Chavez 1 Kayla Chavez Peters Engl 499 29 September 2012 The Purpose of Law in Literature “Forgive me, gentlemen of the jury, but there is a human life here, and we must be more careful.” -The Brothers Karamazov Law is an attempt to make order out of chaos, to focus and define a small part of our world which, as a whole, we may never comprehend. It is necessary to every society, as a way of organizing our world and making sense of our interactions with each other. We submit to law, trusting it will protect us from each other, and defend our property and lives, so that we can function in society without constant worry. Inevitably however, law will sometimes fail our expectations, and because of this, many lose sight of law's importance, alienating the field with accusations of inhumanity because they are so disappointed. The emerging field of Law and Literature recognizes the flaws in the legal system and seeks to remind people of law's intention to uphold order and protect people. Law and Literature does this by examining legal scenes in literature to determine what their meaning is in the story, as well as what insights the literature provides into the nature of the legal profession. While literature should not be looked at as a savior of law's purpose, using literary theory to look at law, or looking at literary depictions of law, can help us understand that the legal process is an imperfect human creation. Using ideas from the relatively new field of Law and Literature to analyze legal scenes from classic texts, (Herman Melville's Billy Budd, Fyodor Dostoevsky's The Brothers Karamazov, and Franz Chavez 2 Kafka's The Trial respectively) I will turn the elements of despair or cruelty into spotlights which point out the necessity of law, and support the belief that we should constantly work towards its improvement. -

Generations of Americans eventually came to recognize Private Henry Fleming as the key fictional image of a young American soldier: confused, unprepared, and pretty much alone. But despite Crane’s pervasive ironies and his successful refutation of genteel literary treatments of warfare, The Red Badge can nonetheless be read as endorsing battle as a ticket to manhood and self-confidence. Not so the First World War verse of Lieutenant Wilfred Owen. Owen’s antiheroic, almost revolutionary poems introduced an enduring new archetype: the young soldier as a guileless victim, meaninglessly sacrificed to the vanity of civilians and politicians. Written, though not published during the war, Owen’s “Strange Meeting,” “The Parable of the Old Man and the Young,” and “Anthem for Doomed Youth,” especially, exemplify his judgment. Owen, a decorated officer who once described himself as a “pacifist with a very seared conscience,” portrays soldiers as young, helpless, innocent, and ill- starred. On the German side, the same theme pervades novelist Erich Maria Remarque’s All Quiet on the Western Front (1928): Lewis Milestone’s film adaptation (1930) is often ranked among the best war movies of all time. Unlike Crane, neither Owen nor Remarque detected in warfare any redeeming value; and by the late twentieth century, general revulsion of the educated against war solicited a wide acceptance of this sympathetic image among Western War, Literature & the Arts: an international journal of the humanities / Volume 32 / 2020 civilians—incomplete and sentimental as it is. -

RAINING ON THE WEST MEMPHIS PARADE: FUNDAMENTAL FAIRNESS DENIED The West Memphis 3 are free!! Yea! Three men convicted in the 1993 murders of three boys in West Memphis, Arkansas, were ordered released after entering new pleas following a court hearing, prosecutor Scott Ellington said Friday. Damien Echols, Jessie Misskelley Jr. and Jason Baldwin pleaded guilty and were sentenced to 18 years in prison with credit for time served, a prosecutor said. They were to be released on Friday. The three entered what is known as an Alford plea, which allows a defendant to maintain innocence while simultaneously acknowledging that the state has evidence to convict, Ellington said. Cause for celebration, right? Not here; I feel nothing but sweet sorrow because, while Damien Echols (who had actually been on death row most all of the intervening time), Jessie Misskelley Jr. and Jason Baldwin are free, a solid little chunk of the American justice system, due process and fundamental fairness was sacrificed in the process. Let one of the three, Mr. Baldwin, speak for himself and me here: This was NOT justice. I did not want to take this deal, but they were going to kill Damien an I couldn’t let that happen. And therein lies the huge rub. The facts had never been particularly solid against these three once young men. They were brow beaten by avaricious prosecutors, sought to be lynched by a southern community ginned up on fear, horror and emotion and poorly served by their attorneys at the original trial level. In short, every facet of the American system of due process was compromised and tainted, and they have sat convicted, one on death row, ever since as a result. -

1997 SUNDANCE FILM FESTIVAL The 1997 Sundance Film Festival continued to attract crowds, international attention and an appreciative group of alumni fi lmmakers. Many of the Premiere fi lmmakers were returning directors (Errol Morris, Tom DiCillo, Victor Nunez, Gregg Araki, Kevin Smith), whose earlier, sometimes unknown, work had received a warm reception at Sundance. The Piper-Heidsieck tribute to independent vision went to actor/director Tim Robbins, and a major retrospective of the works of German New-Wave giant Rainer Werner Fassbinder was staged, with many of his original actors fl own in for forums. It was a fi tting tribute to both Fassbinder and the Festival and the ways that American independent cinema was indeed becoming international. Abstract This thesis examines written, audio-visual and musical representations of real-life British serial killers Myra Hindley and Ian Brady (the ‘Moors Murderers’) and Peter Sutcliffe (the ‘Yorkshire Ripper’), from the time of their crimes to the present day, and their proliferation beyond the cases’ immediate historical-legal context. Through the theoretical construct ‘Northientalism’ I interrogate such representations’ replication and engagement of stereotypes and anxieties accruing to the figure of the white working- class ‘Northern’ subject in these cases, within a broader context of pre-existing historical trajectories and generic conventions of Northern and true crime representation. Interrogating changing perceptions of the cultural functions and meanings of murderers in late-capitalist socio-cultural history, I argue that the underlying structure of true crime is the counterbalance between the exceptional and the everyday, in service of which its second crucial structuring technique – the depiction of physical detail – operates. -

Barron. Life Of Pi‘s Gil Netter is producing. It’s a coup for the studio to land Boyens, who hasn’t really worked outside her long collaboration with Peter Jackson and Fran Walsh, with whom she shared the Oscar for Best Adapted Screenplay in 2002 for the Best Picture winner The Return Of The King. She has teamed with Jackson and Walsh on The Lord Of The Rings and The Hobbit trilogies, as well as King Kong and The Lovely Bones. It turned out that when Sean Bailey’s Disney division called, it was a fortuitous moment, and the formative story of the iconic wizard was the right subject matter. Boyens came from New Zealand to meet with Bailey and supervising execs Tendo Nagenda and Foster Driver, and Merlin was a character and a world that appealed to her. No. 18CR-93-516 DAMIEN ECHOLS DEFENDANT/PETITIONER MOTION FOR DECLARATORY AND INJUNCTIVE RELIEF Having recently learned of the West Memphis Police Department’s (“WMPD”) spoliation of evidence in his case, apparently both before and after his Alford plea, Damien Echols moves this Court to exercise its continuing supervi- sory jurisdiction over this case to declare the violation of his rights by this miscon- duct and to enjoin its continuation pending the development of a full factual record upon which the Court can consider awarding appropriate relief to Echols for the damages it has caused him. As grounds for this motion, Echols asserts the follow- ing: Background 1. Echols was one of three teenagers tried and convicted of killing three young boys in the infamous West Memphis Three case. Echols was sentenced to death as a result of his murder convictions. Throughout the proceedings, Echols and his co-defendants Jason Baldwin and Jessie Misskelley, Jr. (collectively “the WM3”) maintained their innocence of the crimes. 1 2. Over the course of the eighteen years following the murders, and con- sistent with their claims of innocence, the WM3 pursued numerous factual and le- gal challenges to the convictions. In connection with one of those challenges, in November 2010, the Arkansas Supreme Court ordered the trial court to hold a hearing to consider whether newly analyzed DNA evidence might exonerate the WM3. Ultimately, the development of further evidence in anticipation of that hearing - including the results of additional new DNA testing of certain evidence - led the parties to negotiate an Alford plea resolution of the cases, enabling the WM3 to maintain their innocence while being immediately released from prison.
