Preface In August 2012, Research Institute of Foreign Capital Introduction and Utilization, Southwest Jiaotong University (RIFCIU-SWJTU), the organization for external monitoring & evaluation on resettlement for Ya’an-Lugu Expressway Project performed field investigation and completed monitoring and evaluation independently. The monitoring organization continues to implement the external independent monitoring and evaluation in strict accordance with the requirements of Asian Development Bank. Two field monitoring and evaluation teams specially organized by the monitoring organization were dispatched to Mianning County of Liangshan Yi , as well as Shimian County, Hanyuan County, Yingjing County and Yucheng District of Ya’an City for field investigation on working field of land requisition and relocation and resettlement for the Ya’an - Lugu Expressway Project.

After comprehensively understanding the progress of project implementation and of land requisition, house demolition and resettlement, compensation standards and fund appropriation for land requisition and house demolition, and the resettlement implementation plan according to the Resettlement Action Plan (RAP) of the Project, the monitoring and evaluation teams collected wide range of the resettlers’ opinions and recommendations about the resettlement results, compared changes in living and production of people affected before and after the resettlement, and finally, based on the updated investigation and statistical data, through analysis, sorting and information feedback, etc., completed the preparation of Phase V of the External Monitoring and Evaluation Report on Resettlement. The deadline of the investigation information on which the current report is based is in the early August 2012.

We hereby present our thanks to Sichuan Ya’an- Expressway Company Limited and the resettlement management organizations of Ya’an City, Sichuan Province and Liangshan Yi Autonomous Prefecture at all levels for the active cooperation and substantial supports to the monitoring and evaluation teams on evaluation thereof.

Overview of Monitoring & Evaluation 1. The External Independent Monitoring & Evaluation Report (Phase VII) submitted by RIFCIU-SWJTU, the external monitoring and evaluation organization for land requisition and house demolition in Ya’an-Xichang Expressway Project (hereinafter referred to as “the Project”) is summarized as follows:

2. As of August 5, 2012, the main works of Ya’an-Xichang Expressway Project have been completed and already opened to traffic on April 28, 2012, and now there are service areas and some non-expressway works left under construction.

As of August 2012, the area of actual permanent land requisition of the Project has reached 17646.509 mu, more than 115.69% of 15253.89 mu (1016.926 ha.) of land area regulated by the Resettlement Action Plan of the Project. Increase in the area of land requisitioned additionally resulted from the reasons such as design changes. Along the whole line of the Project, with houses of 2340 households having been demolished, the actual house demolition area has totaled 316420.97 m2, accounting for 152.63% of the planned house demolition area of 207312.7 m2 stated in RAP of the Project. Along the whole line of the Project, 27 enterprises with a demolition area of 25320.405 m2 and 8 schools have been demolished, for which compensations have been made timely, and have completely been relocated and resettled.

4. Fund appropriation: As of August 2010, the Employer has appropriated 842.1656 million yuan for various kinds of land requisition and house demolition, and 760.5935 million yuan of which has been cashed in various counties and districts.

5. Land requisition and resettlement: The land adjustment and resettlement failed to be implemented along the line of the Project where cultivated land per person is relatively less. Monetary resettlement was taken after the land requisition, namely, all land compensation and requisition compensation were paid to the affected households. While for individual affected village which can be readjusted and resettled, most land compensation would be used to develop agricultural production and public welfare. In Yucheng District, Yingjing County and Shimian County, pilot work has been carried out and social security of land-lost farmers has been implemented in accordance with Trial Measures on Endowment Insurance for Rural-to-Urban Residents due to Land Requisition beyond Urban Planning Area of Yucheng District in Ya’an City (YFB [2009] No. 29), Provisional Measures of Employment and Social Security for Land-requisitioned Farmers (YFF [2009] No. 10), and Outline on Promotion of Social Security for Rural-to-Urban Residents due to Land Acquisition in Shimian County.

6. Temporary land use: Compensation fee has been paid to affected people in accordance with compensation policies in general. The project construction will be completed in the near future and the main works have been completed and open to traffic, so temporary land will hardly increase greatly. Follow-up work will be focused on payment for and reclamation of the temporarily used land, and further compensation for the cultivated land which cannot be restored.

7. With both centralized resettlement and decentralized resettlement for house demolition, the Employer and the local resettlement departments have jointly planned 17 centralized resettlement sites. Currently, the construction of 11 centralized resettlement sites in Yucheng District, Yingjing County and Hanyuan County has been completed and most of

Though the resettlement in Shimian County is characterized by large scale and great difficulty, with the big push by Yaxi Company and Shimian County Government, the construction of resettlement sites has been completed with some households to be resettled having not moved into their houses yet. By August 2012, the number of households resettled in the resettlement sites along the whole line has amounted for 80% of the total number to be resettled.

8. Resettlement results: In general, it was very difficult to carry out the house demolition and resettlement along the line of the Project, everything, however, went well and some fruits were achieved as well. Particularly, the Employer together with the governmental resettlement departments at all levels improved the compensation standard for house demolition in August 2008, greatly promoting the work of house demolition and resettlement. During the process of resettlement, all the resettlement departments adopted various methods to give preferential treatment under the policy framework and implement special resettlement beyond the policies to the affected families, including vulnerable families; meanwhile, families of different ethnos received equal treatment, without any discriminatory policy against ethnic groups.

9. Existing problems:

1) The compensation for newly added land requisition has not yet been paid timely;

2) The compensation for temporary land in Shimian County has not been paid timely, and the compensation standard for forest land is not clearly prescribed;

3) The problem of transforming paddy fields into dry land in Mianning County has not yet been dealt with;

4) The problems such as damage to the local water systems and roads, and reclamation of the temporary land for spoil ground caused by the construction of the construction company have impact on the people along the line;

5) Some of the cost for non-expressway works has not been paid.

10. Focus of monitoring during next phase:

1) Shimian County shall be particularly traced for the payment for temporary land and the introduction of compensation standards on forest land;

2) The results for dealing with the problem of transforming paddy fields into dry land in Mianning County;

3) Attention shall be paid to the damage to the local water systems and roads, impact on the temporary land for spoil ground and the houses damaged in blasting works and so on caused by the construction of the construction company, as well as the compensation and restoration for temporary land;

4) Attention shall be continuously paid to the relocation and moving in of the affected people of the resentment departments of local governments, especially the centralized resettlement sites of Shimian County;

6) The implementation of costs for non-expressway works.

1 Project Progress

1.1 Construction progress

11. On April 28, 2012, a ceremony celebrating formal opening of Ya’an-Xichang Expressway in Sichuan was held in the vicinity of Ganhaizi Super Major Bridge of Ya’an-Xichang Expressway. Jiang Jufeng, Deputy Secretary of the provincial Party committee and provincial Governor, made an important speech and announced the opening of Ya’an-Xichang Expressway, and Wei Hong, Member of the Standing Committee of the CPC and Executive Deputy Governor of the provincial government, presided over the opening ceremony. Gao Feng, Director of the Provincial Communications Department, gave a grief introduction of the construction of Ya’an-Xichang Expressway, and Xu Mengzhi, Secretary of Ya'an Municipal Party Committee, made a speech on behalf of the cities and prefectures along the Expressway. Excellent representatives from companies participating in the construction of the Expressway rode a midibus to hit and cut the ribbon. Responsible personnel from the related provincial departments, Ya’an City and Liangshan Prefecture attended the opening ceremony. See Figure 1 and Figure 2 for the opening ceremony scene and ribbon-cutting ceremony respectively.

12. Ya’an-Xichang Expressway is an important part (in Sichuan) of - Expressway (G5) and -Mohan Highway, one of the eight Western Main Passages, and is located in Ya’an City and Liangshan Prefecture. It stretches approximately along the Southern Silk Road, and connects to -Ya’an Expressway in the north and Lugu-Huanglianguan Expressway in the south, being a fast traffic lane for access to Sichuan Province from the south and north and for opening the radiation to the -Xichang and Yi Nationality regions, and a major passage for connection between Chengdu and Panzhihua-Xichang Economic Region and strengthening of contact and communication with Yunnan and –ASEAN Free Trade Area of Sichuan Province. The Project is constructed with the investment from Sichuan Expressway Construction & Development Corporation, and with the management in the charge of Sichuan Yaxi Expressway Co., Ltd. as the Employer. The Project commenced in 2007. Ya’an-Yingjing Section and Yihai-Lugu Section, with a total length of 90km, were first completed and open to traffic at the end of December 2010 and then, after more than one year’s hard work and diligence, construction of Yingjing-Yihai Section with a length of 150km came to an end as well. Up to this point, the whole of Ya’an-Xichang Expressway has been completed and open to traffic, which realizes complete run-through of Sichuan Section of Beijing-Kunming Expressway. See Figure 3 for photos of Ya’an-Xichang Expressway.

13. Up to now, all service areas along the Ya’an-Xichang Expressway are under construction and parts of the non-expressway works are still under construction.

2.1 Material indexes of land requisition

14. By the time when external monitoring organization started field investigation, the indexes of objects to be affected by land requisition and house demolition of the Project, checked and confirmed by Ya’an-Xichang Expressway Company Limited, land requisition and resettlement departments of local governments of each county (district) and the related agencies, are as follows.

2.1.1 Permanent land requisition

As of October 2012, the area of actual permanent land requisition of the Project has reached 17646.509 mu, more than 115.69% of 15253.89 mu of land area regulated by the Resettlement Action Plan of the Project. The land exceeded formed the supplementary land requisition. See Table 2-1 for statistics of permanent land requisition in the counties and districts.

2.1.2 Temporary land

15. As of the monitoring of this phase, the temporary land is 5144.046 mu in total, as shown in the statistical data of Table 2-2.

2.2 Material indexes for residential housing demolition

16. Along the whole line of the Project, the actual house demolition area has totaled 316420.97 m2, accounting for 152.63% of the planned house demolition area of 207312 m2 stated in RAP of the Project. Relocated households along the whole line total 2340, including 8035 persons. See Table 2-3 for detailed statistics of area of houses demolished along the whole line of the Project. Due to design changes resulting in an increase of affected objects, the amount of houses demolished in the counties and districts in the Project exceeded that as planned previously.

2.3 Infrastructure demolition

17. As of the monitoring of this phase, the external monitoring organization has obtained the statistical data of the relocation of communication, broadcasting & television and power lines as well as the infrastructure demolition in Hanyuan County and Shimian County, as shown in Tables 2-4, 2-5 and 2-6. The external monitoring organization has noticed other resettlement departments without providing data to provide detailed data for the monitoring and evaluation during the next phase.

2.4 Enterprise and school demolition

18. As of the monitoring of this phase, the houses for enterprises and schools planed to be demolished in the Project total 25320.405m2and have all been demolished. See Table 2-7 for details of the enterprises and schools to be demolished.

As of the monitoring of this phase, the relocation and construction of the schools to be relocated in the Project have been completed, and it is known to the monitoring organization that Shimian National Middle School has been formally put into teaching on September 1, 2011, with the restoration and resettlement details as shown in Section 4.5.1 of the Report. 3 Compensation Standards for Resettlement and Monitoring over Compensation Fees 3.1 Compensation policy and monitoring over compensation standards

3.1.1 Compensation policy

20. The external monitoring and evaluation organization for resettlement has detailed compensation policies and standards on resettlement implemented for Ya’an–Lugu Expressway Project in the previous monitoring and evaluation report (Phase V), including adjustment policies of compensation standards. During the monitoring of this phase, with respect to the temporary transition allowance, second relocation fee and change of paddy filed into farmland of the relocated farmer households in Hanyuan County, it is recommended to raise the related standards and supplementary work has been implemented.

3.1.2 Monitoring over compensation standards

21. Compensation standards for land requisition and house demolition specified in the RAP of the Project have been rigorously implemented in general. According to the comparison with actual compensation standards, the compensation standards for land in the Project are generally higher than those planned originally. See Table 3-1 for details.

22. Compensation standards for forest land occupation of Ya’an-Lugu Expressway Project have not been set out yet.

23. A constructive supplementary compensation scheme has been put forward in Hanyuan County for individual paddy fields which couldn’t be irrigated due to construction of the Project and could only be used as dry land, i.e., such paddy fields have been compensated for based on the difference between the annual output value of paddy field (1854 yuan/mu) Research Institute of Foreign Capital 13 Project Loaned by Asian Development Introduction and Utilization, Southwest Bank (2181-PRC) Jiaotong University (RIFCIU-SWJTU)

That is to say, the compensation standard is 673 yuan/mu per year. Calculated on the basis of two seasons a year, compensation of 336.5 yuan/mu per season will be made seasonally until irrigation is restored.

24. With respect to the compensation standards for house demolition, the resettlement departments in each county (district) implemented policies in 2007-2008 to increase house compensation price due to market price increase. See Table 3-2 for house demolition compensation standards of the Project after adjustment. Actual compensation standards of various counties all exceed the requirements by the RAP of the Project. During the monitoring of this phase, the counties and districts all maintained the compensation standards as provided in the monitoring of the previous phase.

As for Hanyuan County, due to the impact of land adjustment for resettlement and relocation & reconstruction of Pubugou Power Station Project, the issue of the house sites of the households to be relocated is solved with delay, which results in the fact that the temporary transitional time of part of these households exceeds the specified time limit, with a maximum transition period of up to 9 months. In order to deal with the actual difficulties of relocated households properly, the time for the payment of temporary transitional allowance has been extended and the transitional periods before the households for decentralized resettlement have confirmed the mode for building houses by themselves and before the house sites have been divided to the households for centralized resettlement are calculated based on the actual conditions.

26. The relocation subsidy standard in Hanyuan County is 358 yuan/person. As stipulated originally, relocation subsidy has been paid once only, which is not in line with the actuality, as the households have performed relocation activities twice, i.e. moving into the transitional houses and then removing therefrom into the permanent houses. Therefore, relocation subsidy shall be paid once again. For this purpose, the government plans to invest more than 14.00 million yuan as compensation for the second relocation.

3.2 Monitoring over compensation appropriation

3.2.1 Situations of fund appropriation

27. Generally timely appropriation of resettlement compensation funds is vital to the production and livelihood restoration of the affected people. 28. As of August 5, 2012, the Employer has appropriated 842.1656 million yuan for various kinds of land requisition and house demolition, and 760.5935 million yuan of which has been cashed in various counties and districts. See Table 3-3 for the statistics of fund appropriation.

29. Compared with the previous phase, great progress has been made in the appropriation of compensation funds in Hanyuan County with satisfactory cashing status. The compensation was always lagged due to impact of Pubugou Power Station Project on Hanyuan County during the monitoring of the previous 6 phases. Since the end of 2010, with the promotion of resettlement for Pubugou Power Station Project, most affected people have been properly settled, and the impact on other projects has been mitigated gradually. So far all compensation funds have been fully appropriated. 4 Monitoring of Resettlement Results

4.1 Monitoring of resettlement results of land requisition and house demolition

4.1.1 Overall evaluation of resettlement results of land requisition and house demolition

30. The external monitoring organization for resettlement has detailed the resettlement results of the Project in the Monitoring and Evaluation Report (Phase VI), and this current monitoring and investigation still hold the positive conclusions: i.e., generally, most regions strictly enforced compensation standards for land requisition and house demolition, and on the basis of full and timely appropriation, resettlement subsidies for land requisition have been successively appropriated timely and exactly on the whole as per time sequencing of various types of affected objects requisitioned, as well as the affected villages and groups all adopted the resettlement modes of land re-adjustment, or monetary resettlement, or both after the land requisition. During the current monitoring and evaluation, the monitoring and evaluation organization learned that Yucheng District, Yingjing County and Shimian County have launched the policies and measures on endowment insurance for land-lost farmers, which will provide the living guarantee for a very few of families totally losing land in the future.

31. The monitoring group conducted sampling survey on 62 households affected by land

The results indicated that the households affected by land requisition had good overall income and the per capita net income of all the households affected was increased to varying degrees compared to that three years ago. The households with 1-2 people which were mainly composed of old people gained small income increase and their income was increased mainly by land requisition compensation; other farmer households, due to obvious income increase from part-time jobs, supplemented with land requisition compensation, gained obvious income increase, especially farmer households with more forest land expropriated and wasteland reclaimed. According to the latest national poverty line standard, the households with per capita income lower than 2,400 yuan per year are included into poor households. 15 ones of sampling-surveyed households belonged to poor households, 8 ones of which had annual net income per capita lower than 1,500 yuan. They were mainly families of the Yi nationality in mountainous areas of Shimian County and Mianning County. These poor households are not resulted from land requisition, but mainly resulted from low labor capacity of their family members, with agricultural income as the main source and no income from part-time jobs, and meanwhile disease and education leaves them in poverty. A whole set of help-the-poor measures intended for poor households have been developed by our country, and it is predicted that they will get rid of poverty soon and start a rural well-off life. See Attachment 2 for Details on the Households Affected by Land Requisition and see Attachment 1 for Basic Information of Sampling-Surveyed Affected Villages. See Figure 4 for panel discussion between the monitoring group and the village cadres and villagers affected.

32. The contractors who temporarily need to use land due to project construction, have generally paid the compensations to the affected people according to requirements of compensation policies. The compensations for temporary land in Shimian County have not been paid.

33. The resettlement in centralized and scattered ways was adopted. Resettlement departments of various regions encouraged the affected people to give first place to independent resettlement, and they, with the cooperation of the villages and groups, assisted in relocating the affected households and solving the problem of re-building the house site. Most of the residents who selected scattered resettlement have finished rebuilding of new houses with the help of the resettlement departments and have moved into the new house to lead a new life. After the completion of new houses, the resettlement departments offered the affected households convenience to transact the housing land permit and house property certificate.

34. 1073 households were resettled in the centralized way in the Ya’an-Lugu Expressway Project; the centralized resettlement sites all are located in Ya’an and subject to the uniform planning and design by the local government, meanwhile, the protective measures were taken in consideration of potential earthquake effect on all resettlement sites to keep safety. The Employer and the local resettlement departments have jointly planned 17 centralized resettlement sites (16 in the previous phase, 2 increased in Shimian County and 1 cancelled in Yingjing County due to the rerouting), construction of which has been completed at present and most of relocated households have moved into the new houses.

35. In general, it was difficult to carry out the house demolition and resettlement work along the line of the Project, but everything went well and some fruits were achieved as well. Particularly, the Employer together with governmental resettlement authorities at all levels has successively improved the compensation criteria for house demolition since August 2008, greatly promoting the house demolition and resettlement work. The resettlement departments of various places adopted various measures to give preferential treatment to affected families with poor conditions, including the vulnerable families within the policy framework and performed the special resettlement. Meanwhile, as for resettlement, every family of different nationalities received equal treatment, without any policy bias against any nationality.

4.2 Monitoring results of centralized resettlement sites

37. Located in Fengmu Village, Babu Township (see Figure 5), the centralized resettlement site of Yucheng District covers an area of 50 mu, which is able to resettle 101 households of 388 persons. The centralized resettlement site was uniformly planned by the government and constructed by relocated households as per the house site of 30m2 per capita; there was no requirement for number of storey, and 80% households constructed the houses of 150m2. The site leveling was conducted in 2009, with house site distributed in November. Currently, 100% relocated households have already moved.

38. No.1 and No. 3 centralized resettlement sites (see Figure 6-Figure 7) were selected along Yingjing Section. Located in the brick plant by the enterprise office of Qinglong Township, No. 1 Resettlement Site covers an area of 17.595 mu and is able to resettle 36 households of 157 persons, while No. 3 Centralized Resettlement Site is situated on the other side of 108 Line on Hongyan Bridge, covers the state owned land of 8.5372 mu, which is able to resettle 30 households of 122 persons. The resettlement sites were uniformly constructed through tender; at present, the relocation in No. 1 Resettlement Site has been finished, and the house construction of No. 3 Resettlement Site has been completed and occupied.

39. There are 6 centralized resettlement sites in Shimian County, which can resettle 686 households of 1791 persons (Figure 8). As the resettlement is relatively centralized, difficult to carry out and has a large scale, the appropriate resettlement site is hard to solve and the work load and difficulty of planning and design are considerable; however, under the positive consultation and great promotion of Yaxi Company and the Shimian County Government, the construction of resettlement sites has achieved better progress compared with the previous phase and the house construction of resettlement sites has been completed. See Attachment 3 for the List of Resettlement Households in Xinmian Town, Shimian County.

40. There are 8 centralized resettlement sites in Hanyuan County, which can resettle 220 households of 856 persons (see Figure 9 – Figure 11). Some of the centralized resettlement sites were uniformly planned by the government and built by the farmers, while the remaining was constructed by the government. Except Danong Resettlement Site (which is not solved due to the dispute between the relocated households and the construction company), the relocated households have moved into other 7 resettlement sites.

4.3 Cases of special resettlement of vulnerable group

41. Liu Zhonghong, male, 45-year old, a villager of Group 4 of Xinchang Village, Tangjia Township, Hanyuan County, is disabled in intelligence without labor ability. He lives with his 18-year son and depends on each other. Based on this situation, they are taken into minimum living standard security by local government, and can get 55 yuan subsidy per person a month. Their cultivated land is more than 1mu, but in poor cultivation conditions, the output is poor. The removed house was an adobe one with an area of about 50 m2, and the compensation for relocation is about 10,000 yuan in total. In consideration of their poor economy, through the negotiation, the project coordination office of Hanyuan County and Yaxi Company decided to provide additional allowance of 20,000 yuan including 10,000 yuan for brick, sand and stone materials, 5000 yuan from social subsidy and the Bureau of Civil Affairs. The Villagers’ Committee helped them to employ construction team and to manage construction. With the great assistance from all sectors of the society, their new brick-concrete house of 90m2 was completed as scheduled (See Figure 12).

42. Cao Zhenghong, male, a villager of Xinchang Village, Tangjia Township, Hanyuan County, is over 70 years old. He is disabled in intelligence with amblyopia. He has a son over 30-year old who is also disabled in intelligence. They have 1 mu cultivated land to plant vegetables and corn, and the output just can support their living. They are taken into minimum living standard security by local government, and can get 55 yuan subsidy per person a month. The demolished house is an adobe one with an area of 60 m2, with the compensation more than 10,000 yuan. During the construction of new house, Cao Zhenghong’s toe was broken. Therefore, local government specially provided him 10,000 yuan subsidy for living and medicine treatment. Cao Zhenghong built a brick-concrete house of 95 m2, with the assistance of local government and the construction company. See Figure 13.

4.4 Interviews with important persons in the know of the affected county & district, township & town, village & group

43. The exclusive interviews with resettlement departments, as well as the important persons in the know of the affected villages and groups by the external monitoring and evaluation organization reflected the general progress of compensation and resettlement for the people affected by land requisition and house demolition in the Project and the existing problems to some extent. It also showed the recovery of production and life of the affected people.

4.4.1 Mianning County

1) Li Haihua, Section Chief, and Xiao Xu (18981575693), Office Clerk, from Coordination Office of Mianning County (Key Office)

44. Ya’an - Lugu Expressway Project (Mianning Section) totally lasts 69.7 km, involving 26 villages of 8 townships (towns) such as Lugu, Shilong, Houshan, Linli, Chengxiang, Caogu, Yihai and Tuowu. At present, land requisition, house demolition and resettlement work has been basically completed and only compensation for newly expropriated land has not been paid.

45. Most left-over issues of Ya’an - Lugu Expressway Project have been solved, however, a part of intricate left-over issues are to be solved through further mutual negotiation. They mainly include the following ones: First, transforming paddy fields into dry land project of Ya’an-Xichang Expressway covers many points and expansive areas, is necessary to be launched as soon as possible and the compensation standard shall be made clear as the masses complained strongly; second, on June 16, 2011, a flood occurred to Yihai Township, Caogu Township and Tuowu Township, Mianning County, and the three townships suffered a great loss as the previous scattered drainage was changed to centralized drainage through drainage ditch built in Ya’an - Lugu Expressway Project. It included economic loss of 391,997.1 yuan from 118.787 mu of restorable cultivated land, economic loss of 367,618.38 yuan from 55.14 mu of unrecoverable cultivated land and economic loss of 339,315.52 yuan in respect of road, pool, economic forest and means of production and livelihood, with 1,098,931 yuan in total. Local affected people strongly demand compensation; third, all townships and towns have reported for many times that non-expressway works shall be paid as soon as possible.

2) Qiu Jinning (of the Yi Nationality) (13881563349), Secretary, and Su Wenming (13795622992), Deputy Township Head, from the Government of Tuowu Township, Mianning County

 Basic information

46. Tuowu Township is located in the north of the county and the zone on the left of , with an area of 263.2 km2. In 2009, the total households were 970, with a total population of 3920, of which the Yi nationality accounted for 98%. In 2011, the total households were 1032, with a total population of 4160 persons, of which the Yi nationality accounted for 98.6%. National Road No. 108 runs through the whole territory and the township government is located 48 km away from the county seat in the south. It administers four administrative villages including Tuowu, Sangu, Huangjiaba and Luba, with 10178 mu of arable area, and agricultural products mainly are potato, buckwheat and Research Institute of Foreign Capital 22 Project Loaned by Asian Development Introduction and Utilization, Southwest Bank (2181-PRC) Jiaotong University (RIFCIU-SWJTU)

External Monitoring & Evaluation Report on Resettlement in Central Sichuan Roads Development Project oat, abound in Chinese red pepper. Rural per capita net income was 3,564 yuan in 2009 and 4,676 yuan in 2011.

 Land requisition and house demolition

47. The expressway totals 14 km in the Township, affects 8 groups of 3 villages, relocates more than 40 households and involves the land requisition of 538 mu. There are 4 villages of 3411 persons in the township, including only 11 households of the Han nationality. After land requisition, all the compensation was paid to the affected households. Due to large area of cultivated land, there were no land-lost farmers. After house demolition, the farmer households seek for house site for house construction by themselves. Because land purchase price was lower than the compensatory price of house site, all the affected farmer households could find their satisfactory house site for house construction.

 Left-over issues of expressway construction

48. Fort of Luba Group 6 in Bid Section No. 23 has not been commenced for construction; the land destroyed on September 18, 2011 remains unsolved; access roads of Luba Groups 5 and 6 have not been maintained; access road of Luba Group 2 has not been made available; access road outside the culvert of Luba Group 2 is required to be hardened; water pipes at Luba Group 1, Tuowu Group 2 and Huangjiaba Group 1 have not been recovered; 7.3 mu of forest land above Tuowu Toll Station has not been compensated; two access roads of Tuowu Group 2 have not been constructed.

3) Ma Wenhua (13989269312), Secretary, and Zhu Yunfei, Secretary of Youth League Committee, from the Government of Yihai Township, Mianning County

 Basic information

49. Yihai Township is 38 km away from the north of Mianning County, and the revolutionary resort, “Yihai Alliance” is located here. The site of township government is 2080m above sea level, with an area of 128.46 km2. In 1991, it newly built a market and had jurisdiction over 3 administrative villages, namely Yihai, Yanjing, and Lepa. In 2009, the total households were 1354, with a total population of 5366 persons; in 2011, the total households were 1469, with a total population of 5993, of which the Yi nationality accounted for 99.6%. With cultivated area of 7,250 mu, it mainly produces potato and corn as food crop and is abound in Chinese red pepper and walnut. Per capita net income was 3,456 yuan in 2009 and 4,566 yuan in 2011.

 Land requisition and house demolition

50. Land requisition and house demolition involved 17 groups of 3 villages. Land requisition required 688.5mu, which mainly involved the land in Yihai Village, Dayanjing Village, and Lepa Village. The houses of more than 40 households in total were removed. After land requisition, all the compensation was paid to the affected households. Due to large area of cultivated land, there were no land-lost farmers. After house demolition, the farmer households seek for house site for house construction by themselves. Because land purchase price was lower than the compensatory price of house site, all the affected farmer households could find their satisfactory house site for house construction.

The design scheme for traffic access road of Group 3, Lepa Village has not been implemented; land cultivation of Group 1, Lepa Village; construction of convenience bridge on Lepa River; the construction scheme for the culverts of Lepa Village and Yanjing Village has not been implemented; the issue that the bridge of Yihai Power Station was destroyed due to construction of expressway; improvement of drainage ditch in Yihai Section of the expressway and settlement of culvert drainage; the issue that a part of non-expressway works was destroyed has not been disposed; transforming paddy field into dry land and crop compensation; payment of non-expressway works.

4) Mu Xingzhi (of the Tibetan Nationality, Female, 13881554329), Secretary, and Guo Suying (Female, 13881561537), Deputy Township Head, from the Government of Caogu Township, Mianning County

 Basic information

52. Caogu Township is located in the northeast of the county, 22km away from the county seat, and National Road No. 108 runs through the whole territory. It lies in the alpine Erban Mountain area, and the site of township government is 1,960m above sea level. The entire township covers an area of 122.83km2, including cultivated area of 7,377mu which involves the paddy field of 984mu.It administers 3 administrative villages composed of 19 villager groups. In 2009, the total households were 1,630, with a total population of 6,982; in 2011, the total households were 1,758, with a total population of 7,515. Additionally, it is the township gathering people of the Yi nationality. Most of the land in the township is forest land, which accounts for 70% of total area. The cultivated land is 7132mu. Rural per capita net income was 3,157 yuan in 2009 and 4,436 yuan in 2011.

 Land requisition and house demolition

53. Land requisition and house demolition in Caogu Township involved 19 groups of 3 natural villages. Land requisition requested 153,519.31 m2, including paddy field of 18,489 m2. After land requisition, all the compensation was paid to the affected households. Due to large area of cultivated land, there were no land-lost farmers and land requisition didn’t have much impact on lives of the land-requisitioned farmers. 53 households in total were relocated. They seek for house site for house construction by themselves. Because land purchase price was lower than the compensatory price of house site, all the affected farmer households could find their satisfactory house site for house construction. Therefore, the housing conditions of relocated farmers were improved. At present, the construction of rebuilt houses has been finished.

 Left-over issues of expressway construction

54. It is required to extend the drainage ditch of Group 2, Damawu Village for about 10m; it is required to clean the culvert of Group 2, Damawu Village; access road of Group 2, Damawu Village has been occupied by the construction team for 6 years and not been compensated; the forest land occupied during rerouting of 35 KV transmission and transformation line has not been compensated up to now; flood protection embankment is required for Group 4, Dabaozi Village; the land of Wu Changhua’s family in Group 5, Dabaozi Village was destroyed by the flood and has not been compensated; the land under No.1 bridge of Dabaozi Village was flooded and the masses demand compensation for that; the masses demand that fort shall be constructed for the spoil ground of Cheyang Primary School. 5) Ge Yuangang (13518422191), Secretary, Li Pingcai (13398479015), Chairman of the People's Congress, and Zhou Wenyi (15983416062), Chairman of the Township Women's Federation, from the Government of Shilong Township, Mianning County

 Basic information

55. Shilong Township is located in the southeast of Mianning County, and National Road No. 108 runs through the whole territory, with an area of 23.2 km2. It administers 5 administrative villages (Shuangqiao, Minzhu, Heping, Shilong and Gaojian) composed of 25 villager groups. The township government is relocated at Fenlukou, Houshan Township in October, 2002, 24 km away from the county seat. The cultivated area is 10,586mu. In 2009, the farmer households were 4,080, with a population of 15,058; in 2011, the total farmer households were 4,080, with a total population of 14,954. Total agricultural output value accounts for 60%, total industrial output value 30% and the three industries 10%. Rural per capita net income was 4,561 yuan in 2009 and 6,221 yuan in 2011.

 Land requisition and house demolition

56. The expressway totals about 4.78 km in the Township and affects 15 groups of 3 villages including Gaojian Village, Shilong Village and Heping Village. It involves the land requisition of 292.75 mu, including paddy field of 124.97 mu and dry land of 167.78 mu. The monetary resettlement was adopted after the land requisition and the compensation has been paid to the affected households totally, without the land adjustment.

57. Secretary Ge Yuangang presented that construction and service of the expressway could significantly promote local economy and transportation of agricultural and sideline products from and to the township was very convenient. In addition, local traffic accident rate would reduce significantly after the expressway was open to traffic, which enabled the safety of villagers from villages beside the original national road to be greatly improved. Meanwhile, he also hoped that the expressway management was continuously strengthened, such as construction of protective guard, etc.

 Left-over issues of expressway construction

58. Transforming paddy field into dry land and crop compensation; house vibration of 14-household villagers in Gaojian Village and Shilong Village has not been solved; unit price of non-expressway works has not been raised, which causes serious losses of a part of works; land compensation for non-expressway works has not been paid; it is required to register and correct the missing non-expressway works reported before this year; the mountain in Shilong Village belongs to landslide mountain and the stability of skid resistance body is to be observed.

4.4.2 Shimian County

1) Ye Xiubin, Director (13981631351), Li Xiqiang, Section Chief (13981633607) and Yi Fubao, Division Chief (13981631351) from Expressway Coordination Office

59. There are six centralized resettlement points, the two larger of which are Caobapai centralized resettlement community and Chuanxindian centralized resettlement community.

External Monitoring & Evaluation Report on Resettlement in Central Sichuan Roads Development Project Currently, Caobapai, where 102 households will be resettled, and Chuanxindian, where 507 households will be resettled, have almost been built up and are expected to be submitted by the end of December. Part of those resettlement households will move into the new house before the Spring Festival. Most of the households in Caobapai community consist of the residents which are still engaged in farming, so considering their farming activities, flat roofs are designed specially in the resettlement house. This fully takes the convenience of the people’s production and living into account.

60. In Shimian County, a total of more than 1800 mu of forestland was taken over, and Liziping Nature Reserve is provided with the special funds for forest land protection, including the fixed protection fund of more than 2 million yuan and temporary protection fund of more than 200,000 yuan. The compensation standard for forest land affected by Ya’an-Lugu Expressway Project in Shimian County has not been formally introduced yet; however, the compensation for ground appurtenance has been paid. The actual compensation price for forest land reaches 40000 yuan/mu, including the vegetation recovery fee and compensation for ground appurtenance.

61. In 2011, a few of permanent land requisition, mainly including the supplementary land requisition, is added in Shimian County. The compensation for land requisition has been paid to the villager groups. However, the allocation plan of compensation reserved by collective organizations has not been developed.

2) Dai Qiang, Deputy Township Chief (13056599153) from Liziping Township Government

 Basic information

62. Liziping Township is located in the south, 35 km from the county. This township covers an area of 5.12 million mu where the minimum and maximum altitude is 1400 meters and 1880 meter respectively. Lizi Village, the site of the township government is 1470 meters above sea level. There are 2 nationalities composed of 7 administrative villages or 25 villager groups within Liziping Township. The total population of 4611 here consists of Yi, Han and Tibetan nationality. The area of arable land (dry land), forest land and grass land in the township is 2107 mu, 282555 mu and 390745 mu respectively. In 2011, the rural per capital net income was 5734 yuan.

 Land requisition and house demolition

63. The four villages in this township affected by the Project involve Yuangen Village, Lizi Village, Menghuo Village and Gongyi Village, among which, Yuangen Village is affected severely by house demolition. For the Project, more than 300 mu of arable land are occupied, more than 500 mu of land for farming are returned to forest, and 167 households are affected by land requisition. This township is resettled taking the principle of “giving priority to land resettlement and supplementing it with monetized resettlement” to ensure the land pare capital after the land requisition is not less than that contracted. The demolition affects 79 households, about 390 persons.

3) Luo Jianhong, Secretary (13881602908) and Li Chenggang, Chairman (13881630689) from Caluo Township Government

Caluo Township is located in the south of Shimian County, 17 km from the county and National Highway 108 runs through the whole township. This township covers an area of 76.3 km2 where the minimum and maximum altitude is 1100 meters and 1180 meter respectively. Fulong Village, the site of the township government is 1350 meters above sea level. Under its jurisdiction, there are Han, Yi, Tibetan and Bai nationalities composed of 5 administrative villages or 32 villager groups in the township. It totally has 1192 households with the total population of 4184. Arable land here has an area of 101 hectares, including 12.8 hectares of effective irrigation, 5986.5 hectares of forest land and 2700 mu of mulberry field. In 2011, the rural per capital net income was 5595 yuan.

 Land requisition and house demolition

65. The Project involves three villages: Shangli Village, Fulong Village, Nanya Village, among which, Nanya Village is affected most severely by demolition. The principle of land requisition and resettlement is giving priority to land resettlement and supplementing it with monetized resettlement if not meeting farming standard, so as to ensure the arable land area after land requisition is not less than that of the original. Compensation standard for those villages is 38157 yuan/mu; particularly, compensation granted to farmers follows 17000 yuan/mu for paddy field, 15000 yuan/mu for dry land and 15000 yuan/mu for land returning to forest and compensation for young crops follows 800 yuan/mu for paddy field and 600 yuan/mu for dry land. Compensation for land requisition has been appropriated to the villages and groups. Demolition affects 62 households across this township, composed of about 244 persons.

4) Xiang Jianping (13320503216), Director of Sub-district Office, and Luo Daidi from Sub-district Office of Xinmian Town of Xinmian Town Government

 Basic information

66. Xinmian Town is located in the county area and have jurisdiction over six 6 village, composed of 30 villager groups with an area of 18.5 square kilometers. There mainly are Han, Yi and Tibetan nationalities. According to the sixth census, this town has a permanent population of 3265 households and a total population of 9742. The area of arable land totals 226 mu. The villages and groups under its jurisdiction are distributed along the National Highway 108 and Lugu-Shimian Line. The Miancheng Sub-district Office governs 8 community committees and 47 resident groups with an area of 10.4 square kilometers. According to the sixth census, the permanent population reaches 13127 households and the population totals to 31625.

 Land requisition and house demolition

67. Highways across this town are as long as 6 km with 3 bid sections. Two villages (Dongqu Village and Shunhe Village) and 5 communities of a sub-district (Yanzi Community, Laojie Community, Xinjie Community, Chuanxindian Community and Caobapai Community) are affected, of which, Dongqu Village has the most serious impact.

4.4.3 Hanyuan County

External Monitoring & Evaluation Report on Resettlement in Central Sichuan Roads Development Project 68. ① Permanent land requisition: Land requisition and demolition in Hanyuan County is not similar with that in other counties and cities along the Ya’an-Lugu Expressway Project. The former involves the relocation of people from both Hanyuan Reservoir area and Ya’an Expressway Project as well as the relevant policies for the expressway project is inconsistent with that for Hanyuan Reservoir area.

69. According to the original standard, the compensation of 18540 yuan/mu shall be paid. And now, the resettlement of the relocated households which have been identified, i.e. not from reservoir area has been completed generally while all compensations for land requisition and demolition have been paid including the difference between standard compensation for land requisition and demolition due to the expressway project and 18450 yuan/mu) which was made up in February 2012. All those compensations are paid to the households directly (The term “95%” referred to previously means the appropriation progress of those compensations but now disbursement has been completed 100%). Transition allowance for relocated people from the reservoir area affected by the Ya’an-Lugu Expressway Project has been paid to the present since the commencement of the Project (transition allowance is referred to as the compensation for young crops equal to 829.5 yuan/mu, paid quarterly, and now, such compensation has been paid for nine quarters), and the difference between standard compensation for land requisition and demolition due to the expressway project and 18450 yuan/mu will be paid one time after their identities are authenticated and the resettlement is finished. The final compensation standard will not be net of transition allowance. Currently, such problem as inundation of land rather than houses fails to be solved, so the identities of those relocated people are subject to confirmation and are still controversial.

70. In addition, the compensations for land requisition and demolition over more than 600 mu of collective land will be confirmed by the end of 2012 and thus have not been appropriated. The compensations will be appropriated to various townships upon funding (regarding permanent land requisition, the area of non-arable land (mainly barren mountains and slopes) is half of that arable land). Specific appropriation amount will be refunded for any overpayment according to the settlement between Yaxi Company and the local government in September 2012, which is estimated to close to 50 million yuan.

71. ② Land for temporary use: Total more than 1000 mu of land has been occupied temporarily. By far, more than 200 mu of land has been reclaimed while the remaining more than 800 mu of land used temporarily are still not reclaimed. In general, the reclamation of land for temporary use is in slow progress. This shall be attributed to that different construction companies are responsible for different bid sections and the Employer has a commitment to the reclamation of land for temporary use but not documented it, resulting in ineffective recovery efforts. At present, some land for temporary use in Tangjia, Xiaoguan and Jiuxiang has been reclaimed and the reclamation of those more than 200 mu land has been accepted by the Employs but there is no money to pay. Funds for more than 500 mu of land for temporary use which can not be reclaimed, such as spoil ground have not been appropriated, because of the lack of reclamation program for Hanyuan County and reclamation standards.

72. Due to the lower housing compensation over the past, the relocated people from the Ya’an Expressway Project do not enjoy the “post-resettlement support” policy like those from reservoir area. People can not understand why there shall be difference between the policies for the reservoir area and the expressway area, leading frequent petitions to the higher authorities and gathering events. For example, the compensation standard for

External Monitoring & Evaluation Report on Resettlement in Central Sichuan Roads Development Project Shuangxi Township is 22 times while for Jiuxiang, 28 times and for Fuchun, 25 times. This standard varies from relocation policy for people from the reservoir area to that from expressway area. However, people can not understand and so they gather. Considering this situation, recently, Yaxi Company paid part of the secondary relocation fees. Generally, the special compensation for Hanyuan paid by Yaxi Company includes two parts, transition allowance, i.e. compensation for young crops and secondary relocation fee.

73. Another 12000 yuan for resettlement are paid to the two scattered relocated households in Jiuxiang Village and Yanping Village. Such funds are appropriated to villages to find house sites upon the coordination of village governments. At present, the house sites have been in place for two month and resettlement house is under construction.

74. Regarding the nine-household centralized resettlement point of Danong Village, the resettlement compensation has been appropriated to each household. However, the construction company found by those nine households absconded during construction with their resettlement compensations; therefore, the construction of houses is in slow progress. Now, under the support from the local government, construction of the centralized resettlement point for the nine households has been completed.

75. As to the one extremely poor household of four, including one disable, in Fuquan Township which petitions frequently, more than 100,000 yuan of compensation for house demolition has been paid in accordance with relevant policies and compensation standard. However, this is not enough to build a house (It is estimated that the construction of a new house requires at least 160,000 yuan). Therefore, this household still lives in the temporary transition house granted by the government with 260 yuan of transition allowance per month. At present, the Fuquan Township Government has come forward to be responsible for building a house at quality level same with that they live now, which is under construction. During the construction of new house, the transition allowance of 260 yuan/month was paid for more than a year and has been stopped. Considering the special conditions of this household, it is possible to extend the payment of transition allowance for up to six month. But until now, specific program has not been developed.

76. Jiefang Primary School has been resettled well. Yaxi Company compensated more than 200,000 yuan and provided with infrastructure, and the local government funded the remaining part with financial subsidies.

 Restoration of infrastructure

77. On the one hand, two village roads were damaged seriously, causing people travel difficulties and posing a threat to their personal safety. Upon the agreement with the construction company, the village roads will be constructed with the compensation of 500,000 yuan/km; however, such fund has not been in place yet and thus by far, village roads restoration project has not yet commenced too. More than 3 million yuan of fund for construction of local roads has poor coordination with Yaxi Company.

78. On the other hand, non-expressway works have not been completed. Some areas are in serious cases, such as lack of water, road breaking, blocking of flood control trenches and weirs. The masses in Jiuxiang and Tangjia reacted strongly.

79. This shall be attributed to the difference between the construction of non-expressway works in Hanyuan and Yucheng and Yingjing. In Yucheng and Yingjing, Yaxi Company pay to the local government which then organizes the construction, while in Hanyuan, the Research Institute of Foreign Capital 29 Project Loaned by Asian Development Introduction and Utilization, Southwest Bank (2181-PRC) Jiaotong University (RIFCIU-SWJTU)

External Monitoring & Evaluation Report on Resettlement in Central Sichuan Roads Development Project Employer appoints the construction company for construction and infrastructure recovery with the funds provided by Yaxi Company, resulting in insufficient attention paid for this part of works.

80. The current situation is: Partial non-expressway works have been completed by the construction company but not thoroughly; and some works are entrusted to the local governments but the funds are not fully paid.

4.4.4 Yingjing County

1) Director Wang from Land Requisition and House Demolition Office of Yingjing County

81. Yingjing Section of Ya’an-Lugu Expressway has been partially opened to traffic and the houses of relocated households have been already constructed. However, following problems on land requisition and house demolition are not solved:

82. The temporary land is difficult to reclaim. If temporary land of more than 300 mu for stock yard and other purposes is reclaimed, cost of 20000 yuan/mu will be required. If these lands are requisitioned permanently, its compensation is more than 20000 yuan/mu. In addition, the land is located in narrow and long places where the arable land per capita is less, so the affected farmers prefer to reclaim the land. This problem is to be solved.

83. The problems on engineering include: ① the drainage pipe does not reach the safe drainage places due to insufficient length, causing the farmland to be inundated; ② there are potential geological disasters and the retaining walls are not constructed in some spoil grounds.

4.4.5 Yucheng District

1) Zhou Cong, Secretary from the Guanhua Township Government of Yucheng District

84. Generally speaking: 1) The affected infrastructure by the Project has been improved compared to that before the commencement of the Ya’an-Lugu Expressway Project, and non-expressway works were performed well with significant improvements in roads, water supply, etc.; 2) All funds for compensation and resettlement due to land requisition and demolition have been appropriated in place in a timely manner; 3) the compensation for land requisition and demolition has been appropriated by the land and resources bureaus to each household; 4) land adjustment in the villages affected by the Project has been fully completed; 5) the centralized resettlement points for the affected people by the Project have been built up, and the house sites for other scattered relocated households has been determined where the affected households can select a site for house building; 6) new houses for the affected people by demolition have been built up and been moved in.

85. The major problems faced by the Ya'an-Lugu Expressway Project in Guanhua Township are the leftover problems: 1) Reclamation of the temporary land. Rent for the temporary land in Guanhua Township received by the people has been stopped in February 2012. However, the Employer has not agreement with the Township Government on the unit price of reclamation. The former intents to follow the standard for Yingjing, i.e. 10000 yuan/mu and additional 3000 yuan/mu for the land with reclamation difficulties, which in the latter's opinion, are too low. This has led to the withdrawal of the construction company and the temporary land can not be returned to the people. Moreover, the rent has not

2) Wang Zhixiang, Secretary (13508169332) from Babu Township Government of Yucheng District

86. All infrastructure of centralized resettlement point has been constructed, so have the houses for scattered resettlement. The centralized resettlement point in Fengmu Village is constructed Babu Township Government with a total investment of 1 million. And now, “three supplies and one leveling” (supply of water, electrify and road and leveled ground) has been realized. The investment of 500,000 yuan will be spent to build cement bridges and bus stations, creating a beautiful model village. However, the District Government only funds 300,000 yuan, causing larger financial gas.

87. Total over 200 households in Babu Township have been covered by endowment insurance for landless farmers. In November 2009 they applied for social security and reached specified age. That means they can receive 464 yuan per month since December, which will increase to 584.5 yuan in 2010 and 724 yuan in 2011.

88. Currently, the main problems include: Duo to collapse along the Ya’an-Lugu Expressway and network closure, additional 14 - 17 mu of land has been requisitioned and compensated according to the compensation standard for permanent land requisition, which has been paid fully by Yaxi Company; 228.886 mu of temporary land in the whole township, involving about 1540 households of farmers (some farmers are double-counted) is difficult to be reclaimed and has no agreed reclamation standards; the construction company did not continue to pay the rent of temporary land after not use it; the funds of 1.2 million yuan for the non-expressway works (Phase II) have not been fully paid to the successful construction company, and the financial gas reaches to 800,000 yuan in despite of 400,000 yuan of loan provided by the government; moreover, the ancillary facilities at the both sides of the expressway have some problems about recovery to be solved, such as irrigation ditches in Hulu Village. During infrastructure recovery, this contradiction between the governments, which intend to improve facilities, and the Employer, which requires controlling the size of funds, has led the dissatisfaction at infrastructure recovery from local people.

4.5.1 Schools

91. The education department of Shimian County has merged the former Huilong Middle School and the former National Middle School into the present Shimian National Junior Middle School, and the new campus has come into service on September 13, 2011. The investment for new campus construction totals over 30 million yuan, among which, 28 million yuan has been donated from Taiwan. Besides, Yaxi Company has contributed 4.8 million yuan (including 1.2 million yuan appropriated in the transitional period) to the local education department for the development of education. Bid invitation, design and construction of the new campus with high quality teaching hardware facilities have all been completed by Taiwan party. The new campus occupies a land of 30.2 mu, with a building area of 19,700 m2, office buildings of 6,800 m2 as well as 970 students, 62 teachers and 18 classes for three grades. Each classroom has an area of 80 m2 to accommodate only 50 students. The public area is designed on the scale of 1:1, i.e. 1 m2 for 1 student; each dormitory is design on the scale of 1:4, i.e. 32 m2 for an 8-personed dormitory.

All educational resources in Shimian County have been integrated in the Shimian National Junior Middle School, improving the educational quality. In addition, hardware facilities of the school rank the first in Shimian County and come out top in Ya’an City. Its headmaster is satisfied with the resettlement and has good wishes for the future of the school.

93. All kinds of related enterprises have been relocated and resettled for the Project, with no problem left over. The Daduhe Noodle Factory in Shimian County with which the previous negotiation failed has reached an agreement with the Yaxi Company and the local resettlement department. There are total 793.47 m2 of houses demolished with 746,500 yuan of compensation. So far, reconstruction of the factory has been completed and production recovered. The new plant of Daduhe Noodle Factory is shown in the figure below. See the monitoring reports of previous five phases for the details of resettlement of other enterprises.

4.6 Infrastructure restoration

94. Infrastructure reconstruction caused by the Project includes road demolition, water diversion, pipeline transfer, communication and power transmission line relocation, etc., and the infrastructure is under the gradual and orderly recovery and reconstruction. According to agreements reached between Yaxi Company and local government, infrastructure affected shall be reconstructed in two principles: one is construction before demolishing in order to avoid affecting normal production and living of the people; the other is reconstruction as per grade and quality of the original to avoid decreasing infrastructure level of area affected. The monitoring group confirms after investigations: both principles have been carried out completely and local governments are satisfied with infrastructure reconstruction.

5.1 Monitoring and evaluation conclusions

95. The land requisition, house demolition and resettlement for Ya’an-Lugu Expressway Project have been carried out systematically as per the originally specified schedules and procedures. Up until the field investigation conducted by the Monitoring Team in August 2012, 115.69% of RAP for land requisition along the whole line has been completed, with the area for land requisition exceeding the planned area. The area for house demolition is far more than 152.63% of planned area for house demolition stated in RAP of the Project and the main reason is that design changes during the Project construction result in increased area for land requisition and house demolition. At present, the focus of resettlement has changed from the compensation for land requisition and house demolition to the resettlement and drive for the income recovery for affected people. The current major task is to promote the construction of centralized resettlement sites, and ensure the compensation for affected people in place and the reclamation of temporary land, especially in Hanyuan and Shimian Counties. Viewing from the land requisition, house demolition and resettlement in all counties and districts, owing to the careful preliminary preparation for resettlement, the manageable RAP, the rational compensation standards, the well implemented resettlement measures, the extensive public participation and the enthusiastic work of the resettlement management organization, all resettlement work can be performed in strict accordance with the RAP without any major problems. With great importance attached to some issues found by the External Monitoring Team in previous phases, the Employer and the local governments have taken the following measures for the actual issues to greatly improve the living of dislocated persons and accelerate the progress of resettlement, which is appreciated by dislocated persons.

96. Therefore the Monitoring Team can come to the following conclusions:

① From all kinds of information gathered, we reach a definite conclusion: Either the dislocated persons affected by land requisition or the dislocated persons affected by house demolition have all been well resettled basically. Till now, no affected people live in poverty or their living standard falls down owing to land requisition or house demolition for the Project construction, which is in compliance with the general resettlement policy target of the ADB and Chinese Government.

② All the compensation standards for land requisition, house demolition and resettlement are not inferior to those stated in the RAP. Additionally, in order to protect the affected households’ living conditions against deterioration, the Employer and the local governments have taken various measures to improve the compensation standards to cope with rising prices. Special attention has also been given to the vulnerable groups in this Project. Therefore the resettlement work brings about fine effects.

③ The housing conditions of relocated persons who have been resettled are generally improved. The original houses of many relocated households were simple and crude. The highway construction creates a good opportunity for them to rebuild their houses with the compensation given by highway project owner and their own savings. All the new houses are commodious and comfortable, which is the satisfactory result of the relocated persons.

External Monitoring & Evaluation Report on Resettlement in Central Sichuan Roads Development Project ④ Generally, the highway project owner can timely make payment of compensation in place, and the local governments are not found to pocket or appropriate any compensation for land requisition and house demolition for any other purpose. This ensures the smooth implementation of resettlement.

⑤ Resettlement management organizations at all levels, especially those of local governments, have done a lot of work for the dislocated persons carefully.

5.2 Problems and suggestions

97. The main issues found during the field investigation by the Monitoring Team of External Monitoring and Evaluation Organization and their proposed countermeasures are as follows:

98. In some counties and districts, the new land compensations have not been paid to affected people and in Shimian County, there is still no compensation standard for forest land. Therefore how to effectively paying compensation for land requisition for this Project to affected people has become the focal issue among conflicts to be settled most emergently.

99. Part of compensation for temporary land of Shimian County has not been paid to the affected households and it is suggested that relevant departments should implement this as soon as possible.

100. With the completion of the Project construction, the issues related to the reclamation of temporary land and its restoration appraisal have been put on the agenda. Local resettlement departments also need to put their thought and energy into solving problems, such as the transformation from paddy fields into dry lands by improper irrigation due to damaged water systems, the definition of lands which fail to reclamation (e.g. spoil ground) and relevant compensation and the restoration of damaged roads. The Employer shall strengthen the coordination of and supervision over various negative impacts on production and living of villagers, coordinating with the local governments in issuing policies of compensation and restoration and supervising timely the construction company’s restoration and compensation as per these policies for affected people.

101. Social security related to land-lost farmers has not been implemented and it is suggested that relevant departments should take positive steps to implement it.

5.3 Focus of monitoring during next phase

102. Focus shall be given particularly to payment of compensation for new land requisition. Shimian County shall be particularly traced for compensation standards on forest land and payment of compensation for temporary land.

103. The construction company shall be supervised for the restoration of local water systems and roads damaged due to construction, temporary land for spoil ground and houses damaged in blasting works, etc. The implementation plan and progress for compensation for temporary land and reclamation shall also be supervised.

104. Attention shall be paid to the future life supply of few land-lost farmers after the land requisition and the issue and implementation of social security policies in all areas shall be particularly traced and understood.
