The President and Congress: Separation of Powers in the United States of America
Harold H Bruff* THE PRESIDENT AND CONGRESS: SEPARATION OF POWERS IN THE UNITED STATES OF AMERICA ABSTRACT Although the framers of the Australian Constitution adopted many features of the United States Constitution, they rejected the separation of legislative and executive power in favour of responsible government in a parliamentary system like that of the United Kingdom. In doing so, Australians depended on existing conventions about the nature of respon- sible government instead of specification of its attributes in constitutional text. The United States Constitution contains detailed provisions about separation of powers, but unwritten conventions have produced some central features of American government. This article reviews conven- tions developed by Congress that constrain Presidents in the domestic sphere with regard to the appointment of executive and judicial officers and the funding of the federal government. The article then reviews conventions developed by Presidents that liberate them in the conduct of foreign relations and war making. These aspects of the American experience may aid the analysis of problems of executive power under the Australian Constitution. I INTRODUCTION ike our peoples, our constitutions are cousins. Ever since the framers of the Australian Constitution adopted some features of the United States Consti- Ltution (especially federalism), the development of constitutional law in the two nations has proceeded along similar although not identical paths.1 This article considers a feature of the United States Constitution that Australia did not adopt: separation of the legislative and executive branches of government. Instead, your framers adopted the model of responsible government as it then existed in the separate Australian colonies and in the United Kingdom. -

Political Parties and Citizen Movements in Asia and Europe
and social media, citizen movements have emerged as an alternative to political party membership for citizen participation in democratic decision-making processes. Diverse groups of citizens, often including high numbers of youth, have made an increasing impact on democratic processes in Asia and Europe. By using social media to organize and stage their protests, they manage to circumvent political parties and CSOs as the traditional entry points for political participation and representation. A joint project of the Asia-Europe Foundation (ASEF), the Hanns Seidel Foundation and International IDEA, this publication looks closely at initiatives and activities undertaken by political parties in Asia and Political Parties and Citizen Movements in Asia Europe Europe to relate to CSOs and citizen movements. Political parties POLITICAL PARTIES AND in the two regions operate in different domestic political contexts and different socio-economic conditions. Different approaches and a CITIZEN MOVEMENTS IN myriad of experiences are analysed in this book: from complete non- alignment between citizen movements and parties, as in the case of ASIA AND EUROPE Spain, to a very formalised party-CSO engagement in Sweden and Norway, to a watchful approach from the incumbent government toward protest movements in Vietnam, to CSOs-turned political parties in India and the Philippines. This book offers valuable lessons rapidly emerging citizen protests. CHAPTER Our democratic rights ustralia’s system of government is a federal A parliamentary democracy operating under a constitutional monarchy. The former means that all Australian citizens over the age of 18 are able to participate actively in some parts of government; we vote for candidates from the political parties we believe will best represent us. The latter means that our head of state is Elizabeth II, the Queen of the United Kingdom; her representative in Australia is the governor-general. As active citizens in the 21st century, we are encouraged to play a part in political processes by voting, debating, discussing, questioning and sharing our opinions and ideas. Political parties campaign for our vote at election time, and are increasingly using new forms of technology, such as social media, to target voters and present information.
