Introduction and Overview of Proposed Study Plan (PSP) Meetings (PowerPoint presentation) Brian Edwards (GRDA) welcomed everyone to the meeting and provided a general introduction and overview of the Proposed Study Plan (PSP) meetings. Darrell Townsend (GRDA) presented an overview of the Pensacola Project (Project) and overall relicensing process. Chuck Sensiba (Troutman Sanders) explained that the Federal Energy Regulatory Commission (FERC) held the relicensing proceeding in abeyance for part of 2017 and that as a result, the relicensing process lags several months behind the process envisioned in FERC’s regulations. GRDA will request a license extension to allow for full completion of environmental studies and input from relicensing participants before GRDA files its Final License Application (FLA). Rachel McNamara (FERC) clarified that it is the FERC Division of Hydropower Administration and Compliance’s decision whether to grant the extension.

Version: 6/26/18 1 Greg Estep (USACE) provided an overview of the U.S. Army Corps of Engineers’ (USACE) flood control operations for the Pensacola Project and various other flood control projects within the region (PowerPoint presentation).

Discussions Related to the USACE Presentation USACE explained that it monitors and maintains gages on the Spring and Neosho rivers, as well as other tributaries upstream of the Pensacola Project, in order to manage flood control operations in the basin. USACE stated that it will not be a cooperating agency in the FERC relicensing process for the Project but that it will participate. There were concerns raised regarding protecting areas upstream of the Project. USACE stated that not enough real estate was purchased upstream of the Project and that USACE is trying to reduce impacts throughout its flood control operations. USACE stated that flood control operations focus on balancing protection throughout the basin. USACE provided clarification on resuming Project operations at reservoir levels within the rule curve targeted elevations after a storm. For example, if the rule curve target is elevation 744 ft Pensacola datum (PD) and USACE knows there is enough water coming in to fill the reservoir back to the target level, then USACE will direct GRDA to draw the Pensacola reservoir down to elevation 743 ft PD. Questions arose regarding who has the authority and responsibility for managing upstream flooding and whether any of the flooding is a result of upstream projects. USACE stated that upstream releases out of John Redmond could potentially impact downstream flooding, but that there are several hundred miles of river upstream of the Pensacola Project (up to John Redmond) that contain many control points (USACE monitoring locations), as well as areas without control points. It was also stated that normal rainfall causes downstream flooding. The point that insufficient lands were purchased upstream of the Project was raised again and an inquiry was made as to whether there were additional lands available to be purchased and/or a plan to transfer flowage easements to GRDA. Also, with respect to lands along the reservoir in which USACE does hold flowage easements, USACE stated that they are working on transferring flowage easements to GRDA, as required by Congress. A USACE Water Control Plan was developed in 1990 and revised in 2007. It was noted that there have been changes in operations at the Pensacola Project since the last plan revision and in most of the watershed. Questions arose as to whether recent floods and changes in operations would warrant changes to the plan. USACE indicated that a study conducted to revise the Water Control Plan would cost $5-10 million dollars. USACE stated that nothing has changed in the plan or with regard to USACE’s flood operating procedures since 2007. There is only a certain amount of flood storage available and USACE stated that the Water Control Plan is still a good plan. USACE uses the flood storage that is available. Discussions continued regarding how often USACE would like to have a study performed if money was not an issue. USACE would like to be able to conduct a study any time there is believed to be a need, but USACE feels it likely would come back to the same place with the plan. During the 2007 revision of the plan a significant amount of money was spent for a minor revision.

Version: 6/26/18 As part of the study to revise the 2007 plan, all projects, including John Redmond upstream of the Pensacola Project, as well as all projects that USACE operates in the Arkansas River System, were analyzed. During the study USACE considered what would occur when one reservoir was adjusted and how it would impact other reservoirs in the system. USACE operates the system by making up storage at one project that may cause issues at other projects. USACE looks at all projects in the system and tries to balance the costs and benefits while also trying to balance for flood control, recreation, hydropower, safety, environmental concerns, etc.

Hydrologic and Hydraulic Modeling Study Presenters: Nick Hathaway and Ryan Greif – Mead and Hunt (PowerPoint presentation) There was a question regarding any proposed changes to operations at the Project. GRDA is not proposing any changes to Project operations at this time. There were several questions about whether relicensing participants would have a chance to propose conditions and provide comments on what will be modeled, and whether relicensing participants would be provided with the results of the initial modeling. The Initial Study Report (ISR) and the Updated Study Report (USR) will provide opportunities for relicensing participants to comment. Concerns were raised regarding inundation of tributary areas where rare, threatened, and endangered and other species may exist. There was also concern that the hydraulic modeling study area was limited to certain tributaries and the mainstem river and did not include other areas such as Lost Creek, Buffalo Creek and small tributaries off the Elk River. GRDA stated that the focus of the Hydrologic and Hydraulic Modeling Study (H&H Study) is on larger tributaries, but if determined necessary other areas can be added. It is common practice in modeling to create boundary points and the same could be done for smaller tributaries if deemed necessary for study. If other tributaries were to be added to the study area more bathymetric data would be needed to assess those areas and adequate stream gage data would be required. A comment was made that it would be helpful in the Revised Study Plan (RSP) to show graphically or on a map what the available datasets cover. There were discussions on performing additional model runs under alternative operating scenarios and it was pointed out that FERC will request access to the model to perform additional runs in house as needed. It was recommended that the study area be further refined and it was stressed that the model needs to be robust so additional runs can be performed and FERC can make a determination. Parties were interested in expanding the model and analysis to Project effects on the entire watershed. GRDA responded that the study is based largely on existing available information and streamflow data (preferably hourly) and new data would be necessary to expand the model and analysis. Inquiries were made as to whether all of the data and models would be publicly available and posted for review and comment. The information will be made publicly available as much as possible. The topic of pre-dam conditions and data was raised during this discussion. It was clarified that the relicensing process will not be focusing on pre-dam conditions. Rather, FERC’s

Version: 6/26/18 environmental baseline is current conditions, the existing license and how the Project is currently operating. It was stated that the model will show results for elevations from 742-745 ft PD and a comment was made that water surface elevation at 740 ft PD should be considered as the starting pool. If determined necessary, this will be done. With regard to the proposed Operations Model, the question was raised why the existing USACE model was not being used, and instead GRDA is developing an Excel model. GRDA stated that using other types of software would not have allowed the model to be open for others to access and use, while the Excel model gives more flexibility. Other software often comes with constraints with programming codes and Excel is more accessible. There was interest in seeing inundation maps at different flood events and not just peak. Inundation maps will be developed for various inflow scenarios to depict the peak inundation, and tabular data can also be produced from the model to analyze more specific inundation characteristics. There was concern regarding the lack of detail on the calibration of the model and the description of parameters on stage or timing of the flood, tolerances, etc. GRDA indicated that it is often hard to provide parameters but these will be defined as much as possible in the RSP. A comment was made that the scenarios GRDA proposes to run are not adequate because the new license will last for 40 years and the question was asked if the study would be able to anticipate future changes. The H&H Study will look at what has happened with changes in bathymetry and potential Project-related effects in the past. It was stated that the H&H Study needs to assess how different operations modeling will affect various resources. A request was made to provide more detail in the RSP regarding triggers for doing more studies to assess effects to resources or what existing data would preclude doing more studies.

Sedimentation Study Presenter: Laura Rozumalski – FreshWater Engineering (PowerPoint presentation) The question was asked if the Sedimentation Study would be examining the content of the sediment in addition to the movement and levels of sediment. This study is examining how sediment moves through the system and not the content of the sediment. It was noted that the Year One Study will use cross-section data and inquiries were made regarding what data is available and if this study will be using the same data as the H&H Study. This study will compare cross-section data against existing data. There was a concern that a sediment transport model was not being proposed and that data was only being collected during low flow periods and not flood events. It was stressed that a sediment transport model throughout the reach was needed to see what is happening in the system. It was also stated that sediment data collected will mostly be sand and the study will show that it is moving most of the time. An inquiry was made regarding how shear analysis is intended to be used.

Version: 6/26/18 Recent U.S. Geological Survey (USGS) bathymetric data will be used and the study will be looking at the instream processes that are taking place. The study proposes to collect real-world data from which to draw conclusions instead of modeled assumptions. Data will be collected during flood events as feasible. One goal is to develop the relationship between real-world data and what the model shows and to quantify how those change with respect to bed shear stresses. Shear analysis will be used to determine the size of sediment that is mobilized in different areas in the watershed and quantify the amount of sediment being transported. Everyday flows are transporting sediment not just high flow events. The study will be looking more at common flow events that are transporting sediment, in addition to flood events. A discharge analysis will be performed to determine frequency of flow events and the amount of sediment transported at each of those flows. The question was raised of how the study will evaluate the effect of flood events on sediment transport. This study is not designed to address specific flood events, the focus is effects on sediment transport due to operational changes. It was stated that if the study is only looking at common flows then there is going to be no change. The study is not only looking at low flow events and will be looking at a range of flow events. It was mentioned that the study will be looking at other sediment transport studies that do not cover entire reaches and seem very local and the question was raised as to how these studies would be extrapolated to other areas with different geography, etc. If it was determined that there is a limit based on reviewing other studies, the study would move into the Year Two Study to collect additional data. An explanation on how Acoustic Doppler Current Profiler (ADCP) data will be used to evaluate sediment transport was requested. Field data will be collected for suspended sediment at cross- sections and by using the velocity profiles the study would be able to determine what velocities are transporting what sediment. The question was posed as to how a literature review will help analyze effects and it was stated that it is a progression of understanding that involves building off existing knowledge and using what is already known. A comment was made that GRDA should develop a sediment transport model. FERC staff stated that it has not made a determination on that yet and that it would analyze effects of resuspended sediment including, and if necessary, contaminated sediment. It was emphasized that FERC will review the RSP and study proposals and make a determination based on all information received.

Introduction and Overview of Proposed Study Plan (PSP) Meetings (PowerPoint presentation) Brian Edwards (GRDA) welcomed everyone to the meeting and provided a general introduction and overview of the Proposed Study Plan (PSP) meetings.

Recreation Facilities Inventory and Use Assessment Study Presenter: Danielle Hanson – HDR Engineering, Inc. (PowerPoint presentation) A question was raised if there were going to be any recreation studies performed upstream or downstream of Project. The current study plan is focused on the five FERC-approved recreation sites that are owned and maintained by GRDA. An inquiry was made regarding what makes a recreation facility FERC-approved. FERC staff stated that FERC-approved facilities are recreational facilities that are required in the current license that GRDA has the authority to operate and maintain or that GRDA contracts another entity to operate and maintain. Proposing that other recreation sites be added as FERC-approved sites was discussed. Oklahoma Department of Wildlife Conservation (ODWC) mentioned that they often field complaints about there being limited public access and inadequate facilities. ODWC would like to increase access, or significantly improve existing access. FERC staff responded that recreation

Version: 6/26/18 sites can be added to the Project. There are additional sites that are not FERC-approved offering free or reduced cost recreational opportunities. It was recommended that the study collect use data and visitor experience data for a representative sample of these other sites. It was also recommended that GRDA inventory informal recreational use in the tailrace area. It was asked whether the study plan would include gathering lake elevation information on when all boat launches become inaccessible, or just the five FERC-approved sites. The current study plan focuses on the five FERC-approved sites. A comment was made regarding extensive flooding issues in and around the City of Miami and why no upstream recreation studies were being proposed. GRDA’s proposed Hydrologic and Hydraulic Modeling Study (H&H Study) will be investigating upstream effects of Project operations. This study is focused on recreation resources, currently the five FERC-approved sites. A statement was made that during a high water event the new Wolf Creek facility was damaged and the question was asked if the study will look at effects of changing water levels. GRDA indicated that this is not an explicit component of the study, but the user survey does include a question whether the visitor has experienced any water level issues that have affected their recreational experience. It was noted that GRDA’s Big Hollow recreation site is believed to provide limited access and it was stressed that GRDA is not going to get a representative look at recreation use by limiting the study area to the five FERC-approved sites. It was reiterated that the survey should be expanded to include other public access sites. Comments will be taken into consideration during the development of the Revised Study Plan (RSP). Socioeconomics Study Presenter: Jenna Borovansky – HDR Engineering, Inc. (PowerPoint presentation) Concerns were raised that the study was only proposing to study current conditions and no prior effects of Project. The study will focus on reviewing available information on existing conditions as the baseline. Relicensing participants were encouraged to submit information into the FERC record if they are aware of relevant information. Multiple statements were made that the cost of insurance has gone up, businesses are closing, etc., and that those aspects should be considered as part of the study. These are cumulative effects and GRDA encouraged relicensing participants to submit any relevant information they may have. It was also mentioned that the Federal Emergency Management Agency (FEMA) has modified its flood hazard areas and the question was asked whether this would be taken into consideration during this study. GRDA indicated that it will review this information, but that it is not clear at this time how that data will be used. The study will be focused on Project effects and analyzing baseline data. The study will identify and summarize available data sources. FERC staff encouraged relicensing participants to provide written comments and provide links to relevant data sources. Clarification was requested regarding whether the analysis will be broken out by county or summarized for the four county area. The study will mainly focus on the four county area, but will also summarize information at a regional level as information is available.

Version: 6/26/18 Cultural Resources Study Presenter: Rob Quiggle – HDR Engineering, Inc. (PowerPoint presentation) There was a discussion regarding the Area of Potential Effects (APE), which is currently defined as the FERC Project Boundary, and whether the APE will be redefined following the inundation studies. The question was also asked if the Historic Properties Management Plan (HPMP) will reference additional lands within the APE. The APE will be redefined based on the results of the H&H Study and additional lands within the APE will be referenced in the HPMP as necessary. A comment was made about contacting private landowners when performing the Pre-fieldwork Report (PFR). It is common practice to reach out to private landowners to conduct surveys on those lands. Questions were brought up regarding how specific locations will be identified to conduct field work, how locations where there are Project effects will be identified, and what criteria will be used to identify those areas. It was asked if the archeologist will determine in the field the sites that will be tested and if the specific criteria will be included in the study plan. The archaeologist conducting the study will look at the reservoir for areas to potentially exclude from surveying and obtain concurrence from the Cultural Resources Working Group (CRWG) that such areas may be excluded. The study will determine Project affected areas and look at the reservoir, areas of erosion, review information provided by the CRWG, and review potential study sites with the CRWG. Visual reconnaissance will be conducted to determine sensitive areas using professional judgment to determine areas to sample and criteria will be included in the RSP. It was stated that National Register of Historic Places (NRHP) eligibility evaluations are often made during the study period but are not discussed in GRDA’s study plan. It was recommended that the study plan explain that this will be done in the HPMP. It was stressed that as much as possible should be evaluated prior to filing the Final License Application so that more information can be incorporated into the HPMP. It was also recommended that if NRHP eligibility can be completed efficiently during the reconnaissance investigation, that could result in some efficiencies and help determine whether certain areas should be avoided. It was noted that there was no curation plan included in the study plan for items collected and how they will be evaluated and that this should be elaborated on in the RSP. GRDA will work with the CRWG to determine curation procedures and build on NRHP determinations. FERC staff mentioned that they will need to see a study plan and methodology for Traditional Cultural Properties (TCP) in order to make their study plan determination. It was stated that Tribes are often not comfortable discussing locations of TCP sites, but Tribes may still want to discuss issues with sites and there needs to be a method to address this. Additional detail was requested regarding Tribal consultation and study plan implementation and if separate meetings will be held at various Tribal locations. GRDA indicated that more detail regarding TCP methods and initiating consultation with Tribes will be provided in the RSP. Some commenters expressed an interest in studying inundated cultural resources. FERC stated that the HPMP should contain language regarding potential opportunities to conduct studies to assess inundated sites when they become exposed (such as seasonal fluctuations or drawdowns for maintenance purposes). This study is somewhat limited by the Integrated Licensing Process (ILP) schedule, but GRDA will attempt to study potential cultural sites at low water levels when possible and potentially revisit sites during other times of low lake levels.

Version: 6/26/18 FERC stated that a communication protocol should be included in the RSP for this study as well as any other study that requires consultation. The U.S. Bureau of Indian Affairs (BIA) commented that on federal trust lands, restrictions will not allow GRDA to photograph, touch, or conduct any scientific studies on anything that is found. GRDA will need to describe what is found and obtain permission from the Tribes. There was a question as to whether Tribal monitors would be present during field work along with the certified archaeologist that will be assessing the sites. GRDA will consult with Tribes on how best to treat artifacts. It was noted that there will be a Programmatic Agreement (PA) with FERC and it was asked if there would also be an agreement with the Tribes. FERC’s PA is with the State Historic Preservation Officer (SHPO) and Tribal Historic Preservation Officers (THPO). Additional detail was requested regarding the standards that GRDA will require for the archaeologist that will be conducting the study. GRDA has not yet selected an archaeologist to conduct these studies, but will ensure that they meet the U.S. Department of the Interior’s (DOI) standards and have experience in the area. BIA stated that any surveys GRDA conducts on Tribal trust lands will require an Archaeological Resources Protection Act (ARPA) permit from the BIA and will entail consultation with the Tribes and BIA. Additionally, anyone who will be on the property conducting surveys will need to meet DOI standards. It was mentioned that conducting oral history interviews is probably one of the best ways to collect background information as part of this study. The comment was made that NRHP evaluations should be made even if the physical artifacts are not eligible because the location could be eligible. These matters are not currently addressed in the study plan but will be reviewed and taken into consideration when developing the RSP. A question arose regarding the APE and whether it could include adjacent sites such as mitigation sites. FERC commented that the Coal Creek site is an existing compliance action that is being worked on right now and that the proposed APE does not include these mitigation lands. It was emphasized by commenters that GRDA must endeavor to overcome resentment from the Tribes that these issues were not properly addressed in the past. A comment was made that the CRWG is not synonymous with Tribes and that this should be made clear in the study plan. It was stressed that the inclusion of Tribes in this study is very important. It was pointed out that there is a distinct difference between mitigation of impacts and mitigation to avoid impacting resources and that the goal should be to avoid impacts. It was stressed that there should be ongoing, continuous, frequent consultation with the Tribes in order to address issues as soon as possible to avoid further impacts. FERC clarified an earlier description of the PA and stated that Tribes that do not have Tribal lands within the APE are treated as concurring parties.
