Bakgrunn: I stortingsmelding 7 (2010 – 2011) ”Kampen mot organisert kriminalitet - en felles innsats”, beskrives bekjempelse av MC – kriminalitet som en sentral del av innsatsen mot organisert kriminalitet i Norge. Politidirektoratet har i sin rapport ” Politiets bekjempelse av kriminelle MC-gjenger i perioden 2011 til 2015” gitt bakgrunnsmateriale og strategiske føringer for hvordan dette arbeidet skal videreføres. Våren 2011 var det en KS-samling i København med deltakelse fra politisk nivå og administrasjonen fra de største byene i Norge. Hensikten med møtet var å informere om 1 % - klubbene 1 i Norge og få kjennskap til hvordan man jobber med problemstillingen i Danmark. Den 12. april 2011 vedtok formannskapet i Trondheim at rådmann skal iverksette et ”arbeid med felles strategi for bekjempelse av kriminell virksomhet knyttet til 1 % - klubbenes virksomhet og rekruttering til disse miljøene.” Denne strategiplanen vil kort beskrive hvilke strategier som kommunen vil benytte for å nå målene: Bekjempe nyetableringer av 1 % MC-klubber i regionen. Bekjempe kriminell virksomhet knyttet til 1 % klubbenes virksomhet. Bekjempe rekruttering til disse miljøene. I Trondheimsregionen er det hovedsakelig fire MC – klubber som er definert som kriminelle. Disse klubbene anser seg som et brorskap, og mange av medlemmene er straffet. 1 1 % MC klubber. 1 % begrepet sies å ha blitt innført etter et motorsykkeltreff i California i 1947 hvor det fant sted en del ulovligheter. Den amerikanske motorsykkelforeningen (American Motorcyclist Association – AMA ), som arrangerte motorsykkeltreffet, skal ha uttalt at problemene ble forårsaket av den ene prosenten avvikere som sverter publikums syn på motorsykler og motorsyklister.

Appellants Robert Lee Norman, Russell J. Schoenauer, and Pelayo Jose Cuervo were convicted of numerous narcotics and firearms offenses, many of which related to what the government alleged to be a conspiracy to distribute controlled substances that lasted from 1978 through 2001. Norman, Schoenauer, and Cuervo appeal their conspiracy-related convictions, and Norman and Schoenauer appeal their resulting sentences. Schoenauer further appeals the forfeiture of his property, and the firearms convictions that were unrelated to the conspiracy. The government cross-appeals the district court’s1 two-level downward sentencing departure for Schoenauer. We affirm. PROCEDURAL BACKGROUND On March 28, 2001, a grand jury returned a multiple count indictment charging the defendants and others with various narcotics and firearms offenses. The government filed several superseding indictments, culminating in a fourth superseding indictment filed on December 19, 2001.
