NEW BUSINESS a) Student Safety Issues Report from Campbellton Elementary School was received regarding the safety of students walking to and from school. Darren will respond with a letter to the PAC's explaining transit options for the students in the Woodburn and Petersen areas.

b) 7:15 Quadra Island Ferry Connection - Dave Burns Dave explained the request for a bus to meet the Quadra Ferry at 7:15 and the work that had been done to try to find options to accommodate this. MOTION(R.R/OP) "The Committee supports the implementation of a test period for using one of the current Elk Falls Mill buses at 7:15 am to service the Quadra Island Ferry along Dogwood to the Timberline / North Island College campus until the end of January." Dear Mr. Matthews, Mayor and Council:

This letter is pursuant to our letter of November 4, 2002 requesting seed funding for the 2003 Haig-Brown Festival. Consideration of our letter was deferred at your November 12, 2002 meeting for future budget considerations.

However, there is some urgency, as we need to produce an initial stock of brochures that Tourism NCI can take to Fishing & Adventure Trade and Consumer shows starting in January. That requires us to go to a printer in early December and we currently have no funds in place. This is an initial portion of our marketing and festival budge that we hope to "lever" at least four times by corporate sponsorship, that our fundraising committee is currently strategizing.

Can this please be considered at Council's earliest convenience?

Campbell River's first Haig-Brown Festival, held last spring, was a great success. It raised the profile of one of our most famous citizens, showcased Campbell River's cultural and tourist attractions and brought hundreds of new visitors to our area.

This year, the Festival will be held on September 27 and 28, 2003. Although the Festival is several months away. we need to quickly prepare brochures to meet some of the approaching deadlines for tourism publicity and sports fishing shows. A contribution of $3,000 from the District of Campbell River would make a hugc difference in our ability to broaden awareness of the Festival. Other costs associated with the event are covered by the participating organizations, donations and volunteers.

Establishing the Haig-Brown Festival as an annual destination event is an important part of the diversification of our local economy. Representatives of our committee would be pleased to meet with you to provide more details about this year's Festival. We look forward to your support.

B) HOUSEKEEPING/INFORMATIONAL ITEMS

1)Habitat Restoration Projects - Jim VanTine noted that the planting within the Raven Channel extension is now complete.

2) Estuary Management Commission Membership - It was noted that three Commission member's terms would expire at the end of 2002. Estuary Management Commission Meeting Minutes - November 19th, 2002 Page 2 of 3

3) Sewage Pump Station #2 Upgrade - Ron Neufeld advised that Stantec Consulting has been hired by the District to complete detailed design of the upgrade to existing Sewage Pump Station #2. The project is scheduled for tender in early 2003 with construction expected to be completed within 2003.

4) Campbell River South Bank Stabilization - Ron Neufeld advised that the District has hired Kerr Wood Leidel to complete the detailed design for the bank stabilization of the south bank of the Campbell River (upstream of Maple Street). Detailed design is scheduled to be complete by the end of March. Construction is dependent on provincial funding under the Flood Protection Program.

5) Integrated Stormwater Management Plan - Ron Neufeld advised that the District has hired Urban Systems to undertake an Integrated Stormwater Management Plan for the Holly Hills/Perkins Road area. An open house is scheduled for early December to provide information to affected/interested owners.

6) Ocean Blue Cedar Invitation - Ron Neufeld advised that he had received an invitation from Ocean Blue Cedar to view their business operations. Charlie Cornfield suggested that the Commission should, as part of its mandate, assist in the development of a relocation strategy for Ocean Blue Cedar. Ron Neufeld will refer Ocean Blue to the Commission Chair for a potential site visit.

7) Estuary Development Permit Guidelines - Charlie advised that Development Permit guidelines will be prepared for the estuary area. Russ Irish suggested that the District department responsible for the guidelines be invited to make a presentation to the Commission on the Development Permit process & schedule.

8) Unauthorized Access to Baikie Island - It was noted that District crews hadplaced some barriers in an effort to limit access, but that they had not been effective.

Recommendation: The Estuary Management Commission recommends that the 2002 Campbell River Estuary Management Commission Year-End Report be received by Council as information.

Background: The Commission last submitted a progress report dated December 18, 2001. This report covered the activities of the Commission in 2001. A copy is attached for reference.

Discussion: 1) Commission's Achievements/Activities: The Commission's mandate, as described by Council Bylaw, is in the following five areas: a) Industrial Relocation: Water-lot Leases - As with the majority of vacant water-lots within the estuary, recently vacated water-lots within Baikie Slough, previously used for industrial purposes, have been designated for fish and wildlife values to protect future uses.

b) Habitat Restoration and Rehabilitation: Baikie Island Inter-Tidal Benching - habitat restoration projects were completed as compensation for habitat damage elsewhere (Ken Forde Boat Ramp - Rotary Club, and Menzies Bay - Merril & Ring) Raven Channel Extension - The second phase of the Raven Channel, which now extends into Baikie Slough, was completed in 2002 (with the exception of some plantings which will be completed in the new year).

c) Monitoring and Enforcement: No issues arose in 2001.

d) Facilitating Local Management Plans: Memorandum of Understanding (MOU) - A three year MOU has been signed between the District of Campbell River, Fisheries and Oceans Canada and the Ministry of Water, Land and Air Protection. Estuary Park Management Plan (Baikie Island) - In cooperation with the Nature Conservancyof Canada, a Baseline Inventory Study has been completed as has a Management Plan for Baikie Island and the surrounding area. It is expected that these two documents will be registered on title prior to the end of the year as per the terms and conditions of the covenant registered on title. Qltr 0 2 1 aw3i. , 2.ooZ Date: November 19, 2002 Subject: Campbell River Estuary - 2002 Status Report ------Tyee Spit Parks Plan - A Long-Range Park Plan has been completed for the park portion of the Tyee Spit. Estuary Management Plan Update - As recommended in the original Estuary Management Plan, an update to the Plan has been completed to reflect current conditions while maintaining the long-term vision for the estuary area.

e) Reporting to Council: Throughout 2002, the Commission continued to provide recommendations for Council's consideration on all issues pertaining to the estuary. Council has, for the most part, accepted the Commission's views as consistent with the Estuary Management Plan and in the best interest of the community as a whole. Specific applications considered in 2002 included: E&B Helicopters Development Permit Campbell River South Bank Flood Protection proposal

2) Commission's Terms of Reference and Mandate: Commission Representation - Currently, the Commission is made up of 2 senior government representatives (1 from DFO and 1 from MWLAP), 1 First Nations representative, 2 industrial/commercial representatives, 2 representatives from the Campbell River recreational community and 4 citizens at large. 5 of these terms will expire at the end of this year and are currently being advertised. It should be noted that the updated Estuary Management Plan recommends additional representation from First Nations and from the tourism/commercial sector. Council should give this consideration when filling Commission vacancies for 2003. DCR staff participation - The Commission does not currently have formal staff representation other than what is provided through the Commission secretariat position. This position is an administrative support position and does not have any voting privileges. The Commission supports this position and agrees with the non-voting status of the position. The Commission's access to further staff expertise/information has been adequate. Public Accountability - The Commission's meetings are generally open to the public unless required to be in-camera as per the Local Government Act. The Commission recognizes that the estuary is a unique resource and feature that belongs to the entire community and as such the public has a right to be part of the decisions that may affect these lands. Accordingly, the Commission supports and encourages an open and accountable approach with respect to all issues pertaining to the estuary. In particular, the Commission encourages greater provision of information through utilization of the District's Web site and the provision of an annual public open house as recommended in the updated Estuary Management Plan.

3) Financial & Policy Implications of Commission: To date, the following represents an approximation of funds (from all sources) spent on restoration, enhancement, education and land acquisitions within the estuary (reference Estuary Management Plan Update - Appendix H attached): Pre-1997 - $590,000+/- impacting 5.20ha. 1997- $284,000+/- impacting 1.73ha. 1998- $465,500+/- impacting 1.45ha. 1999- $468,500+/- impacting 3.60ha. 2000- $1,800,000 impacting 18.50ha. 2001- $102,000+/- impacting 0.21ha. 2002- $211,800+/- impacting 1.05ha. This represents in excess of $3.9 million that has been spent on over 31 ha. of restoration, enhancement and land acquisitions within the estuary area. The District's annual budget in 2002 for administering the Commission was approximately $5,200. These funds were adequate for items such as administrative support (District staff time), courier costs, photocopy costs, printing costs, etc. It should be noted, however, that the Estuary Management Plan update recommends further administrative support including items such as Web-based information, Commission orientation/training and an annual public openhouse. It is questionable that these recommendations can be accomplished within the existing budget.

Conclusion: The Commission is extremely satisfied with the progress that has been made towards the long-term goals established in the 1996 Estuary Management Plan and is particularly pleased with the endorsement of the updated Plan that will serve to guide the Commission through the next several years.

As a whole, the Commission continues to function co-operatively, constructively and, for the most part, by consensus. The Commission remains committed to the well being of the estuary area and will continue to strive to implement the recommendations and objectives of the Estuary Management Plan.

Background:

It has been observed by Commission members as well as others that vehicles continue to gain access to Baikie Island causing damage to environmentally sensitive areas. The District is committed to protecting Baikie Island as outlined in the recently adopted Baikie Island Management Plan. District crews have apparently placed some barriers, however, to date it would appear that vehicular access is still being gained to Baikie Island. Accordingly, the Commission is recommending that a permanent keyed gate be installed to prevent vehicular access across the Baikie Island bridge.

Recommendation

That Planning Services be authorized to purchase a Hewlett Packard colourplotter,model HP Designjet 5500 (42 inch- Q1251A)at a cost of $10,350 and that the financial plan be amended accordingly.

Background / Discussion

An unusual situation has come up where the zoning bylaw amendment applications revenue will exceed budget expectations. This surplus can be partially attributed to an improvement in applications this year, but mainly to application fees held in a holding account and left unattended to by former planning services managers. These applications were previously dealt with, but the associated revenue was not previously brought into the revenue accounts. As a result, revenues for rezoning applications will exceed expected revenues by more than $15,000.00 for 2002.

Planning Services would like to request a financial plan amendment to use part of these funds to purchase a 42" colour plotter. At present, planning relies on use of the Engineering Services plotter. This plotter, however, can only handle up to 36" inch wide maps, is ten years old, and nearing the end of it's utility. Engineering Services is content to continue to rely on use of their older plotter for now, however, have stated they would find it beneficial if another newer plotter were available to serve as back-up for their needs.

Recent initiatives between planning services and other departments, has resulted in access to geographic information system (GIS) development at the District, in conjunction with the Regional District. Existing legal composites, streams, official community plan (OCP) and zoning bylaw mapping has been incorporated into the GIS mapping capabilities. Other initiatives are currently in process, including integrated storm water as well as watershed area mapping. Planning Staff believe that the GIS information and plotter will be invaluable to the process to review the OCP, and will be very active preparing maps for presentation purposes for public display, Council presentations, Committee review, etc. We also feel that revenues from map sales could also improve by providing a better product than previously available.

Staff have reviewed available plotters, which range in price from $7,772 for a 36" inch plotter, to $8,995 for a 42" inch model, to $16,295 for a 60" inch model, and feel the best combined value and utility is with the 42"inch model. With consideration of provincial and federal sales taxes on top, $10,350 is required.

Conclusion

If approved, the acquisition of the new plotter by Planning Services will serve many needs, not only within Planning Services, but will also be of assistance to other departments within the District that are participating in the GIS initiative. In this regard, it will also provide much needed "back-up" for the older

This is what I've found for plotters so far. From speaking with people and research, HP seems to be the manufacturer to go with.The deciding factor for which unit to choose is the print size. The current plotter is a 36 inch. A new 42 inch is not a significant increase in price over a new 36 inch, as you'll see below. Background

The Ministry of Forests wrote to the District of Campbell River informing the District that a Request for Proposals for operating and maintaining Forest Service Recreation Sites and Trails was being issued. Attached to the letter was a list of all the recreation sites and trails in the Campbell River area. Of all the sites and trails listed only one, the Beaver Lodge Lands, falls within the District's boundaries.

Discussion

While researching the possibility of operating and maintaining the Beaver Lodge Lands, the local Forestry Officials told the Parks and Recreation Manager that the Beaver Lodge Lands were no longer in the list of eligible sites and trails. Beaver Lodge Lands are no longer on the list of eligible sites because the Beaver Lodge Trust Lands Renewal Act governs the Beaver Lodge Lands. This act states that Forestry is responsible for the money required for the ongoing management of the Beaver Lodge lands. The Act also states that the land must be held in trust and managed by the Crown only for the purposes of experimental work in reforestation and forest management. Reports from the Regional District and the local Ministry of Forests Office indicate that the Regional District is likely to pursue the RFP for the Forestry Recreation Sites and Trails.

As a result of the preceding information, it is Staff's position that at this time the District not consider an RFP for operating and maintaining the Forestry Sites and Trails as outlined in the October 18,2002 letter from the Ministry of Forests. The Forest Service will be contacting the District to discuss the operation and management of the Beaver Lodge Lands.

In the next few weeks a Request For Proposals for operating and maintaining Forest Service Recreation Sites and Trails will be advertised throughout the Province. You have previously shown an interest in the recreation program and I am available to meet with you to explain the process, and answer any questions you might have.

Earlier this year, the Ministry of Forests announced it would be gradually phasing out its responsibility for maintaining Forest Service recreation sites and trails in order to focus on the ministry's core forest stewardship responsibilities. The ministry is currently seeking partners to take over the operations and maintenance of recreation sites and trails under formalized partnership agreements.

It is the intention of the Ministry of Forests to:

retain all recreation sites and trails in public ownership; keep open as many recreation sites and trails as possible; continue to provide safe, sanitary, socially acceptable and "environmentally sound rustic, public recreation opportunities; encourage volunteerism and local community involvement to help benefit local economies; build partnerships with non-government organizations, the forest industry, local governments and First Nations; use agreements to formalize the proposal; continue to honour effective agreements currently in place for operating recreation sites and trails; recognize groups and organizations that have made significant donations and/or volunteer contributions towards the development and/or maintenance of sites and'trails; and maintain the Ministry of Forests entrance sign at recreation sites and trails, while also promoting the identity of the partner organization.

The proposal call will close the week of December 2, 2002. Proposals will be evaluated and partnership agreements will be developed and finalized over the winter months.

Explanatory Note

The purpose of this Bill is to ratify and confirm previous dispositions by the Crown of certain lands in a parcel of lands known as the "Beaver Lodge lands" that where conveyed to the Crown in trust for the purposes of experimental work on reforestation and forest management.

The bill also permits further dealing with a portion those lands. All of the the remaining land, together with additional lands to be acquired by the Crown must be held in trust and managed by the Crown only for the purposes of experimental work in reforestation and forest management.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions

In this Act "Beaver Lodge lands" means lands conveyed to the Crown on February 25, 1931. by the Campbell River Land and Development Company Limited, all as described in Schedule 1; "core lands" means the Beaver Lodge lands less the developed lands; "developed lands" means the lands that have been disposed of, or are proposed to be dealt with, all as described in Schedule 2; "trust lands" means the core lands, and all other land in proximity to the core lands that is designated as trust lands by the Lieutenant Governor in Council under section 4 (2).

Purposesof this Act 2. The purposes of this Act are as follows:

a.to ratify and confirm previous dispositions of, and dealings with, portions of the Beaver Lodge lands by the Crown, the Lieutenant Governor in Council, b.) to confirm that the core lands will continue to be managed by the Crown for the purposes for which the Beaver Lodge lands were conveyed to the Crown; c.to permit the minister to dispose of the developed lands; d.to permit the acquisition of additional land and the designation of that land as trust lands.

Beaver Lodge Lands 3.

1.The trust under which the Beaver Lodge lands were transferred to the Crown is terminated in respect of the developed lands. 2.All previous dispositions of, and dealings with, the developed lands by the Crown, the Lieutenant Governor in Council, ministers of the Crown or public officers are ratified and 038 httn //www_ for_ gov.bc. ca/vancouvr/distriet/caml)bell/bi1152.htmI 11/07/2002 bILL 52 Page 3 of 5

confirmed. 3. The minister may, in accordance with the Land Act, dispose of the developed lands which are vested in the own on the day this Act comes into force, and dispose of the trust lands for the purpose of any road right of way that does not exceed 30 metres in width. 4. The minister must, before July 1, 1994, acquire as Crown land additional land in proximity to the core lands in order that the area of the trust lands is at least 502 hectares, and the additional Crown land must be designated as trust lands under section 4 (3). 5. No action, other than with respect to subsection (4), shall be brought or maintained in a court against the Crown, the Lieutenant Governor in Council, ministers of the Crown or public officers, and no compensation is payable to any person in relation to this section, for any consequence of this section or resulting from any past or future dispositions of or dealings with, the Beaver Lodge lands or the developed lands.

Trust lands 4.

1.The core lands are confirmed as trust lands. 2. The minister must, in respect of the trust lands, file a certificate with the registrar under the Land Title Act in accordance with the requirements of section 5 (3) to (5). 3. The Lieutenant Governor in Council must designate as trust lands all land acquired under section 3 (4). 4. The core lands and the land designated as trust lands under subsection (3) may be used only for experimental work in reforestation and forest management, and will be known as the "Beaver Lodge Forest Lands". 5.The Minister of Forests must, before July 1, 1994, establish a resource use plan for the trust lands and in establishing the plan must consult with the public.

Acquisition of land 5

1.For the purpose of acquiring land which may be designated as trust lands under section 4 (3), the minister, on behalf of the Crown and with the approval of the Lieutenant Governor in Council, may do any of the following: o (a) purchase or otherwise acquire land; o (b) transfer Crown land to any person in exchange for land which may be designated as trust lands; o expropriate land or property and, if expropriated, the Expropriation Act applies. 2. Appropriation

6. Money required for the ongoing management of the Beaver Lodge Forest Lands under section 4 (4) must be paid out of an appropriation of the Ministry of Forests.

PROVINCE ACTS TO RESOLVE BEAVER LODGE LANDS ISSUE

Land Exchanges To Expand Original Size of Trust

CAMPBELL RIVER-The province is negotiating a land exchange to restore and expand the size of the Beaver Lodge Lands trust in CampbellRiver, Environment,Lands and Parks Minister John Cashore and ComoxValleyMLA Margaret Lord announced today.

Legislation will be introduced to restore and expand the size of the trust and provide for limited development in an area proposed to be excluded from the trust lands.

This decision recognizes the importance of the trust to local residents, said Cashore. "Events have progressed beyond the point where restoration of the original lands in the trust is feasible. New legislation will ensure that the Beaver Lodge Lands will be protected by an Act of the Legislature. We have reviewed all legal, financial and environmental implications and have acted to maintain community stability and a respect for the environmental sensitivity of these lands, he added.

Lordsaid, "Thisis the best option since it preserves the environmental integrity of the area, particularly the critical habitat for a diverse range offishand wildlife."

North Island MLA Colin Gabelmann was present at the announcement and confirmed that as Attorney General, he will continue to monitor the resolution of the various issues and public interest concerns surrounding the Beaver Lodge Lands.

The province will seek to acquire privately-owned lands to expand the existing trust area and protect that area throughlegislation.

ProvinceActsTo Restore The Size Of Beaver Lodge Lands trust../2

Legislation will also allow limited development on land which will be excluded from the trust. Under the proposed legislation, the Dogwood Street extension will be permitted to proceed, providing a north-south arterial road to relieve traffic on the Island Highway. Residential development will be permitted on 32 hectares east of the Dogwood Street extension and Hilchey Road will be extended beyond Dogwood Street but only if viable alternatives cannot be found.

Sites have been identified within the Beaver Lodge Lands for a proposed joint high schoollcollege and McPhedran Elementary School. A review of land holdings in the Campbell River area was undertaken to identify alternate school sites outside the Beaver Lodge Lands. However, no suitable alternatives were found. The new trust area will be managed as the province's first experimental forest pr'-tected under legislation. "I strongly encourage the public to get involved in the development of a local resource use plan for the Beaver Lodge Lands, said Cashore.

The Beaver Lodge Lands were given to the province in 1931 for experimental work in reforestation and forest management. Since then, the land has been administered by the Ministry of Forests and has been available for hiking and other recreational activities. As there was no reference to the gift on the title for these lands, some of the property was set aside by the province for the District of Campbell River's expansion without knowledge of the gifting. The district had been pursuing plans to develop community housing, a new high school, an elementary school, commercial development and an expanded North Island College within the lands. In August 1992, a search of Ministry of Forests' archival files revealed the existence of the trust. The Ministry of Attorney General reviewed the issue and advised that a trust obligation was established and remains. Recommendations submitted by the Beaver Lodge Lands Task Group form the basis of the decision. That group was composed of representatives from the ministries of Environment, Lands and Parks; Forests; Education; Advanced Education; and Transportation and Highways. Legal advice was provided by the Ministry of Attorney General. Background

At the May 28, 2002 Council meeting, Council asked staff to pursue the B.C. Parks' Request for Information process for the Elk Falls Park. As a result, staff completed the RFI and the RFQ processes for B.C. Parks. The District received confirmation that they were qualified to proceed to the RFP.

Discussion

On September 23, 2002 B.C. Parks posted a draft RFP on their web site. This draft RFP presented proposed bundles of parks. The North Island Bundle includes 14 sites throughout the North Island, from the Courtenay area , on the Northern Gulf Islands and North of Sayward. One of those sites is Elk Falls Park. The Parks and Recreation Manager contacted B.C. Parks to ascertain if B.C. Parks would entertain proposals on individual parks. B.C. Parks' response has been that they expect applicants to make their proposal based on the bundles presented. The Parks and Recreation Manager has also asked B.C. Parks to ask if Elk Falls Park can be removed from the bundle. B.C. Parks has been non-committal. Mr. John Furney, of BC Parks has responded by saying that the bundles will be finalized by the time the RFP is issued. There has been no confirmation on a date for issuance of the RFP.

Elk Falls is near Campbell River and is an area well utilized by Campbell River residents. There would be merit in securing the operation of Elk Falls Park. However, it is Staff's position that operating all the B.C. Parks presented in the proposed bundle does not fall within the District of Campbell River's Parks and Recreation Department Mandate.

Conclusion

If Elk Falls Park is not pulled out of the North Island Bundle then the District should withdraw from the process.

I've made a little headway, but not as much as I would have liked. I'm going away for a week so thought I'd pass along what info I have so you can follow up on it while I'm away if you'd like. The Campbell River Forest District was responsible for planning for the Beaver Lodge Lands. The contact there used to be Ron Burrell (sp?). I don't know that he's there anymore though. The other person who could possibly have information is Rudi Mayser in the MSRM Coast Region office in . Rudi's number is 250-751-7130 and his e-mail address is [email protected]. He used to work in planning for the Vancouver Forest Region so would likely know something about planning for the Beaver Lodge Lands. Hope this helps. Does any of this help? I would like to see the plan. The District of Campbell River is looking into the possiblitiy of managing the Beaver Lodge Lands and I want to make sure we have the resources to do it properly and that we can uphold any previous agreement established for the area.

Recommendation

That Council approve a $3,000 budget amendment with funds coming from contingency for the purpose of conducting an acoustic assessment of the Community Centre Auditorium.

Backjround

When the Community Centre was being built Staff and the contractor made efforts to use materials that were known for their acoustic qualities. As a result, the auditorium has eight feet of wood panelling on the walls and the remaining wall is covered with acoustic carpet. Both products are known to be good sound absorbers and are used in many auditoriums to reduce the reverberation that often occurs in large auditoriums.

However, it was apparent after the first large gathering that there were some acoustical problems. At the Grand Opening it was quite difficult for the people in the back half of the gym to hear the speakers. Staff has tried rearranging the set-ups and purchased additional speakers. Both changes improved the situation for lecturers (provided they utilized our recommended set-up and paid for extra speakers) but these measures did not improve the situation for other types of event. The situation is at its worst when a band is playing in the auditorium.

Over the past two years the Parks and Recreation Department has received many complaints from groups regarding the acoustics. Some of those groups have chosen to rent other facilities for their events because of the acoustic problems they encountered at the Community Centre. Staff believe that the poor acoustics in the auditorium could have a negative impact on the use of the main hall for special events if not corrected.

Discussion

In an attempt to understand and rectify the problem the Parks and Recreation Manager has spoken to a wide variety of people who work with sound; a music technician, WCB worker with a background in sound and acoustics, a technician from the Tidemark and the owner of the Music Plant. There was no consensus on the cause of the problem or on a solution for the problem. Staff's position is that the District needs to hire a professional who can assess the situation, pinpoint the causes and suggest affective solutions. Maintenance Services sent out letter to acoustical contractors and received a proposal for $3,000 to do an acoustical assessment of the Community Centre.

Recommendation: That Council endorse the District's application for two-thirds funding under the Canada/BC Infrastructure Program for the Foreshore Sewer Project currently estimated at $4.0 million and that the District's Financial Plan be amended accordingly.

Background: Council has previously approved the detailed design of the Foreshore Sewer project to McElhanney Consulting Services and has included a pre-design allowance within the District's 5-year Financial Plan.

Discussion: This is the most significant capital project that the District will be undertaking in the immediate future and it has been identified as a good candidate for funding under the Canada/BC infrastructure Program. The District is currently completing the appropriate application for consideration in the next round of the funding program. In order to strengthen the District's application, a Council resolution that clearly supports the project is required.

Recommendation:

That the single-family dwelling sanitary sewer user fee be raised by $12.00 per annum to $210.00 per annum and that the balance of the sanitary sewer user fees be adjusted accordingly and that water user fees remain unchanged for 2003.

Background:

The Corporate Services Director provides to Council each year an updated five-year forecast on the operations of the water and sewer revenue funds. The update is provided by way of the attached schedules for each fund.

Discussion:

Waterworks Revenue Fund: Our current forecast for the Waterworks Revenue Fund (Schedule "A") indicates, under present assumptions that a user fee increase is not required for next year. However this forecast must be tempered by the fact we are b:_sing our projections on continuing operations of the waterworks system under current standards. With the demand to place more emphasis on management of our watershed and expected new regulations from the province with respect to waterworks systems itis not unreasonable to assume that sometime in the next five years water rates will have to be increased just to deal with these two issues. Then there is the issue of capital investment in upgrading the system and the renewal of an aging infrastructure all of which will make maintaining the current rate structure very difficult over the years ahead. Hopefully user fee increases for water can be delayed until the sanitary sewer revenue fund operations are fully funded by its users.

SanitarySewerRevenue Fund: The projected financial forecast of declining surplus for the Sanitary Sewer Revenue Fund (Schedule "B") is not new information to Council. The forecast clearly shows the continued urgent need for increased sewer user fees over the next five years. Council is reminded that the need for increased sewer user fees was projected right from the outset

071 of the expansion of the sewer system along with the construction of a new sanitary sewer treatment facility.In order for the present operation to be fully funded from annual revenues the single-family use fee will need to be $260.00 a year. These projections are based on our assumption that we will be able to obtain grant funding for major capital works through the Canada/BC Infrastructure program and thisis probably overly optomistic on our part.

Part of Council's debt management strategy is to try and not have debt charges for the water and sewer utilities to not exceed 50% of revenues. In the case of the sanitary sewer revenue fund our current projection shows debt charges going to approximately 55% of total revenue for 2003 and raising to just over 57% in 2004 before debt to revenue begins to decline. If our projections follow through as predicted Council could expect that the debt will be back within policy beginning in 2008.

Conclusion:

Nobody likes fee increases and it would be nice to be able to defer a rate increase in 2003 however to do so will only cause greater hardship in future years.

METERED USERS

Charges to be billed quarterly for use of the Sanitary Sewer System within the boundaries of the Municipality by those users whose premises have a water meter installed to measure the quantity of water delivered to their premises.

PUBLIC ICE ARENAS

A public ice arena shall be charged for use of the sanitary sewer system according to the quantity of water delivered to the premises which is actually discharged into the sanitary sewer as measured by a water meter as follows:

$1.70 per 100 cubic feet or part thereof computed to the nearest 5 cents with a minimum charge of $17.50 per month.

OTHER USERS

Persons whose premises have a water meter installed to measure the quantity of waterdelivered to their premises shall be charged for use of the sanitary sewer system according to the quantity of water delivered to their premises as measured by a water meter as follows:

Summary: PlanningServices Department is recommending to Council that it adopt the new Planning Procedures Bylaw. Furthermore, we recommend that Council waive the requirement for a Neighbourhood Public Meeting and the Public Hearing requirement for Bylaw 2991. This Bylaw is not directly related to specific land use issues and is not a site-specific application. In other words, staff feel that public input is not necessary for this bylaw since it only concerns "procedures" for applications, rather than changes in land use or density, which could impact on other property owners.

Discussion: The recommendations presented in this report will allow the Planning Services Department to implement the new Planning Procedures Bylaw in its entirety.

A Bylaw to define procedures under which an owner of land may apply for an amendment to the Official Community Plan or Zoning Bylaw or for the issue of a permit under Part 26 in the Local Government Act.

WHEREAS the District of Campbell River has adopted an Official Community Plan and Zoning Bylaw;

AND WHEREAS the District of Campbell River is required, in accordance with Section 895 of the Local Government Act, to establish procedures by bylaw to amend a plan, bylaw or issue a permit;

AND WHEREAS the District of Campbell River may by bylaw, impose application fees in accordance with the provisions of Section 931 of the Local Government Act and Section 15.1 of the Liquor Licensing Act;

NOW THEREFOREthe Council of the District of Campbell River, in openmeetingassembled,enacts asfollows:

1. This bylaw may be cited for all purposesas the District of Campbell River Planning Procedures Bylaw No. 2989, 2002.

2. This bylaw shall apply to the following:

(1) Amendments to:

(a)the Official Community Plan, and (b)the Zoning Bylaw.

(2) Issuance of:

(a)Development Variance Permits, (b) Development Permits, (c)Temporary Commercial and Industrial Use Permits, and (d)Applications to the Board of Variance.

Applications

3. (1) Applications for an amendment, a permit or to the Board of Variance shall be made by the owner(s) of the land involved or by a person(s) or company authorized in writing by the owner(s), to be referred to hereinafter as the applicant. (2) Applications for amendments, permits or to the Board of Variance shall be made to the Planning Services Department of the District of Campbell River on the applicable form. (3) In accordance with Section 920.1 of the Local Government Act the District may require development approval information regarding anticipated impact on such matters as:

a) transportation patterns including traffic flow, b) local infrastructure, c) public facilities including schools and parks, d) community services, and

e) the natural environment of the area affected. (4) All notification for Official Community Plan amendments, Zoning Bylaw amendments, and applications for a Development Variance Permit must be mailed or otherwise delivered to the owners and occupiers of all properties within a 100 metre radius of the lot lines of the land involved under an application. (5) In the case of applications to amend an Official Community Plan or a Zoning Bylaw the applicant is required to hold a Neighbourhood Public Meeting prior to presentation of the application to Council for 080 Bylaw No. 2989 Page 2 of 13 1S` and 2° reading. The applicant is required to present the minutes and results of the Neighbourhood Public Meeting to the Planning Services Department not less than one week prior to the presentation of the application and bylaw(s) to Council for 1s` and 2nd reading. 9 a) Neighbourhood Public Meeting is an"in-place" meeting held by the owner/applicant to discuss and answer any questions relating to the proposed development or project at a location that will be suitable to accommodate and provide information to all adjacent land owners within 100 metres of the limits of the subject land under consideration. (6) In the case of applications for a Development Variance Permit Council may require the applicant to hold a "Neighbourhood Public meeting" prior to the Planning Services Department sending out notification. When so required, the applicant must present the results of the Neighbourhood Public meeting to Council prior to consideration of approval. (7) In the case of applications to amend an Official Community Plan, a Zoning Bylaw, or applications for Temporary Commercial or Industrial Use Permits, the applicant shall be responsible for erecting a Development Proposal Sign to the specifications outlined in Schedule "C" attached herein, and forming part of this bylaw. (8) In the case of an application to amend a Zoning Bylaw, Council may waive requirements for holding of the public hearing in accordance with the provisions of Section 893 of the Local Government Act: a) where the proposed zoning amendment is in compliance with the applicable Official Community Plan policies; and b) no significant objections or issues as determined by Council were received at the Neighbourhood Public Meeting. (9) For approval of Development Permits, Council herein delegates approving authority in accordance with Section 920 of the Local Government Act to the Administrator on the advice of the Planning Services Manager (or alternate chosen by the Manager) and the Manager of Engineering Services (or alternate chosen by the Manager) to approve and issueall minorDevelopment Permit applications. Council will retain the approving authority of major Development Permit applications. a) Minor Development Permits - includesall multiple family residential applications containing less than 10 dwelling units in total, the subdivision of land, natural resource preservation, local convenience stores and commercial and industrial applications for less than 92.9 square metres (1000 square feet). b) Major Development Permits - includesall commercial and industrial development greater than 92.9 square metres (1000 square feet), all multiple family residential development for 10 or more dwelling units, development permits involving a variance, and all phased development applications where the total development is in excess of (a) above.

Development Application Fee

4. Upon the submission of application for a bylaw amendment, a permit, renewal of a permit, or to the Board of Variance, the applicant shall pay the District of Campbell River an application fee in the amount set out in Schedule `A' attached herein, and forming part of this bylaw. Any refunds applicable shall be made in accordance with Schedule `B' attached herein, and forming part of this bylaw.

Process

5. The District of Campbell River must in accordance with Section 895 of the Local Government Act, consider every application for: (a) an amendment to an Official Community Plan Bylaw, or Zoning Bylaw; or (b) the issue of a permit under Part 26 of the Local Government Act that requires a resolution of the District of Campbell River Council.

The following is a general outline of the process for each application type. The District otherwise reserves the right to defer a given application to require additional or alternate information.

(2) The Planner prepares information sheet and circulates for comments. (3) Application proceeds to the Committee of the Whole. (4) Application proceeds to Council for support or rejection. (5) Planning Services Department notifies applicant. (6) If supported, the complete application is forwarded to the Land Commission along with the fee made payable to the Minister of Finance & Corporate Relations. (7) Once the Land Commission has issued a resolution on the application they notify the owner/applicant and the District of Campbell River Planning Services Department.

ii) Board Of Variance (1)Complete application and fee submitted by the owner/applicant. (2)The Building Inspector prepares a report for the Municipal Clerk including: (a)Date of application (b)Appeal address (c)List of all adjacent land owners (Note: adjacent includes lots separated by roads and right of ways etc.) (d)Description of the zoning of the subject property under application (e)Description of appeal (i.e. variance requested) and applicable regulations (f)Signature of the Building Inspector

(3) Notification to adjacent property owners.

(4) Board of Variance hearing scheduled.

(5) Proposal presented to the Board of Variance.

(6) Verdict from the Board of Variance and the Building Inspector notifies the applicant.

iii) Development Permit (Minor) Complete application and fee submitted by the owner/applicant. The Planner prepares information sheet and circulates for comments. Application review by Planning Services and Engineering Services Departments. Approving Authority (Administrator) approves or rejects application. Planning Services notifies applicant. If approved, the Notice of Development Permit is registered at Land Titles.

(a) compliance with the Official Community Plan Policies; (b) as determined by Council, no significant objections or issues raised or received at the Neighbourhood Public meeting.

x) Subdivision (Fee Simple and Bare Land Strata) Applications (1) Complete application and fee submitted by the owner/applicant. (2) The Planner prepares information sheet and circulates for comments. (3) Where issues or concerns are raised, the District may require consultation to address those issues (i.e. across District departments, with commenting agencies, and with the applicants). (4) The Approving Officer, within sixty (60) days of receipt of the application, either rejects the application or issues a Preliminary Layout Approval (PLA) and sends it to the applicant. (5) Where a PLA has been issued, the applicant completes the outstanding required items outlined as part of the Preliminary Layout Approval, prior to requesting final approval. (6) All outstanding fees are to be paid to the District of Campbell River by the applicant at the time of request for final approval. (7) Reviewed by the Approving Authority and final approves the subdivision when all requirements r. and terms have been met. u (8) Planning Services Department notifies the applicant, and final approves the plan-for registration.

Amendments - Approval or Refusal

6. The District of Campbell River Council may, upon receipt of a report completed by the Planning Services Department proceed with an amendment bylaw or reject the application. Permits - Issuance or Refusal

7. The District of Campbell River may, upon receipt of a report completed by the Planning Services Department:

(a)authorize the issuance of the permit; (b)authorize the issuance of the proposed permit as amended by the District of Campbell River Council in its resolution; (c)refuse to authorize the issuance of the permit.

Refusal - Amendments and Permits

8. Where an application, amendment bylaw, or an amendment to a permit has been refused by the District of Campbell River Council or an Approving Authority at the District of Campbell River, the Planning Services Department shall notify the applicant in writing within fifteen (15) days immediately following the date of refusal, including any reasons for rejection, as well as any applicable refunds as outlined in Schedule "B".

Re-Application

9. Subject to Section 895 (3) of the Local Government Act, re-application for an amendment or permit that has been refused by Council or an Approving Authority at the District of Campbell River shall not be considered within a six (6) month period immediately following the date of refusal. The Planning Services Department will immediately consider and process a `new" application which is significantly different from an amendment or permit that has been refused by Council.

REFUNDABLE AMOUNTS

1. Development Fees that are refunded prior to the file/application circulation are eligible for the cost of the Development Fee less 10% for administration. 2.Development Fees that are refunded after circulation and prior to Planning Services Department report to Council for consideration are eligible for the cost of the Development Fee less 30% for administrative costs. 3. Development Proposal Sign Requirements

For Amendments to the Official Community Plan, Zoning Bylaw, and for Temporary Commercial and Industrial Permits

Specifications: These requirements and a Development Proposal Sign Format Sheet will be attached to applications for amendments to the Official Community Plan, Zoning Bylaw, and to applications for Temporary Commercial and Industrial Permits. The Notice of development sign(s) shall be a minimum of 1.8 metres x 1.2 metres (6 feet x 4 feet) in size and constructed of 1.3 cm (1/2 inch) plywood or other durable material with a dark blue background and white lettering. It will include a Site Map that is white with dark blue or black highlights. Lettering will be block capitals with:

Headings and sign copy not less than 7.62 cm (3 inches) in height. Map lettering not less than 3.8 cm (1.5 inches) in height. Adjacent land uses to the subject property are to be indicated on the plans.

Where the sign is mounted on a building, it must be unobstructed from the street, and the bottom edge shall be a minimum of 122 centimeters from the ground.

Locations: The notice shall be posted in a location unobstructed to view from the street:

(a) no further than six metres from the property line abutting a street; and (b) where property abuts two or more streets, excluding lanes, a sign shall be posted no further than six metres from each abutting street or alternatively from the intersection point of the two streets at a 45 degree angle; or (c) where placement of a required sign on a property is not feasible, the notice may be posted on an abutting road right of way, subject to approval by the District of Campbell River.

Timing: The sign(s) must be posted a minimum of 10 days following application to the District of Campbell River.

Posting: It is the responsibility of the applicant to make, buy, or rent the sign(s) and to post the same. Failure to install the sign(s) according to these requirements will result in a postponement in the processing of the application.

Dear Mayor Lornie:

Today the Chief Judge revoked the assignment of duties for the Stipendiary Justice of the Peace in your community. This action is based on a concern that they do not have the hallmarks of judicial independence required to issue search warrants and perform bail.

In other locations throughout the province where there are no stipendiary justicesof the peace, these duties are performed at the Justice Centre by judicial justices who do have judicial independence. Even in communities where there is a Stipendiary Justice of the Peace, the police have been using the Justice Centre when the Stipendiary Justice of the Peace was not available and for daytime search warrant applications. The duties performed by the Stipendiary Justice of the Peace in your community will be transferred to the Justice Centre effective November 18, 2002. Procedures have been sent to the police regarding accessing the Justice Centre. All documents will be sent to the Centre by fax and hearings will be by telephone. This process has been successfully used in many communities since 1999. I recognize that Stipendiary Justices of the Peace have provided long and valued service to their communities. However, as constitutional jurisprudence has developed in recent years, it has become apparent that even the most basic functions of criminal procedure may require that officials possess the hallmarks of judicial independence. Accordingly, in order to ensure the integrity of the criminal justice process, it has become necessary for the Chief Judge to revoke the assignment of duties for Stipendiary Justices of the Peace.

have been withdrawn as a result of the Newspaper's failure to advertise the notices. Both hearings have been rescheduled for a Special Council meeting on December10, 2002.

0 Due to the requirements of Section 257 of the Local Government Act, Council can only proceed with implementation of the new planning procedures as outlined below, wherein there must be 24 hours between 3rd reading and final adoption of the new procedures bylaw. Further, the new procedures bylaw must be adopted before Council can waive the public hearing requirement for Zoning Amendment Bylaw No. 1991.
