This complaint is submitted regarding Cox Communications and their failure to correct a closed captioning problem with their service in Orange County,

California. This on-going problem has led to additional issues, which are detailed below.

I suffer from Post-Otitis AUditory Dysfunction (POAD). POAD is an intermittent and unpredictable hearing loss that includes deficiencies in auditory perception and development of phonemic awareness or the ability to recognize the separate sounds that make up a word. Issue 1 It has been no less than eight months since I have made Cox Communications aware of the fact that closed captioning displays only gibberish for most channels above 100 when using their High Definition DVR converter box. Their television broadcast stations go well into the 700 series, which discloses the magnitude of this problem. To date, they have made no attempt to correct it. Also, All of the High Definition channels do not receive any closed captioning at all. Issue 2 Not only has this problem existed for an unacceptable length of time, Cox Communications obviously has no intention of correcting it. Every time I have contacted their customer service department, regarding this, I am consistently told that this is the first time they have been informed of it. To further aggravate this deficiency, customer service habitually states that there must be a problem with the customer's TV or wiring inside their house. Then they state that if the customer desires to have a Cox technician come to their home, there will most likely be a service charge imposed. The purpose of this tactic is two-fold. It improperly shifts the responsibility to the customer and dissuades them from pursuing any further action with Cox Communications. After many of in-depth conversations I have

had with several Cox technicians, it is conclusive that the problem lies within the infrastructure of Cox Communication's system and/or equipment in Orange County. Issue 3 Cox Communications is doing everything possible to avoid dealing with this issue. When I pressed them to rectify this inadequacy, one of their representatives finally admitted the problem is in their High Definition DVR box. That individual offered two possible solutions. The first was to downgrade to a non-DVR box. To do so would result in receiving a lesser service. The second was to cancel their service and get a satellite dish. Both of these suggestions are not only unacceptable because it demands that people with disabilities to accept lesser services, but they also give rise to a more compelling question. What about fixing the problem? There are no other options for DVR service offered by Cox Communications, or by any third party, due to the nature of their digital service. This severely limits any alternative choices I may want to pursue and forces me to rely on their performance. Because of this, I will not give up on this issue and will press it until Cox Communications complies with its legal responsibility as stated by the Americans with Disabilities Act.

RESOLUTION REQUESTED - COX FIX THE CLOSED CAPTIONING PROBLEM ON THEIR DVR BOXES WITHIN 30 DAYS OF THIS COMPLAINT, AS THEY HAVE ALREADY HAD OVER 8 MONTHS TO CORRECT IT. COX SHOULD BE FINED FOR FAILURE TO COMPLY WITH THE AMERICANS WITH DISABILITIES ACT. Dear Mr. Leone;

This letter is in response to Cox communication "response to Complaint letter written on 2/2412006 regarding my complain of problems with the closed captioning service.

Cox is attempting to diminish the severity ofthe problems with their service, by first stating that the 2 main issue are "gibberish on channels above 100" and "a lack ofclosed captioning on only some ofthe high definition channels". This is a partial truth. They seem to have overlooked the fact that many ofthe channels do not display closed captioning, and of the ones that do, they do so with a large time delay between what is spoken and what is in closed captioned text.

In the paragraph beginning on page 2 and ending on page 3, Cox states "Cox ... offered a high definition box without the DVR while waiting on a solution from the vendor, which Mr Kalron declined.". This is again a half-truth, as they make it sound as ifthey offered to give me a non-DVR unit to use in the meantime. I refer to my original complaint letter on 12/2/05 to the FCC (see page 2 ofthat letter) "11/2/2005 2:24pm a Cox representative named Tanya stated "You can trade-in for a non-DVR box. Or why don't you just switch to satellite?" This option given would have me return the DVR and get the non-DVR unit. I then would not be able to record any high definition shows, which is a benefit enjoyed by people who do not suffer hearing impairment. This option was simply a downgrade in equipment with a corresponding reduction in price. However, they attempt to make it appear that they are giving me free equipment, which is not the case.

Cox Communications did give me billing credits as compensation for my inability to record programming due to inherent failures within their DVR cable box including closed captioning issues. These issues refer back to my first complaint from June 2005. At that time, I spoke to Tanya, in their main complaint department, after getting absolutely no cooperation from their front-line service representatives. This credit given was specified to compensate me for the lack ofservice for the prior three months ofthe DVR digital box rental. It took them 4 to 5 months to it issue the credits on because ofmy constant complaining. As acknowledged by Cox in their statement on the I" paragraph on page 2 "The FCC closed captioning rules further provide that cable operators, as distributors ofvideo progranuning, must ensure that the progranuning it retransmits contains captioning as required by the rules (with the ability to rely on certifications from its programmers that the programming contains all required captioning) (47 C.F.R. §79.1 et seq.}." That being so, then why is Cox putting up roadblocks to report problems with channels? They seem to explain their view on this in the last sentence on page 3 that continues to page 4 and I quote it "And while Cox is also not held responsible for a lack of captioning on the broadcast stations it carries. Cox will take steps to troubleshoot issues on these channels to ensure that there is not a system problem."

As per 47 C.F.R. § 79.1 (G) I) as stated below, Cox, as stated in their letter ofFebruary 24, 2006 by their own admission, they are in direct violation ofthis regulation by failing to give proper notice to station or owner ofthe non compliant progrannning. In the last paragraph ofpage 3, they spend a great deal ofeffort to state that many ofthe channels I reported are "exempt" or "they are not responsible". While this may be true that not all charmels fall under the FCC requirements, this does not relieve them from their responsibility for the many channels that do fall within their responsibility as stated above.

This verifies why Cox is in violation ofFCC Rules and Regulations - 47 C.F.R. § 79.1 (G) I) "for failure to forward complaint within seven days ofreceipt to the programmer or send written instructions to the complainant on how to refile with the programmer. "

One of the more aggravating broadcast issues concerns an excessive delay ofthe closed captioning as it corresponds to the spoken word. It is common for the closed captioning to appear 10 seconds after the dialogue is spoken. The difficulty in following the storyline, with this inexcusable delay, is obvious. Their excuses, on the surface, sound plausible. However, these arguments fail when comparing the High Definition channels to their corresponding normal channels. For example, channel 705, which is KTLA HD, has a ten second lag compared to channelS KTLA has only a one second delay for the same show. When discussing this disparity with Cox representatives, they appear to be completely oblivious to this timing variance and gives one the impression they do not even monitor their own programming.

On page 3, the 4th pararaph Cox states "Cox has confirmed through a visit to the customer's home after the Motorola upgrade (February 14 2006) that closed captioning was being transmitted properly on high definition channels except for broadcast channel KTLA-HD". It should be noted that they observed this problem for a full thirty minutes and expressed surprise that KTLA HD had such a problem. It seem incomprehensible to me that they never saw this obvious flaw on their own monitors and leads me to believe that this service call was merely a delaying tactic as has been their pattern in the past.

During this same service call, they stated that ifthe cable guide (the on-line menu that lists their programming and its corresponding information) does not display (CC) in the show description, then there is usually no CC for that particular the show. I question the validity ofthis statement because cable guide is offmost ofthe time. It rarely gives the title let alone any additional information.

It is important to point out, at this time, that now the closed captioning on the HD channels (when it is there and working properly) displays the CC without a black background. The non-HD channels show a display oftext, contained in a black background, which blocks out everything behind it. I have requested Cox to correct this as well on the non-HD channels.

Cox is attempting to claim exemptions for new stations, which are part ofexisting networks, and this an intentional perversion ofthe FCC rule by Cox for their own convenience and to circumvent the regulations.

The music stations that Cox asserts are exempt are not according to FCC rule 47 CFR Part 79.1 (d) 10). The rule states a music station exempt only for" Primarily non-vocal musical programming. Progranuning that consists primarily ofnon­ vocal music." The stations Cox refers to fail to meet this exemption.

Paid advertisements longer in duration than I0 minutes are also snbject to the requirements ofclosed captioning requirements. They are not exempt as per FCC rule 47 CFR Part 79.1 (d) (6).. Here is yet another problem that Cox fails to address.

There is a solution available to Cox that would aid them in correctiog these and any other problems with shows they rebroadcast. Cox should provide a reporting procedure, on their website, to make it easy for reporting problems with programs they show. This would allow them to recognize and correct problems before any complaints to FCC arise. They acknowledge that it is their responsibility, as a re-broadcaster, that they "must ensure that the programming it retransmits contains captioning as required by the rules". However, this is an impossibility ifcustomers have no way to communicate their problems. As shown by this complaint to the FCC, they have repeatedly failed to ensure proper closed captioning. Enabling customers to report these problems directly to Cox is not just desirable, it should be required by the FCC. One would think Cox would embrace an easy system oflogging problems on stations or shows for consumers. Instead, it appears they are reluctant to do so because it creates a paper trail disclosing their pattern ofnoncompliance with the regulations.

After over halfa year ofcomplaining to Cox, nothing had been done to correct the problem. Now that I have contacted the FCC, Cox is beginning to respond to me. However, they still refuse to acknowledge there are numerous problems, a few ofwhich have been addressed, but have done little or nothing to rectify all ofthem.

This is just a small representation ofthe problems, 1did not even get to all the channels at the time. Ifneeded, a far mOTe extensive list can be compiled. The list would easily exceed 7 pages per day.

I allege Cox is in violation of Sections 303 (u), 305. 330 (b) of the Communications act, as amended, and the Commission's Rules, 47 C.F.R. Parts 15,119 and \5.122, and part 79.1 el esq. Ofthe Commission's rules, and the authority delegated in section 0.141 ofthe Commission rules 47 C.F.R 0.141. ela! . And Statute: Sections 711 and 713 ofthe Telecommunications Act (47 USC 613) Regulations at 47 CFR, Part 79.1 And ("Television Decoder Circu.itry Act of 1990" or "Prohibition on the shipment ofcertain television receivers"): Statute: Sections 303(u) and 330(b) of the Telecommunications Act (47 USC 330) Regulations: 47 CFR Part 15.119 and 15.122. COX is in violation with the Television Decoder Circuitry Act of 1990 They are also in violation ofthe rules that state effective Jan 1 2006 they are required to broadcast 1000/0 ofchannels with Closed Captioning. The high definition shows are in clear violation ofthis, since most shows in High definition were created after 1998. USC is "United States Code." CFR is "Code ofFederal Regulations." Any errors or additions to the above complaint need to be brought to my attention as soon as possible. A response is requested in within 30 days ofthe date ofthis notice.

I am writing this letter to complain about the Closed Caption service on the Motorola DTC6412 III. For at least 8 months, the closed captioning service has not worked properly, due to an apparent problem at Cox. I have attempted many times to get this fixed. I have been toid Cox would be fixing it soon, it never happened. On multiple occasions, the Motorola DTC6412 III set top box has been replaced. This has never corrected the problem. Just wasted a lot of my time reprogramming the shows back and losing forever shows I wanted to retain.

I have taken upon myself to compile some information on what channels have problems with closed captioning. Please refer to the 6-page document attached (to see the printout in correct order place the pages in the following placement format) 1 2 34 56 cc ok means after viewing the channel for a few minutes, the closed captioning displayed readable words. This is not saying that it worked 100% correct. There is usually a fair amount of miscellaneous errors like missing words or sentences. There were 61 of these at the time

NONE means at the time ofmy reviewing the channel no closed captioning displayed even after waiting up to 4 minutes. There were 20 channels with no closed captioning

GIBBERISH means the closed captioning displayed is intelligible. an example ofgibberish is actor says" The cat fell offthe ledge" and Closed Captioning shows "htkfs sdfja djlfsa lojj j jl" there were 21 channels in gibberish out of 102 .

Also attached is a 2-page listing of some ofthe shows I attempted to watch over a I week period that contained closed captioning as gibberish.

There were more contacts with Cox than this. And please note when reading 1investigating this that the problem is in their system or all of the DVR boxes (WHY DO THEY KEEP SENDING OUT SERVICE PEOPLE ?(HAVE THEM FIX IT AT THEIR END)

Prior to July 2005 (I do not have the exact date. I called Cox support complaining (again) about the closed captioning issue. They send a tech out. He told me that a "Phase 3 " box was coming out at the end of July, and to wait and contact Cox support. Call then at the end of July and request "Phase 3 Box" to replace mine because the phase 3 box would be compatible with my TV.

In June 2005 (I Spoke to Tanya in their main complaint dept after getting tired of the std support reps.) I was to be given a service credit for the prior 3 months of (the digital box rental) due to service problems relating to basic functionally of the DVR box. At this time I also complained about the Closed captioning problems. (they credited me the 44.70 for 14.90x3 on the 10105/05 billing cycle after I complained about that too.) on the same call, I was also supposed to receive a service credit for the NEXT 3 months of (the digital box rental) due to service problems relating to basic functionally of the DVR box including closed captioning service issues, as they said they would not fixing the problem for at least 3 months "at least not until October. 2005 (they credited me the 44.70 for 14.90x3 on the 11/05/05 billing cycle after I complained A LOT about that too they also told me at this time that a comment was added to my file stating no service for service problems to be given to me. (It is their service not living up to FCC Rules) Cox is in violation of Statute: Sections 711 and 713 of the Telecommunications Act (47 USC 613) Regulations at 47 CFR, Part 79.1 and Statute: Sections 303(u) and 330(b) of the Telecommunications Act (47 USC 330) Regulations: 47 CFR Part 15.119 and 15.122. In October, I made calls regarding the closed captioning issues and they said they did not know when the closed captioning would be fixed.

They have sent service reps out to my house many times concerning the closed captioning issue ( making TV signal either up or down each time -sometimes they said too much signal could cause the problem. service reps came out over 7 times since Jan. I called a lot more times than they came out

Also, I am requesting Cox to discontinue all commercials they have concerning satellite service, as the commercials claim satellite has poorer service, yet when dealing with Cox's customer service they make it out that satellite service is better, by recommending it to get service without problems. This also would be in violation of the FCC and FTC Rules concerning Broadcasting information that Cox knows is false.

I am writing this update letter to complain about the ongoing issues for Closed Caption service on the Motorola DTC6412 III. For at least 10 months, the closed captioning service has not worked properly, due to an apparent problem at Cox. I have attempted many times to get this fixed. Ihave been told Cox would be fixing it soon, it never happened. On multiple occasions, the Motorola DTC6412 III set top box has been replaced. This has never corrected the problem. Just wasted a lot of my time reprogramming the shows back and losing forever shows I wanted to retain.

I have taken upon myself to compile some information on what channels still have problems with closed captioning. Please refer to the 2-page document attached.

cc ok means after viewing the channel for a few minutes, the closed captioning displayed readable words. This is not saying that it worked 100% correct. There is usually a fair amount of miscellaneous errors like missing words or sentences.

NONE means at the time ofmy reviewing the channel no closed captioning displayed even after waiting up to 4 minutes. There were 18 channels with no closed captioning compared to 20 on complaint filed 11/12/05 not much improvement.

GIBBERISH means the closed captioning displayed is intelligible. an example ofgibberish is actor says" The cat fell offthe ledge" and Closed Captioning shows "htkfs sdfja djlfsa lojj j jl" do not see this error much currently. They appear to have addressed it.

NEW ERRORS CC ONE LINE OVERLAP means closed captioning instead ofnormal scrolling, has one line fixed position box overlapping prior cc text creating gibberish. Think ofa typewriter and typing on the same line without moving the roller. fros BOX DISPLAYED. Means a solid black box (varying in size between I/S to 7/S ofthe screen size) appears and remains there until the channel is changed or Closed captioning is turned off. This problem has many variations. 1 BOX with no text blocking the image ofshow being watched. 2 BOX with CC TEXT being displayed, with the box blocking the image of show being watched. 3 BOX randomly doing the above. 4 BOX doing the above (I or 2 ) just viewing the show on that channel. 5 BOX varying in size from 1/5 ofscreen visible to 7/S. Obscuring the images ofthe show being watched at the time. CC ON SHOW MISSING WORDS. Means random words missing from cc compared to what is said. Varies from any where to just a couple in a show to 60% (I am not counting the shows that only had 2 CC words displayed the whole show.) Example: Th cat the hot today VS The cat fell offthe hot tin rooftoday. This is actually a very recurring problem on the Cox system. Ifthe same thing was done with audio feeds, that would be fixed very quickly, why is it not fixed on Closed Captioning?

CC has gibberish interlaced with the show. Example - ThE@ CatT feLl 034 Hot tin% roo# today. - Different than the gibberish problem earlier described in this letter (think Gibberish Lite)

CC timing problems. The CC displayed is out ofsync with images by a great deal, making the CC useless. This timing ranged from 5secs AHEAD to 10secs BEHIND images being displayed. (these were logged from only one night) I have seen more before, but lack info on those.

NO CC Except on commercials Usually occurred on News broadcasts thought that was very strange.

An error not mentioned above, but one I would like to have addressed most commercials do not display CC, is this a problem with COX system? Or are the commercials required to display closed captions?

Pattern I have noticed. KTLADT channel 705 the high definition version ofKTLA 5, would air the same show on both channels at same time, yet the 705 show would have no CC but 5 would.

Also High Definition channels continue to not show Closed Captioning on most shows.

Also attached is a 2 page listing ofsome ofthe shows not displaying closed caption in violation ofto watch over a day plus a few reoccurring shows I watch a lot.

I was contacted around the 17th ofJanuary 2006 ( a little more than 45 days after my initial complaint) by a representative of Cox Communications. At that time I informed them that while the gibberish issue plaguing the digital channels appears to have finally addressed ( only fixed around the 17th ofJanuary 2006 ) ,and that there are still problems. I informed them ofthe square box problem, and the no cc problem still prevalent.

Also, I am adding to the complaint a problem I failed to mention in the prior communications that needs to be addressed. The Motorola DTC6412 III set top box has multiple output formats. 1 coaxial (3 rca video, 2 audio) 2 hdmi 3 svideo 4 component (1 video rca 2 audio rca) ofthese outputs, I was UNABLE to receive any closed captioning outputted to the following formats: svideo and component (1 video rca 2 audio rca). I was attempting to connect a vcr to the set top box to record a program while it was showing the closed captions displayed. I have not been able to test the HDMI output for CC displayed. I would like this to be fixed within the next 30 days. I am also requesting Cox to be fmed daily for non compliance retroactively since III7/06 as it was more than 45 days after original written complaint submitted, and over 10 months since they were verbally told ofthe problems. I am also requesting the FCC to validate this as a violation verses a allegation.

I allege COX IS in violation of Sections 303 (u), 305, 330 (b) ofthe Communications act, as amended, and the Commission's Rules, 47 C.F.R. Parts 15.119 and 15.122, and part 79.1 et esq. Ofthe Commission's rules, and the authority delegated in section 0.141 ofthe Commission rules 47 C.F.R 0.141. et a/. And Statute: Sections 71 I and 713 ofthe Telecommunications Act (47 USC 613) Regulations at 47 CFR, Part 79.1 And ("Television Decoder Circuitry Act of 1990" or "Prohibition on the shipment ofcertain television receivers"): Statute: Sections 303(u) and 330(b) ofthe Telecommunications Act (47 USC 330) Regulations: 47 CFR Part 15.119 and 15.122. COX is in violation with the Television Decoder Circuitry Act of 1990 They are also in violation ofthe rules that state after Jan 1 2006 there is supposed to broadcast 100% ofchannels with Closed Captioning.
