MESSAGE FROM THE CHIEF ELECTORAL OFFICER

This report provides summary information from Annual Revenue Returns filed by political parties, as well as Election Financing Returns filed by political parties and candidates following the 2016 General Election.

Political parties’ officials were required to submit two detailed returns in 2016: all were filed in accordance with the Elections Act.

Candidates’ official agents were required to submit campaign returns in 2016: 62 of 63 were filed in accordance with the Elections Act.

This report involved the review of 70 detailed returns and almost 1,700 contributions, reconciliation of parties’ and candidates’ reporting, aggregation of contributions within the reporting periods, and follow-up where clarification or amendments were required.

2016 was a year of progress. Legislation was implemented that respects judicial decisions regarding the rights of participation guaranteed by the Canadian Charter of Rights and Freedoms, and enhances equity and fairness in public disclosure. Modernized resources increased accuracy, efficiency, and statutory compliance. Contributors’ guides were created to promote understanding and to supplement the detailed guides for officials and official agents.

Advance preparation began in December 2015, when political parties’ officials were notified of new responsibilities based on legislative amendments approved earlier that month. While the amendments came into effect for completion of the 2016 returns (submitted in 2017), immediate notice allowed officials time to develop record-keeping practices, beginning in January 2016, to comply with the new statutory framework.

Party officials provided input on the interpretation and application of the legislation, challenges relating to their responsibilities to their parties and their candidates, and the draft versions of the modernized resources designed to streamline the completion of returns and enhance compliance and accuracy in reporting.

The success of the processes and resources that were developed for use in 2016 are a tribute to the officials’ expertise and their active involvement in the process. Their thoughtful consideration and practical input is gratefully appreciated and our sincere thanks go out to the parties’ officials identified in this report and to their predecessors. They are commended for the hundreds of volunteer hours they spend in managing the financial activities for their parties and supporting the official agents appointed by candidates at election time.

While their feedback on the processes and resources was largely positive, resources were prepared under tight time constraints amongst many other competing priorities. Moving forward, party officials will be invited to share their ideas for future enhancements that will better support them in fulfilling their responsibilities.

Compliance has been identified as a concern in the past. I believe that, with party officials’ input, we can improve resources and support to promote increased compliance. While some returns filed in 2016 required follow-up or clarification, officials and official agents were in frequent contact with Elections Yukon to achieve compliance with the legislation and were cooperative in resolving issues that were identified.

Even though the intent of the electoral finance provisions is limited primarily to the disclosure of contributions and expenses, the terms used in the legislation are not commonly used and interpretation can be challenging. It is not surprising that misunderstandings sometimes occur; however, it’s more important to recognize the sincere efforts towards compliance.

It became apparent that the administration of financial activities varies significantly between parties. Some parties manage these activities centrally to address the practical challenges of candidates’ banking and record-keeping; some candidates manage independently of their party. These differences magnify the complexity of the record-keeping and reporting. This report strives to clearly present financial activities of parties and candidates in a manner that facilitates understanding and meaningful comparison.

Accurate reporting would not be possible without the efforts of parties’ officials and the official agents responsible for the financial activities of candidates’ campaigns. They are typically volunteers; many of whom are acting in the capacity for the first time. Whether experienced or new to the position, they were required to adapt to new processes resulting from the legislative amendments – and, for many, to the automated completion of their returns. Given that official agents may take on the role within the campaign period, and often in the midst of many other priorities, the level of compliance demonstrates a strong commitment.

Compliance with reporting requirements ensures transparency in the financial activities of political parties and candidates. Compliance could not be achieved without the diligence and integrity of the officials and official agents who invested many long hours to fulfill the roles assigned to them by law. REPORTING OF FINANCIAL ACTIVITY

The Elections Act requires the reporting of political financing activities on an annual basis and for each election campaign.

Registered political parties (parties) file an Annual Revenue Return by March 31, reporting revenue received in the preceding calendar year.

Parties and candidates file an Election Financing Return within 90 days after the return to the writ following an election, reporting revenue and expenses related to the campaign. Parties and candidates may request an extension to the filing deadline, if required.

The Elections Act does not require registration or reporting by third parties or constituency (riding) associations. There is no requirement for the reporting of contributions made to individuals contesting party leadership or nominations.

Revenue

Annual Revenue Returns and Election Financing Returns identify revenue received for the reporting period, which includes: • contributions (of money, goods, and services) • proceeds from fundraising activities • donations received at meetings and rallies held for political purposes • membership fees • event registration fees • loans • income from investments and other sources Contributions

Contributions are gifts made to a party or candidate in the form of money, goods, services or discounts off the usual price of goods and services. Contributions are identified by type (either monetary or in kind).

Monetary contributions are contributions in the form of money and include cash, the monetary value of negotiable instruments (such as cheques) and money conveyed by credit card or other similar means. This type of contribution is eligible for a political tax credit. In kind contributions are contributions of goods and services. As examples, these include donations of goods, such as used office equipment or donations of services, such as computer repairs. Official receipts are issued for both types of contributions, but only monetary contributions are eligible for a political tax credit from Canada Revenue Agency.

Contributors Contributions can be made by: • persons, meaning o an individual o a corporation which is incorporated in any jurisdiction o a partnership or other unincorporated association, organization or body that is registered under the Partnership and Business Names Act • unincorporated groups, meaning o a trade union o a political party o any other entity that is not a person Contribution Limits There is no limit on the amount of contributions that a contributor can make, as long as it is properly receipted and reported by the party or candidate.

There is no restriction on who can contribute to a party or a candidate, as long as the contributor’s information is provided.

There is no limit on the total amount of contributions a party or a candidate can accept, as long as the contributions are properly disclosed. Anonymous contributions cannot be accepted by a party or a candidate and, if received, must be turned over to the Chief Electoral Officer for payment to the Yukon Consolidated Revenue Fund (if money) or disposal (if goods).

Contribution Tax Credits

As at January 1, 2016, the maximum annual credit is $650, which results from a contribution of $1,275 or more. The credit amount is calculated as the sum of: • 75% of the first $400 of contributions • 50% of the next $350 of contributions • 33.33% of the next $525 of contributions Disclosure of Contributions

All contributions, both monetary and in kind, must be reported by parties and candidates. The reports must include duplicate copies of all official receipts issued. Contributors’ information is disclosed publicly if total contributions exceed $250.

A contribution over $250 is made when the total of monetary and in kind contributions exceeds $250 in a reporting period and when the total of annual and campaign contributions to a party exceeds $250 in a calendar year.

This report contains information from the Annual Revenue Returns filed by parties for the 2016 calendar year, as well as information from the Election Financing Returns filed by parties and candidates for the 2016 General Election.

Contributions are reported by type (monetary or in kind), by category (up to $50, $50.01 to $250, and over $250) and by contributor (person or unincorporated group).

Returns filed with the Chief Electoral Officer by parties and candidates are public information. These returns are available for public inspection at Elections Yukon during regular business hours. The Elections Act prohibits the disclosure of names of contributors who contribute a total of $250 or less.

Reports published by the Chief Electoral Officer are available on the Elections Yukon website or by contacting the office.

Expenses

Election Financing Returns identify expenses incurred for the reporting period, which include: • amounts paid for goods and services • value of goods and services contributed, which are deemed to be expenses in the reporting period Legislation

December 2015 amendments to the Elections Act affected the reporting of parties’ and candidates’ financial activities in 2016.

One key legislative amendment established consistent disclosure provisions for all contributors. Beginning with the 2016 calendar year, contributor information for both persons and unincorporated groups, and for monetary and in kind contributions, is consistently disclosed for contributions over $250.

Prior to 2016: • contributor information for unincorporated groups was publicly disclosed for contributions over $50, while the disclosure threshold for persons was over $250 • contributor information for in kind contributions was publicly disclosed for contributions over $50, while the disclosure threshold for monetary contributions was over $250 Communications

A Guide for Contributors was posted to the website and was provided to parties’ officials and candidates to inform their contributors of the requirements and disclosure provisions of the Elections Act.

For the first time, parties’ and candidates’ returns were provided as fillable pdf’s, which automatically performed all calculations and transferred totals from various schedules to the appropriate summary pages. These returns, available through the website, were designed to increase legibility, eliminate the requirement for manual calculations and reduce the likelihood of errors.

Contributions entered on the automated returns could also be used to produce official receipts. This reduced the requirement for parties’ officials and candidates’ official agents to hand-write hundreds of receipts, eliminated transposition errors and omissions, and increased legibility of copies that must be maintained by officials/official agents and used for reconciliation purposes by Elections Yukon. These were all issues of concern identified by stakeholders in the past.

The modernized resources were widely used, with all parties and more than half of the candidates using the automated returns. Most of these used contribution information from the returns to produce official receipts electronically, either independently or with assistance from Elections Yukon.

This initiative successfully streamlined the work of officials/official agents and ensured consistent, accurate aggregation and reporting by Elections Yukon.

ANNUAL/CAMPAIGN REPORTING BY POLITICAL PARTIES

As at December 31, 2016, there were four political parties registered in accordance with section 44 of the Elections Act. Political Party Official Yukon Green Party Scott Gilbert Yukon Liberal Party Julia Spriggs Yukon New Democratic Party Jim Cahill Yukon Party Linda Hillier The registration of the Yukon First Nations Party was cancelled on October 31, 2016, following the close of nominations for the November 2016 General Election. The party’s registration was cancelled, in accordance with section 47(5) of the Elections Act, when the party did not endorse any candidates in the general election. There were no new political parties registered in the 2016 calendar year. Annual Reporting Requirements

Registered political parties (parties) file an Annual Revenue Return by March 31, reporting revenue received in the preceding calendar year. Parties are not required to report annual expenses. Election Campaign Reporting Requirements

Parties file an Election Financing Return within 90 days after the return to the writ following an election. The returns identify all contributions and expenses related to the campaign, whether received or incurred prior to the campaign period.

For the November 2016 General Election, the campaign period began on October 7, 2016 and ended on December 14, 2016 (30 days after the return to the writ).

Legislation

Parties’ officials are responsible for the financial activities of the party, and must: • issue receipts for contributions to contributors • provide duplicate tax receipts to Elections Yukon • make all payments by or on behalf of the party • keep copies of receipts, records and books of account to provide additional detail to Elections Yukon and verification to Canada Revenue Agency, on request • complete, sign, and file the Annual Revenue Return and Election Financing Return

Amendments to the Elections Act, approved by the Legislative Assembly in December 2015, affected the reporting of parties’ financial activities in 2016. Party officials were notified of the amendments on December 14, 2015 to provide them with time to adjust their record- keeping practices.

Beginning in 2016, officials were required to: • report and issue official receipts for in kind contributions on Annual Revenue Returns o With this amendment, the full value of revenue is reported, whether it is received as a monetary or in kind contribution. This allows for a more accurate picture of revenue and a better comparison between parties, since some parties receive a significant portion of revenue through in kind contributions, while others receive only monetary contributions. • report the receipt of other revenue on Annual Revenue Returns o With this amendment, the full value of revenue is reported, whether it is received as a contribution or as proceeds from fundraising activities, donations at meetings and rallies, membership fees, event registration fees, income from investments, loans, etc. Again, this allows for a more accurate picture of revenue and a better comparison between parties, since some parties receive a significant portion of revenue through these activities, while others receive only contributions. • report all campaign-related expenses incurred prior to the campaign period on Election Financing Returns o With this amendment, the full value of campaign expenses is reported: this amount is often viewed as the “campaign value”. In the past, these pre-election expenses were not subject to disclosure, since Annual Revenue Returns do not include expense reporting. • issue official receipts for in kind contributions on Election Financing Returns o With this amendment, contributions can be properly aggregated and contributors received acknowledgement of contributions of goods and services.

Communications

Legislative amendments resulted from recommendations made by the Chief Electoral Officer in December 2014, following consultation with parties’ officials. Once approved by the Legislative Assembly in December 2015, amendments were provided to parties’ officials to provide them with time to adjust their record-keeping practices beginning on January 1, 2016.

2016 was a year of progress. In the past, parties’ officials manually completed returns and official receipts. These responsibilities were labour-intensive, time-consuming, and prone to error. The modernized resources identified on pages 5 and 6 of this report were designed to increase accuracy and reduce the redundant, manual aspects of completing their returns.

Parties’ officials received the modernized resources for review, and input was shared at a meeting held on July 8, 2016. Further consultation is planned to obtain their input following the use of these resources for annual and campaign reporting.

The Guides for Officials containing annual and campaign finance requirements were provided to parties’ officials to ensure that appropriate records were maintained and proper practices were followed to facilitate completion of the revised returns required for the 2016 calendar year. Parties’ Reporting All four parties submitted Annual Revenue Returns by March 31, 2017, the statutory deadline. All four parties submitted Election Financing Returns by February 13, 2017, the statutory deadline, or by the extension requested by the party and granted by Elections Yukon. Total annual revenue of $641,023.78 was received by the parties, which included: • 687 annual contributions (monetary), totalling $223,042.36 • 32 annual contributions (in kind), totalling $12,921.00 • other annual revenue, totalling $54,410.18 • 365 campaign contributions (monetary), totalling $201,968.13 • 10 campaign contributions (in kind), totalling $10,163.41 • campaign contributions received on behalf of candidates, totalling $76,902.00 • amounts received from candidates for expenses, totalling $59,453.25 • other campaign revenue, totalling $2,163.45

In total, parties received 1,658 official receipts: all were accounted for, as required by the Elections Act.

Parties’ Annual Revenue/Election Financing Returns Information from returns filed by each party, which follows, consolidates both the Annual Revenue Return and the Election Financing Return filed for 2016. A list of contributors who have contributed over $250 is provided for each party, in accordance with the Elections Act. The total contribution by an individual contributor includes both annual and campaign contributions made in 2016, whether monetary or in kind. A description of the goods/services appears for in kind contributions. It is noted that: • total revenue includes all revenue received by the party in 2016 o specific detail with respect to annual and campaign revenue, provided on each party’s annual and campaign returns, is also provided • campaign contributions received on behalf of candidates are noted on the party’s Election Financing Return for reconciliation to individual candidates’ returns o the contributions are reported on the individual candidates’ returns and contributors’ information is disclosed there, if required • annual and campaign returns are filed separately, but should both be considered to identify the financial position of a party for the calendar year o for example, a party will identify a campaign deficit if campaign expenses exceed campaign revenue o at the same time, annual revenue received in 2016 and in prior years may offset or exceed the campaign deficit, depending on annual expenses (which are not reported by parties) o for ease of reference, parties’ annual revenue for 2012 through 2015 (the years following the last general election) is presented below

CAMPAIGN REPORTING BY CANDIDATES

As at October 17, 2016, the close of nominations for the 2016 General Election, 63 candidates had filed Nomination Papers. Details are provided in The Report of the Chief Electoral Officer on the 2016 General Election.

Each candidates is required to appoint an official agent, in accordance with the Elections Act, to manage the financial activities of the campaign. Official agents are appointed on the Nomination Paper and must consent to their appointment in writing.

Election Campaign Reporting Requirements

Candidates file an Election Financing Return within 90 days after the return to the writ following an election. The returns identify all revenue and expenses related to the campaign, whether received or incurred prior to the campaign period.

For the November 2016 General Election, the campaign period began on October 7, 2016 and ended on December 14, 2016 (30 days after the return to the writ).

Legislation

Candidates’ official agents are responsible for the financial activities of the campaign, and have similar responsibilities to those of party officials (identified on page 7 of this report). Key responsibilities include the maintenance of financial records, issuance of official receipts and the filing of a completed Election Financing Return on behalf of the candidate.

Amendments to the Elections Act, approved by the Legislative Assembly in December 2015, affected the reporting of candidates’ campaign activities in 2016.

For the November 2016 General Election, official agents were required to: • report all campaign-related expenses incurred prior to the campaign period o With this amendment, the full value of campaign expenses is reported: this amount is often viewed as the “campaign value”. • report all contributions received prior to the campaign period o With this amendment, the total of all contributions received by the campaign is reported and properly disclosed. • issue official receipts for in kind contributions o With this amendment, contributions can be properly aggregated and contributors received acknowledgement of contributions of goods and services. • obtain the candidate’s signature prior to filing the return o With this amendment, each candidate had the opportunity to verify the accuracy of the return filed on the candidate’s behalf.

Statutory provisions for the refund of candidates’ nomination deposits were updated to reflect judicial decisions on rights of participation guaranteed by the Canadian Charter of Rights and Freedoms. Deposits were refunded to candidates whose returns were filed in compliance with the Elections Act and were no longer dependent on receiving a specific percentage of votes cast.

Communications

The report issued by the Chief Electoral Officer following the 2011 General Election indicated that “compliance with the election financing provisions of the Elections Act continues to be a major problem”. The legal obligation of candidates and official agents to fulfill the filing requirements was emphasized. A similar concern was expressed in the report issued following the 2006 General Election, which reported that insufficient information was provided on many returns and a lack of understanding of reporting requirements was noted.

To address these concerns, resources provided to candidates and their official agents were enhanced to include a line-by-line guide for completion of the Election Financing Return. The guide was designed to support the completion of a printed copy or the fillable pdf version of the return, which was available online.

The Guide for Official Agents, which identified campaign reporting requirements, was provided to prospective candidates along with their nomination packages. The intent of providing the guides early was to ensure that official agents were aware of their responsibilities before committing to the role and to ensure that appropriate records were maintained and proper practices were followed in the early days of the campaign period (prior to the filing of the candidates’ Nomination Papers).

In future, guides will be available to parties for pre-election distribution to prospective candidates to provide candidates and their official agents with additional time for review and preparation. Given that guides had to incorporate legislative amendments passed in December 2015, they were not available well in advance of the 2016 campaign period.

Candidates’ Reporting Sixty-two of the 63 candidates submitted Election Financing Returns by February 13, 2017, the statutory deadline, or by the extension granted by Elections Yukon. The filing deadline in Mountainview was extended to February 17, 2017, following a judicial recount and subsequent delay to the return to the writ. Nomination deposits were refunded to these 62 candidates. One candidate, Victor Kisoun (Independent candidate in Watson Lake), was granted an extension but has not filed an Election Financing Return at the time of printing. Follow-up is underway, in accordance with the Elections Act.

Total campaign revenue of $377,303.75 was received on behalf of all candidates, which included: • 582 campaign contributions (monetary and in kind), totalling $255,022.43 • amounts received from/paid by parties, totalling $121,821.32 • other campaign revenue, totalling $460.00 In total, candidates received 672 official receipts. All were accounted for, as required by the Elections Act: • 58 candidates submitted all official receipts, including those that were completed, unused or marked as void • 3 candidates submitted affidavits to account for official receipts that were misplaced • 1 candidate submitted an affidavit to account for official receipts that were destroyed • 1 candidate has 3 official receipts, for submission with the outstanding Election Financing Return

Candidates’ Election Financing Returns Information from Election Financing Returns filed on behalf of each candidate follows (in ballot order). A list of contributors who have contributed over $250 is provided for each candidate, in accordance with the Elections Act. The total contribution includes both monetary and in kind contributions made by an individual contributor. A description of the goods/services appears for in kind contributions. It is noted that total revenue includes all revenue received by the candidate, including: • contributions (monetary and in kind), whether made directly to the candidate or to the party on the candidate’s behalf • net amounts received from a political party (monetary and in kind), reflecting amounts paid by a party minus candidates’ contributions held by the party • other revenue, including proceeds from fundraising activities, donations received at meetings and rallies, membership fees, etc. Deficits, where noted, identify the debt holder(s). Surpluses, where noted, were submitted to the party and confirmation of the payment was provided to Elections Yukon.
