The Isle of Man Police Board, in pursuance of Section io (i) (c) of the Police (Isle of Man) Act, 1962, after consultation with the Governor, the Finance Board and the Isle of Man Police Federation, DO hereby determine as follows :—

OVERTIME 1. (i) Subject to the provisions of this Article, where a member of the police force to whom this Article applies, other than a member who is paid a detective duty allowance, remains on duty after his tour of duty ends or is recalled to duty between two tours of duty, he shall be granted, if and as soon as the exigencies of duty in the opinion of the Chief Constable permit, in respect of each unit of time during which he so remains on duty after his tour of duty ends or after being so recalled (hereafter in this Determination referred to as " overtime ") an equal period of time off and in addition for each three units of overtime in any week an additional quarter of an hour of time off.

(2) If in respect of the overtime during any week time off is not granted within such time (not exceeding three months) after that week as the Chief Constable may fix, the member, if he is below the rank of , shall be granted for each unit of overtime worked during that week for which time off has not been granted an allowance of one twenty-fourth of one day's pay, fractions of a penny being ignored, and after the time so fixed any right to time off in respect of that week shall cease.

(3) In computing any period of overtime for the purposes of this Article: (a) where the member is engaged in casual escort duty, account shall be taken only of— (i) the time during which he is in charge of the person under escort, (ii) such other time as is necessarily spent in travelling to or from the place where the member is to take charge of, or hand over, the person under escort, as the case may be, and, (iii) any other time that may be allowed by the Chief Constable, so however that, if the member is so engaged overnight and has proper sleeping accommodation, whether in a train or

2 otherwise, the Chief Constable may exclude such period, not exceeding eight hours, during which the member is not in charge of the person under escort as he considers appro- priate in the circumstances ; (b) where the tour or tours of duty does not or do not amount in the aggregate to more than the normal period of duty, no account shall be taken of any overtime except so much as together with the tour or tours of duty exceeds the normal period of duty ; (c) no account shall be taken of any overtime for which the member received an allowance under Article 20 of this Determination ; (d) where a member is recalled to duty, the period of overtime shall include the time occupied by the member in going from and returning to his home not exceeding such reasonable limit as may be fixed by the Chief Constable ; (e) where a member has completed a full tour of night duty which ends at any time after 2 a.m. and before Io a.m. and is recalled to duty before nine and a half hours have elapsed from the time when such tour of duty ended, he shall be deemed, if the period of overtime worked on that occasion amounts to less than sixteen units of overtime, to have worked in respect of that period a period of overtime equal to sixteen units of overtime ; (f) no account shall be taken of casual overtime except as authorised by paragraph (3A) of this Article.

(3A) A member shall for any period of not less than two units of casual overtime be granted, if and as soon as the exigencies of duty in the opinion of the Chief Constable permit, time off of twenty minutes for each such unit if in any fortnight the aggregate number of units of casual overtime, excluding any period of less than two units, is not less than twelve.

(3B) In respect of any overtime worked on any special occasion by an inspector, other than an inspector who is paid a detective duty allowance, paragraph (2) of this Article shall apply as it applies to overtime worked by members below the rank of inspector.

(3C) Where on any special occasion a member below the rank of who is paid a detective duty allowance is required to do duty in connection with that special occasion, then, if he remains on such duty beyond the normal daily period of duty, he shall be entitled in respect of such overtime to time off in accordance with paragraph (i) of this Article or an allowance in lieu thereof in accordance with paragraph (2) of this Article.

(4) For the purpose of this Article— reference to a member recalled to duty shall not include a reference to a member who is only warned to be in readiness for duty if required ; the expression ' unit ' means a complete quarter of an hour, the expression ' week ' means that period of seven days beginning with such day as is fixed by the Chief Constable, 3 the expression ' casual overtime ' means a period of overtime of less than four units during which a member remains on duty after his tour of duty ends, other than a period in respect of which the member was informed at the commencement of his tour that he would be required to remain on duty after his tour ended, the expression ' fortnight ' means that period of fourteen days begin- ning with such day as is fixed by the Chief Constable, the expression ' special occasion ' means an occasion designated as a special occasion for the purposes of this Article by the Chief Constable. (5) This Article shall apply to a member of the force who is not— (a) above the rank of Inspector, (b) employed in duties which have been specially excepted by the Governor.

2. DUTY ON PUBLIC HOLIDAYS AND WEEKLY REST DAYS

(r) Every member of the police force shall, so far as the exigencies of duty permit, be allowed a day's leave on each public holiday. (2) Every member of the police force shall, so far as the exigencies of duty permit, be granted one day's rest in every seven, or 52 days in every year (hereafter in this Determination referred to as " a weekly rest day "), in addition to annual leave. (3) Every member of the police force below the rank of Superin- tendent shall, so far as the exigencies of duty permit, be allowed, in addition to his weekly rest day, one rest day in every fortnight (hereinafter called `an additional rest day ') on which he is not required to perform police duty. (4) Every member of the police force below the rank of Superin- tendent who is required to do duty on a public holiday or on a day which would otherwise have been a rest day shall be granted, if and as soon as the exigencies of duty permit, time off equal to one-and-a-half times the period of completed quarters of an hour of duty on each such day. (5) If in the opinion of the Chief Constable the exigencies of duty do not permit the grant of time off under the last preceding paragraph within such time (not exceeding three months) as he may fix, the member shall be granted in lieu of time off an allowance at the rate of three sixty- fourths of one day's pay for each quarter of an hour of duty on each such day, fractions of a penny being ignored. (6) For the purposes of this Regulation— (a) a member of the- police force who is paid a detective duty allowance in respect of duty on a public holiday or on a day which would otherwise have been a rest day shall be deemed to be required to do duty on such day only if he has been specifically ordered to do duty ; (b) one day's pay shall be calculated at the weekly rate of pay divided by five-and-a-half, fractions of a penny being ignored ; 4 (c) a reference to a day which would otherwise have been a rest day is to be construed as a reference to a day which according to the roster of rest days was to have been a rest day for the member concerned, and for the purpose of determining what would have been such a day any alteration in the roster made less than eight days before that day shall be ignored except where the alteration is made at the request of the member concerned ; (d) the expression ' rest day' means a weekly rest day or an additional rest day ;

(e) the expression ' fortnight ' means that period of fourteen days beginning with such day as is fixed by the Chief Constable ;

(f) a period of less than eight completed quarters of an hour of duty on a public holiday or on a day which would otherwise have been a rest day shall be treated as though it was a period of eight completed quarters of an hour of duty ;

(g) where a member is recalled to duty after completing a tout of duty his period of duty shall include the time occupied by him in going from and returning to his home on and after his recall, not exceeding such reasonable limit as may be fixed by the Chief Constable ; (h) where a member is required to do duty on a public holiday or on a day which would otherwise have been a rest day (otherwise than when he is recalled to duty after completing a tour of duty), his period of duty shall include the time occupied by him in going to and returning from his place of duty not exceeding such reasonable limit as may be fixed by the Chief Constable, save that any period of time so occupied which together with the member's period of duty amounts to more than four hours shall be disregarded.

APPLICATION OF ARTICLES I AND 2 IN EMERGENCIES 3. On any occasion or occasions of emergency the Governor may direct that the provisions of Articles i and 2 of this Determination shall apply only to such extent and under such conditions as he may determine.

PAY

PAY 4. (i) The rate of pay of a member of the police force shall be in in accordance with the scale of pay for his rank set out in Schedule hereto. (2) In calculating service of any of the aforesaid scales of pay— (a) there shall be included any period which is included in the member's pensionable service by virtue of the fact that he has served in Her Majesty's forces ; (b) there shall be included any previous period or periods of service in the rank he holds during a temporary promotion thereto ; 5 (c) where the member at the end of a period of temporary promotion reverts to the rank he held immediately before that period he shall thereafter be deemed to have held during that period the rank to which he so reverts ; (d) subject to the foregoing provisions of this paragraph, service means service since the member's last appointment as a constable or service since the member's last promotion to the rank he holds, as the case may be. (3)(a) Nothing in the foreging provisions of this Article shall affect the operation of any Regulations relating to discipline or of Article 8 of this Determination, (b) Notwithstanding sub-paragraph (b) of paragraph (z) of this Article in the case of a member of the Police Force who has been reduced in rank as a punishment there shall not be included any period of temporary promotion before the date of the said punishment. (4) No pensionable payments except those referred to above shall be made.

PAY DAY

5. (i) Members of the police force shall be paid at such intervals as the Board with the approval of the Finance Board may fix and the Board may fix different intervals for different classes (2) In fixing the intervals for any class the Board shall have regard to the wishes of the members of that class.

6. CALCULATION OF MONTHLY, WEEKLY AND DAILY PAY

(t) One month's pay shall be calculated for all purposes at the annual rate of pay divided by twelve, fractions of a penny being ignored. (2) One week's pay shall be calculated for all purposes at the annual rate of pay divided by fifty-two and one-sixth, fractions o( a penny being ignored. (3) One day's pay shall be calculated except for the purposes of Article 2 or 3 of this Determination at the weekly rate of pay divided by seven, fractions of a penny being ignored.

TRANSFERS

7. (i) (a) A member of another police force above the rank of constable who transfers to the same rank in the police force shall be entitled to count, for the purpose of reckoning his pay, service w'lich he was entitled to count for that purpose in the police force from which he transfers (unless otherwise agreed upon) as follows: - (i) if he transfers from a police force with the same or a higher scale of pay for his rank, all previous service in that rank ;

6 (ii) if he transfers from a police force with a lower scale of pay for his rank, such service in that rank as will bring his rate of pay up to the rate of pay that he was receiving in the police force from which he transfers.

(2) A constable who— (a) transfers from another police force ; or (b) having resigned from a police force, joins or joined after loth May, 1948, the same or any other police force, shall be entitled to count for the purpose of reckoning his pay all service which he was entitled to count for that purpose in the police force from which he transfers or resigned.

ALLOWANCES ALLOWANCES 8. All allowances shall be non-pensionable and the amounts and con- ditions of payment shall be subject to the approval of the Finance Board and no allowances shall be paid except such as are prescribed in this Determination or approved by the Finance Board, and shall be subject to review whenever comparable allowances in the police forces of Great Britain are altered. RENT ALLOWANCE 9. (1) The Board shall provide each member of the police force with a house or quarters free of rent and rates or shall pay him a rent allowance which shall be either a maximum limit allowance or a flat-rate allowance: Provided that— (i) a member to whom Article to of this Determination applies who is provided with quarters shall be paid a rent allowance in addition ; (ii) a member who is either a married man separated from his wife or a man who has divorced, or been divorced by, his wife and who regularly makes periodic payments to her or for her benefit may be granted an addition to his rent allowance equal to which- ever is the lesser of the two following amounts, namely, the amount by which his former allowance exceeds his present allow- ance or the amount paid by him to or for the benefit of his wife or former wife. (2) A maximum limit allowance— (a) shall be paid to a married man not separated from his wife, (b) shall be paid to a member, not being a married man (other than a man separated from his wife) who— (i) has attained the age of thirty-five, (ii) has served for five years as a member of the police force, and occupies as owner or tenant the accommodation in which he is living ; 7 1c) may, if the Board thinks fit, be paid to a man, not being a man to whom sub-paragraph (a) or (b) of this paragraph applies, who— (i) has a dependant relative living with him, (ii) is separated from, or has divorced or been divorced by, his wife, or (iii) is a widower ; and in all other cases a flat-rate allowance shall be paid.

(3)(a) A maximum limit allowance shall, subject to the maximum limit, be the aggregate of the amount paid in rates and— (i) where the member owns the house he occupies, the amount which in the opinion of the Board would be paid in rent therefor if the house were let unfurnished, (ii) where the member is living in unfurnished accommodation, the amount paid in rent therefor, or (iii) subject to sub-paragraph (a) (i) of this paragraph, where the member is living in furnished accommodation, an amount which in the opinion of the Board would have been paid in rent therefor had the accommodation been unfurnished ; Provided that where part of the said house or part of the said accommodation is let to or occupied by a tenant or lodger, as the case may be, who is not a member of the police force, the Board may make a deduction from the said aggregate in respect of such part ; 13) The maximum limit shall be fixed by the Board.

(4) A flat-rate allowance shall be an allowance equal to half the amount fixed as the maximum limit for members of the same rank.

(5) In this Article- 0) the expression " his former allowance " means— (i) in relation to a man who immediately before his wife com- menced to live apart from him, was being provided with a house or quarters free of rent and rates, a sum fixed as the value for the time being of that house or those quarters, and (ii) in relation to any other man, the maximum limit allowance which would for the time being be payable to him if he were still entitled to a maximum limit allowance and he were paying the aggregate calculated in accordance with sub- paragraph (a) of paragraph (3) of this Article which he was paying immediately before his wife commenced to live apart from him ; (o) the expression " his present allowance " means the rent allowance which is being paid to the man, or, as the case may be, a sum fixed as the value for the time being of the house or quarters, with which under this Article he is provided. 8 SUPPLEMENTARY RENT ALLOWANCE

10. (t) This Article shall apply to a member of the police force who— (a) is a widower with a child or children who is being paid a maximum limit allowance under the last foregoing Article or a married man ; (b) is not living with his family ; and (c) satisfies the Chief Contable that the only reason why he is not so living is that he is unable to find suitable accommodation for his family at a reasonable cost within a reasonable distance of his place of duty. (2) Notwithstanding the provisions of Article 9 of this Determination, the rent allowance to be paid to a man to whom this Article applies shall be that which would be payable to him under the said Article 9 if he were a member of the force living with his family.

(3) A man to whom this Article applies shall be paid a supplementary rent allowance at the following rate: - (a) if he is provided with quarters free of rent and rates, 17s. 6d. a week ; (b) if he is not so provided, 25s. od. a week. (4) A supplementary rent allowance payable under paragraph (3) of this Article may be reduced or withdrawn by the Board in respect of any period consisting of one or more complete weeks throughout which the man in question is absent from his usual place of duty and is either- - (a) on leave of absence ; or (b) provided with board and lodging free of charge or an allowance in lieu.

(5) This Article shall cease to have effect on a date to be declared by the Board.

COMPENSATORY GRANT (r) In each year a member of the police force who has during the preceeding year paid income tax in respect of a rent allowance or any compensatory grant mentioned in this paragraph paid or made to him in respect of his service in the force shall be paid a compensatory grant. (2) The amount of the compensatory grant shall be equal to the amount by which the income tax in fact deducted during the preceding year according to the certificate of the Assessor of Income Tax from the member's emoluments in respect of his service in the force is increased by virtue of the inclusion in such emoluments of a rent allowance or any compensatory grant mentioned in this Article paid or made to him. (3) The compensatory grant may, except in the circumstances described in paragraph (4) of this Article be paid by such instalments throughout the year in which it is payable as the Board may determine. 9 (4) Where a member of the police leaves the force or dies whilst serving in the force he or his personal representatives, as the case may be, shall be paid the whole of the compensatory grant due to the member during that year and, in addition, shall be paid a further compensatory grant equal to the amount by which the income tax in fact deducted be- tween the beginning of the year and the date on which he leaves the force or dies, according to the certificate of the Assessor of Income Tax, from the member's emoluments in respect of his service in the force during that period is increased by virtue of the inclusion in such emoluments of a rent allowance or any compensatory grant mentioned in this Article paid or made to him. (5) For the purpose of this Article the word " year " means the year commencing on the sixth day of April and ending on the following fifth day of April. REMOVAL ALLOWANCE 12. (I) Where a member of the police force moves his home otherwise than on transfer from one force to another, and the removal is, in the opinion of the Chief Constable, due to the exigencies of Police duty or is made at the request of the Chief Constable and is, in his opinion, in the interests of the efficiency of the force, the Board shall either reimburse the reasonably incurred cost of removal or carry out the removal. (2) Where a member of the police force moves his home on transfer from another force, the Board either may reimburse the reasonably incurred cost of removal or may carry out the removal. (3) Where the cost of removal is reimbursed or the removal is carried out by the Board under this Article, the member shall, in respect of expenditure incidental to the move (other than the said cost) be paid the sum of to and, if the expenditure exceeds that sum, be reimbursed the excess, so however that the excess payment shall not exceed the amount set out in the following Table opposite to the rank he holds : Provided that any such expenditure unreasonably incurred shall not be taken into account for the purpose of calculating the excess.

A member of the police force who is not supplied with boots by the Board shall be paid in lieu a boot allowance at the rate of 3s. a week. DOG HANDLER'S ALLOWANCE 14. A member of the police force who is required to act as a dog handler shall be paid a clothing allowance at the rate of 5s. a week for so acting. PLAIN CLOTHES ALLOWANCE 15. A member of the police force who is required to do duty in plain clothes for a period of not less than one week shall be paid a plain clothes allowance at the rate set out in the following Table opposite to the rank he holds :— 10 TABLE Rank Amount Inspector 15s. od. a week Sergeant 13s. 6d. a week Constable ... 12S. 6d. a week Provided that a sergeant or constable— (i) who is required to do duty in plain clothes for not less than six days in any period of three months shall be paid a plain clothes allowance in respect of each day at a rate equal to two-elevenths of the weekly rate. (ii) who is provided with overalls when doing duty in plain clothes or for any other reason is, in the opinion of the Board, put to substantially less or substantially more than the normal expenses caused by wearing his own clothes on duty may be paid a plain clothes allowance at a rate approved by the Board. DETECTIVE DUTY AND DETECTIVE EXPENSES ALLOWANCE 16. (1) If the Chief Constable is satisfied that a member of the police force while engaged in detective duties is usually engaged in outside duty, that member shall be paid a detective duty allowance— (a) in the case of a member holding one of the ranks specified in the Table in this paragraph, at the rate set out in the Table opposite to the rank he holds ; (b) in any other case, at such rate as shall be determined by the Board ; TABLE Rank Amount Inspector ... (2) A member of the police force in receipt of an allowance under paragraph (1) of this Regulation shall also be paid a detective expenses allowance at the rate of los. od. a week. (3) If immediately before the first day of July, 1949, the Chief Constable was satisfied that a member of the police force was normally engaged in detective duty other than outside duty, that member shall, if he applied to the Chief Constable before the first day of August, 1949, continue to receive the detective allowance which he was receiving im- mediately before the first day of July, 1949, until the Chief Constable is satisfied that he is no longer so engaged or until he is promoted, and so long as he receives the said allowance he shall be treated for the purposes of this Determination, other than paragraph (2) of this Article, as if he were paid a detective duty allowance. SUBSISTENCE, REFRESHMENT, LODGING AND TRAVELLING ALLOWANCES 17. (I) A member of the police force of or below the rank of Superin- tendent who, being retained on duty beyond his normal period of duty or being engaged on duty away from his usual place of duty, necessarily incurs additional expense to obtain food or lodging, shall— II (a) if the period for which he is so retained or engaged exceeds one hour but does not exceed five hours, be paid a refreshment allowance ; (b) if the period for which he is so retained or engaged exceeds five hours, be paid a subsistence allowance ; (c) if the said expense includes the expense of obtaining lodging, be paid a lodging allowance. (2) Notwithstanding anything in the preceding paragraph a member of the police force of or below the rank of Superintendent who satisfies the Chief Constable that during his normal period of duty he was, although not away from his usual place of duty, unable by reason of the exigencies of duty to obtain his meals in his usual way and that he necessarily incurred additional expense for the purpose may be paid a refreshment allowance. (3) The amount of the said allowances and also for travelling shall be according to the following scales :—

(4) Where the place of duty of a member of the police force has been temporarily changed the expression in this Regulation " usual place of duty " shall, after such period from the date of change as the Chief Constable may determine, mean the temporary place of duty. Provided that- 12 (i) if a lodging allowance is payable as well as a subsistence allow- ance in respect of a total period of retention of engagement of sixteen hours or less, the subsistence allowance shall be of the amount appropriate to a retention or engagement for a period exceeding eight hours and not exceeding twelve hours ; (ii) if the Chief Constable is satisfied in any particular case that the amount of the allowances specified above is not sufficient to cover the actual expenses necessarily incurred, he may authorise payment of the difference ; (iii) if the Chief Constable is satisfied in any particular case that the amount of the allowances specified above would be excessive having regard to the additional expenses necessarily incurred, he may direct that the amount of the allowances shall be reduced to such an amount as he determines, not being less than the amount of such expenses ; (iv) if a member of the police force is so retained or engaged for a period exceeding one week, he may, if the Chief Constable is satisfied that the allowances specified above would be excessive, be granted in lieu thereof a weekly allowance at such lower rate as may be necessary to cover his reasonable expenses ; (v) if a member of the police force is required during any period to accompany a member of the police force of a higher rank, this Article shall apply in relation to that period as if the member of the lower rank held that higher rank or, where the other member is above the rank of superintendent, held the rank of superin- tendent. ADVANCE TO COVER EXPENSES WHEN AWAY ON DUTY 18. Where a member of the police force of or below the rank of inspector is required to do duty away from his usual place of duty he shall be given an advance to cover, as far as practicable, any expenses which he will probably incur. ALLOWANCES IN RESPECT OF MEDICAL CHARGES 19. The Board shall reimburse a member of the police force any charges incurred in his case under the following Regulations (which Regulations relate to charges for certain drugs, medicines and appliances and for dental treatment). (a) The National Health Service (Isle of Man) (Charges for Drugs and Appliances) Regulations, 1952. (Regulations 3, 4, 9 and Schedule). (b) The National Health Service (Isle of Man) (General Dental, Supplementary Ophthalmic Services, and Pharmaceutical Services) Regulations, 1952. (Regulation 3 and Schedule). (c) The National Health Service (Isle of Man) (General Dental Ser- vices and Fees) Amendment Regulations, 195o. (Regulation 3 (4) ). (d) The National Health Service (Isle of Man) (General Dental, Supplementary Ophthalmic Services, and Pharmaceutical Services) Regulations, 1952. (Regulation 4 and Schedule). (Regulations 22 and 23). 13 (f) The National Health Service (Isle of Man) (Hospital Charges for Drugs and Appliances) Regulations, 1952. (Regulations 3, 4, 6, 7 and Schedule). (g) The National Health Service (Isle of Man) (Charges for Special Appliances) Regulations, 1953. TEMPORARY DUTY ALLOWANCE 20. (1) A member of the police force of or below the rank of inspector who is required to perform the duties of another member of the force holding a higher rank than his own— (a) if the member whose duties he is performing is unable, for a continuous period of seven or more days to perform those duties, by reason of the absence of himself or any other member on account of injury or illness, (b) if the member whose duties he is performing is unable, for a continuous period consisting of two or more days, to perform those duties for any other reason, other than by reason of the absence of himself, or any other member on annual leave, or on a public holiday, or on a weekly rest day or additional rest day within the meaning of Article 2 of this Determination or for time off granted under paragraph (4) of that Article. shall be granted, in respect of the whole of the period during which he is performing those duties, an allowance in addition to his pay equal to the difference between his rate of pay and the lowest rate of pay for the higher rank. (2) For the purposes of this Article a period of duty shall be deemed to be continuous if it would be continuous but for the inability of the member to perform the duties by reason of his absence on a public holiday, or on a weekly rest day or additional rest day within the meaning of Article 2 of this Determination, or on time off granted under paragraph (4) of that Article, or on time off granted under paragraph (t) of Article I of this Determination. (3) In this Article the expression " day" means, in relation to a member of the police force, his normal daily period of duty. (4) This Article shall not apply to the per- forming the duties of Chief Constable. ALLOWANCE FOR RECURRING ESCORT DUTY, ETC. 21. An allowance may be paid, of such amount and under such conditions as may be approved by the Board on the recommendation of the Chief Constable, in respect of recurring escort duty or other specific duties involving recurring retention on duty beyond the normal period and not covered by any other payment. PRIVATE EMPLOYMENT OF POLICE 22. A member of the police force employed at the expense of a private person or persons shall be entitled to such payments as are provided in this Determination by way of subsistence or lodging allowance or refresh- ment allowance or as payment in respect of overtime, but shall not receive any special allowance in consideration of the purpose for which he is employed. All payments so due shall be made by the Board and recovered from the person or persons for whose benefit the constable is employed. 14 'CONTINUANCE OF ALLCIWANCES WHEN MEMBER ILL 23. If a member of the polite force who is regularly in receipt of a plain clothes allowance, detective duty allowance, detective expenses allowance or any allowance to meet an expense which ceases during his absence from duty is placed upon the sick list, the allowance shall be payable during his absence from duty up to a period of one month, but thereafter, during the remainder of his absence from duty, payment may be suspended at the discretion of the Chief --'onstable. Provided that a boot allowance shall not cease to be payable while the member is on the sick list.

PROMOTION EXAMINATION ALLOWANCE 24. (T) A constable who on or after the first day of January, 1961, has taken or takes an examination or paper in consequence of which he has obtained or obtains a pass in the qualifying examinations held under the Isle of Man Police (Promotion) Regulations, 1957, for promotion from constable to sergeant shall be paid a constable's promotion examination allowance of L30 unless he has previously obtained a pass, or been deemed to have obtained a pass, it the qualifying examinations held under the Isle of Man Police (Promo ion) Regulations, 1957, for promotion from constable to sergeant or has, while serving in the police force service in which may be reckonable as pensionable service for the purpose of the Isle of Man Police Pensions Regulations, 1956, received a payment for passing the examination which qualifies him for promotion from the rank of constable to that of sergeant in that police force. (2) A sergeant who on or after the first day of January, 1961, has taken or takes an examination or paper in consequence of which he has obtained or obtains a pass in the qualifying examinations held under the Isle of Man Police (Promotion) Regulations, 1957, for promotion from sergeant to inspector shall be paid a sergeant's promotion examination allowance of £30 unless he has previously obtained a pass, or been deemed to have obtained a pass, the qualifying examinations held under the Isle of Man Police (Promotion) Regulations, 1957, for promotion from sergeant to inspector or has, while serving in a police force service in which may be reckonable as pensionable service for the purpose of the Isle of Man Police Pensions Regulations, 1956, received a payment for passing the examination which qualifies him for promotion to the next rank above sergeant in that police force.

CHIEF CONSTABLE'S TRAVELLING ALLOWANCE 25. The Chief Constable shall receive an allowance for the use of his private car for police purposes of such amount as may be fixed by the Board.

SICK LEAVE

DEDUCTIONS FROM PAY OF SICKNESS OR INJURY BENEFITS z6. (a) Subject to the provisions of paragraph (b) hereof, there shall be deducted from the pay of a member of the police force the amount of any sickness benefit under the National Insurance (Isle of Man) Act, (948, to which he may be entitled, or injury benefit under the National Insurance (Industrial Injuries) Act, 1948, to which he may be entitled. 15 (b) To avoid as far as possible the work of adjusting sick pay and the need to claim benefit for each absence, officers who give the undertaking set out below may receive sick pay without abate- ment, within the limits of their normal entitlement. The form of the undertaking is as follows :— (i) I wish to take advantage of the arrangement to draw un- abated sick pay as an alternative to drawing separately national insurance benefit and sick pay abated by the amount of that benefit for so long as I may be eligible for sick leave on full pay. (ii) I wish to be given reasonable notice of the date on which I shall cease to be eligible for sick leave on full pay. (iii) I undertake to inform the Government Treasurer promptly if, notwithstanding this application, I should draw any sick- ness or injury benefit under the National Insurance Acts. I also authorise the Isle of Man Board of Social Services to furnish the Government Treasurer, on request, with par- ticulars of any sickness or injury benefit drawn by me. (iv) I understand that it will be open to me at any time to give notice that I no longer wish to draw unabated sick pay but to adopt the alternative of drawing national insurance benefit and sick pay abated by the amount of that benefit. I also understand that if I give such notice the authority given to the Isle of Man Board of Social Services in paragraph (iii) will not apply to any claim for benefit, etc., that I may later make.

SPECIAL CONSTABULARY

27. (1) There may be paid to special constables sums by way of— (a) reimbursement of out of pocket expenses necessarily incurred in the execution of duty or an allowance in lieu thereof, (b) an allowance in consideration of wages lost by a special constable while required for duty or during a period of temporary in- capacitation for following his ordinary employment by infirmity of mind or body occasioned by an injuiry received in the execution of his duty without his own default or by illness contracted in the execution of his duty without his own default, and (c) allowances in respect of such other matters as the Board and the Finance Board may approve: Provided that any allowance so paid shall be of such amount and subject to such conditions as the Board may from time to time approve. (2) Except as expressly provided in this paragraph a special constable shall not be entitled to any remuneration in respect of his services as such.

28. Any allowance or other grant for which a special constable may be eligible under the preceding paragraph of this Order may be withheld by the Chief Constable in any case where he is not satisfied that the special constable is well conducted and efficient in the discharge of his duties. 16 POLICE CADETS PAY 29. A police cadet shall be paid weekly in accordance with the scale set out in Schedule 2 hereto or such Schedule as amended or revised from time to time by the Board with the approval of the Finance Board. ALLOWANCES 3o. A police cadet shall be paid the same refreshment, subsistence, lodging and travelling allowances as are prescribed for constables by Article 17 hereof. DEFINITIONS, SHORT TITLE AND COMMENCEMENT DEFINITIONS 31. (i) In this Determination, unless the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them, that is to say— the expression " pensionable service " means pensionable service for the purposes of the Isle of Man Police Pensions Regulations 1949, or any regulations amending or replacing those Regulations ; the expression " public holiday " means Christmas Day, Good Friday and Bank Holidays ; the expression " the police force " means the Isle of Man Con- stabulary ; the expression " Chief Constable " includes the Deputy Chief Con- stable and also any Inspector of police carrying out any duties under this Determination deputed to him by the Chief Constable or Deputy Chief Constable ; the expression " Board " means the Isle of Man Police Board ; Other expressions shall have the same meanings as in the Isle of Man Police Regulations, 1953. (2) For the purposes of this Determination service in the police force from which a member of a police force is or has been transferred, and service in the police force to which he is or has been so transferred shall be treated as if it were service in the same police force. (3) The Interpretation Act, 1949, shall apply to the interpretation of this Determination as it applies to the interpretation of an Act of Tynwald. (4) Reference in this Determination to any enactment shall be taken as referring to that enactment as amended from time to time by any other enactment. TITLE AND COMMENCEMENT 32. This Determination may be cited as the Isle of Man Police Pay and Allowances Determination, 1963, and shall come into operation on the same being approved by Tynwald. In addition a supplementary payment shall be made to a member of the force for acting as Deputy Chief Constable of £115 per annum with effect from 1st September, 1962, and £120 per annum with effect from ist February, 1963. In addition a constable shall be paid a supplementary payment of £30 a year on the completion of seventeen years' service and a second supplementary payment of £35 a year on the completion of twenty-two years' service ; and Article 4 (2) of this Determination shall apply for the purpose of calculating such service as aforesaid.

Cadets holding the General Certificate of Education in English, Mathematics or Science and one other paper at ordinary level, or the Entrance Examination of the Local Government Examinations Board will be placed on appointment one point higher on the scale. In such cases the salary at the age of 18 years will be £375 with effect from 1st August, 1963, £385 with effect from 1st August, 1964, £405 with effect from 1st August, 1965.

EXPLANATORY NOTE (This Note is not part of the Determination but is intended to indicate its general purport) Pay and allowances for the have been contained in Regulations made by the Governor and approved by Tynwald. With the coming into force of the Police (Isle of Man) Act, 1962, these provisions no longer have effect and it is necessary for provision to be made by the Police Board in terms of the Act. This Determination makes that provision. In appropriate places, " Board " has been substituted for " Governor " and " Finance Board " for " Tynwald " and other suitable adapations have been made. The scales of pay set out in Schedule 1 for the grades of Superinten- dent and below are those now operative. A 31% increase in Chief Constables' salaries in Great Britain with effect from 1st September, 1962, has not previously been considered by Tynwald and the revised scale has been included. Cadets have been paid on a N.A.L.G.O. scale and as that scale has been revised with effect from 1st August, 1963, the revised scale has been included in Schedule 2. Cadets have also been made eligible for the same subsistence and travelling allowances as are constables.
