Brown, Advisor Between 1984 and 1991, heavy metal became one of the most publicly popular and commercially successful rock music subgenres. The focus of this dissertation is to explore the following research questions: How did the subculture of heavy metal music between 1984 and 1991 evolve and what meanings can be derived from this ongoing process? How did the contextual circumstances surrounding heavy metal music during this period impact the performative choices exhibited by artists, and from a position of retrospection, what lasting significance does this particular era of heavy metal merit today? A textual analysis of metal- related materials fostered the development of themes relating to the selective choices made and performances enacted by metal artists. These themes were then considered in terms of gender, sexuality, race, and age constructions as well as the ongoing negotiations of the metal artist within multiple performative realms. COREY FROST Abstract The increasing use of “bitch” among women makes it harder to see links between the word and patriarchy. In pop culture and in everyday life, men and women use “bitch” as an epithet against women (and non-conventional men) as well as a means of expressing dominance over a person or object. Women who “reclaim” the term—by declaring themselves “bitches,” calling other women “bitches” in a friendly way, or using the term as a female-based generic—unwittingly reinforce sexism. Unlike the term “feminist,” which is tied to a movement for social change, “bitch” provides women only with false power, challenging neither men nor patriarchy. E USED TO BELIEVE that feminists found the term “bitch” unacceptable. Years ago, when one of us analyzed terms that make women invisible and men the norm—“freshman,” “chairman,” and “you guys”—she wrote, perhaps naively: “I’m not referring [in the case of sexist language] to such words as ‘bitch,’ ‘whore,’ and ‘slut.’ What I focus on instead are words that students Wconsider just fine: male (so-called) generics” (Kleinman 2000: 6). Unlike “you guys,” “bitch” is a slur; and there’s no doubt that the word has a female referent, and a non- human one at that.1 Feminists knew that women could act in mean-spirited ways, but we also knew that using “bitch” to describe them reinforced sexism. Yet, there is little in historical documents that captures the laughter, joy and sorrow that creates the soul of a minoritized people. These tales are historically reimagined gazes into Black lives that portrays that which makes us all human. Through this collection, voice is given to what can’t be found in historical documents in an effort to bridge that gap. BMI submits these comments to state publicly its position on fractional licensing for the benefit of other interested parties. As we described in BMI’s August 6, 2014 public comments, the advent of digital processing and Internet streaming has revolutionized the way that the public hears music performances. The Department’s ongoing review of the consent decree must address the current and foreseeable future marketplace and make the changes necessary to bring the consent decree into the 21st Century. (BMI) submits these public comments in response to the solicitation of public comments by the Antitrust Division of the U.S. Department of Justice (Department) as part of its current review of the consent decrees in United States v. Broadcast Music, Inc. and United States v. American Society of Composers, Authors and Publishers.1 INTRODUCTION The 1966 BMI consent decree, last amended 20 years ago, is outdated and in need of comprehensive reform. It reflects legal theories that have been rejected in modern antitrust cases and commentary, and predates subsequent court decisions that have repeatedly found that BMI’s non-exclusive blanket licensing of performance rights in its repertoire does not violate the antitrust laws. The BMI decree also fails to account for the vast changes in the technology and markets for the public performance of music in which BMI operates. The digital revolution in information processing and communications has completely transformed the way music performances are heard by the public and equally changed the way in which information about music performances is collected and processed. In particular, the rise of Internet streaming as a principal way the public hears performances of music has created market needs that are now not being met because of inefficient and anticompetitive restrictions in the BMI consent decree that serve no sound purpose today. 1.
