Judicial Statistics of Pakistan 2009 Judicial Statistics of Pakistan 2009 National Judicial (Policy Making) Committee Published by the Secretariat of Law & Justice Commission of Pakistan, Supreme Court Building, Islamabad. www.ljcp.gov.pk Foreword With great pleasure I present the Annual Report for the year 2009 on Judicial Statistics of Pakistan which contains judicial data of the superior courts, namely the Supreme Court of Pakistan, Federal Shariat Court, 4 Provincial High Courts and the District Courts. The importance of this Report has increased many folds especially after the implementation of the National Judicial Policy‐2009 for enabling the people to know how the courts in the country are striving to provide expeditious justice to the public. It will also enable the Courts to ensure transparency and accountability within the justice system. It is towards this goal that the present Report has been prepared by the Secretariat of the Law & Justice Commission of Pakistan, as mandated by the National Judicial (Policy Making) Committee. It provides detailed information about the judicial system, sanctioned strength of the judicial as well as administrative staff and annual budget of courts. The Report is going to be published with some delay, due to time consumed in collecting detailed judicial data from various courts. It is hoped that the data provided in the Report will be useful for the judiciary to make plans for addressing the problem of backlog and gradual increase in litigation. It can also be utilized by researchers, judges and lawyers for the analysis of the performance of the courts and for proposing solutions to problems faced by the judicial system of Pakistan. The Secretariat of LJCP will make sure that the Report reaches the libraries of public/private sector, institutions, justice system related agencies, law schools and libraries of the courts and the Bar Councils/Associations for their valuable comments & suggestions. Special issue of the CJEI Report (February, 2008) ustice Iftikhar Muhammad Chaudhry, the twentieth Chief Justice of Pakistan was suspended by President General Musharaff in March last year leading to a worldwide uproar against this act. However, by a landmark order J handed down by the Supreme Court of Pakistan, Justice Chaudhry was reinstated. We at the CJEI were delighted and hoped that this would put an end to the ugly confrontation between the judiciary and the executive. However our happiness was short lived. On November 3, 2007, President General Musharaff suspended the constitution and declared a state of emergency. Soon the Pakistan army entered the Supreme Court premises removing Justice Chaudhry and other judges. The Constitution was also suspended and was replaced with a “Provisional Constitutional Order” enabling the Executive to sack Chief Justice Chaudhry, and other judges who refused to swear allegiance to this extra­constitutional order. Ever since then, the judiciary in Pakistan has been plunged into turmoil and Justice Chaudhry along with dozens of other Justices has been held incommunicado in their homes. Any onslaught on judicial independence is a matter of grave concern to all more so to the legal and judicial fraternity in countries that are wedded to the rule of law. In the absence of an independent judiciary, human rights and constitutional guarantees become meaningless; the situation capable of jeopardising even the long term developmental goals of a country. As observed by Viscount Bryce, “If the lamp of justice goes out in darkness, how great is the darkness.” This is really true of Pakistan which is presently going through testing times.

    Journal of International Criminal Justice Research Volume 1 – July, 2014 Judicial activism in Pakistan in commercial and constitutional matters: Let justice be done though the heavens fall1 Muhammad Raheem Awan University of Bedfordshire, United Kingdom ABSTRACT Pakistan has been experiencing unprecedented wave of judicial activism since 2006. The expansion within constitutional fundamental rights has broadened the scope of public interest litigation “PIL” in almost every sphere of life. Frequent exercise of judicial powers by the Supreme Court of Pakistan “SCP” more specifically “SuoMoto” (action on court’s own motion) jurisdiction2 is seen to be over taking all kind of matters e.g. political, social, economic and foreign direct investment “FDI”. The Apex Court of the country has handed down several judgments under suo moto jurisdiction within the last one decade on matters ranging from insignificant issues such as: prices of daily commodities such as sugar, oil, gas as well as crimes’ investigation to the disqualification of Prime Minister. Moreover the SCP annulled the constitutional amendments, statutory provisions and commercial deals involving billions of dollars FDI. Proceedings and verdicts in such cases would have their long-lasting implications within certain areas of law for which these judgments are handed down. This paper’s prime focus examines the likely outcomes of judicial activism in the political and constitutional arena of Pakistan. Exercise of Suo Moto as a routine matter raises serious questions regarding its constitutionality, effectiveness, desirability as well as sanctity of treaties and agreements executed by successive Pakistani governments. In addressing these issues this paper examines the philosophy of judicial activism; its origin, scope of PIL in expansion of fundamental rights, Suo Moto and other constitutional powers of the SCP.
