The cup was presented to Associate Justice Horace Gray on March 22, 1902 by his law clerks, and engraved on its tarnished surface are the names of the nineteen Harvard Law School graduates who served as Justice Gray’s law clerks.1 While the details surrounding the presentation of the cup have been lost to history, the gift was likely prompted by the failing health of Justice Gray and his future departure from the Supreme Court. The loving cup is still held by the Gray family, passing to the heirs of Professor John Chipman Gray, the famous Harvard Law School professor and half-brother of Horace Gray, upon the death of the childless Horace Gray.

PEPPERS Law clerks have been part of the American judicial system since 1882, when Supreme Court Justice Horace Gray hired a young Harvard Law School graduate named Thomas Russell to serve as his assistant.1 Justice Gray paid for his law clerks out of his own pocket until Congress authorized funds for the hiring of “stenographic clerks” in 1886. In the decades following the Civil War and before the advent of modern medicine, it was far more common than it is today for a Supreme Court justice not to appear in the courtroom for an oral argument or in the building for a conference. A recurrent culprit for these absences was the requirement, abolished in 1911, that justices visit far- flung federal courts during their recesses; these Every justice starts a newcomer: Brewer (left) and Gorsuch weeks- or even months-long excursions by carriage over the most primitive of roads caused all manner of malady and missed days of work.
