Whether you love it, hate it, or are indifferent, American football encompasses a huge part of modern American cultural identity and passion. 2 Particularly with the rise of television, American football became the country's biggest spectator sport, a cultural pinnacle, and the primary focus of both collegiate athletics and professional sports. Through football, Americans celebrate their local, school, emotional, regional, national, and other identities. Football is an American holiday tradition, a promoter of corporations and universities, a staple of towns, a grower of leaders and promoter of teamwork, a symbol of war, a topic of controversy denounced by some as promoting violence, sexism, and greed, and supported as promoting family values in a religious setting by others. Depending on one's point of view, football may symbolize everything that is right or wrong with American culture and society. -

I had visited him on Thursday, September 13, two days after the World Trade Center and Pentagon were attacked on September 11. Then on the national day of mourning on Friday, September 14, I wrote an essay in response to the events of the week. It included the following portion that begins with reference to a photo excursion I had taken with a friend, Janis Pyle. She wanted me to bring my camera and help her document farms and other places of her rural heritage in central Iowa. It was on that outing that I saw Don for the last time. Janis and I talked about the attacks on New York and Washington and how people would be quick to retaliate rather than understand that the best form of national defense is to share power and resources more equitably in the world. Janis and I also talked at length about rural and small-town life and how the agricultural economy is in really bad shape. It is hard for some people to realize how bad things are because the tragedy of the farm scene doesn’t have the kind of visual impact for television as airliners hitting the Twin Towers and the subsequent collapse of those icons of American prosperity. The farms we visited were like so many around the Rolfe area, vastly different than when they thrived with activity in past decades. -

FForewordoreword Shortly after her confirmation, then-Chairman Ricki R. Helfer directed the FDICs staff to undertake this study. She strongly believed that a careful examination and analysis of the banking crises of the 1980s and early 1990s would provide information that would allow the FDIC to better fulfill its mission. The banking problems of the period were of a magnitude not seen since the Great Depression and the advent of federal deposit insurance and therefore provide a unique win- dow through which we can study the causes of, and the regulatory and supervisory response to, sharply increased numbers of bank failures in a modern economic and banking environ- ment. There have, of course, been significant changes since the early 1990s in the perfor- mance and structure of the banking industry. Moreover, in the wake of the banking crises and subsequent legislative reforms, changes in the supervisory process have attempted to ensure improved monitoring of bank risk and more timely intervention in, and closure of, troubled banks. But not all the issues raised by the problems of the 19801994 period have been laid to rest. Moreover, the current improved condition of the industry and the supervi- sory changes of the late 1980s and early 1990s do not mean that banking problems cannot return sometime in the future. Although it is clear that the problems of the past are unlikely to be precisely repeated in the future, the study of these recent crises is nevertheless in- structive. At the very least, the history of the turbulent time in banking should teach us that we cannot afford to be complacent, and the FDIC hopes this study that glances backward will be helpful as we look forward. -

(\1(0"" Cl)llDCf OVERVIEW Indians have a unique claim on the United States government for the support of their children's education. That claim is based on treaties signed by Indian Nations and the United States government and on Jaws passed by Congress which provide funds specifically for the education of Indian children. Almost every treaty signed with an Indian tribe commits the Federal government to provide education for Indian children. Congress made its first appropriation for Indian education one hundred and seventy years ago. Since that time, it has provided funds for the education of Indian children in mission schools, Federal boarding schools, and public schools. Today, two thirds of all American Indian children attend public schools. While they have a special claim to Federal support, Indian children are entitled to the same educational opportunities as other children. They have a constitutional right to equal protection under state and Federal Jaws, and as state citizens to state aid for public schools. Those rights and the reality of public education that they are in fact provided are two quite different things. Regulation, Prohibition, and Fantasy: the Case of FanDuel, DraftKings, and Daily Fantasy Sports in New York and Massachusetts Zachary Shapiro* In the second Republican presidential primary debate of 2016, a moderator asked presidential hopeful Jeb Bush about whether daily fantasy sports should be regulated by the government. While Bush responded that daily fantasy sports “has become something that needs to be looked at in terms of regulation,” New Jersey governor Chris Christie took great umbrage that a question about fantasy sports was being asked. “Can we stop?” Christie said. “How about this? How about we get the government to do what they're supposed to be doing: secure our borders, protect our people and support American values and American families. Enough on fantasy football. Let people play, who cares?”1 While many problems are more pressing than daily fantasy sports (“DFS”), it would seem that the attorney generals of quite a few states disagree with Governor Christie’s “live and let play” philosophy. Increasingly, state officials are seeking measures to prohibit or regulate the market for daily fantasy sports. Increased scrutiny is quite a logical development. Over the last two years, DFS has grown into a multi-billion dollar industry, with millions of participants playing each week. Daily * Zachary Evan Shapiro is in his third year at Harvard Law School.
