Story...............................................................................................95 iv EXECUTIVE SUMMARY Precis This report is the fifth Quarterly update of the Nepal Health Sector Support Programme 3 covering the period from July 1st, 2018 to September 30th, 2018. The Federal Ministry of Health and Population has completed restructuring at the National level; sub-National structures development is still in process. The Learning Laboratory concept is being established with most field assessments completed. A concept-note for an innovation to support nutrition is being developed. Most planned technical assistance interventions were on-time and are achieving stated result targets. Changes of key personnel in the Ministry are the most significant challenge to institutional capacity enhancement through technical assistance. The technical assistance team provided various analyses, draft briefs, and other content-related interventions. Transactional assistance and functionary duties are often included in the technical assistance role. It is reiterated that the international experience in devolution informs us that focal areas for technical support include (1) strengthening national stewardship of devolution, (2) strengthening local governance of healthcare, (3) strengthening human resources management and developing workforce incentives, and (4) developing and installing workable healthcare delivery systems adapted to local needs. As raised last Quarter, a detailed framework and work plan to support sector devolution is absent. Provincial and local governments will require a well-planned, appropriately timed Ministerial stewardship, and skilled technical support, to attain the capacity and competencies to govern, plan, manage, deliver, and monitor health services. The Programme has raised this matter with the Ministry at various levels, and with the World Health Organisation and the Department for the International Development in Nepal. The development context The health sector remains in the early stages of devolution following federalisation. Many changes in key positions have been witnessed. Uncertainty in the permanence of incumbents to key positions remains. Sub-national structures are under deliberation. Significant sector capacity-related issues are emerging at sub-national levels. District Health Office engagement in healthcare service delivery remains, but the role is becoming less clear in terms of the management and monitoring of healthcare services. Healthcare data quality and upward flow remains a concern and there is little to affirm data that can be or is used in health governance. Technical assistance Most technical assistance personnel are located on the campuses of their respective counterparts, thus enabling ease of access. Most technical assistance is demand-driven. On June 22, over 200 Armed Police Force (APF) of Banke revolted to protest against poor ration quality and senior official's ill- treatment. They also beat up APF battalion chief and other senior officers. On June 23, the rebelling armed forces reached an agreement with the government and formed a nine-member team to listen their grievances and corruption done by senior officials. A similar event that took place in Parvat district, however, went unnoticed. On June 20, civil servants urged the National Human Rights Commission (NHRC) to take strong action against the Minister for Forest and Soil Conservation Matrika Yadav for locking up the Lo- cal Development Officer of Lalitpur, Dandu R. Ghimire, in a toilet for allegedly allowing illegal stone quarries at a community forest in Lalitpur. Frequent robberies in the highways and the rise of extortion, kidnapping and killing by non-state armed actors have weakened the sense of public security. The public life in Bir- gunj has been paralyzed due to the killing of one government official by the cadres of Ta- rai Mukti Tigers. Similarly, in a confrontation between the police and Akhil Tarai Mukti Morcha (ATMM) in Bara four cadres of the latter were killed. A cloth trader was killed in Birgunj while two persons were killed in Butwal. On June 21, Bardibas bazaar remained closed due to the bombing of the petroleum pomp by the cadres of Janatantrik Tarai Mukti Morcha (JTMM).

The country’s king stepped down in 2006, and two years later Nepal declared itself a republic, electing a Constituent Assembly in 2008 to write a new constitution, which is currently being drafted. Though the process of democratization has had setbacks and been marked by violence at times, Nepal has conducted reasonably peaceful elections, brought former insurgents into the political system, and in a broad sense, taken several large steps towards entrenching a functioning democracy. This still-unfolding democratization process makes Nepal of interest to Congress and to U.S. foreign policymakers. A Congressional Nepal caucus has been newly formed, which should help further strengthen relations between the two countries, which have traditionally been friendly. U.S. policy objectives toward Nepal include supporting democratic institutions and economic liberalization, promoting peace and stability in South Asia, supporting Nepalese territorial integrity, and alleviating poverty and promoting development. Nepal’s status as a small, landlocked state situated between India and China also makes it important to foreign policymakers. Nepal’s reliance on these two giant neighbors leads it to seek amicable relations with both, though ties with India have historically been closer.

    SADF COMMENT Nepalese President’s visit to India: A new 16 May 2017 dawn in India-Nepal relations Issue n° 86 Rishi Gupta is a Doctoral Candidate Rishi Gupta at the Center for South Asian Studies, Jawaharlal Nehru University, New Delhi, India. Nepalese President Bidhya Devi Bhandari concluded her maiden visit to India on 21 April 2017. This was her maiden overseas visit since assuming the office of the President in October 2015 and to mark the importance of her visit, Nepal observed a two-day public holiday. She was received by the President Pranab Mukherjee at the Rashtrapati Bhavan in New Delhi, where she was accorded a ceremonial Guard of Honour. On her five-day visit to India, she was accompanied by a high- level delegation including Minister for Foreign Affairs Ram Sharan Mahat; she also met with many ministers and officials of the Indian government and paid a visit to Prime Minister Modi’s home state Gujarat and temple city of Bhubaneswar in the state of Odisha. After President Mukherjee’s ‘goodwill’ visit to Nepal in November of 2016, the number of official and ministerial level engagements has increased. The much-anticipated maiden visit to India solidifies the ‘special relations’ between the two countries*. The visit downplayed the differences between India and Nepal that had emerged after the Madhesi movement in Nepal. Last year, in a diplomatic chaos, the K.P. Oli-led government in Nepal had cancelled its President’s visit to New Delhi. President Bhandari was set to visit India in May 2016 to attend a cultural festival in the city of Ujjain in the Indian state of Madhya Pradesh.

Poudel, Ph.D., University of Louisiana at Lafayette As more than 1,750 youths are leaving the country daily for foreign employment, rural villages in Nepal are turning into lonely places with broken families, barren agricultural lands, and absence of youths. While about seven million Nepalese reportedly are working in foreign countries, about 6,000 migrant workers have lost their lives in past nine years in foreign lands, imports of agricultural commodities and food items is increasing at alarming rate every year in Nepal. Dust pollution in the cities have reached to a point that rains have started falling as slurries of dusts and people have to drive away from the cities to get full breath of clean air. Food contamination and toxicity, poor quality of drinking water, soil pollution, deforestation, deteriorating law and order, sub-standard hospital facilities, unaffordable education, poor academic standards, and adverse climate change impacts are escalating further degradation of Nepalese society. In order to effectively address these challenges and drive the nation in the fast-paced path of socio-economic transformation, there is no alternative to a massive grassroots-based agro-Jadibuti industrialization of the country through sustainable utilization of nation’s vast natural resources. 1 Prof. Durga D.     Salient Features of the Constitutions of Nepal and India: A Comparative Observation Dilli Raj Gautam1 Abstract While comparing the Constitution of Nepal 2015 and the Constitution of India 1950 the paper comparatively analyses the major issues such as citizenship, inclusiveness, fundamental rights and independence of judiciary. Both constitutions are committed to socialism based on democratic norms and values, including people’s competitive multiparty democratic system of governance, civil liberties, fundamental rights, federal republic, secularism, adult franchise, periodic elections, full freedom of the press, and independent, impartial, competent and free judiciary and concept of the rule of law. This qualitative research article observes the salient features of the constitution of Nepal and India in descriptive and analytical order with comparative methodology.
