First, we appreciate the difficulties of marketing the pub in such a tough economic climate and realise the vendors must be faced with many challenges at this time. We maintain we are willing to work with the vendors to achieve the common aim of retaining the pub as a community asset. The aims of the LACPL are to have an open pub with additional services that meet the needs of the community, and to work with supporters and other potential buyers (whose aims are aligned with our group), to achieve this goal. We understand that Allerdale’s relevant test for this application is “whether every effort has been undertaken to endeavour to retain the community asset before assessing any alternative land use”, and that “the main focus of this issue relates to the supporting valuation and marketing evidence.” We note that three offers have been made for the pub and are aware of a number of viewings. We believe the existence of one or more serious buyers and one or more valid offers meets Allerdale’s criteria to retain the community asset; and the vendors failure to consider ‘every effort’ and ‘endeavour to retain the community asset’ means the application for change of use cannot be accepted.

INTRODUCTION 1.1 These are the Site Allocations Policies that Cumbria County Council has submitted to the Secretary of State for consideration, together with the Proposals Maps. The policies identify the sites and the areas of land that the County Council considers are needed for working and for safeguarding minerals and for managing wastes over the period to 2020, within Cumbria outside the two National Parks. 1.2 Because of the amount of information that has to be shown on the Proposals Map, it is in four parts. These maps show the Mineral Consultation Areas, Mineral Safeguarding Areas; areas that have been designated for their international, national and local environmental interests, consultation zones for airfields, military and Technical Sites and areas that are shown on the Environment Agency Flood Maps as being at risk from flooding.
