Legal Requirements at Sporting Events

• Carriage of passengers to designated Sporting Events Voluntary Guidelines - England and Wales For some years the coach industry has complied with a voluntary code of practice whereby operators taking passengers to a designated sporting event meet certain guidelines set by the police. This has worked very well, and it has seldom been necessary for a Traffic Commissioner to take any further action against an operator who has contravened the guidelines. Nevertheless the police in England and Wales are concerned that football hooliganism is again on the increase, and have asked the Commissioners to remind PSV operators of the guidelines. This has been done in conjunction with the Confederation of Passenger Transport (CPT).

Carriage of passengers to designated Sporting Events Voluntary Guidelines - England and Wales

PSV operators are reminded of the terms of Section 1 (1) of the Sporting Events (Control of Alcohol) Act 1985, as amended by the Public Order Act 1986, which

2 prohibits the carriage of alcohol on a PSV that is being used for the principal purpose of carrying passengers for the whole or part of a journey to or from a designated sporting event.

A “designated sporting event” generally means any association football match, whether national or international. The full legal definition of “designated sporting events” may be found in The Sports Grounds and Sporting Events (Designation Order) 1985, as amended by SI 1520/1987.

It is an offence for an operator of a PSV (or his servant or agent) knowingly to cause or permit the carriage of alcohol on journeys to which these Regulations apply.

In addition to these statutory provisions, the police have asked that operators comply with the following guidelines when conveying passengers to such sporting events: a. Coach operators taking bookings from groups of supporters are to notify the police liaison officer at the destination, at least 48 hours before the event, of the number of supporters expected to travel and the number of coaches booked. b. Coaches are not to stop within 10 miles of the venue either en route to or on departure from the event unless prior agreement is obtained from the local police liaison officer. c. Unless directed otherwise by a police officer, coaches may stop at premises where intoxicating liquor is sold only if it is sold ancillary to a substantial meal. Prior agreement for meal stops where alcohol is available should be sought from the operator’s local police liaison officer. d. Coaches are to arrive at the venue no earlier than two hours before and not later than one hour before the scheduled start of the game, unless otherwise directed by police. e. Coaches are not to set down or uplift passengers at any unauthorised locations without prior permission of the police. f. Coaches must leave the venue within one hour of the finish of the event. g. Intoxicating liquor must not be carried on coaches travelling to or from designated grounds. Operators will draw hirers’ attention to the requirements of the law, and drivers shall, as far as reasonably practical, supervise boarding passengers and check that they are not obviously carrying intoxicating alcohol. Drivers will not be expected to carry out baggage or body searches, nor will they be expected to confiscate alcohol or to remove passengers without police assistance.

Operators are asked to comply with these guidelines on a voluntary basis. However if the police inform the Traffic Commissioner of any failure on an operator’s part to comply with them the Commissioner will consider applying them as a formal condition to that operator’s licence under the authority of Section 16(3) of the Public Passenger Vehicles Act 1981.”

Section 2 – PSV Operator Licensing

Inspection of licence applications can be requested under the provisions of Regulation 4 of the Public Service Vehicles (Operators’ Licences) Regulations 1995 by anybody who holds statutory objector status. Applications may be inspected free of charge at the Office of the Traffic Commissioner in Leeds by any person who carries written authorisation to act in that capacity.

Objections against applications for licences must be made in writing by a Chief Officer of Police or by a local authority within 21 days of the date on which notice of an application is published in Notices and Proceedings. Objections must be made on the grounds that one or more of the requirements mentioned in Sections 14(1) and (3) of the Public Passenger Vehicles Act 1981 are not satisfied in relation to the application. A copy of the objection must be sent by the objector to the applicant at the same time that it is sent to the Traffic Commissioner. The onus of proof in terms of the grounds on which an objection is lodged lies with the objector. There is no right of objection against an application for a special licence submitted under Section 12 of the Transport Act 1985.

Classification of Operator Licences – There are four classes of licence:

• A Standard International (SI) licence authorises the use of any description of public service vehicle on both national and international operations; • A Standard National (SN) licence authorises the use of any description of public service vehicle on national operations; • A Restricted licence (R) authorises the use of: a) public service vehicles not adapted to carry more than eight passengers and; b) those not adapted to carry more than sixteen passengers when used otherwise than in the course of a business of carrying passengers or by a person whose main occupation is not the operation of public service vehicles adapted to carry more than eight passengers; • A Special Restricted (SR) licence, issued under Section 12 of the Transport Act 1985, authorises the holder of a taxi or private hire vehicle licence to operate local services.

Appeals in connection with PSV Operator Licences must be lodged with the Upper Tribunal – Administrative Appeal Chamber (Transport), 5th Floor, Rolls Building, 7 Rolls Buildings, Fetter Lane, London, EC4A 1NL not later than 28 days after the date of the letter conveying the Traffic Commissioner’s (or Deputy Traffic Commissioner’s) decision. When an application is sent to the Office of the Traffic Commissioner, a copy of all application forms and supporting documents must also be sent to each of the county councils and unitary authorities in whose area the service will operate. Failure to do so may delay acceptance of the application.

Some of the periods of notice applicable before the operation of registered services, including variations or cancellations, are at the discretion of the Traffic Commissioner. In such cases the application must be accompanied by a written explanation of why a short notice period is required.

Any registration may be inspected at the Office of the Traffic Commissioner in Leeds during public business hours. Copies of registrations can be sent by post or fax to any interested party upon prior receipt of a written request together with a fee of £3.00 per copy for posted copies or £5.00 per copy for faxed copies.

Section 4 – Traffic Regulation Conditions

Section 4.1 – Requests

A proposed Traffic Regulation Condition has been requested in St Ives, Cornwall.

Once the TRC has been determined the Traffic Commissioner must hold a public inquiry if requested to do so within 21 days of 23 June 2015, by

a) the traffic authority (council) who made the request b) any traffic authority likely to be affected by the TRC c) any operator who has a service registered within the area affected by the TRC.

The proposed Traffic Regulation Condition is as follows:

PROPOSED TRAFFIC REGULATION CONDITIONS – ST IVES

In order to regulate bus movements in St Ives operating primarily between the Trenwith Car Park and Royal Square it is proposed to impose Traffic Regulation Conditions under Section

15 7(4)(b) of the Transport Act 1985 and Public Service Vehicles (Traffic Regulation Conditions) (England and Wales) Regulations 2004.

In drawing up these conditions it is recognised that passenger flows can peak at certain times with the arrival and departure of touring coaches at Trenwith Car Park. Registration of services as frequent services allows operators flexibility to deal with such peaks.

Section 1 (Royal Square and Trenwith Car Park)

The following conditions shall apply to the use by vehicles operating registered local bus services of the bus stops located at

· St Ives Royal Square (OS Grid Ref. 151694, 040389 Naptan Code 0800COA05255) hereafter referred to as Stop A. · St Ives outside the Backpackers on Chapel Street (OS Grid Ref. 151658, 040385 Naptan Code 0800COD40427) hereafter referred to as Stop B. · St Ives Trewidden Road (OS Grid Ref. 151480, 040190 Naptan Code 0800COA05254) hereafter referred to as Stop C. For the purposes of these conditions the stop is considered to be regulated as a ‘Bus Stand’.

1. Where one or more operators seek to operate services between Trenwith Car Park and Royal Square all services will be registered to operate as frequent services.

2. For any services operating to and from Stops A and or C, no one PSV Operator Licence holder with current service registrations will be permitted to operate more than 2 vehicles to fulfil the requirements of any one frequent service registration.

3. Vehicles scheduled to operate services either between St Ives Rugby Club or Trenwith Car Park and Royal Square and vice-versa will be dedicated to solely operate the requirements, or any part thereof, of one individual service registration on any given day. Operators will be required to keep records of which vehicles are allocated to each service on a daily basis, including details of the start and finish times, journeys operated, drivers undertaking operation of the service and any breaks taken. These records are to be kept for a minimum of six months and made available upon request to an officer of Driver and Vehicle Services Agency, Devon & Cornwall Constabulary, Office of the Traffic Commissioner or Cornwall Council.

4. Detailed, and where necessary updated bus working graphs, are to be submitted with all service registrations where services use Royal Square.

5. No passengers will be permitted to alight from vehicles operating registered local bus services at Stop A which will be reserved for use solely as a departure point;

6. Buses will be permitted to be on Stop A only to allow waiting passengers to board in accordance with Schedule 19, Part 1, Paragraph 3 of The Traffic Signs Regulations & General Directions 2002 (SI 2002/3113) and shall depart upon arrival of another vehicle into Royal Square;

7. All vehicles using Stop A shall only proceed around the island in a clockwise direction;

8. On registered local bus services scheduled to terminate at Royal Square all passengers will alight from vehicles only at Stop B;

9. Only registered local bus services operating through Royal Square to Tregenna Place and beyond will be permitted to utilise Stop B for passengers boarding and alighting. At the time of writing, these are St Ives Minibus Company 1 First Kernow 16, 16A and 300;

16 10. Buses will be permitted to be on Stop B only for as long as necessary for passengers to alight from and board as prescribed in points 5 and 6 above in accordance with Schedule 19, Part 1, Paragraph 3 of The Traffic Signs Regulations & General Directions 2002 (SI 2002/3113);

11. Stop C is reserved for registered local bus services operating exclusively between Trenwith Car Park and Royal Square; and Trenwith Car Park and Porthmeor Beach (Tate Gallery);

12. All services must approach Stop C from the direction of Trewidden Road subject to compliance with The County of Cornwall (St Ives) (Restrictions on Driving) (Consolidation) Order 1990 (see Annex D of this document);

13. At the Trewidden Road stop adjacent to Trenwith Car Park the operating procedure will be as follows;

14. Buses will park in the layby in order of arrival and depart in the same order.

15. Buses will depart from Trenwith at intervals which satisfy the Traffic Commissioners requirements for a frequent service and upon arrival at Royal Square will allow passengers to board and await departure when the next journey from Trenwith Car Park arrives unless required to move earlier so as not to impede a scheduled service.

16. In the event of passenger demand requiring more than one vehicle at any particular time at Trenwith the first and each subsequent vehicle will depart Trenwith Car Park and operate to Royal Square before returning empty to Trenwith to re-join the queue. The last vehicle used in fulfilling a peak in demand will take the place on the Royal Square to to assume the next required departure back to Trenwith Car Park.

17. The reverse of the above will apply in the event of peak loadings from Royal Square to Trenwith Car Park.

18. For any local bus service registered as a “frequent service” an indication of the number of buses to be used in providing the service and the maximum time intending passengers will wait for a journey must be supplied to the Traffic Commissioner and Cornwall Council Integrated Transport Unit at the time of submitting the service registration. In the case of joint registrations the responsibilities of each operator involved in meeting the requirements of the registered service must be stated;

19. Registered local bus services operating to a fixed timetable must not be impeded in departing from the stop at the registered times.

20. No vehicle will be permitted to undertake a reversing manoeuvre at or in the vicinity of Stop A other than in the event of an emergency or the clockwise loop being blocked. Please refer to map in Annex C indicating the extent of the restricted area;

21. At all stops, the driver will switch off the engine upon arrival and not restart it until ready to depart, and will be in breach of this condition if:

a) the bus stands for over 60 seconds with the engine running

b) the bus arrives more than one minute before it is scheduled to depart

c) there are more than 20 persons waiting at the stop at the time of arrival of the bus

d) the bus is stationary for more than one minute without boarding or alighting passengers.

17 Section 2 (The Burrows)

No registered local bus service will be permitted to allow passengers to board or alight along the length the road identified as the U6014 from the junction with The Stennack to and including the roundabout forming access to Trenwith Car Park, commonly known as The Burrows.

Section 3 (Trenwith Car Park)

Any operator wishing to operate within the extent of the Trenwith Car Park must seek the permission of Cornwall Council Parking Services prior to registration of any service with the Office of the Traffic Commissioner and supply evidence of same to the Traffic Commissioner when registering the service.
