers and agrees to insure that standard security procedures are followed in order to prevent escape. Bethany agrees to follow all prescribed security procedures of the jail facility regarding the searching of incoming prisoners and remaining with said prisoner until the arresting officer is duly released by the jail staff or supervisor on duty.

IV. BETHANY RESPONSIBLE FOR RECORDS

Bethany agrees to submit in writing any charge(s) at the time of incarceration. Any sentences imposed by the Municipal Court shall be submitted to the jail staff in writing, signed by the Municipal Judge, together with appropriate release also signed by the judge. The Bethany bond schedule shall be provided to the jail staff; however, bond money or releases shall be handled by the proper Bethany official, or in accordance with attachment "A" if after hours or on weekends.

V. BASIC MEDICAL CARE

Yukon agrees to provide basic medical care to said prisoner, which shall include sick call and self-care, defined as the care of any condition which can be treated by the prisoner himself. This may include such over-the-counter type of medications as may be approved by the jail supervisor. Basic medical care also includes care of any condition which requires immediate assistance by a person trained in first aid procedures.

The cost of hospitalization, prescription medication, surgical, and dental care shall be borne by the City of Bethany. Failure on part of Bethany to provide any required medical treatment prior to incarceration shall provide sufficient basis for Yukon to refuse said prisoner admittance to said jail facility under the terms of this agreement.

The jailer on duty shall have the discretion to refuse a prisoner from Bethany should the jailer feel the prisoner is in need of medical examination or treatment prior to incarceration. Bethany shall provide to Yukon a release from a licensed physician or physician's assistant stating said prisoner is capable of being incarcerated without further detrimental medical complications. The failure on the part of Bethany to provide the required written medical release shall provide a sufficient basis for Yukon to refuse the prisoner admittance into said jail facility under the terms of this agreement.

Any Bethany prisoner on an emergency basis may be taken to the hospital for treatment or examination at the discretion of the jail staff or supervisor on duty, and any cost incurred from said treatment or examination shall not be the responsibility of the City of Yukon and to the extent permitted by law, Bethany agrees to hold harmless and indemnify the City of Yukon for any such charges. Bethany shall provide transportation and security for any Bethany prisoner needing treatment, examination, or hospitalization.

VI. COST PER DAY

The cost per day for each Bethany prisoner detained and cared for in the Yukon jail facility to be paid by Bethany to Yukon shall be $42 per day for each prisoner for the term hereof. A day for the purpose of this agreement is a calendar day, or any part thereof, and not a twenty-four (24) hour period of time. Said rate is subject to renegotiation and adjustment in the event this agreement is renewed or extended at the expiration hereof.

The fee for housing each prisoner shall be paid for each and every day or part thereof a Bethany prisoner is incarcerated in the jail facility on a City charge(s), or if for State charge(s) the prisoner will be considered a Bethany prisoner until the prisoner is booked into the County jail.

Bethany shall provide necessary equipment and supplies for booking and discharge of Bethany prisoners.

VII. BILLING PERIOD

Yukon shall bill Bethany for prisoner services on a monthly basis. The monthly billing shall list the prisoner's name, date of birth, the date the prisoner was incarcerated, the offense(s) with which the prisoner was charged, the date the prisoner was released from the Yukon jail facility, and the total cost of the prisoner's incarceration. B€thany agrees to promptly remit payment for the statement sent by Yukon for performance of services called for under this agreement.

VIII. RECORDS AND PERSONNET

The Yukon Police Department will maintain control over all personnel provided to the jail facility by the City of Yukon. All records initiated or generated by the Yukon Police Department will be maintained by the Yukon Police Department.

IX. HOLD HARMLESS CIAUSE

To the extent allowed by law, Bethany hereby agrees to indemnify and hold Yukon harmless for I any claim, action or cause of action including the cost of litigation and attorney fees arising from the.jalse arrest or wrongful incarceration of persons under this agreement.

lT lS FURTHER AGREED that Bethany, to the extent allowed by law, shall hold harmless and indemnify Yukon for any hospital, doctor, or other medical expenses associated with the care and custody of a Bethany prisoner.

lT lS FURTHER AGREED that Bethany shall reimburse Yukon any expenses resulting from the repair of any damages caused by Bethany's prisoners to the jail facility.

A RESOLUTION OF THE CITY OF YUKON, OKLAHOMA, COMMEMORATING THE 1921 TULSA RACE MASSACRE

WHEREAS, in the early 20th century, de jure segregation confined Tulsa’s Black residents into the “Greenwood District”, which they built into a thriving community with a nationally renowned entrepreneurial center known as the “Black Wall Street”;

WHEREAS, at the time, and racist violence were common throughout the United States and went largely unchecked by the justice system;

WHEREAS, reports of an alleged and disputed incident on the morning of May 30, 1921, between two teenagers, a Black man and a White woman, caused the White community of Tulsa, including the , to call for a amidst a climate of White racial hostility and White resentment over Black economic success;

WHEREAS, on , 1921, a mob of armed White men descended upon Tulsa’s Greenwood District and launched what is now known as the “Tulsa Race Massacre”;

WHEREAS, over a period of 24 hours, the White mob’s violence led to the death of an estimated 300 Black residents, as well as over 800 reports of injuries;

WHEREAS, the White mob looted, damaged, burned, or otherwise destroyed approximately 40 square blocks of the Greenwood district, including an estimated 1,256 homes of Black residents, as well as virtually every other structure, including churches, schools, businesses, a hospital, and a library, leaving nearly 9,000 Black Tulsans homeless and effectively wiping out tens of millions of dollars in Black prosperity and wealth in Tulsa;

WHEREAS, Oklahoma local and State governments dismissed claims arising from the 1921 Tulsa Race Massacre for decades, and the event was effectively erased from collective memory and history until, in 1997, the Oklahoma State Legislature created a commission to study the event;

WHEREAS, on February 28, 2001, the commission issued a report that detailed, for the first time, the extent of the Massacre and decades-long efforts to suppress its recollection;

WHEREAS, none of the law enforcement officials nor any of the hundreds of other White mob members who participated in the violence were ever prosecuted or held accountable for the hundreds of lives lost and tens of millions of dollars of Black wealth destroyed, despite the Tulsa Race Massacre Commission confirming their roles in the Massacre, nor was any compensation ever provided to the victims or descendants of the Massacre; WHEREAS, the year 2021 marks the 100th anniversary of the Tulsa Race Massacre:

NOW THEREFORE, BE IT RESOLVED that the Yukon City Council;

(1) recognizes the forthcoming centennial of the Tulsa Race Massacre;

(2) acknowledges the historical significance of this event as one of the largest single instances of State-sanctioned violence against Black people in American history;

(3) honors the lives and legacies of the estimated 300 Black individuals who were killed during the Massacre and the nearly 9,000 Black individuals who were left homeless and penniless;

(4) condemns the participants of the Tulsa Race Massacre, including White municipal officials and law enforcement who directly participated in or who aided and abetted the unlawful violence;

(5) condemns efforts to cover up the truth and shield the White community, and especially State and local officials, from accountability for the Tulsa Race Massacre;

(6) condemns the continued legacy of racism, including systemic racism, and White supremacy against Black people in the United States, particularly in the form of police brutality;

(7) encourages education about the Tulsa Race Massacre, including the horrors of the massacre itself, the history of White supremacy that fueled the massacre, and subsequent attempts to deny or cover up the Massacre.

BE IT FURTHER RESOLVED that the Yukon City Council encourages the local community, local agencies and all respective community members at large to recognize, increase awareness of, expand education regarding, and condemn any and all forms of discrimination.
