Late Kaladhar, Age: 32 years, Caste: Babaji (Budigajangam)/Sc, Occ: Coolie, R/o. H.No.9­38, Guddelgulapalli, H/o. Velichala Village of Ramadugu mandal of . ….Petitioner/Accused No.1 And The State through Station House Officer, Ramadugu ….Respondent/Complainant. Offences under Section 307, 290 of IPC PETITION FILED UNDER SECTION 439 OF CR.P.C. This petition coming before me on today for hearing in the presence of Sri Raju Nunavath, Advocate for the petitioner/accused and the learned Addl. Public Prosecutor for the state, having been heard and stood over for consideration to this day, the Court made the following:

::O R D E R:: 1. The bail application is filed under Section 439 Cr.P.C., praying the Court to enlarge the petitioner/accused No.1 on bail pending investigation.

2. Notice given to Addl.Public Prosecutor, who reported that the investigation is completed and charge sheet is filed. 3. Heard both sides. 4. Now the point for consideration is:­ Whether the petitioner/ accused No.1 can be enlarged on bail ?

5. POINT: The learned counsel for the petitioner/accused No.1 submitted that on 07­ 08­2020 at 09.00 hrs the Complainant lodged a report stating that, they are brothers. His younger brother Venukonda Chakradhar became slave to drink and often quarreling with their mother. Chakradhar is due of Rs.70,000/­ to his mother, who gave complain in PS Ramadugu, keeping the same in mind, 2 on 6­8–2020 his younger brother came to his house in drunken state and abused his mother, on that his mother went to (LW.1’s) house and slept. On 7­ 8­2020 at about 5.30 A.M he went to the house of his younger brother, but his younger brother who is in drunken state had again picked up quarrel with his mother. Later his younger brother with the assistance of his younger brother’s wife and her parents attacked and beat on the head of his mother indiscriminatly with a pestle, with an intention to kill her, as a result his mother received severe bleeding injury. Thereby requested to take necessary action.

Basing on the above report the police Ramadugu registered a case in Cr.no.109/2020 for the offences under Section 307, 290 of IPC.

6. On the other hand the learned Addl.Public Prosecutor, who reported that the investigation is completed and charge sheet is filed

7. Perused the record. It is seen that the present crime was set in motion on 07­08­2020. C.D. Part I discloses that the alleged offences are under Sections 307, 290 of IPC. C.D Part I further discloses that the investigation is completed and charge sheet is filed. In view of the circumstances and as the charge sheet is filed, I am inclined to grant bail to the petitioner/accused No.1. 8. In the result, the petition is allowed and the petitioner/accused No.1 is ordered to be enlarged on bail on his executing a self bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) with 2 sureties for a like sum each to the satisfaction of learned J.M.F.C.,(Excise Court), Karimnagar. Typed to my dictation, corrected and pronounced by me in the open Court on this the 9th day of September, 2020.
