था न उपल ध कराने संबंधी OाĐप िनयम, 2019 एतद् ůारा Oकािशत Ƙकया जाता है, िजसका उŶे य उϝ त OाĐप िनयमĪ से Oभािवत होने वाले सभी संभािवत लोगĪ से राजपJ मĞ इस अिधसूचना के Oकाशन कƙ ितिथ से तीस ƘदनĪ कƙ अविध कƙ समािƁ से पहले उन िनयमĪ के संबंध मĞ आपिēयां और सुझाव आमंिJत करना है; यƘद कोई आपिēयां और सुझाव हĪ , तो उ हĞ उप-सिचव (पशु क या ण), भारत सरकार, पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय को Oेिषत Ƙकया जाए; िनधाϕƗरत अविध के भीतर आम जनता से Oा त सभी आपिēयĪ/सुझावĪ पर के Lीय सरकार ůारा उिचत Đप से िवचार Ƙकया जाएगा ; भारत िवव पशु वा  य संगठन (ओआईई), जो िव व  या पार संगठन (ड  यूटीओ) के अंतगϕत एक अंतर-शासाकƙय िनकाय तथा मानक िनधाϕरक िनकाय है, का एक सद य देश है। ओआईई पशु क या ण के िलए भी मानक िनधाϕƗरत करता है। अत: अब केLी य सरकार पशुĸ के Oित ;ूरता िनवारण अिधिनयम, 1960 (1960 का 59) कƙ धारा 11 कƙ

उप-धारा (1)(ड.) के साथ पƗठत धारा 38 कƙ उप-धारा (1) ůारा Oद त शिŎयĪ का Oयोग करते ćए एतद् ůारा िन न िलिखत िनयम बनाती है, अथाϕत् :- OाĐप िनयम 1.1.1. संिϓ त नामनामनाम औरऔरऔर Oार भ ––– (i) इन िनयमĪ को पशुĸ के Oित ;ूरता िनवारण (अंडे देने वाली मुƞगϕयĪ ) िनयम, 2019 कहा जाएगा।

(ii) ये िनयम सरकारी राजपJ मĞ उनके Oकाशन कƙ ितिथ से लागू हĪगे। 2.2.2. उŶेय --- इन िनयमĪ के अंतगϕत गैलस गैलस डोमेिटकस OजाितयĪ कƙ वािणिϤयक चूजĪ या मुƞगϕयĪ के िलए अंडे के उपा दन हेतु पर प रागत आXय घेरĪ , िजहĞ पहले बै टरी ƚपंजरĪ के Đप मĞ उिलिखत Ƙकया गया था, मĞ रखी गई अंडे देने वाली मुƞगϕयĪ और चूजĪ के िलए था न कƙ अपेϓा को  प ट करने हेतु उनके िलए था न उपल ध कराने का समाधान Ƙकया गया है। 3. पƗरभाषाएं ––– इन िनयमĪ मĞ, यƘद संदभϕ मĞ अ य था अपेिϓत न हो तो, - i. ‘अिधिनयम’ से पशुĸ के Oित ;ूरता िनवारण अिधिनयम, 1960 (1960 का 59) अिभOेत है; ii. ‘पर प रागत आXय घेरĪ ’, ( िजहĞ पूवϕ मĞ बैटरी ƚपंजरĪ के Đप मĞ उिलिखत Ƙकया गया था) से ऐसा िघरा ćआ ϓेJ अिभOेत है िजसका िवता र अलग-अलग हो सकता है तथा िजसमĞ अंडे देने वाली मुƞगϕयĪ और चूजĪ कƙ संϞया यू नतम अपेिϓत था न के अनुĐप होगी ताƘक उनके Oित ;ूरता का िनवारण हो सके। iii. ‘पयाϕवरणीय िथित ’ से अिभOेत उस था न से है जहां मुगĖ पालन Ƙकया जा रहा है। iv. ‘फामϕ’ से अिभOेत उस भूिम, भवन, सहायक सुिवधा ĸ और अ य उपकरणĪ से है, िज हĞ अंडĪ के उपा दन हेतु मुगĖ पालन मĞ पूरी तरह अथवा आंिशक Đप से उपयोग मĞ लाये जाते हġ, फामϕ पƗरसर पंजीकरण Oयोजनाथϕ के िलए सिžिहत Oकृित के होने चािहए। v. ‘फामϕ का वा मी’ अथवा ‘फामϕ संचालक’ से अिभOेत Ƙकसी यिŎ (यĪ ) अथवा कंपिनयĪ अथवा  यवसािययĪ अथवा कृिष संगठनĪ अथवा सिमितयĪ से है जो फामϕ के  वा मी हġ अथवा उसके संचालन को िनयंिJत करते हġ और इनमĞ यिŎ (यिŎयĪ ) और कोई अ य  यिŎ शािमल है िजनके ओर से फामϕ संचािलत Ƙकया जा रहा है। vi. ‘अंडे देने वाली मुƞगϕयĪ ’ से अिभOेत मानव उपभोग और अ य उपयोग हेतु अंडĪ के वािणिϤयक उ पा दन करने के िलए रखी गई गैलस गैलस डोमे टी कस Oजाित कƙ यौन पƗरपϝ व मादा पिϓयĪ से है। vii. ‘लेयर पुलेϧस ’ (पुलेϧस ) से अिभOेत अंडे सेने से यौन पƗरपϝव ता होने तक वा िणिϤयक Đप से लेयर उ पा दन OयोजनĪ के िलए संवधϕन कƙ गई गैलस गैलस डोमे टी कम Oजाित कƙ मादा पिϓयĪ से है। viii. ‘पंजीकरणकताϕ Oािधकरण ’ से अिभOेत राϤ य और संघ राϤ य ϓेJĪ के पशु पालन िवभाग से है जहां मुगĖ पालन फामϕ था िपत Ƙकया गया है। ix. ‘‘ पशुĸ के Oित ;ूरता का िनवारण हेतु सिमित (एसपीसीए)’’ से अिभOेत पशुĸ के Oित ;ूरता का िनवारण (पशुĸ के Oित ;ूरता का िनवारण के िलए सिमितयĪ कƙ था पना और िविनयमन) िनयमावली, 2001 के िनयम 2 के खड (ड.) मĞ यथापƗरभािषत सिमित से है (26 माचϕ, 2001 के का.आ. 271(ड.) ůारा अिधसूिचत) । x. ‘‘ राϤय बोडϕ’’ से अिभOेत राϤय सरकार ůारा राϤ य मĞ गƗठत Ƙकए गए राϤ य पशु क या ण बोडϕ से है। xi. ‘‘पशु िचƘकसा य वसायी’’ से अिभOेत भारतीय पशुिचƘक सा पƗरषद अिधिनयम, 1984 (1984 का 52) कƙ धारा 2 के खंड (छ) मĞ यथा पाƗरभािषत पंजीकृत पशु िचƘक सा  य वसायी से है। xii. ‘ओआईई’- िवव पशु वा  य संगठन (ओआईई), 181 सद य देशĪ सिहत एक अंतरराEी य संगठन है, िजहĪ ने िवव भर मĞ पशु-वा  य मĞ सुधार करने और क या ण करने के िलए इसे अिधदेश Ƙदया है। 4.4.4. िनयमĪ कƙकƙकƙ अनुOयोϤय ताताता-ता ---ये िनयम उन फामĬ पर लागू हĪगे, जहां कॉलोनी के बाड़Ī मĞ अंड़े देने वाली मुƞगϕयĪ को रखा जाता है। 5. फामĬ का पंजीकरण - i. संबंिधत राϤय अथवा संघ राϤय ϓेJĪ के पंजीकरणकताϕ Oािधकरण ůारा यथा िविनƠदϕ ट Ƙकए जाने वाले Oित फामϕ मुƞगϕयĪ और/अथवा चूजĪ कƙ ऐसी संϞ या रख रहे फामĬ का  वािमव रखने वाले अथवा फामĬ का Oभार रख रहे यिŎ अथवा हितयां, संबंिधत राϤ य सरकार अथवा संघ राϤ य ϓेJĪ के पशु पालन िवभाग से अपने फामĬ को पंजीकृत कराने के िलए आवेदन करĞगे। ii. राϤय का पशु पालन िवभाग पंजीकरण कƙ  वी कृित देते समय ऐसी शतĠ अिधरोिपत करेगा जो वह अ य वतϕमान था नीय कानूनĪ के अनुसार उिचत समझĞ। ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3

iii. पंजीकरण हेतु आवेदन पJ मĞ फ़ामϕ कƙ Đपरेखा , पशु पालन, डेरी उźोग और Ƙकसान क या ण िवभाग, कृिष और Ƙकसान कया ण मंJालय ůारा समय-समय पर िविहत जैव-सुरϓा संबंधी  यव था एं और अ य संबŵ सूचना (जो िनयमाधीन अपेिϓत हĪ ) शािमल हĪगी।

iv. पंजीकरण Oािधकरण , अहातĪ के िनयमानुसार होने के संबंध मĞ उसका समाधान हो जाने पर फ़ामϕ का पंजीकरण करेगा और एक पंजीकरण Oमाण -पJ जारी करेगा।

v. पंजीकरण Oमाण -पJ इसके जारी Ƙकए जाने कƙ तारीख से पांच वषϕ के िलए िविधमा य होगा। फ़ामϕ का  वा मी या Oभारी यिŎ वतϕमान -Oमाण -पJ के समा त होने कƙ तारीख से तीन महीने कƙ अविध के भीतर एक आवेदन पJ के माय म से पंजीकरण Oािधकरण को आवेदन करके इस Oमाण -पJ का समय-समय पर नवीकरण करा सकेगा।

vi. Oये क फ़ामϕ जो इन िनयमĪ के Oारंभ होने से पहले ही Oचालन मĞ है इनके Oारंभ कƙ तारीख से तीन महीने कƙ अविध के भीतर व यं को संबंिधत राϤ य के पशु पालन िवभाग मĞ पंजीकृत कराएगा।

vii. पंजीकरण Oमाण -पJ को फ़ामϕ मĞ Ƙकसी सहज दृय था न पर Oदƞशϕत Ƙकया जाएगा।

6.6.6. मुगĖ पालन फ़ामϕ केकेके वावा मीमीमी यायाया फ़ामϕ Oचालक काकाका उतउत ररर दाियव ...-.---

(i) फ़ामϕ/कंपनी/सोसाइटी/संगठन का  वा मी/Oचालक /सवīϢ च अिधकारी अंडा देने वाली मु ƞगϕयĪ के क या ण के िलए िनधाϕƗरत पयाϕवरणीय शतĬ के अनुसार इन िनयमĪ का अनुपालन सुिनिƇत करने के िलए उत रदायी होगा।

(ii) यƘद संिवदाकार तथा ƘकसानĪ के बीच कोई ऐसी संिवदा है िजसके तहत मुगĖ पालन फ़ामϕ हेतु, फ़ामϕ के  वा मी के िलए िनवेश संिवदाकार ůा रा Ƙकया जाना है तो फ़ामϕ का  वा मी और संिवदाकार दोनĪ ही इन िनयमĪ का अनुपालन सुिनिƇत करने के िलए उ त रदायी हĪगे।

(iii) यƘद फ़ामϕ पर सरकार का वािम व है तो इन िनयमĪ के अनुपालन का उतरदािय व सं था के Oधान का होगा।

7.7.7. िनरीϓण काकाका OाOाOा िधकार ƘदएƘदएƘदए जाने कƙकƙकƙ शिŎशिŎशिŎ ...-.--- राϤ य या संघ राϤय ϓेJ का पशु पालन िवभाग या पशुĸ के Oित ;ूरता के िनवारण हेतु बोडϕ/राϤय बोडϕ/िजला सोसाएटी (एसपीसीए) अनुपालन को सुिनिƇत करने के िलए उपयुϝ त त र के अिधकाƗरयĪ को Ƙकसी फ़ामϕ का िनरीϓण करने और ऐसे िनरीϓण के िनकषĬ कƙ एक Ɨरपोटϕ पंजीकरण Oािधकरण को Oतु त करने के िलए Oािधकृत कर सकता है और उपयुϝ त  त र के अिधकारी-

(i) Ƙकसी उपयुϝत समय पर फ़ामϕ मĞ Oवेश कर सकते हġ और फ़ामϕ का िनरीϓण कर सकते हġ; Ƙकसी  यिŎ से पंजीकृत फ़ामϕ के संबंध मĞ उसके ůारा रखे गए फ़ामϕ Đपरेखा Ɨरकॉडϕ को O तुत करने कƙ मांग कर सकते हġ।

(ii) िनरीϓण के दौरान िनरीϓणकारी अिधकारी यथा िविनƠदϕ ट जैव-सुरϓा OोटोकोलĪ और िनयमĪ का पालन करेगा।

(iii) कोई भी िनरीϓक , सं;मण का िनवारण करने के िलए जैव-सुरϓा सरोकारĪ के तहत Ƙकसी फ़ामϕ का िनरीϓण , बहत र घंटे कƙ अविध के भीतर एक से अिधक बार नहĕ करेगा। जैव सुरϓा OोटोकोलĪ को सुिनिƇत करने के िलए उसे अपने सभी िनरीϓणĪ का Ɨरकॉडϕ रखना चािहए।

8. अंडे देने वाली मुƞगϕयĪ केकेके िलए था ननन Oबंधन

सभी नए फ़ामĬ या पुराने ƚपंजरĪ के Oितथा पन के िलए िन न िलिखत िविनƠदϕ टताĸ को पूरा Ƙकया जाना चािहए :-

Oये क पϓी के िलए फशϕ का था न पांच सौ पचास वगϕ सĞटीमीटर से कम नहĕ होगा और O येक ƚपंजरĞ मĞ Oािधमानत : कम से कम 6 से 8 पϓी रखे जाने चािहए और इस Oकार अंडा देने वाली मुƞगϕयĪ के िलए अंडे देने, खड़े होने, पंख फड़-फड़ाने, आसपास घूमने और चारे तथा पानी तक पćंचने के िलए उिचत था न को सुिनिƇत Ƙकया जाएगा।

9.9.9. था ननन उपल ध ताताता केकेके ƗरकॉडĬ काकाका रखा जाना :::

(i) फ़ामϕ का वा मी या Oचालक यह सुिनिƇत करेगा Ƙक अिधकतम आवासन घन व सीमा से अिधक न हो और मुƞगϕयĪ के िलए उपल ध कुल फशϕ ϓेJ ;  था न उपल ध ता; और आवास के भीतर रखे जाने वाले पिϓयĪ कƙ अिधकतम संϞया का Ɨरकॉडϕ रखेगा।

(ii) फ़ामϕ का वा मी या Oचालक उपल ध पिϓयĪ कƙ संϞया , दैिनक मौतĪ और मारे गए पिϓयĪ कƙ संϞ या का Ɨरकॉडϕ रखेगा।

(iii) ये Ɨरकॉडϕ िविहत Oािधकारी ůारा िनरीϓण के िलए उपल ध कराये जाएंगे।

10. चारे केकेके संबंध मĞमĞमĞ Oितषेध :

(i) मुƞगϕयĪ को मरे ćए चूजĪ के अवशेषĪ का चारा देना Oितषेिधत होगा।

(ii) िवकास को बढाने वाली दवाĸ का Oयोग Oितषेिधत होगा।

(iii) एंटी-बायोƗटक दवाĸ को िचƘक सी य OयोजनĪ (रोग के उपचार) के िलए और Ƙकसी पशु िचƘक स क के पयϕवेϓण के अधीन ही Ƙदया जाएगा।

(iv) रोऑ िगराने के िलए चारा न Ƙदया जाना Oित षेिधत होगा।

11. िचƘकसी ययय देखभालदेखभाल....————फ़ामϕ का वा मी या Oचालक आवासन के दौरान और आपातकालीन िचƘक सी य देखभाल कƙ िथित मĞ पयाϕ त Oबंधन और िचƘकसी य देखभाल उपल ध कराने के िलए पयाϕ त जनशिŎ , िजसमĞ पंजीकृत पशु िचƘक स क शािमल है, को िनयोिजत करेगा। आपात िथित मĞ पशु िचƘक स क से संपकϕ के िलए संपकϕ यौ रे Ƙकसी सहज-दृ य  था न पर Oदƞशϕत Ƙकए जाने चािहएं।

12. नरनरनर चूजĪ कƙकƙकƙ सुखसुखसुख मृयु ...—.———अंडज उपिĔ ा शाला (हैचरी) नर चूजĪ कƙ सुख मृयु के िलए ओआईई के ƘदशािनदğशĪ मĞ िविहत Ƙकसी Ƙ;यािव िध का उपयोग करेगा।

13. Oजनन अशϝत मुƞगϕयĪ काकाका िव;य ::: फ़ामϕ, Oजनन अशϝत मुƞगϕयĪ को िवशेष Đप से लाइसĞस धारक बूचड़खानĪ या Ƙकसी पंजीकृत या पारी को बेचेगा तथा Oजनन अशϝ त मुƞगϕयĪ को लाना, ले जाना और उनका वध लागू िनयमĪ के अनुसार होगा।

141414.14 . पंजीकरण रŶरŶरŶ करना ::: यƘद Ƙकसी मुगĖ पालन फ़ामϕ का रखरखाव, इन िनयमĪ के तहत आव य क तरीके से नहĕ Ƙकया जा रहा है, तो पंजीकरण Oािधकारी िलिखत मĞ कारण बताओ नोƗटस देने के बाद और तीस ƘदनĪ कƙ अविध के भीतर  यिŎ को कारण बताओ नोƗटस का जवाब देने का अवसर देते ćए , पंजीकरण का OमाणपJ रŶ कर सकता है।

15. पंजीकरण काकाका िनरसन ::: यƘद फ़ामϕ, िनरीϓण के दौरान पाIJ गई किमयĪ का एक िविश ट समय-सीमा के भीतर अनुपालन करता है तो पंजीकरण Oािधकरण ůारा पंजीकरण को रŶ न करने पर िवचार Ƙकया जाएगा।

16. अपील : इन िन यमĪ के तहत, ऐसे अिधकारी या Oािधकरण को Ƙकसी फ़ामϕ के पंजीकरण से इनकार करने या रŶ करने के Ƙकसी आदेश पर अपील कƙ जाएगी जैसा Ƙक राϤ य सरकार इस संबंध मĞ िनƠदϕ ट करेगी।

17. शाितयां ::: यƘद कोई फ़ामϕ का वा मी या फ़ामϕ का Oभारी , िनयमĪ का उ लंघन करता है तो उसे पशुĸ के Oित ;ूरता िनवारण अिधिनयम, 1960 के अंतगϕत यथा िनधाϕƗरत जुमाϕने के साथ दंिडत Ƙकया जाएगा। उ लंघन एक इकाई ůारा Ƙकए जाने पर Oभारी यिŎ को अपराध का दोषी माना जाएगा और उसके अनुसार उसे दंिडत Ƙकया जाएगा।

18. Oवतϕन समय :::

(i) राϤय सरकारĞ इन िनयमĪ के अनुपालन के िलए आव य क Oशासिनक OावधानĪ को 31 Ƙदसंबर , 2019 तक अिधसूिचत करĞगी। राϤय इसे तुरंत संबंिधत Oशासिनक मंJालय को सूिचत करĞगे। ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5

(ii) मौजूदा फामϕ, 01 जनवरी, 2025 से पहले नए पशु क या ण ƘदशािनदğशĪ मĞ बदले जाएंगे।

(iii) ये िनयम आिधकाƗरक गजट मĞ Oकािशत होने के बाद 01 जनवरी, 2020 को लागू हĪगे।

New Delhi, the 29th April, 2019 G.S.R. 335(E).—Whereas a draft of the Space allowance for conventional colony enclosures of egg-laying hens for commercial egg production, 2019 is hereby published, as required under sub-section (1) of section 11 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), for inviting objections and suggestions on the said draft rules from all persons likely to be affected thereby, before the expiry of the period of thirty days from the date of publication of this notification in the Official Gazette; The objections and suggestions, if any, may be sent to the Deputy Secretary (Animal Welfare) to the Government of India, Ministry of Environment, Forest and Climate Change; All objections/suggestions received from the public within the specified period shall be duly considered by the Central Government; India is a member country of World Organization for Animal Health (OIE), an inter-governmental body and standard setting body under World Trade Organization (WTO). OIE also prescribes standards for animal welfare. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 38 read with sub-section (1) (e) of Section 11 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), the Central Government hereby makes the following rules, namely:- DRAFT RULES 1. Short title and commencement .-(i) These rules may be called the Prevention of Cruelty to Animals (Egg Laying Hens) Rules, 2019. (ii) They shall come into force on the date of their publication in the Official Gazette. 2. Objectives .-These Rules address space allowance for commercial pullets or hens of species Gallus gallus domesticus to clarify space requirement of laying hens and pullets kept in conventional colony enclosures, previously referred to as battery cages, for egg production. 3. Definitions - In these rules, unless the context otherwise requires, - i. ‘Act’ means the Prevention of Cruelty to Animals Act, 1960 (59 of 1960); ii. ‘Conventional colony enclosures’(previously referred to as battery cages) means a confined area which can have varying dimensions and number of laying hens and pullets conforming to minimum space required so as not to inflict cruelty. iii. ‘Environmental condition’ means the location where poultry farming is taking place. iv. ‘Farm’ means the land, building, support facilities, and other equipment that are wholly or partially used in poultry farming for the production of eggs; the farm premises should be contiguous in nature for registration purpose. 6 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(i)]

v. ‘Farm owner’ or ‘farm operator’ means any person(s) or companies or entrepreneurs or farmers organisations or societies who own(s) or controls the operation of a farm and includes individual(s) and any other person on whose behalf the farm is being run. vi. ‘Laying hens’ (hens) means sexually mature female birds of the species Gallus gallus domesticus kept for the commercial production of eggs for human consumption and other usage. vii. ‘Layer pullets’ (pullets) means female birds of the species Gallus gallus domesticus raised for commercial layer production purposes from hatch until the onset of sexual maturity. viii. ‘Registering Authority’ means Animal Husbandry Department of the State and Union Territories where the poultry farm is established. ix. “Society for Prevention of Cruelty to Animals(SPCA)” means the Society as defined in clause (e) of rule 2 of the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001 (notified vide S.O. 271(E) dated 26 th March, 2001). x. “State Board” means a State Animal Welfare Board constituted in a state by the state government. xi. “Veterinary practitioner” means a registered veterinary practitioner as defined in clause (g) of section 2 of the Indian Veterinary Council Act 1984 (52 of 1984). xii. “OIE” – World Organisation for Animal Health (OIE) is an international organisation with 181 member countries, which have given it a mandate to improve animal health and welfare throughout the world. 4. Application of rules - These rules shall apply to the farms where egg laying hens are housed in colony enclosures. 5. Registration of farms - i. Persons or entities owning or having charge of farms keeping such number of hens and/or pullets per farm as may be specified by the Registering Authority of the concerned State or Union Territories shall apply to get their farms registered with the Animal Husbandry Department of the concerned State Governments/ Union Territories. ii. The Animal Husbandry Department of the State shall, while granting registration, impose such conditions as it may deem fit as per other extant local laws. iii. The application for Registration shall include the farm layout, bio-security arrangement as prescribed from time to time by the Department of Animal Husbandry, Dairying and Farmers’ Welfare, Ministry of Agriculture and Farmers’ Welfare and other relevant information (required under the rules). iv. The Registering Authority, if satisfied that the enclosures are as per the Rules, shall register the farms and issue a certificate of registration. v. The certificate of registration will be valid for five years from the date of its issuance. The certificate may be renewed from time to time through an application made by the person owning or in charge of the farm to the registering authority, within three months from the date of expiry of the existing certificate of registration. vi. Every farm operating prior to the commencement of these rules shall, within a period of three months from the date of its commencement, register itself with the Animal Husbandry Department of the concerned State. vii. The registration certificate shall be displayed in a conspicuous place at the farm. 6. Responsibility of poultry farm owner or farm operator .- i. The owner/operator/Highest Ranking official of farm/company/society/organization shall be responsible for ensuring the compliance of these rules as per the given environmental conditions for the welfare of layer hens. ii. In case of contract farming between contractor and farmers, where inputs for poultry farming are provided to the farm owner by the contractor, both the farm owner and the contractor shall be responsible for ensuring compliance of these rules. ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 7

iii. Where a farm is owned by a government, the responsibility of compliance of these rules shall be on the Head of the institution. 7. Power to authorise inspection - For the purposes of ensuring compliance, the Animal Husbandry Department of the State or Union Territories or the Board/State Board/District Society for Prevention of Cruelty to Animals (SPCAs) may authorize officials of appropriate level to inspect any farm, and submit a report containing the findings of such inspection to the registration authority, and officials of appropriate level may – i. enter at any reasonable time and inspect the farm; and require any person to produce farm layout records kept by him in respect of the registered farm. ii. during the inspection, the inspecting official must follow biosecurity protocols and norms as specified.; iii. no inspector shall visit more than one farm within a period of seventy two hours for biosecurity concerns to prevent the spread of infection. He should keep the record for all of his visits to ensure biosecurity protocols. 8. Space allowance for laying hens: All new farms or replacement of old cages must meet following specification: Floor space per bird shall not be less than 550 square centimeter and each cage should accommodate preferably a minimum of 6-8 birds, thus ensuring reasonable space for laying hens for lying down, standing up, flapping wings, turning around and access to feed and water. 9. Maintenance records of space allowance: i) The farm owner or the operator shall ensure that the maximum housing density is not exceeded and maintain records of the total floor area available to the hens; the space allowances; and maximum number of birds kept within the house. ii) The farm owner or the operator shall maintain the record of available number of birds, the daily mortality and number culled. iii) These records shall be made available for inspection by the prescribed authority. 10. Prohibition with regard to feed: i) The feeding of hens with remains of dead chicks shall be prohibited. ii) The use of growth promoters shall be prohibited. iii) Antibiotics may be administered for therapeutic purposes (disease treatment) and only under supervision of a veterinarian. iv) Withdrawal of feed to induce a molt shall be prohibited. 11. Veterinary Care . -The farm owner or farm operator shall deploy adequate manpower including registered veterinarian to provide adequate management and veterinary care during housing and in emergency medical care. The emergency contact details of the veterinarian should be displayed at a conspicuous place. 12. Euthanasia of male chicks .- The hatcheries shall use any of the procedure for euthanasia for male chicks as prescribed in the OIE guidelines. 13. Disposal of spent hens .- The farm shall sell the spent hens preferably to the licensed slaughter houses or to a registered trader and transport and slaughter of spent hens shall be in accordance with the applicable rules. 14. Cancellation of Registration . - If any poultry farm is not maintained in the manner required under these Rules, the registering authority may, after serving a show cause notice in writing, and giving an 8 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(i)] opportunity to the person to reply on such show cause notice within a period of thirty days, cancel the certificate of registration. 15. Revocation of Registration .- If the farm complies with the deficiencies identified during the inspection within a specific time frame, the registering authority shall consider revoking the registration. 16. Appeal . - An appeal shall lie from any order refusing or cancelling the registration of any farms under these Rules to such officer or authority as the State Government may specify on this behalf. 17. Penalties. -If any person owning or having charge of farms contravenes the Rules, he shall be punishable with fine as prescribed under Prevention of Cruelty to Animals Act, 1960. When the contravention is by an entity, the person in charge shall be deemed to be guilty of the offence and shall be punishable accordingly. 18. Enforcement time. – (i) State governments shall notify the administrative provisions necessary to comply with these rules not later than 31st December 2019. States shall forthwith inform the same to the concerned administrative ministry. (ii) Existing farms will change to new animal welfare guidelines not later than Jan. 1, 2025.
