FOREWORD Notwithstanding ’s illegitimate occupation of & for over seven decades, and continued oppression against the Kashmiris resulting therefrom; India’s recent illegal, undemocratic and unconstitutional actions followed by the most brutal military clampdown amid total communication blackout merits attention of the global political-legal-diplomatic community more than ever before. India’s imposition of strict curfew, detention of the entire political leadership, large-scale arrests of thousands of innocent Kashmiris coupled with extremely harsh suppression of all fundamental human rights amidst the full freeze on landline, mobile and internet communications is fast leading to “major humanitarian crisis” for more than 8 million people in the & partially for about 6 million in the Jammu Region. Waking up the world’s conscience is imperative to prevent the Indian Occupation Forces from affecting an unrelenting massacre, while the supplies of food, medicine and other necessities of life are deliberately withheld. This humble compilation based on scantily available information from IOJK till 25 August 2019 merits widest circulation leading to a strong global pressure on the Government of India to abide by United Nations Security Council Resolutions and fulfilling its own decades old promises such as, made by India’s first Prime Minister Pandit Jawaharlal Nehru in January 1952, “Kashmir is not the property of India or ; it belongs to the Kashmiri People. When Kashmir acceded to India, we made it clear to the leaders of Kashmiri people that we would ultimately abide by the verdict of their plebiscite; if they tell us to walk out, I would have no hesitation in quitting Kashmir. We have taken this issue to the United Nations and given our word of honour for a peaceful solution; as a great nation we cannot go back on it. We have left the question to find a solution to the people of Kashmir; and we are determined to abide by their decision.”

There is an urgent need for the global politico-diplomatic community for rising to the occasion and play their due role in preventing an impending genocide in IOJK or else posterity will never forgive them for inaction at this crucial juncture in history. 1

HUMAN RIGHT VIOLATIONS BY INDIA IN INDIAN OCCUPIED KASHMIR “We declare that human rights are for all of us, all the time: whoever we are and wherever we are from; no matter our class, our opinions, our sexual orientation.” – Former United Nations Secretary General Ban Ki-moon

General 1. For decades, India has denied basic human rights including the right to self- determination to Kashmiris flouting numerous resolutions of UN Security Council; but recently it has raised the severity of atrocities amid a tight security clamp down. India’s unilateral abrogation of Article 370 and 35A (explicitly violating the wishes of Kashmiris) is an attempt to legitimize its occupation and affect forced annexation of the territory. Due to the fear of massive uprising and protests, India is now unabashedly stifling the voice of Kashmiri people, primarily to prevent the spill over of news about suppression of fundamental freedoms. Indian Occupation Forces are perpetrating severe brutalities against the innocent populace and aggravating their lives on daily basis.

2. Over the last month or so, the Government of India has staunchly denied access to the World Community and International Human Rights Organizations by crossing all norms of humanity. An upward surge has been witnessed in various kinds of violations including killings, humiliation and conduct of cordon & search operations to cover up the illegal actions of the Government of India. Presence of 700,000 personnel and almost 700,000 troops from other security agencies including CRPF, SOG, Black Cat Commandos, Police and intelligence agencies have made the life of Kashmiri masses miserable. Hiding the real situation in IOJK, Indian authorities resort to atrocious methods and gross human rights violations through its security forces especially RAW / CRPF / Indian Army.

3. In nutshell, India is using diversionary tactics, disinformation and obfuscation of facts and events to create a smokescreen over violation of basic human rights of people in IOJK.

4. In the words of Lord Eric Avebury, an English politician and human rights campaigner, ―The atrocities committed by Indian imperialists in occupied Kashmir surpass brutalities of apartheid regime in South Africa or of Nazis 50 years ago‖. Human rights abuses have been 5 a part of Indian campaign against Muslim Kashmiris since 1947 particularly after 1990. The oppression has been manifested in different types of human rights abuses such as disappearances, torture, rape and molestation of Muslim women etc. Indian troops have seldom been held accountable despite committing serious human rights violations (HRVs) due to imposition of black laws such as the Armed Forces Special Powers Act (AFSPA), which gives soldiers effective immunity from prosecution for serious human rights abuses. India has put aside all its obligations to ensure political and civil rights of Kashmiris as the State party to different international humanitarian treaties such as The International Covenant on Civil and Political Rights (ICCPR). Moreover, it backtracked from its promise to hold plebiscite in IOJK according to the wishes of Kashmiri people under the aegis of UN. Ironically, international community, UN and powerful states have forgotten the golden document of Universal Declaration of Human Rights (UDHR) and have turned deaf and dumb towards severe human rights issues in Indian occupied Kashmir. India not only violates the basic rights of Kashmiris but also dubbed reports on HRVs by authentic UN bodies such as Office of the High Commission for Human Rights (OHCHR) as false and motivated narrative. Summary of the statistics of various human right violations from January 1989 till August 2019 is as under:-

6. Indian Narrative. Over a period of time, India has developed a narrative in which she is trying to change the dynamics of Kashmir Freedom Movement (hereafter referred to as the Movement). The evolved narrative entails tagging legitimate Kashmir Movement with international and/or cross border state sponsored terrorism, making a pretext for non- engagement with Pakistan, precluding efforts by the international community for third party mediation, employing all possible means to quell the Movement, and instituting demographic and constitutional changes for illegal and forced annexation of the disputed territory without any regards for the peoples’ aspirations, international laws and UN Resolutions. Towards this end, the Indian Government is geared upto:-  Desperate under the influence of Rashtriya Swayam Sewaksangh (RSS) / Hindu fundamentalists to change the demography of IOJK and strengthen the hold of central government in Kashmir affairs. In order to materialize these ambitions; India has recently abrogated Article 370 of Indian Constitution which gives special status to IOJK in all matters except communications, defence and foreign affairs, and Article 35 A which gave IOJK legislature the power to define State’s ―permanent residents‖.  Using Indian economic and diplomatic strength, to promote India’s stance on Kashmir violating UN Resolutions as her internal matter.  Attrite, exhaust and undertake phased elimination of pro-movement entities.  Make Hurriyat leadership (pro-movement) totally irrelevant through falsified links with external factors on different accounts with a view to permanently sideline them.  Project Kashmir as India’s internal matter, keep the international human rights bodies away from IOJK and divert focus of World Community from the region which is bleeding since decades especially last one year.  Propagate to isolate Pakistan on false charges of terrorism / unrest in IOJK and try to force it to compromise on Kashmir Issue.  No engagement with Kashmiri leadership and Pakistan on Kashmir dispute, thus forestall any possibility of solution of Kashmir dispute bilaterally.  Preclude any option of third party mediation or even indulgence by international organizations / international actors. 8

7. Pakistan Centric Efforts

 India is continuously blaming Pakistan for its involvement in IOJK and cross (LoC) terrorism. Besides activating its media, it is also using its NGOs and think tanks to propagate anti-Pakistan perceptions.  India unintermittently pressurizes Pakistan to curtail its historic contacts with pro- movement leadership. Moreover, it also obstructs adding Kashmir Issue to the agenda points of bilateral dialogue which otherwise constitute the foundation of relations between the two countries.  India keeps blaming Pakistan for abetting / facilitating Lashkar-e-Tayyeba (LeT) for terrorist activities in mainland India and IOJK; however, it has never been able to provide any concrete evidence.  Indian Ceasefire Violations (CFVs). As a pressure tactics, India resorts to CFVs resulting into civilian casualties. Since January 2017, India has carried out over 4,754 CFVs causing casualties to dozens of innocent civilian. 8. International Reports on HRVs in IOJK  OHCHR’s Report (2018) on the Human Rights Situation in Kashmir  In June 2018, OHCHR released a comprehensive report which mostly documents India’s gross HRVs in IOJK. The report covers indian State machinery’s human rights abuses in IOJK from June 2016 to April 2018, including impunity and lack of justice, excessive and brutal use of force, arbitrary arrests of innocent Kashmiri people, use of pellet shotguns; 9

torture; enforced disappearances; reprisals against Human Rights defenders and journalists; violations of rights to health and education and sexual violence. Practically, the report is United Nations’ diplomatic breakthrough into the status of Jammu and Kashmir; and is an undeniable reaffirmation of what Pakistan has long highlighted to the international community.  OHCHR’s Recommendations for the Government of India . India to fully respect its international human rights obligations in IOJK. . Urgently repeal AFSPA and concurrently remove the requirement for central government’s prior permission to prosecute security forces personnel. . Establish independent, impartial and credible investigations into the deaths of civilians. . Investigate all deaths that have occurred in the context of security operations. YOUTH RUN OVER BY . Investigate all cases of abuse CRPF VEHICLE committed by armed forces. . Provide relief and rehabilitation to all individuals suffered. . Investigate and prosecute all cases of sexual violence. . Bring into compliance with international human rights standards all Indian laws relating use of force. . Amend PSA to ensure compliance with international human rights law. . Release or charge under applicable criminal law, all detainees. . Treat any person under 18 in line with Convention on rights of the child. . Investigate blanket bans on restrictions on access to the internet, mobile, communication and information. . End restrictions on movement of journalists and end ban on publication of newspapers. 10

. Fully protect right of self-determination of the people of Kashmir as protected under international law.  Negative Reaction by the Government of India. The Government of India, as predicted, reacted vociferously by terming the report as fallacious, tendentious and motivated. Arguably, India has called into question the credibility of United Nations‟ institution of OHCHR  OHCHR Sequel Report 2019. In July 2019, OHCHR released its sequel report covering the period from May 2018 to April 2019. In addition to building on contents of the previous report, this report documents in detail the excessive use of force and extrajudicial killings, use of pellet guns, impunity enjoyed by Indian forces, use of torture, lack of credible investigations into HRVs and lack of freedom of expression in IOJK. The report reinforces the legal and normative basis of J&K question and also reaffirms the right of self- determination. One of the key recommendations of the report is the call for establishment of a Commission of Inquiry for investigation into HRVs.  Amnesty International Report 2019. In June 2019, Amnesty International in its report, ―Tyranny of a Lawless Law‖ highlights the draconian nature of Public Safety Act (PSA) which circumvents the criminal justice system in IOJK and undermines accountability, transparency and respect for

human rights. The report finds a pattern of abuse by authorities, PELLET VICTIM FROM – 29 MAY 19 subjugating individuals to severe mental and physical torture and calls for an independent investigation into human rights abuses in the valley.  Human Rights Commissions (HRC) Special Rapporteurs Letter to India. In March 2019, three current Special Rapporteurs on Extrajudicial Executions, Torture, and Right to Health – Agnes Callamard, Dainius Puras and Nils Melzer wrote a letter to Indian Government and asked about steps taken to address the 11

HRVs listed in the June 2018 report of OHCHR. Reacting angrily to this letter, India has informed the United Nations body that “it will no longer entertain any communication with the HRC‟s Special Rapporteurs on the report”.  UK - All Parties Parliamentary Kashmir Group (APPKG) Report 2018. On 31 October 2018, APPKG, a UK parliamentary body, released its report on massive HRVs and atrocities committed by Indian forces in IOJK. The report highlights the draconian laws, including the AFSPA and PSA, under which Indian occupation forces are committing human rights abuses in IOJK with impunity. The report calls for an immediate ban on the use of pellet guns against innocent unarmed civilians in the valley by the Indian Army. Furthermore, it condemns the illegal arrests, enforced disappearances in occupied Kashmir, and calls for the prosecution of Indian Armed Forces. The APPKG, chaired by Member of Parliament Chris Leslie, demands in the report that a comprehensive public investigation should be made into identities of the bodies found in mass / unmarked graves.  APPKG Resolution in UK Parliament. On 7 March 2019, the Chairperson of APPKG, Debbie Abrahams, submitted a resolution in the British Parliament seeking settlement of the Kashmir dispute and an end to uncertainty between Pakistan and India. The resolution said that the unresolved Kashmir dispute was the main cause of tension between the two nuclear neighbours and its settlement could herald progress and prosperity in the region. The resolution asked the UK government and Parliament to play their moral role in resolution of the Kashmir dispute.  US Report on Human Rights 2018. The Annual US Report on Human Rights (2018) while citing wide spread HRVs by Indian forces in IOJK has called for an international probe into the rights’ abuses in the territory. 12

 Organisation of Islamic Countries (OIC) Resolution on IOJK 2019. On 2 March 2019, a ministerial meeting of the OIC passed a resolution, condemning India’s state terrorism, expressing deep concerns over the atrocities and HRVs being committed in IOJK. Furthermore, it reaffirms OIC’s unwavering support for the Kashmiri people in their just cause. The resolution highlights that Jammu & Kashmir remained the core dispute between Pakistan and India and its resolution is indispensable for the dream for peace in South Asia. It also reminds the international community of its obligation to ensure implementation of UN Security Council resolutions on the Jammu & Kashmir dispute. 9. Repeal of Article 370 and India’s Continuing HRVs. On 5 August 2019, the Indian government abrogated Articles 370 and 35A, dissolved the state of IOJK, and bifurcated it into two Union Territories. Indian action constituted material change to the situation in Kashmir which is prohibited under UNSC resolutions 38 and 91. Since Kashmir is an internationally recognized dispute with UNSC resolutions on it, Pakistan does not view it as an internal matter of India. From Pakistan’s perspective, IOJK is an illegally occupied territory by India.

 Infact, revocation Articles 370 and 35A is aimed at altering the demographic structure of the IOJK, which directly impacts the inalienable right to self- determination of the Kashmiri people as well as violates a variety of civil, political, economic, social and cultural rights. As a consequence, illegal Indian settlements in Kashmir are anticipated which will deepen the axes of conflicts and lead to more violence.  According to prominent Social and Human Right Activist Arundhati Roy, Indian government prepared the ground before repealing Article 370. She said, ―On 1 August, in preparation for that (abrogation of Article 370), the already draconian Unlawful Activities Prevention Act was amended to expand the definition of terrorist to include individuals, not just organizations. The amendment allows the government to designate any individual as a terrorist without following the due judicial process of a First Information Report, charge sheet, trial and conviction.‖  A team of four activists including Jean Drèze (Economist), Kavita Krishnan (Communist Party of India), Maimoona Mollah (All India Democratic Women’s Association) and Vimal Bhai (National Alliance of People’s Movements), spent 13

five days, 9 to 13 August in IOJK and issued a detailed report titled “Kashmir Caged”. During their visit they gained first-hand information about situation in IOJK, a mention of which is interspersed in the succeeding paragraphs, while a brief depiction of IOJK’s situation (Post 5 August Abrogation of Article 370) is at Annex A.  Vice President of Jammu & Kashmir Democratic Freedom Party (DFP), Mehmood Ahmed Saghar in a letter addressed to the leaders of the five permanent members of the UN Security Council termed the repeal of article 370 as an Act of Aggression and highlighted the prevailing precarious situation in the region. He mentioned in his letter, ―The entire valley has been turned into an open-air-jail by the Indian authorities, normal life has been brought to a grinding halt and people caged in their homes have been living in horrifying conditions. This inhuman lockdown has led to shortage of medicines and essential food commodities in the troubled region. Voices of human rights defenders have been silenced and subjugated. Section 144 forbidding any gathering of citizens has been imposed to prevent the movement of people. The eyes of the international community must open to the fact that the worst effected in this inhuman clampdown are the children and senior citizens‖.  An Unpopular Decision. Nobel laureate Dr Amartya Sen has vehemently criticised the Indian government’s decision to revoke occupied Kashmir’s special status. Indian government, immediately after abrogating Article 370, not only enforced a clamp down, but also portrayed a wrong picture of “all is well” in IOJK. Contrary to this perception PROTEST DEMONSTRATION BY NATIONAL CONFERENCE ON created by Indian Government, the ABROGATION OF ARTICLE 370 Kashmir Caged Team sums up their experience, ―We met BJP spokesperson on Kashmir affairs, Ashwani Kumar Chrungoo at the office of Rising Kashmir, a Kashmir newspaper. The conversation was initially cordial. He told us he had come to Kashmir from Jammu to persuade people to support the abrogation of Article 370. His main argument was that since the BJP had won a 46% vote share in J&K and had won 14

an unprecedented majority in Parliament, they had not only a right but a duty to keep their promise of scrapping Article 370. ‘46% vote share – that’s a license’, he said. He refused to acknowledge that this 46% vote share while winning only three seats (Jammu, and ) was possible only because the voter turnout in the three other Lok Sabha seats (Srinagar, and ) was the lowest in the whole country. When asked, should a Government impose an unpopular decision on people of Kashmir who have not voted for that decision, at gunpoint? Chrungoo said, ‘In Bihar when Nitish Kumar imposed prohibition, he didn’t ask the alcoholics for their permission or consent. It’s the same here.’ His contempt for the people of Kashmir was evident from this analogy‖.  Funeral Processions. The intensity of funeral processions over last couple of years is enough to challenge false Indian claims of cross border infiltration in Kashmir. If these were so called terrorists coming from across the border, such huge processions would not have existed. Pictorial representation of some funeral processions is given at Annex B.  Deployment of Additional Troops. Deployment of additional 180,000 troops having absolute impunity under draconian laws, imposition of curfew, arrest/ imprisonment of Kashmiri leaders and suspension of communication services, among other, clearly reflect Indian designs. It is now clear that these precautionary measures were taken by India to neutralize Kashmiri resistance to its actions and to divert world's attention from attempts to change the demographic structure of IOJK. These measures will result in increased repression in IOJK, foster a cycle of violence, and plunge the region in prolonged conflict.  Massive Arrests. Massive arrests have been made in Jammu & Kashmir and are still continuing at an unabated speed. Till 26 August, more than 1,100 political activists and innocent Kashmiris have been arrested and shifted to Agra (Uttar Pradesh). Similarly, more than 70 Hurriyat leaders have been arrested and shifted to Agra. Resultantly, hundreds of political leaders and activists remain arrested, including many outside IOJK, without access to family members or legal counsel.  Some accounts of arrests are as under:-

 According to Kashmir Caged Report, at least 600 political leaders and civil society activists are under arrest. There is no clear information on what laws are invoked to arrest them, or where they are being held. A very large number of political leaders (exact figures not known) have been placed under house arrest.

 A magistrate, speaking to AFP on condition of anonymity, said that at least 4,000 people were arrested and held under the PSA.

 According to Kashmir Media Service more than 900 political leaders & workers have been house arrested or are in jails and 6,000 people have been arrested under the PSA. Hotels, guest houses, private and government buildings have been converted into make shift jails.

 Agence France-Presse reported that the authorities have detained thousands of Kashmiris under the PSA, a controversial law that allows detention for up to two years without charge or trial.

 On 15 August, the authorities detained , a Kashmiri politician, a day after he gave an interview to the media criticizing the government’s decision.

 In Srinagar, very young schoolboys and teenagers had been arbitrarily picked up by police or army/paramilitary and held in illegal detention. Kashmir Caged Team wrote, ―We met an 11-year-old boy in who had been held in a police station between 5 August and 11 August. He had been beaten up, and he said there were boys even younger than him in 17

custody, from nearby villages. Hundreds of boys and teens are being picked up from their beds in midnight raids. The only purpose of these raids is to create fear. Women and girls told us of molestation by Armed Forces during these raids. Parents feared meeting us and telling us about the arrests (abductions) of their boys. They are afraid of PSA cases being filed. The other fear is that the boys may be disappeared – i.e. killed in custody and dumped in mass graves of which IOJK has a grim history. As one neighbour of an arrested boy said that there is no record of these arrests – illegal detentions – so if the boy disappears i.e. killed in custody, the police / army can just say they never had him in custody in the first place.‖

 Dr Amartya Sen was critical of the government’s decision to keep the mainstream political leaders of the occupied valley under arrest. He said, ―I don’t think you will ever have fairness and justice without hearing the voices of the leaders of the people and if you keep thousands of leaders under restraint and many of them in jail, including big leaders who have led the country and formed governments in the past […] you are stifling the channel of democracy that makes democracy a success.‖

 Activation of Torture Cells. Indian Occupation Forces have kept over 471 dedicated torture centers which are functioning in IOJK. As per report published in 2017, there were about 400,000 people who had been tortured from a moderate to severe degree. Besides beating them ruthlessly, common methods of torture even in normal police station / CRPF and army camps are head dipping in dirty water, rolling on front / side legs, electric shocks, inserting chili powers in private parts, cutting body parts or mutilating, keeping detainees naked, sexually abusing, inserting rods into their bodies and psychological humiliation etc. 18

 Torture in Prisons – Post 5 August. Political Activist claimed SRINAGAR - 9 JULY 2019 human rights abuses are being carried out in IOJK to serve the agenda of the ruling Bharatiya Janata Party. Rashid claimed that in , four men were called into the Army camp and interrogated (tortured). A mic was kept close to them so that the entire neighbourhood could hear them scream, creating an environment of fear for residents of the area. Maximum killings in IOJK take place during cordon and search operations, fake encounters and while conducting torture in prisons. Data of killings for last two years till Aug 2019 is shown below:-

 Killing of Innocent Kashmiri Civilians. Over the years, Indian Occupation Forces have continually and continuously committed grave atrocities against the Kashmiri civilians. They often resort to unprovoked, indiscriminate and disproportionate use of force which frequently results into damage to life and property of the locals. The Indian forces, exploiting protection granted to them under the notorious draconian laws, carry out use of excessive force causing lethal injuries and even deaths. An incomplete list of those who were killed by Indian military actions is attached at Annex D.  Imposition of Curfew and Emergency-Like Situation. Curfew and lockdown imposed since 4 August 2019 after revocation of special status of Jammu and Kashmir by India, has led to shortage of food, medicines, essential supplies and inaccessibility to health services. Treatment of people injured with pellet guns is also a compounding emergency. India has turned Kashmir into the largest prison in the world, where inmates have scant or no access to food and medicine. One this curfew is lifted, situation in IOJK will flare up, which will 20

lead to more extrajudicial killings, including killings in custody, blinding through the use of pellet guns and the use of rape, torture and enforced disappearance, arbitrary arrests, detentions and restricted communications.  Former US State Department spokesman Richard Boucher said that India has imposed martial law in occupied Kashmir to suppress the freedom movement. The increasing Kashmir dispute can also affect peace process in Afghanistan.

 OIC has also demanded India to immediately lift curfew in Kashmir.

 Dr Amartya Sen said, ―The Indian government has described its decision to place held Jammu and Kashmir under a massive security blanket as preventive measures to prevent a civilian backlash that it is, nevertheless, facing. That’s the classic colonial excuse. That’s how the British ran the country for 200 years. The last thing that I expected when we got our independence… is that we would go back to our colonial heritage of preventive detentions‖.

 A detail account of curfew situation is at Annex E.

 Communication Blackout. India has cut off all modes of communication and information in IOJK, including internet, telecommunications services as well as electronic media coverage. This is a blatant usurpation of basic human rights in IOJK and building up international pressure on India to end the virtual shutdowns and curfews. In the words of Mr David Kaye, special Rapporteur on the promotion and protection of the right to freedom of opinion and expression of OHCHR, "There is something about this shutdown that is draconian in a way other shutdowns usually are not."  Local newspapers could not update their online editions. Following assertions by prominent organisations and leaders indicate gravity of the situation:- 21

 UN Human rights spokesperson showed concern over communication black out.

 US news publication Foreign Policy wrote that newspapers in Srinagar haven’t been published since Monday (5 August); Kashmir has been turned invisible even inside Kashmir.

 Amnesty International urged Prime Minister Modi to lift Kashmir communication blackout.

 Meenakshi Ganguly, South Asia Director at Human Rights Watch said, ―Officials should cease using broad, repressive means to curtail the flow of information, or to prevent people from peacefully assembling and expressing their views‖. The Indian authorities also asked the social media site to suspend some accounts for allegedly spreading false information.

 The United Nations special rapporteur on freedom of expression and opinion, David Kaye, also expressed concern over the current communication clampdown.

 A journalist told Kashmir Caged Team, ―Newspapers are printing in spite of everything. Without the internet, we do not get any feed from agencies. We were reduced to reporting the J&K related developments in Parliament, from NDTV. This is undeclared censorship. If Govt is giving internet and phone connectivity to police but not to media houses what does it mean? We had some people come to our offices, speaking on behalf of Army and CRPF, asking why are you publishing photos of the curfew-affected streets?‖ Kashmiri TV channels are completely closed and unable to function. Kashmiri newspapers that carry the barest mention of protests (such as the one on Soura) are made to feel the heat from the authorities. Foreign press reporters are facing restrictions on their movement by the authorities and are unable to communicate with their own main offices because of the lack of internet. Kashmir Caged Team visited Press Enclave in Srinagar on 13 August, and found the newspaper offices closed and the area deserted except for a few stray journalists, and some CID men. One of 22

the journalists told them that papers could not be printed till at least 17 August, because they have run out of newsprint which comes from .

 The Executive Editor of Kashmir Times, Anuradha Bhasin has said that the present restrictions and clampdown on the media is comparable to that in the early 90s. She said, ―Kashmir had seen human rights violations, partial or complete ban on Internet and mobile connectivity, but this was the first time since the early 1990s when the fixed line phones too had stopped working and the mobility of journalists had been completely affected. This is the first time in 30 years that I have no information of what is happening in the Valley or parts of Jammu directly from our reporters. We are relying on the information being published in Delhi papers or the international press‖.

 Use of Pellet Guns. Hospitals are receiving numerous people with pellet gun injuries after the revocation of article 370. There have been reports of sporadic protests in IOJK since August 5, and of security forces using pellet shotguns that have led to about a dozen injuries. Pictorial coverage of pellet gun victims is at Annex F while a list of victims with pellet / bullet injuries is at Annex G. Accounts of pellet

incidents are as below:- A steady trickle of civilian victims of pellet-gun injuries at the city hospital has lent credence to reports of unrest in the Valley 23

 28 individuals being admitted with pellet injuries to SHMS hospital.

 Some 10,000 people protested in Soura (Srinagar) on 9 August. The forces responded with pellet gun fire, injuring several. The use of pellet-firing shotguns as a crowd-control weapon in IOJK has received widespread condemnation because of the large number of protester deaths and injuries.

 On 6 August, a graphic designer for the Rising Kashmir newspaper, Samir Ahmad, (in his early 20s) had argued with a CRPF man near his home in the Manderbag area of Srinagar, asking him to allow an old man to pass. Later the same day, when Samir opened the door to his house, CRPF fired at him with a pellet gun, unprovoked. He got 172 pellets in his arm and face near the eyes, but his eyesight is safe. It is clear that the pellet guns are deliberately aimed at the face and eyes, and unarmed, peaceful civilians standing at their own front doors can be targets.

 On 18 August, scores of people including a girl and little child were injured when Indian troops fired bullets, pellets and teargas shells on protesters in Soura, Rainawari, , Lal Bazaar Gojwara and Kathi Darwaza in Srinagar and Dooru area of .

 In a report dated August 9 2019, Al Jazeera documented the case of Asrar Khan, a class 11 schoolboy, who was hit by pellets and is currently under sedation at the hospital, fighting for his life. ―He has suffered serious head injuries and our priority right now is to save his life,‖ a hospital official told Al Jazeera. A doctor at Shri Maharaja Hospital said they had attended to approximately 40 pellet victims in the past three days (8-10 August). 24

 Shortage of Food / Medicine. With shops shut due to official restrictions, curfew-bound IOJK facing shortages of essential items, including food and medicines. Serious shortages of food especially milk for the children are reported. Patients have faced shortages of prescription drugs. ATMs are cashless and banks shut. It appears that the shortage of food, supplies and medicine is being created by design – to break the will of Kashmir people and then distribute daily supplies amongst them to win over their sentiments.  Health Care Services. A group of 18 doctors from across India warned that the grim situation in IOJK had led to a blatant denial of the right to healthcare in the territory due to curfew and communication blackout. The doctors through a joint letter coordinated by Dr. Ramani Atkuri, a public health consultant in Madhya Pradesh urged the Indian government to lift the curfew at the earliest. The letter pointed out that the lockdown and snapping of all modes of communication has made it very difficult for the people in Kashmir valley to access health care. People are unable to call an ambulance. Hospitals that are usually crowded are largely empty now. Certain medications are out of stock in local stores. Dialysis and Chemotherapy patients are unable to come for treatment. Expecting women are also facing issues. The current situation indicates blatant denial of the right to health care and right to life.  Women Molestation. Indian troops have molested countless women and girls while abducted hundreds of boys during midnight raids from 5 to 13 August, said a report released by a group of rights activists in . Amongst top social media trends after abrogation of Article 370, ―Buy a Plot in Kashmir‖ and ―Marry a Kashmiri Girl‖ remained on top in India. Ironically many BJP leaders, including Chief Minister, Haryana Manohar Lal Khattar initially flaunted such propositions, only to back off after sever public backlash. Another BJP MLA, Vikram Saini also joined the charade. Some accounts of violation of women’s rights is at Annex H. 25

 Attacks on Religious Places. In order to create a sectarian divide between Muslims, Indian state machinery has been attacking religious places and blaming different sects for such attacks; just to divert their focus from the freedom movement.  Post 5 August, Indian Occupation Forces have slammed a strict curfew and prevented all types of movement which affected various Muslim religious congregations as well. Just after one week, Muslims all over the world observed Eid ul Adha (one out of the two holy occasions during the Islamic calendar); but Kashmiri Muslims were forcefully stopped from offering the collective Eid Prayers and were inhibited / discouraged from offering the mandatory sacrifice of animals (Qurbani) which is an obligation connected to this religious festivity.

 Due to a strict ban on movement / assembly, the regular prayers offered in mosques five times a day are obviously compromised. Moreover, the weekly congregation of Friday Prayers has also been discontinued due to the unnecessary restrictions imposed by the Indian Occupation Forces. 26

 Some of the historic attempts made by India to desecrate Islamic religious shrines in recent past are given as under:-

. Torching of Dargah (Barelvi sect) in Srinagar on 15 October 1993. . Burning of Dargah Ghaus-ul-Azam (Barelvi sect) in , Srinagar on 25 June 2012 and Charar-e-Sharif (Barelvi sect) in on 10 May 1995. . Killing of President Jamiat-e-Ahle Hadith Maulvi Showkat Ahmed Shah in an Improvised Explosive Device (IED) blast in , Srinagar (Ahle Hadith sect) on 8 April 2011. . Burning of Alam Sharif and torching of Imam Bargah in Srinagar (Shia and Sunni sects) on 29 June 2012. . Burning of mosque of Ahl e Sunnat along with houses of Shia community to create rift between both the sects on 13 August 2013.  Arson and Damage to Property. Indian occupation forces plan and then deliberately execute damage to property of civilians and use this heinous practice as a tool of coercion to dissuade the populace from participating in further 27

protests etc. pictorial description of this regular practice of Indian security forces is at Annex I.  Use of Chemical Weapons by Indian Occupation Forces in IOJK  Reportedly in order to curb legitimate Kashmir Freedom Movement and create fear among masses, Indian Army has recently started using chemical weapons against innocent Kashmiri people in IOJK. The dead bodies of chemical weapons’ victims are completely burnt and beyond recognition. Ministry of Foreign Affairs, Islamabad protested against this new form of atrocity and issued press a release on 6 July 2017, stating: „If use of chemicals in the ammunition is confirmed, then it would constitute a serious violation of International norms and India‟s International obligations under Chemical Weapons Convention (CWC)‟.

 Indian Domestic Commercial Chemical Industry. India has domestic commercial chemical industry, and produces the bulk of its own chemicals for domestic consumption. In 1992 India signed the Chemical Weapons Convention, stating that it did not have chemical weapons nor have capability to manufacture chemical weapons. India has history of producing Sarin and nerve gas agents in different quantities, and has various production facilities, prominent ones being at Maharashtra, Gujarat, Kanpur and UP.

 Brief History of India using Chemical Weapons in IOJK

. In June 1999, India used chemical weapons / ammunition in IOJK against Mujahideen for the first time. 28

. Reportedly on 9 December 2016, Indian army used chemical weapons against Mujahideen Majid Zargar at Vesu-Qazi Ghund, district Anantnag in IOJK. . On 4 July 2017 at Bahmnoo District , again Indian army used chemical weapons against Mujahideen, Jehangir Kanday, Kifayat Ahmad and Faisal Ahmad. Their bodies were charred and were beyond visual recognition (Photos Attached). Four houses were destroyed by the army while using chemical weapons at Bahmnoo & Kakpora in Pulwama. . Indian Occupation Forces are using, inter alia, Israeli made chemical compound (RD 2PNG) which burns property / livestock within seconds. It also has the ability to completely burn that house which it is fired upon seeking targeted destruction of the entire infrastructure.  Use of Semi / Half Jacketed Bullets  Indian Army has been using semi / half jacketed bullets for suppressing the indigenous uprising of the Kashmiris. Such ammunition is used to cause excessive damage to the victim’s body and is, therefore, prohibited under international conventions.

 It only adds up to India’s frequent violations of international laws and treaties coupled with the efforts of causing pain and suffering to the Kashmiris.

 Innocent Victims. Historically, Indian forces hurt or injure benign and innocent civilians to terrorize the neighbourhoods. This victimization is targeted at women, children, the elderly and unarmed men / youth etc; some occasional pictures showing such excesses of the Indian soldiers are shown at Annex J.  Prejudice of Indian Supreme Court. Supreme Courts refuses to accord urgent hearing on 370. The Supreme Court, on 16 August, refrained from giving any ruling on Anuradha Bhasin’s (Executive Editor of Kashmir Times) plea challenging the restrictions imposed on journalists in Jammu and Kashmir recommending a ―wait-and-watch‖ policy. Later the has pended hearing against all petitions dealing with the Government’s J&K decision 29

till 1 October 2019 thus causing a unwanted / uncalled for delay on a subject otherwise needing immediate attention from the Indian judiciary.  Land Purchase. The abrogation of article 35 A leads to the possibility of people other than Kashmiris of purchasing land in IOJK thus, changing demography.  Amid anticipation about the possibility of buying land in IOJK by people from other states, Dr Amartya Sen said it should have been “something for the people of the state (occupied Jammu and Kashmir) to decide. This is something in which Kashmiris have a legitimate point of view because it is their land”.

 Going by google trends after the Indian government’s decision to revoke Kashmir’s Special Status, most number of searches to buy land in Kashmir appeared with Jharkhand at the top followed by Delhi and Haryana.

 Indian Member of Parliament Assad ud Din Awaisi brought forth a grim reality that after abrogation of Article 370, some 700,000 troops deployed in IOJK become suddenly eligible to purchase property. Not only these soldiers, but RSS activists and wealthy Indians from remaining parts of India will now become eligible to purchaser land.

 International Community’s Response on HRVs  Letter by US Member of Congress. US Member of Congress Thomas R. Suozzi initiated a letter to the US Secretary of State Mike Pompeo describing the grave situation in IOJK; and demanded that cognizance be taken of the human rights violations taking place there. Copy of the letter is attached at Annex K.

 Members UK Parliament. Faisal Rasheed, Member of Parliament for Warrington South strongly condemned Indian Government decision of repealing Article 370 and sent a letter signed by over 45 fellow members of the parliament United Nations General Assembly to intervene and prevent India’s unconstitutional attack on IOJK. Letter is at Annex L.

 Member of Canadian Legislative Assembly termed occupation of Kashmir as a crime. 30

 Human Rights Watch. India needs to step back in IOJK; authorities should release political detainees, lift the communication black out and allow access to media and independent observers and order security officials to respect human rights.

 Amnesty International. Amnesty International showed apprehensions about unilateral Indian decision which is likely to increase risk of further HRVs and inflame tensions.

. Secretary General of Amnesty International Kumi Naidoo in a statement issued on Amnesty’s website said, ―The actions of Indian government have thrown ordinary people’s life into turmoil, subjecting them to unnecessary pain and distress on the top of the years of human rights violations they have already endured. The people of Jammu and Kashmir should not be treated as pawns in a political crisis, and the international community must come together to call for their human rights to be respected. We reiterate our calls to the Indian government to act in accordance with the international human rights law and standards towards people living in Jammu and Kashmir, including in relation to arrests and detentions of political opponents, and the rights to liberty and freedom of movement‖. . Amnesty International India Chief Aakar Patel said, ―The additional deployment of thousands of security forces, a blanket blockade of telephone and internet services and restrictions on peaceful assembly already pushed the people of J&K to the edge. To make matters worse key political stakeholders have been placed under house arrest. Blanket and indefinite suspension of telecommunications services in J&K are also not in line with international human rights standards. These shutdowns affect the ability of people in Kashmir to seek, receive, and 31

impart information, which is an integral part of right of freedom of expression. An end to the abuses in J&K cannot come without the involvement of its people‖.  OIC. The OIC on 17 August has strongly condemned the ongoing security clampdown, communications blockade and denial of religious freedoms to Kashmiris in IOJK.

. According to a statement of the OIC’s Independent Permanent Human Rights Commission, ―Local and international media have widely reported the fact that Kashmiris were prevented from offering the congregational Eid prayers at Srinagar’s historical Jama Masjid and other mosques for fear of protests against the government.‖ The commission added, ―These arbitrary and unjustified administrative measures have prevented Kashmiris from performing their religious rites, a blatant violation of the right to freedom of religion, which includes the right to manifest one’s religion in teaching, practice, worship and observance, guaranteed in Article 18 of the Universal Declaration of Human Rights and International Covenant on Civil and Political Rights, the Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief and other international human rights instruments.‖ . The OIC stated it was ―further appalled by the worsening humanitarian situation arising due to long curfews and closure of economic and social activities, which are causing severe hardships for the patients to reach hospitals and general population to replenish food and fuel supplies. These and other similar restrictions, constitute collective punishment of the populace and a grave violation of international human rights and humanitarian law, hence deplorable and detestable.‖ . The OIC has demanded the UN High Commissioner for Human Rights to urgently intervene and stop HRVs in Jammu and Kashmir where the government of India is breaching both international as well as domestic laws. 32

. ―While welcoming the recent statement of the UN secretary-general on the ongoing situation in IOJK, we call upon him and the UN high commissioner for human rights to urgently intervene to urge the government of India to: (a) immediately lift the curfew in IOJK and restore fundamental freedoms and liberties to Kashmiris; (b) release all political leaders and other political prisoners; (c) respect their right to peaceful assembly, protest and movement; (d) remove the information and communication blackout and allow freedom of expression and press ensuring reporting of facts; (e) avoid resorting to violent means including use of any forms of lethal weapons against unarmed demonstrators; (f) bring an end to the economic blockade; and (g) withdraw its security forces from Kashmiri towns and villages,‖ the statement read.  International Commission of Jurists. Secretary General Sam Zarifi condemned legislative steps taken by India. The statement said, ―The Indian government’s revocation of autonomy and Special Status of Jammu and Kashmir violates the rights of representation and participation guaranteed to the people under Indian Constitution and International Law, and is a blow to rule of law and human rights in the state and in India‖.

 OHCHR. The United Nations’ human rights agency on 7 August said India’s decision to take away Jammu and Kashmir’s special status would lead to deterioration of human rights problem in the region. Spokesperson for the Office of the United Nations High Commissioner for Human Rights Rupert Colville said, ―What we are now witnessing in Indian- administered Kashmir takes what was already a bit of pattern to a whole new level‖. He referred to a UN report from last month on the human rights situation that documented how authorities in the region ―have repeatedly 33

blocked telecommunications networks to muzzle dissent, used arbitrary detention to punish political dissidents and employed excessive force while dealing with protests, leading to extrajudicial killings and serious injuries‖. The spokesperson said, ―The rights body was deeply concerned that the latest restrictions in Kashmir would exacerbate the human rights situation in the region. We are again seeing blanket telecommunications restrictions, the reported arbitrary detention of political leaders and restrictions on peaceful assembly. These restrictions will prevent the people of occupied Kashmir and their elected representatives from participating fully in democratic debated about the future status of Jammu and Kashmir. The fact that hardly any information at all is currently coming out from occupied Kashmir is of great concern in itself‖. It is worth mentioning that India had earlier rejected both reports initiated by OHCHR in 2018 and 2019; letter is attached at Annex M.

 UN Human Rights Experts. Special Rapporteur on freedom of opinion David Kaye (USA), Special Rapporteur on human rights Michel Forst (France), Chair-Rapporteur Working Group on Enforced Disappearances Bernard Duhaime, Special Rapporteur on right to peaceful assembly, Clement Nyaletsossi Voule and Special Rapporteur on extrajudicial executions Agnes Callamard on 22 August 2019, expressed concern over the human rights situation after Indian parliament revoked the constitutionally-mandated status of Jammu and Kashmir. They called upon India to put an end to the violation of human rights. The experts said, ―The shutdown of the internet and telecommunication networks, without justification from the Indian government is inconsistent with the fundamental norms of necessity and proportionality. The blackout is a form of collective punishment of the people of Jammu and Kashmir, without even a pretext of a precipitating offence. We are gravely concerned about allegations that the whereabouts of some of those detained is not known as well as the general heightened risk of enforced disappearances, which may proliferate against the backdrop of mass arrests and restricted access to the internet and other communications networks‖. 34

 Genocide Watch. On 22 August, Genocide Watch, a global organisation dedicated to the prevention of genocide, has issued two warning alerts for India — one for the occupied territory of IOJK and the other for Assam state. Details at Annex N. According to 'Genocide Watch' warning is declared when there are signs of the early stages of genocide in progress. The most recent genocide alert issued by the organisation was for IOJK, in which it identified the genocidal process, based on Dr Stanton's 10 Stages of Genocide and on the basis of these developments, it has called upon the United Nations and its members to warn India not to commit genocide in IOJK. 10 Stages of Genocide in IOJK are:-

. Classification: Hindu and Sikh Indian army ―us‖ vs Kashmiri Muslim civilian ―them‖ . Symbolisation: Muslims have Muslim names (on ID cards), , dress, mosques . Discrimination: Hindu pandits were economically dominant until 1990; BJP reasserted Hindu power . Dehumanisation: Muslims are called ―terrorists‖, ―separatists‖, ―criminals‖, ―insurgents‖ . Organisation: 600,000 heavily armed Indian army troops and police dominate occupied Kashmir . Polarisation: Modi and the BJP incite anti-Muslim hatred; social media spread falsehoods . Preparation: The Indian army occupies Kashmir; BJP leaders speak of the ―Final Solution‖ for Kashmir . Persecution: Kashmiri Muslims are locked down, subject to arrest, torture, rape, and murder . Extermination: Since 1990, there have been at least 25 massacres by Indian troops as well as Muslim fighters with death tolls over 25 . Denial: Modi and BJP say their goals are to ―bring prosperity‖ and ―end terrorism‖; they deny any massacres. No Indian Army troops or police are ever tried for torture, rape or murder. 35

 BJP’s Stance on IOJK Situation  Speaking about the situation in the Valley, which has been in lockdown, BJP General Secretary Ram Madhav said, ―Political detentions are no big deal, this has happened before. People of Kashmir have been misinformed... Internet blackout is nothing new... Deployment of forces on streets in Kashmir is nothing new‖. He blamed Kashmir’s political class for creating panic in the Valley and said there is nothing to nothing to worry about.

10. Conclusion. The United Nations should urge India for an immediate halt to the bloodshed and for an independent and comprehensive investigation into HRVs, the brutality against innocent Kashmiris, as well as lack of access to justice for the victims by the Indian occupation forces. It is time that UN should take proactive measures to prevent further excesses of the victims, duly guided by universal morals & values and charter of the United Nations. 36
