Certificates of Label Approval and Other Labeling and Packaging Materials Dear Ms. Parker: Irish Distillers Group and Comrie Limited have entered into a purchase and sale agreement to sell the company, Paddy Whiskey Limited, brand owner of the brands listed below, to Sazerac Company, Inc. (“Sazerac”), and such sale was finalized and effective May 17, 2016. As the current importer of the brands listed below and due to the purchase and sale mentioned above, Pernod Ricard USA, LLC (“PRUSA”), TTB Permit NY-I-15204 authorizes Sazerac, to utilize any labels, packaging and advertising materials bearing the PRUSA name for the importation, sale and distribution of the following brand, effective May 17, 2016: 1. Paddy’s Irish Whisky; 2. Paddy’s Devils Apple; 3. Paddy’ Beesting In addition and pursuant to ATF Ruling 84-3, PRUSA authorizes Sazerac to adopt and utilize all certificates of label approval (“COLA”) issued to PRUSA for use in the removal of the foregoing brand from customs custody. This authorization shall include, but not be limited to, the following: Paddy’s Irish Whisky COLA # SERIAL # PRODUCT 13114001000164 13P100 Paddy’s IrishWhisky (750ml, 1L) 13155001000374 13P137 Paddy’s Devils Apple (750ml) 13192001000330 13P170 Paddy’s Devils Apple (50ml) 13155001000376 13P136 Paddy’s Beesting (750ml) 13192001000338 13P171 Paddy’s Beesting (50ml) By this letter and with immediate effect, PRUSA also authorizes Sazerac to take any steps necessary to obtain any necessary regulatory approvals required to sell the above brands, including but not limited to use-up label approvals, use-up of inventories of cases, packaging materials and advertising materials, brand registrations, distributor appointments and price filings.
