« État sommaire des versements faits aux Archives nationales par les ministères… » (version de 1962) F/12 COMMERCE ET INDUSTRIE Cette subdivision comprend, actuellement [en 1935], plus de 6 000 articles. On y trouve des documents de la fin du XVIIe siècle ; les plus récents sont des premières années du XXe siècle. I LES BUREAUX Au XVIIIe siècle, les affaires de commerce étaient dispersées entre plusieurs départements ministériels. Au sommet, le Conseil royal de Commerce, “décor plutôt que rouage de gouvernement”, réuni d'abord au Conseil des Finances (1787), puis, le 9 août 1789, au Conseil d'État. Au département de la Marine étaient rattachés le commerce extérieur et maritime, les consulats; le Contrôle général des Finances avait la balance du commerce, les douanes de la Corse, les droits de marque; les provinces du royaume étaient réparties, au point de vue du commerce intérieur, entre quatre intendants de commerce. Au Conseil d'État était rattaché le Bureau du Commerce, créé en 1700. Les manufactures étaient de la compétence du Conseil royal de Commerce, du Bureau du Commerce, du Contrôle général. Il y avait un corps spécialisé d'inspecteurs des manufactures. De juin 1787 à février 1788, le Bureau du Commerce fut réorganisé, l'inspection des manufactures fut remaniée, les intendants de commerce réduits à une unité : Tolozan devint ainsi une sorte de directeur du commerce. Créé le 7 août 1790, le ministère de l'Intérieur fut organisé d'avril à septembre 1791. Il eut dans ses attributions les affaires commerciales et industrielles (6e puis 5e division); les douanes furent données au ministère des Contributions et revenus publics [Finances]. Pendant le régime des Commissions exécutives (12 germinal an II-10 vendémiaire an IV), le commerce et l'industrie furent du ressort des Commissions suivantes : Commission du commerce et approvisionnements, avec ses Agences du commerce extérieur et du commerce intérieur et du maximum – les manufactures comprises -; Commission des revenus nationaux, pour les douanes; – Commission de la Marine, pour les ports de commerce et l'embargo ; – Commission des Relations extérieures, pour les consulats, – Commission d'Agriculture et des arts, pour les manufactures; – Commission d'Instruction publique, pour les inventions et découvertes; – Commission des Armes et poudres, pour les mines. Le 10 vendémiaire an IV, les ministères sont réorganisés : à l'Intérieur reviennent le commerce et l'industrie ; aux Finances, les douanes ; à la Marine, les ports ; aux Relations extérieures, les consulats ; à la Police générale, les poids et mesures et les halles. et marchés (1). (1) Je résume ici très brièvement les indications que j'ai données dans le Bulletin de la Commission des documents économiques de la Révolution, année 1909 (recueil sur la législation de l'industrie de 1788 à l'an XI) et année 1912 (recueil sur la législation du commerce, de 1788 à l'an XI). Par décret du 22 juin 1811, un ministère des Manufactures et du Commerce fut créé ; il ne fut pourvu d'un titulaire que le 16 janvier 1812 ; Collin de Sussy qui, depuis plusieurs années, avait dans ses mains la direction du commerce de l'Empire, fut le premier titulaire du nouveau ministère dont le décret du 19 janvier 1812 énumérait les attributions essentielles : direction et administration du commerce et des manufactures, surveillance et administration des douanes, surveillance des approvisionnements de l'Empire, correspondance avec les consuls, Conseil des prises (2). (2) A noter que le décret créant le ministère (du 22 juin 1811) ne fut publié au Bulletin des Lois qu'en janvier 1812, en même temps que celui du 16 nommant le premier titulaire et celui du 19 énumérant les attributions. – Le Bureau des poids et mesures restait au ministère de l'Intérieur. A la première Restauration, le ministère fut supprimé et les manufactures et le commerce furent attribués au département de l'Intérieur par arrêté du Gouvernement provisoire en date du 5 avril ; le 16 mai, une ordonnance royale créait une direction générale de l'agriculture, du commerce et des manufactures, qui était confiée à Becquey. Lors de la formation du ministère Martignac (4 janvier 1828), le comte de Saint-Cricq, ancien directeur général des douanes, fut nommé ministre-secrétaire d'État, président du Conseil supérieur du commerce et des colonies. Le 20 janvier une ordonnance royale rétablit en sa faveur le ministère du Commerce et des Manufactures. Dans le ministère du 8 août 1829 (ministère Polignac), ce département ministériel fut supprimé et l'on rattacha au ministère de l'Intérieur les services du commerce qui en avaient été distraits en même temps que l'on reconstituait, sous l'autorité du ministre des Finances, le Bureau de Commerce tel qu'il existait avant le 4 janvier 1828. Le 13 mars 1831, Casimir Périer, qui prend la Présidence du Conseil, crée un ministère du Commerce et des 1 « État sommaire des versements faits aux Archives nationales par les ministères… » (version de 1962) Travaux publics qu'il confie au comte d'Argout. Après 1831, voici la série des transformations du ministère : le 6 avril 1834, les Travaux publics sont rendus à l'Intérieur ; le 22 février 1836, les Travaux publics reviennent au Commerce, avec les Mines ; le 19 septembre 1836, le ministère devient le ministère des Travaux publics, de l'Agriculture et du Commerce ; le 12 mai 1839, il perd les Travaux publics ; le 25 janvier 1852, le ministère est supprimé et l'Intérieur devient ministère de l'Intérieur, de l'Agriculture et du Commerce : le 23 juin 1853, on crée à nouveau un ministère de l'Agriculture, du Commerce et des Travaux publics ; peu à peu il est démembré : le 17 juillet 1869, par la création d'un ministère des Travaux publics(1) ; le 14 novembre 1881, par la création d'un ministère de l'Agriculture. Le ministère du Commerce lui- même est augmenté des Colonies du 14 novembre 1881 au 30 janvier 1882 ; il s'appelle ministère du Commerce et de l'industrie du 7 janvier 1886 au 14 mars 1906(2) ; son titre est : ministère du Commerce, de l'Industrie et du Travail du 14 mars au 25 octobre 1906 ; à cette date on crée un département spécial du Travail et de la Prévoyance sociale. (1) Il y en avait eu un déjà, en 1830 (19 mai); il ne dura que quelques semaines. (2) Avec les colonies du 14 mars 1889 au 6 décembre 1892, et du 11 janvier 1893 au 20 mars 1894. II. LES ARCHIVES Jusqu'à leur groupement au ministère de l'Intérieur, les papiers du commerce et de l'industrie avaient été épars comme étaient dispersés les services et bureaux qui les produisaient. Au XVIIIe siècle, on signalait deux dépôts de papiers relatifs à l'administration du commerce : le plus ancien était celui du Conseil devenu le Bureau du Commerce ; on y conservait aussi les papiers de M. de Lavigne qui, au début du XVIIIe siècle, s'occupait d'affaires du commerce(3) ; l'autre, créé en 1726 par M. Fagon, continué par Rouillé son successeur en 1744, puis par les deux Trudaine : il était plus considérable que le précédent et l'on y trouvait des traités de commerce, des mémoires sur le commerce, des papiers de l'administration du commerce et de la Ferme générale, des dossiers relatifs aux inspecteurs et aux députés du commerce, des comptes de la caisse du demi pour cent, des dossiers relatifs aux privilèges des manufactures(4). Dès 1777, Necker avait projeté la création d'un dépôt général des Archives du Commerce qui aurait été ouvert au public. Nous ne savons pas dans quelle mesure il avait réalisé son idée ou si même il en avait commencé la réalisation. Avant la Révolution, Dupont de Nemours était chargé de la direction d'un dépôt des lois commerciales étrangères et des tarifs étrangers. Où était ce dépôt dont on sait seulement qu'il était placé dans les attributions de trois ministres, celui des Affaires étrangères, celui de la Marine, celui des Finances et qu'il fut, en 1791, rattaché au ministère de l'Intérieur ? Archives du Bureau du Commerce, Archives des Trudaine furent, peu à peu, à partir de 1791, réunies – du moins en théorie – au ministère de l'Intérieur. Le 7 mars 1793, un décret de la Convention prescrivait aux agents de l'ancien Gouvernement de remettre, sous quinzaine, aux ministres compétents les documents de leurs anciennes fonctions. Abeille, ancien secrétaire du Bureau du Commerce supprimé, se déclarait prêt à faire la remise des papiers dont il avait encore la garde. C'est le citoyen Vallée, ancien archiviste de ce même bureau, qui, devenu secrétaire du nouveau Bureau de Commerce créé par le Comité de Salut public, reprit l'idée de Necker. Il obtint, du Comité de Salut public, la création, par arrêté du 14 germinal an III, d'un dépôt d'archives commerciales dont il devait être le conservateur : ce dépôt devait être ouvert au public (1). Il fut créé, il fut utilisé et nous savons que l'éditeur Panckoucke, par exemple, y travailla. Plus tard, ce dépôt fut rattaché à l'Intérieur, après la suppression des Commissions exécutives (décret du 13 brumaire an IV); on y réunit, dans un hôtel de la rue Neuve-des-Capucines (au n° 172), les 3 000 cartons du Comité de Commerce, de la section de commerce du Comité de Salut public, ceux de l'agence du Maximum, ceux de l'agence des Matières générales, ceux de la Commission [exécutive] d'agriculture et des arts (2).
