    The Effects of Flood Insurance on Housing Markets by Agustín Indaco, Francesc Ortega, and Süleyman Tas¸pınar Agustín Indaco Carnegie Mellon University in Qatar Francesc Ortega Süleyman Tas¸pınar Queens College, City University of New York Abstract In this article, we analyze the role of flood insurance on the housing markets of coastal areas. To do so, we assembled a parcel-level dataset of the universe of residential sales for two coastal urban areas in the United States—Miami-Dade County (2008–15) and Virginia Beach (2000–16)—matched with their Federal Emergency Management Agency (FEMA) flood maps, which characterize the flood-risk level for each property. First, we compare trends in housing values and sales activity among properties on the floodplain, as defined by the National Flood Insurance Program (NFIP), relative to properties located elsewhere within the same area. Despite the heightened flood risk in the past two decades, we do not find evidence of divergent trends. Second, we analyze the effects of the recent reforms to the NFIP. In 2012 and 2014, Congress passed legislation announcing important increases in insurance premiums and flood map updates. We find robust evidence of large price reductions for properties that were drawn into the flood zone of the new FEMA flood maps. We estimate that, as a result of the mandatory insurance requirement in the flood zone, NFIP insurance costs for such properties in Virginia Beach will increase by an average of about $3,500 per year and lead to a reduction in housing values of about $64,000. Flood insurance is available from the National Flood Insurance Program (NFIP) and is sold through insurance agents like Gowrie Group. There is a 30-day waiting period in most cases. 3. When is flood insurance required? If a home is in a high risk flood zone (Zone A or V), lenders must, by law, require clients to buy flood insurance as a condition of the loan (mortgage). 4. Should I buy flood insurance even if I do not have a mortgage or my home is not in a high risk zone? In many cases, it is advisable to carry flood insurance regardless. The chance of a home suffering flood damage is many times more likely than being damaged by fire. One-quarter of all flood losses occur outside of the high risk flood zones. Homeowner’s insurance policies do NOT provide any coverage for losses related to floods. 5. What does the NFIP policy cover?     Interagency Consumer Laws and Regulations FDPA Flood Disaster Protection Act The National Flood Insurance Program (NFIP) is administered primarily under the National Flood Insurance Act of 1968 (1968 Act) and the Flood Disaster Protection Act of 1973 (FDPA).1 The 1968 Act made federally subsidized flood insurance available to owners of improved real estate or mobile homes located in special flood hazard areas (SFHA) if their community participates in the NFIP. The NFIP, administered by a department of the Federal Emergency Management Agency (FEMA) known as the Federal Insurance and Mitigation Administration (FIMA), makes federally backed flood insurance available to consumers through NFIP Direct Program agents who deal directly with FEMA or through the Write Your Own Program (WYO), which allows consumers to purchase federal flood insurance from private insurance carriers. The NFIP aims to reduce the impact of flooding by providing affordable insurance to property owners and by encouraging communities to adopt and enforce floodplain management regulations. The FDPA requires federal financial regulatory agencies to adopt regulations prohibiting their regulated lending institutions from making, increasing, extending or renewing a loan secured by improved real estate or a mobile home located or to be located in an SFHA in a community participating in the NFIP unless the property securing the loan is covered by flood insurance. KLEIN* ABSTRACT The National Flood Insurance Program (ªNFIPº) of 1968 marked its ®ftieth anniversary in 2018. Despite the program's long history, few appreciate that the NFIP was never intended as a permanent federal subsidy for ¯ood-prone properties along rivers and coastlines abandoned as commercially unviable by the private insurance industry. Instead, Congress provided ¯ood insurance at below-cost rates as only an interim solution until state and local governments enacted permanent self-help land-use regulations that would restrict develop- ment in risky areas. By encouraging local governments to enact ¯oodplain reg- ulations, Congress intended to shift the costs of development in known ¯ood areas back to those who chose to occupy them, thereby sending a strong signal of danger. But despite its lofty goals, the NFIP has failed miserably: It was more than twenty billion dollars in debt to the U.S. treasury as it turned ®fty. At the same time, the nation continues to build in ¯oodplains and to suffer death and devastating property loss from recurrent ¯oods. What can account for the NFIP's failings? Although there is extensive litera- ture on the design ¯aws endemic to the NFIP itself, scant attention has been directed to a pair of external contributors to the program's ineffectiveness: the regulatory and physical takings doctrines. This Article unpacks the role played by those doctrines in undermining federal ¯ood policy. The modern takings movement was gaining momentum at roughly the same time as the NFIP's pas- sage, and several of the movement's often-cited foundational cases took aim at coastal and ¯oodplain development regulations.
