NOTIFICATIONS BY GOVERNMENT HOME DEPARTMENT FIRST SUPPLEMENTAL RECIPROCAL AGREEMENT BETWEEN THE GOVERNMENTS OF TAMIL NADU AND PUDUCHERRY IN RESPECT OF INTER-STATE TRANSPORT UNDER THE MOTOR VEHICLES ACT. [G.O. Ms. No. 118, Home (Transport-III), 18th February 2011, ñ£C 6, F¼õœÀõ˜ ݇´-2042.] No. II(2)/HO/78(b)/2011. Whereas, a reciprocal agreement with regard to the plying of transport vehicles on Inter-State routes was entered into between the Governments of Tamil Nadu and Puducherry in G.O. Ms. No. 899, Home, dated the 12th April, 1985 and published with the Home Department Notification No. II (2)/HO/1990 (h)/1985 at pages 1-15 in Part II—Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 19th April 1985; And, Whereas, the Governments of Tamil Nadu and Puducherry have agreed to enter into a first supplemental agreement under Section 88 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988), in respect of operation of Stage Carriage Services by the State Transport Undertakings and Private Operators on Inter-State routes and also countersignature of goods carriage permits. Now, therefore, in exercise of the powers conferred by sub-section (6) of Section 88 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) the Governor of Tamil Nadu, hereby publishes the following First Supplemental Agreement entered into between the Government of Tamil Nadu and Puducherry, the draft of the same, having been previously published as required by sub-section (5) of Section 88 of the said Act in the Home Department Notification No. II(2) HOPE/690(c)/2009 published at pages 1 to 9 Part II Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 18th December 2009 and after giving, the representatives of the interests affected, an opportunity of being heard and the objections and suggestions received having been considered in consultation with the State Transport Authority, Tamil Nadu. AGREEMENT Whereas, it is decided to control and regulate the plying of Stage Carriage services on inter-State routes between the State of Tamil Nadu and Union Territory of Puducherry by way of permitting the State Transport Undertakings of the both the States to DTP—II-2 Ex. (64)—1 [ 1 ] 2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY operate on new routes to be included in the agreement and also to permit Private Operators to operate on new routes to be included in the agreement and to modify the existing routes covered by previous agreement and to perform additional trips on existing routes, as also to enhance the quota of Goods Carriage permits for each State to be countersigned by the other. Now, therefore, it is hereby agreed to publish the first supplemental agreement on the following terms and conditions entered into between the State of Tamil Nadu and Union Territory of Puducherry, subject to the provisions of previous agreement. I. Operation of Stage Carriage Services: 1. It is agreed by the Governments of Tamil Nadu and Union Territory of Puducherry to include the following routes in the Inter-State Agreement on Single point tax basis:— (a) Routes of private operators of the Union Territory of Puducherry already covered by previous agreement and subsequently varied and saved under approved schemes and permits countersigned by the State Transport Authority, Tamil Nadu as specified in Annexure-I. (b) Routes of private operators of the State of Tamil Nadu already covered by previous agreement and subsequently varied and saved under approved schemes and permits countersigned by the State Transport Authority, Puducherry as specified in Annexure I-A. (c) Routes now operated by Puducherry Road Transport Corporation on Double point tax as shown in Serial Numbers 1 to 21 of Annexure-II. (d) Routes of Private operators of the Union Territory of Puducherry which are plying on Double point tax in pursuance of the Court Order, as shown in Serial Numbers 22 to 24 of Annexure-II. (e) New Routes of State Transport Undertakings of Tamil Nadu to ply on 31 routes as shown in Part-1 of Annexure II-A. (f) Routes of State Transport Undertakings of Tamil Nadu now plying under Double point tax on 37 routes as shown in Part-2 of Annexure II-A. (g) Routes of Private Operators of the State of Tamil Nadu now plying on Double point tax as per the Court Orders, as shown in Part-3 of Annexure II-A. 2. The existing ratio of parity of permits in respect of Inter-State routes, other than the route Puducherry - Karaikkal, between the Government of Tamil Nadu and Government of Union Territory of Puducherry, that is, 4:1, is revised as 3:1, respectively, in future. The ratio will represent the number of buses. So far as the route Puducherry-Karaikkal is concerned, the ratio shall be continued as 1:1. II. Goods Carriages: (1) It is agreed to increase the quota system of Goods Carriage permits from 300 to 800 for Union Territory of Puducherry to be countersigned by the State of Tamil Nadu. (2) It is agreed to increase the quota system of Goods Carriage permits from 3000 to 8000 for the State of Tamil Nadu to be countersigned by the Union Territory of Puducherry. (3) It is agreed to omit the restriction in respect of laden weight. III. Taxation: Subject to the provisions contained in the basic agreement, Stage Carriages covered by counter-signature in the reciprocating State shall be exempted from payment of tax to the reciprocating State. The benefit of single point tax shall apply to the Stage Carriages having both regular and temporary permits subject to the routes finding place in the Inter-State agreement. IV. General: A Committee consisting of the following officials will examine the proposals for the variation / curtailment / extension of routes, increase or decrease in number of trips, inclusion of new routes / additional buses, inclusion of auto rickshaws on par with the Government of Andhara Pradesh and Kerala, inclusion of share-Autos and similar type of vehicles and inclusion of Maxi Cabs in the Inter-State Agreement. The Committee will also examine the issuance of temporary permits for the educational institution vehicles of other States for the purpose of educational tours. (i) The Deputy Transport Commissioner, Villupuram, Tamil Nadu. (ii) The Managing Director, M/s. Tamil Nadu State Transport Corporation Ltd., Villupuram, Tamil Nadu. (iii) The Managing Director, M/s Puducherry Road Transport Corporation, Puducherry. (iv) The Regional Transport Officer, Puducherry.
