Statistics of Cases Handled by LAF Branches in 2011 Index 3 Preface Ever since the establishment of the Legal Aid Foundation (LAF) on July 1, 2004, more than 470,000 people have applied to the Foundation for services. LAF has provided legal consultation to over 160,000 people in addition to legal services including mediation and settlement negotiation, drafting legal documents and representation in court proceedings to over 160,000 disadvantaged people. In year 2011, the Foundation continued to provide various legal aid services, including granting legal aid in 28,495 applications and 66,398 legal consultation applications. To meet the different needs of migrant workers, new immigrants, teenagers, credit card debtors, laborers and other disadvantaged groups, the Foundation proceeded with a variety of existing service programs while launching new ones, including the “Legal Aid for Victims of Human Trafficking” Program, the “Legal Aid for Juvenile Assistance” Program, the “Legal Aid for Consumer Debt Clearance” Program, the “Immediate Support Program for Lador Litigation”, the “Expanded Legal Consultation” Program, and the “First Criminal Interrogation Accompanied by Legal Aid Attorney” Program to protect the rights of criminal suspects. By the end of 2011, a total of 2,580 attorneys have registered as the Foundation’s legal aid attorneys, and their expertise and professional ethics greatly influenced the quality of services they provided to legal aid recipients. To ensure the quality of services, the Foundation’s focus in 2011 was set upon the “elevating the quality of legal aid attorneys project”. A project team was formed to deliberate on the systematic amendment to the criteria of allowing legal aid attorneys’ participation in cases and the evaluation of their performance after case closure. A policy was made on the basis of this focus, in that attorneys with less than two years experience in practice should not represent a legally aided plaintiff or defendant in court proceedings. Also, to advance the quality of application assessment, with the exception of applications made in remote areas, no attorneys with less than three years of experience in practice should be nominated as Commissioner of the Assessment Committee. To reinforce the auditing of the opening of cases, the timeframe for following-up cases with uncollected advance remuneration has been shortened from four months to two months. The mechanism of reporting case closures was amended so that more specific details and documents in relation to conduct of the case must be listed and provided to enable evaluation of the attorneys’ performance in these cases. The complaint procedures and system flow controls were improved to encourage applicants or recipients to raise their complaints. The Foundation continued to conduct and review the Performance Evaluation System, to manage and remove unsuitable attorneys. LAF also actively arranged series of educational trainings for legal aid attorneys to advance their expertise in selected issues concerning disadvantaged groups. All of these efforts were rewarded and effects were seen. Moreover, full-time staff attorneys have been recruited by the Foundation since 2006 to represent victims in the “RCA vocational injuries case”, the “Typhoon Morak case” and in other cases of major social concern. In 2011, the Foundation actively recruited staff attorneys, and continued to seek experienced outstanding and caring attorneys to join Legal Aid. Thirteen Directors are appointed by the president of the Judicial Yuan to serve a term of 3 years on part-time unpaid basis. Directors include: two representatives of the Judicial Yuan; one representative from the Ministry of Justice, the Ministry of Interior and the Ministry of National Defense respectively; four attorneys recommended by the National Bar Association and local Bar Associations as persons who actively participate in legal aid work; two academics or experts who have specialist knowledge in law or in related disciplines; one representative of disadvantaged groups and one representative of aboriginal people. The term of office of the 3rd term Board of Directors commenced from March 23, 2010 and will end on March 22, 2013. The Board of Directors meets once every month, and a total of 12 meetings were convened in 2011.     Report on the 2016 International Symposium on Disaster Prevention and Reduction in Tainan, Taiwan: In Conjunction with the 10th Joint International Symposium on Disaster Risk Management An international workshop on disaster prevention and reduction was held on September 28, 2016 in Tainan, Taiwan. For the workshop, 10 speakers from Taiwan and Japan——recognized as natural disaster experts——were invited. Approximately 50 participants were attended during two sessions related to earthquake and water disasters despite the fact that the powerful Typhoon Megi had inflicted damage throughout Taiwan the day before. The aim of the workshop was to facilitate information exchange and dissemination activity for disaster prevention and reduction in the East Asia region (where natural disasters often occur). It was organized by the Tainan City Government (Mayor Ching-te Lai), National Cheng Kung University - Disaster Prevention Research Center in Taiwan, NCKU-DPRC, (Professor and Director Chjeng-lun Shieh), World Federation of Engineering Organizations - Committee on Disaster Risk Management, WFEO-CDRM, (Professor Emeritus and Chair Toshimitsu Komatsu), and Japan Federation of Engineering Societies, JFES, (Dr. Junichi Satoh, president). The workshop was also supported by the Japanese academic organizations: Architectural Institute of Japan (AIJ) and Japan Society of Civil Engineers (JSCE). The original program and venue were modified because of the typhoon’s impact (see the “Program” below). Opening remarks were given by Mr. Jun-yan Hou—Executive consultant for the Office of Disaster Management in the Tainan Fire Bureau—instead of the mayor of Tainan. Mr. Hou reported on recent events associated with natural disasters in Taiwan and addressed the importance of collaborations between Taiwan and Japan for disaster prevention.

    1 “2016 International Symposium on Disaster Prevention and Reduction in Tainan, Taiwan” In conjunction with the 10th Joint International Symposium on Disaster Risk Management In general, East Asia is one of the vulnerable regions most vulnerable to disasters. Numerous disasters have occurred, even in Taiwan—for example, the catastrophic earthquake disaster in Tainan City in February 2016, and the destructive landslide during Typhoon Morakot that severely affected Siaolin, Kaohsiung in August 2009. Disaster prevention and disaster risk reduction have been promoted preferentially in the regions where disasters often occur. It is urgently necessary to further promote disaster prevention and reduction to protect against future more severe disasters caused by the effects of climate change, as well as potential huge earthquakes, which have not yet been recorded in major cities. To achieve this goal effectively and efficiently, we collaborate and cooperate with a variety of government, academic, and industrial organizations working toward disaster prevention and reduction. This joint international symposium is held by the Tainan City Government, Taiwan National Cheng Kung University (NCKU), the Japan Federation of Engineering Societies (JFES), and the World Federation of Engineering Organizations (WFEO). The main purpose of this symposium is to disseminate better prevention and disaster information internationally through global thought and discussion among disaster experts and interested parties. The symposium will provide an opportunity for the global community to discuss earthquake and water-related disasters based upon experiences worldwide. Development of healthy cities in Taiwan The healthy cities movement began in 1986. It was first promoted by the WHO Regional Office for Europe, and primarily targeted European cities. After almost two decades of work, the results have been very good, and European healthy cities are now exemplars for the world. As a result, WHO regional offices have started to advocate healthy cities for each of their regions. In Taiwan, the Republic of China decided to participate in the healthy cities movement in the beginning of the new Millennium. The Bureau of Health Promotion (BHP), Department of Health called for a pilot proposal in 2003, a cross-disciplinary team of scholars at National Cheng Kung University won the project, and found collaboration from Tainan City, thus, pioneered the healthy city development in Taiwan. BHP has since continued to fund other local authorities to promote healthy cities, including Miaoli County, Hualien County, Kaohsiung City and Taipei County. Since the results have been excellent, some other counties and cities have also allotted budgets to commission related departments for implementation.
