The roles and responsibilities of governments and institutions in the North are evolving rapidly as a result of land claims and self-government agreements, devolution to the territorial governments and the creation of a new territory, Nunavut. New institutions of public government with responsibilities for land use planning and resources management are being created pursuant to land claim settlements. Resource management boards have, or will assume from DIAND, many of its historical regulatory responsibilities. However, in the interim, DIAND is still responsible for managing federal lands in a way that complements the activities of the new institutions and governments. This includes, as a specific component of DIAND’s sustainable development strategy, continuing to develop a program for the effective management of granular resources.

DIAND’s sustainable development strategy also includes a number of the objectives, targets and specific actions that will require or encourage the identification of stakeholders and interest groups. These include strengthening partnerships with other organizations, increasing opportunities for northerners to participate in decisions that affect their future, collaborating with others, increasing the capacity of northerners to benefit from development opportunities, improved consultation, ensuring transparency and inclusiveness as a key to effective communication with northerners.

For the Northern Granular Resources Program to meet its goals with respect to the Department’s commitment to foster sustainable development in the North, there is a need for a better understanding of the range of organizations and individuals affected by granular resource management actions and decisions.

Separate directories, for the Northwest Territories, Nunavut and Yukon have been prepared under contract to DIAND. This series attempts to compile information on government and non-governmental organizations and individuals, owners, operators, service providers involved with, or affected by, any or all aspects of the identification, exploration, regulation, development, management and use of granular resources in Canada’s northern territories. While care was taken to ensure that the information was accurate and current at the time of compilation, it is inevitable that there will be changes or additions. Users of this directory are encouraged to forward any new information to either of the DIAND addresses provided on the back of the title page.

GRANULAR RESOURCES IN THE YUKON

The Northern Affairs Program (NAP) of the federal Department of Indian Affairs and Northern Development (DIAND) has overall responsibility for the control and administration of a wide range of natural resources in the North. This includes the responsibility to ensure that resource development benefits all Canadians while reducing damage to the environment and enhancing the lifestyles of all northern residents. Granular resources are necessary for most development projects in the North. Ownership of land in the North generally includes ownership of granular resources — soil, sand, gravel and certain types of rock that are required for land development and are accessible from the land surface in pit and quarry operations. The laws and regulations affecting the taking and use of granular resources, and the process for obtaining authorizations, vary across the North, and also according to land ownership. In the Yukon, there are several categories of land ownership. Therefore, it is imperative that the needs of a wide array of stakeholders and interest groups must be considered in order to properly develop and manage these important resources. Consequently, DIAND has attempted to compile, verify and update information on all stakeholders involved in granular resources. What follows is a comprehensive directory of those involved with any or all aspects of the identification, exploration, regulation, development, management and use of granular resources within the Yukon.

How to use this directory The directory is divided into three sections. Part one includes a brief overview of the laws, regulations and application process applicable to the various land ownership categories, including key regulatory contacts. Part consists of several alphabetical listings of stakeholders grouped into four main categories and several sub-categories. At the beginning of each category is a brief explanation of the category and its sub-headings. The main categories are as follows: Regulators; Reference; Development and Use; and Services. Each stakeholder listing includes (as available) name, position title and organization, mailing and e-mail addresses, telephone and fax numbers and several keywords that describe the stakeholders’ role or interest in granular resources. The third part contains three indexes of the stakeholders included in the directory and the page on which their full entry is included. The first index lists organizations that are grouped alphabetically under subject categories that generally correspond to those in the second part of the directory. The second index is an alphabetical listing of all organizations in the directory. The final index in an alphabetic listing of all persons in the directory. A map showing DIAND office locations and Resource Management Areas in the Yukon, and some key definitions are provided for handy reference inside the back cover of this document.

The following is a brief list of the major acts and regulations that apply to pit and quarry development in the Yukon: Territorial Lands Act, Territorial Land Use Regulations, Territorial Quarrying Regulations, Yukon Lands Act, Yukon Quarry Regulations, Yukon First Nations Land Claims Settlement Act, Fisheries Act, and Yukon Waters Act. The legislation governing any pit or quarry, and the process for obtaining rights to explore and develop it, will depend on the location of the site and on ownership of the land. The settlement of comprehensive land claims in the Yukon has provided First Nations with title to a total of 41,439 square kilometres of land, including rights to granular materials. As Final Agreements are signed by each of the 14 First Nations, this land will no longer be governed by the Territorial Lands Act; it will be owned and managed by the individual First Nations. To date, seven First Nation Final Agreements have been implemented. In addition, the self-government agreements made as part of claims settlements will allow First Nations to exercise law-making powers on their lands in such areas as land use and control, municipal planning, and licensing and the regulation of businesses. The following paragraphs outline briefly the main categories of land ownership and identify the agencies responsible for regulating pits and quarries.

Territorial Lands Territorial Lands are defined in the Territorial Lands Act as including all lands in the Yukon Territory that are vested in the Crown or of which the government of Canada has the power to dispose. The terms “public lands” and “federal Crown lands” are used also, as synonyms for Territorial Lands. DIAND is responsible under this Act for regulating the use and disposition of these lands, including all soil, sand and quarry operations on these lands. All land use activities are controlled by the Territorial Land Use Regulations and the removal and use of granular materials is governed by the Territorial Quarrying Regulations. Before undertaking the above activities on Territorial Lands, an application must be submitted to DIAND. If exploratory work is required to investigate a potential pit or quarry site, a land use permit will be required prior to commencing such work. Prior to removing any granular materials, a developer must obtain both a land use permit and quarry permit or a lease from DIAND. The types of authorizations required are described below, while the application and review process is described in more detail in the following section. A land use permit authorizes temporary use of land for periods of less than three years. Land use permits are designed to minimize environmental disturbance and contain conditions regarding environmental protection, location and area, timing of operation, type and size of equipment, abandonment and clean-up. A security deposit is required. A quarry permit authorizes a person to remove a specific amount of material from specific lands. Permits expire when the quantity of material or substance mentioned in the permit has been quarried or removed or on the expiry of one year from the date of issue, whichever is earlier.

2 • Granular Resources: A Yukon Directory 1999 LAWS AFFECTING PITS AND QUARRIES IN THE YUKON A lease is required for any operation involving the quarrying of materials where the leaseholder wants exclusive control to access and use the pit during the lease period. A quarry site may be leased for up to 10 years, and a lease may be renewed for a further term of up to 10 years. Reclamation is a legal requirement under the Territorial Lands Act and Land Use Regulations. All disturbed lands must be reclaimed to a productive use. A manual of Development and Reclamation Standards for Yukon Pits and Quarries, available through DIAND, provides direction on what should be considered in preparing a pit or quarry application, developing and managing pit or quarry operations and carrying out the final reclamation phase. Further information concerning the regulations and procedures can be obtained from sources listed in this directory. Commissioner’s Lands Commissioner’s Lands in the Yukon include public lands in and around communities, roads and highways on public lands, and lands for agriculture, grazing, cottage recreation and rural residences that have been transferred to the territorial Commissioner. Although title to these lands remains with Her Majesty in right of Canada (i.e., they are still Crown land), the administration and control of the surface has been transferred to the Government of the Yukon. As a result, the Territorial Lands Act and regulations pertaining to the surface do not apply on these lands. Commissioner’s Lands are administered under legislation passed by the Government of the Yukon; specifically the Lands Act - Chapter 99 - RSY 1986 (http:// legis.acjnet.org/cgi-bin/folioisa.dll/e_stats.nfo/query=*/doc/{t18902}?) and its associated regulations, the Quarry Regulations - OIC 1983/205 (http://legis.acjnet.org/cgi-bin/ folioisa.dll/eng_reg.nfo/query=yukon+quarry+regulations/doc/{@37098}?). The Lands and Property Assessment Branch of the Department of Community and Transportation Services (CTS), within the Government of the Yukon, manages Commissioner’s Lands, including reviewing and processing land use and quarry applications. Further information concerning the regulations, permits and procedures for granular resource extraction and related land use activities on Commissioner’s lands can be obtained from the Government of the Yukon sources listed in this directory.

Community Lands The situation in communities is more complex. Within most incorporated and unincorporated communities, public lands have not yet been transferred to the municipality and are thus still treated as Commissioner’s Lands. In Whitehorse, both the Government of the Yukon and the City of Whitehorse work closely in the identification, regulation and management of granular resources. While applications are processed by the Government of the Yukon and formally referred to the City, consulting the City Planning Department at the outset can save considerable time and effort in identifying a site so as to have a reasonable chance of obtaining permit approval. In the case of hamlets and communities that have formal official community plans and zoning bylaws, pit and quarry developments within a municipality are reviewed by the affected municipality to ensure compliance with their official community plan and zoning bylaw. A separate development permit may be required. Further information concerning the regulations, permits and procedures for granular resource extraction and related land use activities on community lands can be obtained from the Government of the Yukon and other appropriate municipality sources listed in this directory.

First Nation Settlement Lands According to the Yukon First Nations Land Claims Settlement Act, (www.canada.justice.gc.ca/FTP/EN/ Laws/Chap/Y/Y-2.3.txt), First Nations that have signed final agreements have title to settlement lands including ownership of surface materials like sand and gravel. In addition, under the Yukon First Nations Self-Government Act (http:// www.canada.justice.gc.ca/FTP/EN/Laws/Chap/Y/Y-2.6.txt ), First Nations that have signed final agreements may exercise law-making powers on their lands in such areas as use, management, administration, control and protection of settlement lands and their natural resources, planning, zoning and land development, and licensing and regulation of businesses. To date, seven First Nation Final Agreements have been implemented and each is becoming more and more involved in implementing land management procedures. As this situation is evolving, it is imperative that the affected First Nation be contacted at the outset. Further information concerning the regulations, permits and procedures for granular resource extraction and related land use activities on settlement lands can be obtained from the appropriate First Nation sources listed in this directory.

DIAND is responsible for the administration of the Territorial Lands Act as well as the associated Land Use and Quarry Regulations. All applications for activities on Territorial Land must be submitted to DIAND for approval. Information concerning the application and review process for granular resource extraction and related land use activities on other lands can be obtained from the appropriate sources listed in this directory. The process chart on page 7 provides more information on these steps.

Application requirements The Territorial Quarry Regulations provide two ways to obtain soil, sand, gravel and stone materials from public lands.

Quarry and land use permits A permit is issued to individuals, companies or municipalities when sources of materials are limited or the operation will be undertaken for a period of less than one year. Applications for permits for new pits in undeveloped areas, regardless of size, require the same level of detail as required for quarry leases (see following section).

A permit for an existing designated public pit can be issued across the counter because no referral is required. The application must contain the following items: ¥ information on the applicant. ¥ information on the location and general nature of the pit including the volume of material to be extracted. ¥ the required fee; a surcharge will be imposed to cover the cost of subsequent pit reclamation by the government when the pit is exhausted.

Quarry lease A lease gives an individual, company or government exclusive extraction rights to a specific site for a period of more than one year. A more detailed application must be submitted, accompanied by the appropriate fee. The application must contain the following items: ¥ information on the applicant, location and general nature of the pit or quarry to be developed or used. ¥ description of intended development and reclamation activities; use the following outline as a guide.

Application process Application(s) for permits or leases must be submitted to DIAND Land Use Branch in Whitehorse or contact the DIAND Resource Management Officer in the district or sub- district office for processing and referral. General information or information on the status of an application may be obtained from the Land Use Branch office in the Elijah Smith Building at 345-300 Main Street, Whitehorse, Yukon Y1A 2B5 or telephone (867) 667-3173 or fax (867) 667-3214. Brief step-by-step descriptions of the processes for testing permits and for quarry permits or leases, as shown in the chart on page 7, are outlined below.

Application for a testing permit 1) Applicant identifies source and submits application for a land use testing permit. Once a potential source has been identified, an application is submitted to DIAND to allow geotechnical testing of the deposit. 2) DIAND reviews application and initiates a Level 1 environmental screening. (An environmental screening is a requirement of the Canadian Environmental Assessment Act.) The application is usually forwarded to advisory groups for review and comment. These groups are made up of representatives of other government agencies, interested parties, municipalities and First Nations. If strong objections to the project are raised, or if the environmental effects are deemed to be unknown without additional information being provided, the application can be referred for a more involved Level 2 screening ore rejected.

3) Testing permit is approved. If it is determined that the potential environmental effects arising from the project are acceptable or can be mitigated, a testing permit is issued. A set of conditions governing the work may also be attached to the permit.

DIAND issues the land use permit(s) for geotechnical testing on federal Territorial Land. These permits may cover several proposed testing sites in a specified area. Any additions to the testing program require a request for an amendment to the land use permit. Prior to starting work under the land use permit, the local land use inspector must be notified. In other areas, individual testing programs are issued separate permits. 4) Field testing is carried out. After the issuance of the testing permit, the program can be initiated. The testing will involve either drilling test holes at regular intervals or, using a back-hoe, excavating surface pits to a predetermined depth.

Application for quarry permit or lease 1) Applicant submits application for a land use and quarry permit or lease. The process for review of a land use permit or quarry permit may take as little as a month for review, while a quarry lease could take a year or more. If the quality and quantity of the deposit is acceptable, an application is submitted for a pit or quarry permit or lease to allow extraction. The quarry application is more detailed than the testing application and goes through the same consultation process. A successful geotechnical investigation does not necessarily ensure subsequent development approval.

A water licence will also be required when: ¥ water is used for gravel washing, ¥ water is diverted through pit dewatering or channel relocation, or ¥ roads, bridges, culverts, or other structures affect watercourses or water bodies. A water licence may be obtained from the Yukon Territory Water Board, located at 106-419 Range Road, Whitehorse, Yukon Y1A 3V1, telephone (867) 667- 3980 or fax (867) 668-3628. If a culvert is to be installed in fish bearing waters, an authorization or approval will be required from the Department of Fisheries and Oceans, located at 100-419 Range Road, Whitehorse, Yukon Y1A 3V1, telephone (867) 393-6722 or fax (867) 393-6738. 2) Quarry permit or lease is approved. On receipt of written notification of approval, site development can proceed. The life span of the pit or quarry will depend on the quantity of material required and the activity in the area. When a pit or quarry lease is issued, the operator is responsible for all conservation and reclamation activities in accordance with the approved reclamation plan.
