1. BACKGROUND Earthquake Emergency Assistance Project (EEAP) is a project being implemented by loan assistance from the Asian Development Bank (ADB), technical assistance from Swiss Agency for Development and Cooperation (SDC) and counterpart funding from Government of Nepal (GoN). EEAP will support GoN to accelerate recovery and reconstruction following the devastating earthquake of 25 April 2015 and the major aftershock of 12 May 2015. The Project covers 12 affected districts in eastern, middle and western development region of Nepal1.

The Project will restore and strengthen the resiliency of critical public and social infrastructure and services and has four outputs; Output 1: Schools are rebuilt and upgraded, Output 2: Roads and bridges are rehabilitated and/or reconstructed, Output 3: District-level government facilities constructed and/or rebuilt, Output 4: Disaster preparedness and management capacities strengthened.

Under Output 2, strategic roads and district roads damaged by the earthquake and landslides are under rehabilitation. Project roads and bridges will have built back better features for road safety and climate resilience. The initial target of district roads component was rehabilitation and reconstruction of 450 km. A total of 25 potential road sub-projects (474.7 km) had been identified for rehabilitation and reconstruction in 12 sub-projects districts under EEAP2. However, 17 road sub-projects (290 km) has been prioritized for rehabilitation and reconstruction due to budget constraint (please refer Figure 1 and 2 for project location).

National Reconstruction Authority (NRA) is executing agency for EEAP. Ministry of Federal Affairs and Local Development (MoFALD) is implementing agency for rural road component of output 2 under EEAP. The implementing arrangements are as following: MoFALD has established a Central Level Project Implementation Unit (CLPIU) in Kathmandu, headed by a project coordinator to coordinate all project activities. The CLPIU will be responsible for guiding and monitoring District Coordination Committees (DCCs)/District Technical Office (DTO) as they implement project components.

At the district level, project implementation will be the responsibility of the District Level Project Implementation Unit (DLPIU) within the District Technical Office (DTO) of each district. DLPIU will be supported by District Implementation Support Consultants (DISC) which is headed by District Team Leader, technical and social staff. Overall back stopping support to the district will be provided by Central Implementation Support Consultants (CISC).

2. ENVIRONMENTAL SAFEGUARDS IN EEAP EEAP falls in category B project according to ADB Safeguard Policy Statement, 2009. Also, the road sub-projects of EEAP belong to District Road Core Network (DRCN) according to Nepal Rural Road Standard (2055) first Revision, September 2012 of the Department of Local Infrastructure Development and Agricultural Roads. Therefore, it is a legal requirement to carry out Initial Environmental Examination (IEE) according to Act relating to Reconstruction of the Earthquake Affected Structures 2015, Rules relating to Reconstruction of the Earthquake Affected Structures 2016, Working Procedure relating with Environmental Impact Assessment for Reconstruction of the Earthquake Affected Structures 2016 (first amendment, 2016).

Environmental assessment is essential to integrate environmental considerations into development project in order to minimize negative environmental impacts. In this context, IEE reports have been prepared or under preparation for road sub-projects under EEAP to satisfy legal provision of GoN and ADB environmental procedures. The IEE reports of the road sub- projects have to receive concurrence from ADB and approval from NRA and few of them have already got the concurrence and approval.

During the reconstruction and rehabilitation of the road sub-projects, environmental monitoring is an important tool to ensure the compliance of mitigation measures and implementation of environmental management plan (EMP). Monthly, Quarterly and semi-annual Environmental Safeguard Monitoring Report have to be prepared on the basis of report received from DISC team and environmental field visit made by Environmental Safeguard Unit of CISC, EEAP.

3. CONSTRUCTION APPROACH EEAP applies National Competitive Bidding (NCB) approach for construction of road. Contractor will use equipment and manpower to execute the contract within the stipulated deadline. However, spoil disposal is balanced with cutting and filling as far as possible. There will be use of bio-engineering techniques with integrated use of vegetation, simple civil engineering structures and proper water management systems for slope protection. Overall, construction activities will follow the environment friendly approach as much as possible.

4. OVERALL ENVIRONMENTAL SAFEGUARD STATUS Out of 17 road sub-projects, 10 IEE and 3 ToR for IEE have been presented in NRA. 3 IEE reports had been already presented in MoFALD under RRRSDP before the promulgation of Act relating to Earthquake Affected Structure, 2015. And, 1 IEE is under revision at CISC.

5. COMPLIANCE WITH ENVIRONMENTAL SAFEGUARD MEASURES Construction activities in few road sub-projects under EEAP have already started, few are in process. IEE reports have been already prepared for 14 road sub-projects. For better environmental safeguard compliance of the project, implementation of EMP should be done strictly. Few environmental mitigation cost has already been included under Bill of Quantity (BoQ) as civil work cost, besides there is provisional sum of money ranging from NRs. 300,000.00 to NRs. 350,000.00 in BoQ. However, IEE reports suggest that NRs. 24,408,269.34 is required for 14 road sub-project in addition to environmental management cost covered under civil activities. Please refer Annex 3 for details about budget estimate for the implementation of environmental management plan for 14 road sub-projects. Following is summary of environmental compliances and details are given in Annex 4.

5.1. Awareness Raising Training and other Benefit Augmentation Measures Awareness raising training has to be organized by each district before and during the road construction. Half day awareness raising orientation training program for contractor’s workers and field staff as well as home stay training, solid waste management training, environmental awareness training etc. has been planned for local people within zone of influence (ZOI). Total estimated budget for different awareness raising training, solid waste management training and home stay training are estimated to be NRs. 4,020,000.00 for 14 sub-projects.

5.2. Tree Loss and Compensatory Plantation The 13 road sub-projects pass through 43 Community Forests (CFs), 3 National Forests (NFs), 2 Religious Forest and private land with total tree loss of 5,899 (2,583 trees from forest area and 3,316 trees from private land). There is no tree loss from Thaiba-Godamchaur Road Sub- project, Lalitpur. Compensatory plantation (CP) of 69,283 plants (64,575 in forest area and 4,708 in private land) has been targeted at the ratio of 1:25 plants in forest area (CF & NF) and 1:1 plants in private land with total estimated cost of NRs. 11,534,269.34. However, the plantation rate in private land is 1:25 as there is tree loss from private forest. Overall, 56.21% of tree will be lost from private land and 43.79% from forest area with target for compensatory plantation of 6.80% and 93.20% respectively. Area wise, approximately 40 ha of plantation will be due in forest area according to the plantation norms of the Ministry of Forest and Soil Conservation (MoFSC) excluding road side plantation (please refer Annex 5 and Figure 3 for detail).

CISC will be providing backstopping support to district teams for carrying out compensatory plantation works. Plantation agreement has been included in IEE of each sub project. In addition, plantation plan has been prepared as given in Annex 6.

5.3. Slope Stabilization and Bioengineering Activities Unstable slopes area has been identified in IEE as well as detail design report and total NRs. 37,091,810.84 have been estimated for bioengineering activities on actual cost estimate basis. Solukhumbu district has reported the construction of 850 m3 of retaining wall to control landslide at Ch 4+120 and 5+700.

5.4. Spoil Management Spoil disposal sites have been identified and provision of toe walls are given in the detail project design report. Spoils are being managed in specified disposal sites as far as possible. So far, 5 districts (Kathmandu, Bhaktapur, Dolkha, Gorkha and Solukhumbu) have reported construction of toe walls with volume of 568 m3 and 131,890.00 m3 spoils have been managed so far. Spoil management plan has been prepared and circulated to all districts, please refer Annex 7.

5.5. Camp Site Management Drinking water and sanitary facilities (toilets) are provided in the camps by contractor and local houses are rented. In camps, workers use kerosene and LPG gas for cooking.

5.6. Occupational Health and Safety Occupational health and safety measures have been partially followed. Workers have been provided with safety gears like helmet, facemasks, goggles etc. in most of the districts. However, these items are in limited quantity and not sufficient for all the workers in few districts. They need to be educated about the importance and use of safety gears. Group accidental insurance has been done for all the workers in all the project districts where construction work is going on. No injuries have been reported so far.

5.7. Signboard Placing Three districts (Kathmandu, Solukhumbu and Dolkha) have erected 13 signboards at various places along the road with environmental information and notice. Number of signboards ranges from 2 to 8 per sub-project. NRs. 1,860,000.00 budget has been allocated for 14 sub-projects for informative, safety and environmental awareness signboards.

5.8. Grievances Received and Addressed GRM mechanism has been established in 8 districts (Kathmandu, Bhaktapur, Lalitpur, Kavrepalanchok, Gorkha, Dolakha, Okhaldhunga and Solukhumbu). So far, 9 grievances related to environmental safeguard have been reported from two districts and are in process. Most of the grievances are related to compensation for tree loss in missing plot and spoil disposal (please refer Annex 8 for detail grievances).

5.9. Safeguard Desk Meeting Safeguard Desk monthly meetings have been convened by two districts (Kathmandu and Solukhumbu). Both districts have conducted 2 safeguard desk meeting till now.

5.10. EMP Implementation, Monitoring, Reporting and Field Visit Environmental monitoring format has been sent to districts as given in Annex 9. Environmental monitoring is also done by the CISC team during field visits. A sum of NRs. 3,059,000.00 budget has been allocated for monitoring activities.

6. WAY FORWARD For maintain environmental safeguard in all sub-projects, IEE reports have to be prepared and approved from concerned bodies at first. Then the implementation of environmental management planned should be ensured with timely release of budget for proposed activities. Actions required for effective implementation of environmental safeguard measures are discussed below.

1. Obtaining forestry clearance for each sub-project is important as it is legal requirement as well as catalyst to achieve targeted compensatory plantation. Therefore, DLPIU should coordinate with DFO on this regard for roads with already approved IEE. 2. For the IFB awarded sub-project, DLPIU should organize orientation program to workers of contractor on environmental friendly working approach. 3. Spoil disposal activities should be only at designated sites with provision of sufficient toe walls. 4. Frequent field visit to ensure environmental safeguard compliance 5. Budget for implementation of benefit augmentation, mitigation and compensatory measures as suggested in IEE reports for each project.

Annex 6: Plantation Plan

Many sub-projects under EEAP pass through forests area and will be affecting the forest vegetation. According to Working Procedure to Use National Forest Area for National Priority Projects, 2074 B.S. (2017 A.D.), there is provision of compensatory plantation (with protection for five years) at the ratio of 1:25 plants by the project or provide plantation and protection cost to concerned DFO. Appropriate mitigation measures have been/will be recommended in the Initial Environment Examination (IEE) report that has been prepared/under preparation. Planting a huge number of seedlings needs a pre-plan and coordination with concerned stakeholders. Table 1 will be used to manage the planting stock for plantation for different purposes.
