This writ petition is filed under Articles 226 and 227 of the Constitution of India for the following relief’s: a) Directing the Kudachi Police to record the statements of eyewitnesses viz., 1) Shankar Yenkappa Krigar, aged about 42 years, R/o Kanakanwadi, Tq: Raibag & Dist: Belgaum 2) Siddappa laxman Kamate, aged about 238 yars, R/o Rajapur, Tq: Gokark & Dist: Belgaum & 3) Raju Tammani Padolkar, R/o Chinchali, Tq: Raibag & Dist: Belgaum in Kudachi P.S.Crime No.36/2013 as required under Section 161 of the Code of Criminal Procedure, 1973. b) Directing the Kudachi Police to array 1) Laxman Shankar Latkar, aged about 60 years, R/o Chinchali village, Tq: Raibag & Dist: Belgaum, 2) Mallappa Ramu Jadhav, aged about 27 years, R/o Chinchali village, Tq: Raibag & Dist: Belgaum, 3) Mahesh Maruti Chougula, aged about 30 years, R/o Chinchali village, Tq: Raibag & Dist: Belgaum & 4) Sambhaji Mallappa Shinde, aged about 26 years, R/o Chinchali village, Tq: Raibag & Dist: Belgaum as accused no.4 to 7 respectively in Kudachi P.S. Crime No.36/2013. 3

2. Under Articles 226 and 227 of the Constitution of

India, this court cannot interfere with the investigation by police and this court cannot direct the police to conduct investigation in the manner desired by petitioner. Therefore, the petition is dismissed as not maintainable.
