The Committee agreed to take Item 7, 8 and 9 together as they all related to the release of sentencing decisions following Council prosecutions.

7.1 Mr A D McLay spoke to the memorandums updating the Committee on the 8.1 prosecution of Mr S Fisher, R&F Farms Limited, Mr R Collingwood and Collingwood 9.1 Civil Limited for breaches of the Regional Freshwater Plan for Taranaki; the prosecution of Mr J Mead for a breach of the Regional Freshwater Plan for Taranaki; and the prosecution of Mr C Boyd for a breach of the Regional Freshwater Plan for Taranaki.

Purpose The purpose of this memorandum is to advise the Committee of consents granted, consents under application and of consent processing actions since the last meeting. This information is summarised in figures at the end of this report.

Executive summary Memorandum to advise the Committee of recent consenting actions made under regional plans and the Resource Management Act, in accordance with Council procedures and delegations.

Recommendation That the Taranaki Regional Council: 1. receives the schedule of resource consents granted and other consent processing actions, made under delegated authority.

Background The following resource consent applications have been investigated by officers of the Taranaki Regional Council. They are activities with less than minor adverse effects on the environment or minor effects and affected parties have agreed to the activity. In accordance with sections 104 to 108 and section 139 of the Resource Management Act 1991, and pursuant to delegated authority to make decisions on consent applications, the Chief Executive or the Director—Resource Management has granted the consents/certificates of compliance.

The exercise of delegations under the Resource Management Act 1991 is reported for Committee Members’ information. Under the delegations manual, consent processing actions are to be reported to the Consents and Regulatory Committee.

The attached appendices (consent applications in progress) show the total number of applications in the consent processing system over the last twelve months. The number of applications for the renewal of resource consents is also shown. The difference between the two is the number of new applications, including applications for a change of conditions. New applications take priority over renewal applications. Renewal applications are generally put on hold, with the agreement of the applicant, and processed when staff resources allow. A consent holder can continue to operate under a consent that is subject to renewal. The above approach is pragmatic and ensures there are no regulatory impediments to new activities requiring authorisation.

Also attached are the following:  Applications in progress table - the number of applications in progress at the end of each month (broken down into total applications and the number of renewals in progress) for this year and the previous two years.  Consents issued table - the number of consents issued at the end of each month for this year and the previous two years.  Potential hearings spreadsheet outlining the current status of limited/notified applications where hearing committees have been appointed.  Breakdown of consents issued. This is the number of consents issued broken down by purpose – new, renewals, changes or review.  Types of consents issued, further broken down into notification types – non-notified, limited notified or public notified.  Public and iwi involvement in non-notified consents. This assessment excludes routine farm dairy discharges as generally affected party approval and iwi consultation is not required for these.  Application processing time extensions used compared to the previous years.  Consent type process shows the notification type including applications submitted on and the pre-hearing resolution numbers.

Discussion Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act.

Purpose The purpose of this memorandum is to advise the Committee of 21 tailored compliance monitoring reports that have been prepared since the last committee meeting.

Executive summary The Council considers the regular reporting of comprehensive and well-considered compliance monitoring is vital to undergird:  community standing and reputation enhancement for companies that consistently attain good or high levels of environmental performance;  a respectful regard for the Taranaki region’s environment and our management of its natural resources; and  the Council’s accountability and transparency.

There are 21 reports for presentation to the meeting. Recommendations pertaining to each site or programme are set out in the relevant report. The attention of Committee members is directed to the Executive Summary at the front of each report.

Background The Council considers the regular reporting of comprehensive and well-considered compliance monitoring is vital to undergird-  community standing and reputation enhancement for companies that consistently attain good or high levels of environmental performance. Informed feedback is appropriate and valuable, and assists a proactive alignment of industry’s interests with community and Resource Management Act expectations. Reporting describes the effective value of investment in environmental systems;  a respectful and responsible regard for the Taranaki region’s environment and our management of its natural resources. Reporting allows evaluation and demonstration

of the overall rate of compliance by sector and by consent holders as a whole, and of trends in the improvement of our environment; and  the Council’s accountability and transparency. Reporting gives validity to assessments of effective intervention.

These reports have been prepared by staff of the Science Services section and have been submitted to the consent holder for comment and confirmation of accuracy prior to publication. All reports provide environmental performance and administrative compliance ratings for each consent holder in relation to their activities over the period being reported and provide recommendations for the following monitoring year.

Of the 21 reports being presented to this meeting, 18 cover the activities of individual consent holders while 3 reports cover joint monitoring programmes. Within the reports, 58 high, 17 good, 17 improvement required and 1 poor environmental performance ratings were assigned, (Table 1).

So far this year, 69 consent compliance monitoring reports have been completed and presented at C & R meeting relating to the 2015-2016 monitoring year (Figure 1). Science Services have continued to prepare and present a number of case studies to this Committee. Today we are presenting a case study to the Committee which highlights some of the fish transfer work completed by Trustpower at their Patea Hydroelectric Power Scheme (Lake Rotorangi). It also introduces the monitoring planned to assess the effectiveness of this work in establishing fish communities in the upper reaches of the Patea River.

Case Study Trustpower Limited own and operate a power station located on the Patea River. This scheme dams the Patea River behind a large earth dam, forming Lake Rotorangi. This dam presents a significant barrier to the upstream migration of a number of freshwater fish species.

The new resource consents for the Patea Hydroelectric Power Scheme (HEPS) were granted in 2010. Prior to the renewal, migrating fish were captured in a trap at the station, and transferred directly into the lake. This was effective at moving large numbers of fish, but concerns were raised that these fish were not migrating right up the lake and into the Patea River headwaters, largely due to predation by the large number of perch present in the lake. A requirement of the new consents is that Trustpower shall take all reasonable steps to ensure that the Patea Dam and Lake Rotorangi do not prevent the establishment and maintenance of populations of longfin eels, shortfin eels, lamprey, koaro, banded kokopu, giant kokopu and shortjaw kokopu in the major areas of suitable habitat upstream of Lake Rotorangi. The objective of this requirement is to establish and maintain populations of the target species that are comparable with those in similar barrier-free habitats.

To achieve compliance with this condition, Trustpower have used the existing trap located alongside the station discharge, with some modifications to improve its performance (Photo 1). Whitebait, the juvenile form of koaro and the kokopu species, migrate up the Patea River in spring, and juvenile Photo 1 The fish trap located alongside the station discharge. longfin and shortfin eel (known as elvers), migrate up from December through to March. These fish accumulate at the Patea Dam, where they swim up whatever flow they can find in an attempt to continue their upstream journey. The trap exploits this behaviour, by releasing an attractant flow, sufficient for the fish to swim up and enter the trap. Fish are regularly collected from this trap, with the whitebait and elvers separated and weighed. Subsamples of each group are Photo 2 The tailor made fish transporter collected and sent away to a laboratory for analysis, to establish the proportion of each species within each group. This allows the total numbers of each species transferred upstream to be estimated. Using a tailor made transfer trailer (Photo 2), the collected fish are moved into the headwaters of the Patea River for release.

There are various release sites located in the headwaters (Figure 2), with most of the whitebait transferred into the catchment that drains Mount Taranaki.

The catchment that drains the eastern hill country received mainly elvers. Trustpower have provided the numbers of fish transferred into the headwaters up until July 2016 (Table 2). Just over 1.5 million fish have been transferred since this new programme commenced, with the vast majority of these fish being shortfin eel. The most commonly transferred galaxiid is the banded kokopu, with just over eleven thousand transferred so far.

A significant transfer occurred in August 2015, when a number of adult lamprey arrived at the dam (Photo 3). These fish were discovered accumulating where a stormwater pipe was discharging some flow into the river, with a smaller number found in the trap. In total, 392 lamprey were transferred upstream of the dam. These fish were released directly into the lake just above the dam. Photo 1 Lamprey accumulating in a dam seepage collection drain

This is the first confirmed record of adult lamprey at the dam for many years.

Whether this transfer programme is increasing the populations of these species in the headwaters has not yet been determined. A baseline survey was completed in 2012, and a follow up survey is scheduled for completion in the March 2017. This survey will visit the same sites as the baseline survey, and will assess the change in fish communities over time. It is anticipated that the results from this survey will be reported in the 2017-2018 monitoring report for the Patea HEPS.

Discussion

16-49 Hydro Combined Irrigation Water Compliance Monitoring Programme Annual Report 2015-2016 This is the 13th Annual Report issued by the Taranaki Regional Council (the Council) to report on compliance monitoring programmes for resource consents authorising the abstraction of freshwater for irrigation purposes in Taranaki. This report for the period July 2015–June 2016 encompasses the data collected for compliance monitoring for resource consents for pasture irrigation, horticultural and golf course irrigation; as per the recommendations from the previous report.

Water is a public resource and the authorisation to take it is granted through resource consent. Associated with that permission is a public expectation that the water will be used efficiently, an expectation that can be better met if the actual amounts of water taken are accurately measured and recorded. Maintaining environmentally appropriate residual flows in streams and rivers to protect aquatic habitat is of primary concern to the Council when assessing water take applications. Monitoring of compliance with consent conditions is then required to ensure that any significant adverse effects as a result of authorised water takes are avoided.

At 30 June 2016, a total of 76 resource consents to take and use freshwater for irrigation purposes were registered in the Council’s databases. Of that number, 57 were for pasture irrigation, 9 for horticultural activities and 10 for recreational purposes (golf clubs). Sixty-four consents authorised abstractions from surface water (84%) while 12 (16%) utilised groundwater sources. A total of 60 irrigation consents were exercised during the 2015-2016 monitoring year.

The 2015-2016 monitoring programmes for irrigation water permits comprised a range of various components, including liaison with consent holders, site inspections, water take data collection, residual flow monitoring, water quality analysis, data review and compliance assessments. The specific range of monitoring carried out in relation to each consent is dictated by the water source, weather and flow conditions and system design. It was a busy season for the Council’s hydrological monitoring team, as the weather conditions meant the demand for irrigation was high, with irrigation starting as early as the middle of October 2015.

The Council carried out compliance monitoring inspections at 68 sites during the 2015-2016 irrigation season. The inspections included visual checks of the intake structures, screens, staff gauges, fencing around the pump sheds, downloading of data and stream gaugings.

For the summer irrigation period, the rainfall recorded at the Council’s monitoring locations ranged between 61% and 86% of historical mean values. This resulted in rivers and streams running well below mean flows for the period. The low stream flows necessitated close and frequent monitoring by the Council to ensure ecological flows were maintained in those waterways being used to supply water for irrigation. During the period under review, compliance with residual flow conditions for surface water abstractions was assessed by the Council on a total of 73 separate occasions, across 28 waterways. Some irrigators were still taking water in early May 2016.

Consent holder performance was assessed based on compliance with their authorised abstraction rates/volumes, maintenance of minimum residual flows, provision of abstraction records and all other general conditions of their consent(s).

The Council was required to enter a total of 17 incidents over the course of the 2015-2016 period in relation to irrigation consents. These incidents were reported to Council and staff implemented appropriate responses as they were identified. This included the issuing of seven abatement notices and one infringement notices.

During the 2015-2016 year, 47% of exercised irrigation consents in Taranaki achieved a high level of environmental performance and compliance with their consents, while 20% require improvement in their compliance performance.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

In addition to the conditions of resource consents for water abstractions, The Resource Management (Measurement and Reporting of Water Takes) Regulations 2010 place further legislative requirements on holders of consents for water abstractions greater than five litres per second. These include specific requirements for the installation of water measuring devices, verification of the accuracy of water measuring devices and data reporting. The Regulations allow for a staged implementation of the requirements, dependent on abstraction rate. All abstractions are to be compliant with the Regulations by 10 November 2016. The Council will continue to enforce implementation of the Regulations during forthcoming monitoring periods.

This report includes recommendations for the 2016-2017 year.

16-26 Todd McKee Production Station and Power Plant Annual Report 2015-2016 Todd Petroleum Mining Company Limited (the Company) operates a petrochemical production station and adjacent power plant located on Otaraoa Road near , bridging the Waitara and catchments. The McKee Production Station processes oil and gas from the Company’s McKee and Mangahewa groups of wellsites and includes electricity generation and LPG production facilities. Located to the south of the production station, the McKee Power Plant was completed and commissioned during the 2012-2014 period. This 100 MW electricity generating facility provides both peak and base load power for the national grid. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company’s subsidiaries, Todd Energy Limited and Nova Energy Limited, hold 15 resource consents for the sites, which include a total of 137 conditions setting out the requirements that the Company must satisfy. The subsidiaries hold two consents to allow for the take and use of water, five consents to discharge stormwater and wastewater, four consents to discharge emissions into the air, one consent to allow the diversion of unnamed tributaries of the Mangahewa Stream, and three consents regarding the installation and use of structures.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included six inspections of the facilities, six water and six stream sediment samples collected for physicochemical analysis, two biomonitoring surveys of receiving waters, and two ambient air quality surveys.

Stormwater system inspections showed that discharges from the sites complied with consent conditions at the time. Receiving water inspections and sampling showed that the discharges were not causing any adverse effects on the Waitara River or Mangahewa Stream at the time of monitoring.

Biomonitoring in the Mangahewa Stream found that the community health at the upstream site ranged from above average health in summer to average health in autumn. The downstream site community health was of average health with lower indicator values than the previous year. Hydrocarbons from historical contamination were not detected in the stream sediment at the upstream site, but were present at lower concentrations than previous years in the lower site sediment. Further monitoring will be undertaken to assess the trends in sediment hydrocarbon concentrations and stream community health.

There were no adverse effects on the environment resulting from the exercise of the air discharge consents. The ambient air quality monitoring at the production station showed that levels of carbon monoxide, combustible gases, PM10 particulates and nitrogen oxides were all below levels of concern at the time of sampling. No offensive or objectionable odours were detected beyond the boundary during inspections and there were no complaints in relation to air emissions from the sites.

During the period under review, the Company demonstrated an overall high level of both environmental performance and administrative compliance with the resource consents. There were no unauthorised incidents recorded by the Council in relation to the Company’s activities. The McKee Production Station and Power Plant were well managed and maintained.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

In terms of overall environmental and compliance performance by the consent holder over the last several years, this report shows that the consent holder’s performance remains at a high level.

16-95 DH Lepper Trust Piggery Monitoring Programme Annual Report 2015-2016 DH Lepper Trust (the Trust) operates a piggery located on Mountain and Manutahi Roads at , in the Waiongana catchment. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Trusts environmental performance during the period under review, and the results and environmental effects of the Trusts activities.

The Trust holds three resource consents, which include a total of 38 conditions setting out the requirements that they must satisfy. The Trust holds one consent to allow it to take and use

water, one consents to discharge treated effluent to land and into the Waiongana Stream, and one consent to discharge emissions into the air from the piggery operation.

During the monitoring period, the Trust demonstrated an overall high level of environmental performance and compliance with the resource consents.

The Council’s monitoring programme for the year under review included three inspections and three physicochemical water quality sampling surveys.

The monitoring has shown that the consent holder has ensured there is discharge of treated effluent into the Waiongana Stream only when the flow was greater than 5 cubic metres per second.

Consent 0715 was reviewed to allow the consent holder to discharge treated piggery effluent from an oxidation pond treatment system to land and into the Waiongana Stream during fresh (high flow) conditions. Provision has been made to include emissions associated with spray- irrigating treated effluent to land, under air discharge Consent 5206.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

16-19 Greymouth Petroleum Turangi Production Station Annual Report 2015- 2016 Greymouth Petroleum Limited (the Company) operates a petrochemical production station located on Turangi Road at Motunui, in the Parahaki catchment. The Turangi Production Station processes oil and gas from from the Company’s northern Taranaki operations, including the Turangi and Kowhai groups of wellsites. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities. The Company holds three resource consents in relation to the Turangi Production Station, which include a total of 68 conditions setting out the requirements that the Company must satisfy. The Company holds two consents to discharge stormwater and treated produced water onto land, in circumstances where it may subsequently enter an unnamed tributary of the Parahaki Stream, and one consent to discharge emissions related to production activities into the air at this site. During the monitoring period, Greymouth Petroleum Ltd demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included six inspections, four water samples collected for physicochemical analysis, two biomonitoring surveys of receiving waters, and two ambient air quality surveys. The monitoring showed that the site was well managed. All consent conditions relating to site operations and management were complied with. Levels of contaminants in samples collected from the site and receiving waters were within limits prescribed by consent conditions. Biomonitoring in the receiving waters did not show any effect from discharges on the communities in the stream. There were no adverse effects on the environment resulting from the exercise of the air discharge consent. The ambient air quality monitoring at the site showed that levels of carbon monoxide, combustible gases, PM10 particulates and nitrogen oxides were all below levels of concern at the time of sampling. No offensive or objectionable odours were detected beyond the boundary during inspections and there were no complaints in relation to air emissions from the site.

16-79 Hickman JD Monitoring Programme Annual Report 2015-2016 The Hickman JD 1997 Family Trust (the Company) operates a road transport depot located on Waitara Road at Brixton, Waitara, in the Waiongana catchment. The operations at this site mainly involve packaged dairy related products. Goods are stored under roofed catchments with the remaining areas being paved or gravel. The site also has a truck wash facility with waste water draining to sumps and then to the stormwater system.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds one resource consent, which includes a total of six conditions setting out the requirements that the Company must satisfy. The Company holds the consent to allow it to discharge truck washwater and stormwater into an unnamed tributary of the Waiongana Stream.

16-58 Greymouth Petroleum Limited Deep Well Injection Annual Monitoring Report 2015-2016 Greymouth Petroleum Limited (the Company) operates a number of wellsites across the Taranaki region, with major fields located in the Tikorangi and Kaimiro areas. Each wellsite contains varying numbers of producing wells and associated production infrastructure. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) in relation to the Company’s deep well injection (DWI) activities. The report details the results of the monitoring undertaken, assesses the Company’s environmental performance during the period under review and the environmental effects of their DWI activities.

During the 2015-2016 monitoring period, the Company exercised five DWI consents. These consents authorised discharges at the Kaimiro-O, Kowhai-A, Kaimiro-J, Turangi-A and Kaimiro-G wellsites. The Company hold a further four DWI consents which were not exercised during the review period.

During the monitoring period, the Company demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included 15 site inspections, 12 groundwater samples and two injectate samples collected for physicochemical analysis. The monitoring programme also included a significant data review component, with all injection data submitted by the company assessed for compliance on receipt.

The monitoring showed that the Company’s DWI activities were being carried out in compliance with the conditions of the applicable resource consents. There is no evidence of any issues with any injection well currently in use, or the on-going ability of the receiving

formation to accept injected fluids. The results of groundwater quality monitoring undertaken show no adverse effects of the activity at monitored locations. Inspections undertaken during the monitoring year found sites being operated in a professional manner and there were no Unauthorised Incidents in relation to any of the Company’s DWI consents.

During the year, the Company demonstrated a high level of environmental and administrative performance with the resource consents.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

16-50 Methanex Motunui and Waitara Valley Combined Annual Monitoring Report 2015-2016 Methanex New Zealand Limited (Methanex) operates methanol production facilities located at Motunui and Waitara Valley, in the Waitara River catchment. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess Methanex’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of Methanex’s activities.

Methanex holds 11 resource consents, which include a total of 111 special conditions setting out the requirements that Methanex must satisfy. Methanex holds two consents to allow it to take and use water from two abstraction points on the Waitara River. Six consents allow the discharge of effluent /stormwater into the Manu and Waihi Streams and the Tasman Sea via the Waitara marine outfall. Methanex also holds two consents to discharge emissions into the air at its sites. Finally, one consent provides for a structure in the Waitara River associated with the water take.

During the monitoring period, Methanex demonstrated an overall high level of environmental performance at its Motunui site and a high level of environmental performance at its Waitara Valley site.

The Council’s monitoring programme for the year under review at each site included four inspections, continuous self monitoring by Methanex (specifically involving collection of water samples for physicochemical analysis), review of regularly provided consent holder data, two inter-laboratory comparisons and a site visit relating to the requirements of the Resource Management (for Measurement and Reporting of Water Takes) Regulations 2010.

The monitoring showed that Methanex operated both sites in accordance with the requirements of their resource consents. As in previous years, the facilities were well managed and a high level of housekeeping was maintained. There were two unauthorised incidents

recording non-compliance in respect of Methanex’s activities at the Waitara Valley site during the period under review. Both incidents were considered to be unforeseeable and related to mechanical failures or unanticipated issues at the site. In addition both events were adequately mitigated or remedied by Methanex after they occurred. For this reason no enforcement response was considered appropriate or necessary.

During the year, Methanex demonstrated a High level of environmental performance with the resource consents at both facilities. Their administrational performance has been rated as Good, as although the performance against most consent conditions with respect to the administrative compliance was high, issues around testing of the integrity of the water take pipeline and meeting the requirements of the Resource Management (Measurement and Reporting of Water Takes) Regulations 2010 are yet to be resolved. Methanex have been open and participative in their communication with regard to their progress on these issues.

16-12 Lower Waiwhakaiho Air Discharges Compliance Monitoring Programme Annual Report 2015-2016 The Lower Waiwhakaiho area of New Plymouth is the location of several industries that include two abrasive blasting operations, a fertiliser storage and distribution depot, a pallet and drum recycling operation, and an asphalt plant. The companies hold resource consents to allow them to discharge emissions into the air. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the companies’ environmental performance during the period under review, and the results and environmental effects of the companies’ activities in relation to emissions to the air.

The companies monitored during the period under review were Downer EDI Works Ltd, Fitzroy Engineering Group Ltd, Katere Surface Coatings Ltd, Ravensdown Fertiliser Co-op Ltd, and Taranaki Drum & Pallet Recycling.

The companies hold five resource consents, which include a total of 109 special conditions setting out the requirements that the companies must satisfy.

The Council’s monitoring during the year under review included 17 inspections and two deposition gauge surveys.

The deposition gauge surveys found that, in relation to dust resulting in deposited particulates, ambient air quality in the area during the year under review was very good. During the 2015-2016, monitoring year there were two gauging locations, one in the vicinity of each of Fitzroy Engineering Group Ltd and Downer EDI Works Ltd sites, where the guideline

was exceeded at the time of both surveys. Fitzroy Engineering exceeded six of the 12 samples collected, while Downer EDI exceeded one sample from 10. The highest result during the year under review was obtained by one of the Fitzroy Engineering Group Ltd gauges, which was more than twice the guideline rate. The guideline reflects a deposition rate that may cause complaints in a residential area.

In the 2015-2016 year there were no unauthorised incidents related to discharges from any consent holders in the Lower Waiwhakaiho area.

During the year, Downer EDI Works Ltd demonstrated a high level of environmental performance and compliance with their resource consent. No stack testing was required for the monitoring period. Overall, the site was generally found to be well maintained.

During the year, Fitzroy Engineering Group Ltd demonstrated a good level of environmental performance, based on a few exceedances in deposition gauges results.

During the year, Katere Surface Coatings Ltd demonstrated a good level of environmental performance and compliance with their resource consent. Overall, the site was found to be generally well maintained.

During the year, Ravensdown Fertiliser Co-op Ltd generally demonstrated a high level of environmental performance and compliance with their air discharge consent.

During the year, Taranaki Drum and Pallet demonstrated a good level of environmental performance and compliance with the resource consent. Only one inspection was carried out at this site for the period under review, and the consent was surrendered in February 2016.

16-59 NZEC Petroleum Limited DWI Monitoring Programme Annual Report 2015-2016 NZEC Waihapa Limited and Taranaki Ventures Limited (the Company) operate a number of wellsites within the Taranaki Region, most notably the Waihapa-D, Waihapa-F and Waitapu wellsites. The Waihapa-F wellsite is located on Bird Road, Stratford. The Waihapa-D and Waitapu wellsites are located on Cheal Road, Stratford. Each wellsite contains varying numbers of producing wells and associated production infrastructure. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) in relation to the Company’s deep well injection (DWI) activities. The report details the results of the monitoring undertaken, assesses the Company’s environmental performance during the period under review and the environmental effects of their DWI activities.

The Council’s monitoring programme for the year under review included eight inspections, two injectate samples, and four groundwater samples collected for physicochemical analysis. The monitoring programme also included a significant data review component, with all injection data submitted by the company assessed for compliance on receipt.

The monitoring showed that the Company’s DWI activities were being carried out in compliance with the conditions of the applicable resource consents. There is no evidence of any issues with any injection well currently in use, or the ability of the receiving formation to accept injected fluids. The results of groundwater quality monitoring undertaken show no adverse effects of the activity at monitored locations. Inspections undertaken during the monitoring year found sites being operated in a professional manner and there were no Unauthorised Incidents in relation to any of the Company’s DWI consents.

16-67 Malandra Downs Monitoring Programme Annual Report 2015-2016 Malandra Downs Limited (the Company) holds one resource consent to discharge green waste to land for the purposes of dune stabilisation at Albany Road, Patea in the Patea catchment.

Green waste from a Hawera based contractor is transported to the site and discharged over areas of sandy pasture that have undergone aeolian erosion. The green waste helps trap soil and sand and, upon decomposition, adds nutrients and condition to the sandy soils.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the consent holder’s activities. This is the eighth annual report for this site.

Malandra Downs Ltd holds one resource consent to discharge green waste to land. This consent has 10 conditions setting out the requirements that the consent holder must satisfy,

and was varied during the period under review to allow the use of tomato green house green waste from a specified neighbouring property.

During the monitoring period, Malandra Downs demonstrated an overall good level of environmental performance and compliance with consent conditions.

The Council’s monitoring programme for the year under review was comprised of three inspections, assessing the types of materials being received and how the discharge to land was being managed.

During the year, the consent holder demonstrated a good level of environmental performance and a high level of administrative performance. During the year under review severe coastal erosion resulted in small amount of green waste entering the sea along with an eroded section of cliff.

16-6 Renewable Power Ltd Normanby HEP Scheme Annual Report 2015-2016 Renewable Power Limited (the Company) operates a hydroelectric power station located on Normanby Road at Okaiawa, in the Waingongoro catchment. Utilising an existing weir across the Waingongoro River and tunnel under Normanby Road, water is diverted for electricity generation. The station is located approximately 3.2 km downstream of the weir, but due to the tight meander, are located only 90 m apart. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds 3 resource consents, which include a total of 36 conditions setting out the requirements that the Company must satisfy. The Company holds two consents to allow it to take and use water and to dam the Waingongoro River and one consent to use and maintain a weir and ancillary structures in the Waingongoro River.

During the monitoring period, Renewable Power Ltd demonstrated an overall poor level of environmental performance.

The Council’s monitoring programme for the year under review included four compliance monitoring inspections of the site and one hydrological monitoring inspection. In addition, data collected by the Company was received and audited, while data collected by the Council upstream and downstream of the station was also assessed. There was also a considerable amount of time spent liaising with the Company.

The monitoring showed that the scheme is still of a relatively small scale diverting between 1.5 and 3 cumecs of water. However, management of the scheme has been very poor, including a number of instances where insufficient residual flow was released below the weir and the collection of grossly inaccurate residual flow and abstraction data. Furthermore, there has been very little progress in implementing a number of the requirements stipulated by the consents, including upgrading the fish pass, undertaking monitoring of the erosion of the river bed and banks around the scheme, and monitoring of the effects of the scheme on the residual flow reach. This includes no or inadequate baseline information being collected on the trout communities and recreational activities of the residual flow reach, despite the scheme now being operated whenever flows allow. Of most concern, was the provision of false data. In this case, the Company had copied data from the Council website, augmented it slightly and then returned it under the guise of it being residual flow data.

During the year, the Company demonstrated a poor level of environmental and administrative performance with the resource consents. Due to the Company’s performance during the 2015- 2016 period, they were subject to two significant investigations, and as a result of these investigations, received a number of infringement and abatement notices.

This is the first report written for this scheme, although the scheme has been operational on and off since 2010. In addition, there have been a number of changes in ownership. In terms of overall environmental and compliance performance by the consent holder, this report shows that the consent holder’s performance has not improved since they took ownership in 2014.

This report includes recommendations for the 2016-2017 year, including that the compliance monitoring programme be expanded to recognise that the scheme is now fully operational, that the optional review of the consents not be undertaken, and that the Company develops and implements a plan for the large number of consent requirements that are currently outstanding.

16-7 Opunake Power Limited Monitoring Programme Annual Report 2015-2016 Opunake Power Limited (the Company) operates the Opunake hydro electric power scheme located at Opunake, in the Waiaua River catchment. The scheme uses a 4.5 m high weir to divert water from the Waiaua River along a canal to Lake Opunake, and then down penstocks to the Opunake power station. The power station discharges water to the Tasman Sea at Opunake Beach. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities. It should be noted that ownership of the scheme changed during the reported period, with the resource consents transferred from Opunake Hydro Limited to Opunake Power Limited in March 2016.

The Company holds eight resource consents, which include a total of 60 conditions setting out the requirements that the Company must satisfy. The Company holds two consents to allow it

to take and use water, one consent to discharge water into the Tasman Sea, one consent to discharge sand to the Waiaua River, two consents for structures associated with the scheme, and two consents to disturb the bed of the Waiaua River and Lake Opunake.

During the monitoring period, Opunake Hydro Limited and Opunake Power Limited demonstrated an overall good level of environmental performance.

The Council’s monitoring undertaken for the period under review included 5 compliance monitoring inspections and four hydrological inspections undertaken in relation to the scheme. In addition, analyses of generation data, fish pass water level data and lake level data provided by the Company was conducted.

The monitoring showed that despite issues related to erosion in the headwaters, and associated equipment failure including loss of gate control, the scheme operated with few major issues. In comparison with previous monitoring years, compliance with residual flow requirements was high, continuing on from the significant improvement noted in the previous monitoring period. Management of the level of Lake Opunake was similar to that recorded in the previous period, with a higher than normal number of occasions where the lake level dropped below the minimum. Near the end of the reporting period, it was discovered that a large volume of water was escaping the lake when the canal sluice gate was open. This was resolved in the 2016-2017 period. It should be noted that the Company never generated when the lake level was at or below the minimum authorised level during the reporting period, and that leakage was the principle cause when a low lake level occurred. There is still concern about the sand inundation of the head of Opunake Lake, and the reduced recreational value that has resulted from this. The Company is continuing to investigate an array of options, including reducing the potential for sand ingress, modifying the head of the lake to allow better flushing of sand, and a means of removing the sand currently in the lake.

Previous monitoring has determined that the weir and intake remains a barrier to fish passage to the upper Waiaua River, with fish passage for most species provided into the canal and lake only. However, during the reporting period, fish passage was also restricted in the fish pass at times, usually due to excessive flow, although this appeared to have been resolved during a site visit with the representative of the new owner. The Company began preliminary investigations into a possible solution in the reported period, and although the change in ownership delayed this investigation, it is hoped that a trap and transfer system will be in place by the end of the 2016-2017 monitoring period.

With regard to submitted data, the Company improved with regards to providing the data within the required timeframe, and in reducing the amount of erroneous data. However, the data still contained some significant gaps, which requires attention.

During the year, the Company demonstrated a good level of environmental and administrative performance and compliance with the resource consents. In short, the Company needs to resolve issues around fish passage and the continuity of the data record recorded.

16-23 SENZL Pohokura Production Station Annual Report 2015-2016 Shell Exploration NZ Ltd (the Company) operates a petrochemical production station and adjacent wellsite, located on Lower Otaraoa Road at Motunui in the Waipapa and Manu catchments. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds a total of 18 resource consents, which include a total of 195 conditions setting out the requirements that the Company must satisfy. The Company holds one consent to allow it to take and use water, four consents to discharge stormwater, three consents to discharge emissions into the air, six consents for various structures, two consents relating to deep well injection, and one consent each to disturb and occupy the coastal marine area.

During the monitoring period, Shell Exploration NZ Limited demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the period under review included five inspections and four water samples collected for physicochemical analysis. The consent holder also collected various data as required by consent conditions and for self-monitoring purposes.

The monitoring showed that samples of stormwater complied with the limits prescribed by the consents for most of the parameters. The level of pH was slightly below that allowed in the consent on occasion, however this was not considered significant. No adverse effects were noted on the receiving environment as a result of the discharge.

There were no adverse effects on the environment resulting from discharges to air at the Pohokura facility. Inspections showed that emissions from flaring and other sources were well controlled. Monitoring commissioned by the Company showed that there were no exceedances of the relevant New Zealand Workplace Exposure Standards for BTEX constituents at any of the monitored locations. Passive absorption monitoring, however, continued to show elevated benzene levels downwind of the condensate and produced water storage tanks compared to relevant ambient air quality guidelines. Operational changes and engineering work to investigate potential plant modifications to reduce benzene emissions are ongoing.

Ecological assessment of the intertidal coastal area surrounding the Pohokura site found very high species diversity and abundance across the three studied reefs, indicating a stable and healthy reef environment with high water quality along the north Taranaki coastline. The ongoing ecological surveys have shown that the health of the reefs in the vicinity is comparable to other reefs around the Taranaki coastline that are subjected to sand inundation.

This monitoring supports that the Company’s activities have not had any adverse effect on the coastal environment.

In November 2016, Shell New Zealand received an Environmental Award from the Council in the Te taiao me te pākihi – Environmental leadership in business Category for the use of innovative technology to protect the marine environment by avoiding discharges during the He Tāngata, he Tāngata, he Tāngata Project to refurbish the Pohokura offshore platform.

During the year the Company demonstrated a high level of both environmental performance and administrative compliance with the resource consents. There were two self-reported minor leaks of hydraulic fluid at the offshore platform. In both cases, no environmental effects were noted and no further action was taken or required. The Pohokura facilities were well managed and maintained.

16-37 Combined Regional Quarry Monitoring Programme Biennial Report Group B 2014-2016 Currently, there are 26 quarries throughout the region that are monitored by the Taranaki Regional Council (the Council). Between these quarries there are 51 resource consents, authorising water discharges and abstractions, discharges of cleanfill and stream modifications. This report covers the period July 2014 to June 2016, and will be the first report to incorporate the monitoring results of this group of quarries into one streamlined report. There are two biennial streams in which quarry monitoring programmes are reported. This report spans July 2014-June 2016; a reporting period which incorporates nine of the region’s 26 quarries (Group B). The monitoring programmes for another 16 quarries will be included in a separate biennial report (Group A), which will cover the period July 2015-June 2017. For each quarry, this report describes the monitoring programmes implemented by the Council to assess environmental performance during the period under review, and the results and environmental effects of the quarry’s activities. During the monitoring period: Horizon Trust Management Limited demonstrated an overall high level of environmental performance. Vickers Quarries Limited demonstrated an overall high level of environmental performance at the York Road quarry. Vickers Quarries Limited demonstrated an overall high level of environmental performance at the Toko Road quarry.

16-92 WRS Symes Manawapou Landfarm Monitoring Programme Annual Report 2015-2016 Waste Remediation Services Ltd (the Company) operates a landfarm, Symes Manawapou, which is located on Manawapou Road near Manutahi, in the Manawapou catchment, South Taranaki. The consent for this landfarm was originally granted in May 2012 to Remediation Services NZ and was then transferred to the Company in June 2014. This report marks the second full year the Company has been in charge of the Symes Manawapou landfarm.

This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds one resource consent, which includes a total of 27 conditions setting out the requirements that the Company must satisfy.

During the monitoring period Waste Remediation Services Ltd demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the year under review included eight inspections, 14 water samples collected for physicochemical analysis and six composited soil samples.

The monitoring showed that in similarity to the previous monitoring period, salinity impacts in the groundwater are still evident in the impacted well, GND2301. In addition, two wells have shown elevated impacts with one close to the consent concentration. Soil samples detailed no exceedance when compared to the consent conditions with application areas revegetated to a high standard. Housekeeping has recently been addressed. The site contains

material which has been in storage for longer than one year and thus must be processed in the upcoming monitoring period. The Company executed the successful remediation of a former landfarm storage area by excavating a considerable amount of material and replaced it with clean fill. This allowed a former landfarm site to be reinstated.

In comparison to previous monitoring year, the collection of samples this year was undertaken by the Council. This was an improvement to the previous monitoring period whereby the Company did not realise their obligations to collect samples and thus only a minimal level of samples were available to the Council. Total heavy metal analysis was also added to the Council’s soil sampling plan which satisfied a specific consent condition.

There were no unauthorised incidents recording non-compliance in respect of this consent holder during the period under review.

During the year, the Company demonstrated a Good level of environmental and a Good level of administrative performance with the resource consent.

16-113 Greymouth Petroleum Limited Kaimiro-A HF Monitoring Programme Annual Report 2015-2016 Greymouth Petroleum Limited (GPL) operate the Kaimiro-A wellsite, located at 1180 Upland Road, Inglewood. The wellsite lies within the Waiongana catchment and contains two hydrocarbon producing wells and associated infrastructure.

GPL held resource consent 9413-1, authorising the discharge of contaminants associated with hydraulic fracturing activities into land at depths greater than 3,140 m TVDss beneath the Kaimiro-A wellsite until 1 June 2015. The consent was issued by Taranaki Regional Council (the Council) on 25 February 2013 and contained 16 special conditions which set out the requirements that GPL must satisfy. Consent 9413-1 was replaced by consent 10308-1 during the period under review (29 June 2016).

The following report for the period May 2015 to June 2016 outlines and discusses the results of the monitoring programme implemented by the Council in relation to the programme of hydraulic fracturing undertaken by GPL, within their Kaimiro-A wellsite. The report also assesses GPL’s level of environmental performance and compliance with the resource consent held in relation to the activity.

During the monitoring period, Greymouth Petroleum Limited demonstrated an overall high level of environmental performance.

The programme of hydraulic fracturing undertaken by GPL at the Kaimiro-A wellsite during the period being reported was that of the Kaimiro-1 well which took place on 9 June 2015.

The programme of monitoring implemented by the Council in relation to previous hydraulic fracturing activities at the Kaimiro-A wellsite commenced in the 2013-2014 monitoring year. The results of monitoring undertaken between March 2014 and April 2015 were presented in the 2013-2015 biennial report (Taranaki Regional Council, 2015). The results of monitoring undertaken between May 2015 and June 2016 are presented in this report. Monitoring included groundwater sampling at one site, surface water biomonitoring at three sites and the analysis of samples for a range of chemical and isotopic analysis.

The results of the monitoring carried out by the Council indicates that the hydraulic fracturing activities undertaken by GPL have had no adverse effects on local groundwater resources or surface water quality. There were no Unauthorised Incidents recording non-compliance in respect of the resource consent, or provisions in regional plans, during the period under review.

GPL demonstrated a high level of environmental and good level of administrative performance and compliance with the resource consent over the reporting period.

For reference, in the 2015-2016 year, 71% of consent holders achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance.

This report includes recommendations for the further monitoring of any hydraulic fracturing activities at the Kaimiro-A wellsite.

16-29 STDC Eltham Wastewater Treatment Plant Annual Monitoring Programme 2015-2016 The South Taranaki District Council (STDC), operates the Eltham municipal wastewater treatment system (WWTP) located to the east of Eltham in the Mangawhero catchment. STDC holds a resource consent to allow it to discharge treated wastewater to the Mangawhero Stream under high rainfall conditions only. Previously STDC also held a consent for the discharge of emissions into the air but this expired in mid 2011 when it was no longer considered necessary as the nature of the biological processes at the plant met a ‘permitted’ category in the Regional Air Quality Plan. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the environmental performance during the period under review, and the results and effects of the consent holder’s activities, particularly the environmental improvements associated with recent major modifications to the disposal system. This report also records the state of riparian planting and channel improvement initiatives in the lower Mangawhero catchment. Good progress has been made in terms of riparian fencing and vegetation within both the Mangawhero and Mangawharawhara Streams’ catchments in recent years. During the monitoring period, South Taranaki District Council demonstrated an overall good level of environmental performance.

The Council’s monitoring programme included inspections, odour surveys, and limited biological surveys of the receiving waters of the Mangawhero Stream and Waingongoro River. These latter surveys were a means of documenting anticipated improvements in receiving water conditions in the absence of continuous wastewater discharges (a result of the diverted pipeline to the Hawera WWTP in mid 2010). Overall upgraded treatment system was well maintained and operated during the monitoring year in terms of its general performance. A good level of compliance was achieved with the discharge consent in terms of general conditions, with minimal usage of the converted holding basin, and no overflow discharges at any time. Additional industrial loadings at times placed the system under pressure in terms of maintaining positive dissolved oxygen levels. Slight localised pond odours were noted on occasions, and there were eight complaints received during the monitoring year in relation to normal operating conditions in the ponds. Spring and late summer biological monitoring surveys continued to confirm improvements in the biological ‘health’ of the Mangawhero Stream and further downstream in the mid-reaches of the Waingongoro River, compared with pre-wastes diversion monitoring periods. Relatively low dissolved oxygen-levels were recorded in the primary oxidation pond during the monitoring period. This pond has had a high bacterial component of its microflora and average algal taxa richness, although certain of these taxa had been indicative of high wastes loadings on the system. Remediation of the Earthen Anaerobic Digestion (EADER) site was undertaken during the monitoring period, and no odour complaints relating to the EADER have been received since July 2015. Overall environmental performance and administrational performance was high. For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

In terms of overall environmental and compliance performance by the consent holder over the last several years, this report shows that the consent holder’s remains at a good or high level.

Components of a suitable monitoring programme for 2016-2017 have been identified and included in recommendations to this report.

16-61 STOS DWI Monitoring Programme Annual Report 2015-2016 Shell Todd Oil Services Limited (the Company) operates a number of wellsites within the Taranaki Region, most notably the Kapuni wellsites. Each wellsite contains varying numbers of producing wells and associated production infrastructure. Two of the Kapuni wellsites, KA-9 and KA1/7/19/20, were consented for deep well injection (DWI) activities during the review period. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) in relation to the Company’s DWI activities. The report details the results of the monitoring undertaken, assesses the Company’s environmental performance during the period under review and the environmental effects of their DWI activities.

The Company held two resource consents during the review period, which included a total of 32 conditions setting out the requirements that the Company must satisfy. Only one of the consents was exercised during the period being reported.

During the monitoring period Shell Todd Oil Services Limited demonstrated an overall high level of environmental performance.

The Council’s monitoring programme for the year under review included two inspections, two injectate samples, and seven groundwater samples collected for physicochemical analysis. The monitoring programme also included a significant data review component, with all injection data submitted by the company assessed for compliance on receipt.

The monitoring showed that the Company’s DWI activities were being carried out in compliance with the conditions of the applicable resource consents. There is no evidence of any issues with any injection well currently in use, or the ability of the receiving formation to accept injected fluids. The results of groundwater quality monitoring undertaken show no adverse effects of the activity at monitored locations. Inspections undertaken during the monitoring year found sites being operated in a professional manner and there were no Unauthorised Incidents in relation to any of the Company’s DWI consents.

During the year, the Company demonstrated a high level of environmental and administrative performance with the resource consents.

For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

16-86 BTW Company Ltd Oeo Landfarm Monitoring Programme Annual Report 2015-2016 BTW Company Ltd (the Company/BTW) operates a drilling waste disposal landfarm which is located on South Road near Manaia, in the Rawa catchment, South Taranaki. The site was operational from September 2012 to November 2013 when synthetic, water based muds and rock cuttings were disposed to land under the process of landfarming. This report for the period July 2015 to June 2016 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review. The report also details the results of the monitoring undertaken and assesses the environmental effects of the Company’s activities.

The Company holds one resource consent, this includes a total of 24 conditions setting out the requirements that the Company must satisfy.

During the monitoring period, the Company demonstrated an overall good level of environmental performance.

The Council’s monitoring programme for the year under review included seven inspections, nine groundwater samples and five composite soil samples collected for physicochemical analysis.

The main environmental effects associated with the exercise of this consent are centred on a legacy issue, whereby the historical holding of landfarmable material in unlined storage cells resulted in elevated saline and trace hydrocarbon impacts on the groundwater in the direct locality of the storage cells. Specifically, the downgradient monitoring well (GND2287) had indicated elevated salinity since it was installed in 2012.

While there have been elevated TDS concentrations observed in this monitoring period and in the long term record, above the conditional concentration prescribed by the consent of 2,500g/m3, recent analysis undertaken in the upcoming monitoring period has detailed a reduction in these concentrations in both monitoring wells to below the conditional limit.

TPH concentrations in GND2287 (3.3 to 5.6 g/m3 TPH- 2016) in this monitoring period were slightly elevated when compared to the previous years analysis of the same well, with a greater range (4.2 to 4.3 g/m3 TPH- 2015). Unlike last year, the analysis detected trace toluene, ethylbenzene and xylenes in three of the five samples collected from this well, though at low concentrations. It should be noted that only benzene (0.11g/m3) and TPH C15-C36 (0.5 g/m3) were detected in the final sample collected in June 2016 and these values were very close to the limit of detection for these analytes.

Although there were detections throughout the year of additional analytes, the low concentrations recorded are classified as suitable by the Ministry for the Environment for irrigation water.

Soil sampling indicated that the TPH concentrations had detailed a significant decrease when compared to the previous year’s analysis. Specifically mid range hydrocarbons C10-C14 are decreasing in concentration in area F3. F3 is the only area which remains above the surrender criteria. There still remains a good deal of variation within area F3 as observed over the long term sampling record. The Council will continue to monitor this area until it has been classified as acceptable for surrender under the specific consented criteria.

During the year, the Company demonstrated a good level of environmental and a high level of administrative performance with the resource consents.

Taranaki Thoroughbred Racing Abstraction Monitoring Programme Annual Report 2015-2016 Taranaki Thoroughbred Racing (TTR) owns and operates the Pukekura Raceway located on Coronation Avenue, New Plymouth. The site is located within the Te Henui catchment and forms part of the eastern boundary of .

TTR hold resource consent 7470-1.1 which authorises the take and use of groundwater from a bore for watering of racetracks and general purposes, at the Taranaki Thoroughbred Racing Club, as well as watering gardens and other general purposes at Pukekura Park. The consent was issued by the Council on 10 June 2014 and contains 10 special conditions which set out the requirements that TTR must satisfy. The consent has a maximum daily abstraction limit of 500 m3/day.

This report for the period July 2015 to June 2016 describes the monitoring programme carried out by the Council to assess TTR’s environmental performance and level of compliance with consent 7470-1.1.

The Council’s monitoring programme for the period under review included five inspection visits to the site. Inspection visits typically comprised of:  a visual inspection of the production bore, abstraction pipework monitoring equipment and associated infrastructure; and  obtaining manual measurements of groundwater levels in the production and observation bores and retrieving electronic data.

To monitor the exercising of consent 7470-1.1 abstraction volume and rate data are recorded electronically at the site by a data logging system and transferred to the Council via telemetry, so the data can be viewed in real time. Three groundwater monitoring bores were also installed within the vicinity of the production bore to monitor the effects of the abstraction on local groundwater levels. Groundwater levels within two of the monitoring bores (GND2102 and GND2103) are monitored electronically by pressure transducers. Groundwater levels were also recorded in an additional bore (GND2119) in the grounds of Pukekura Park. The pressure transducers installed are programmed to record measurements at 30 minute intervals.

Data collected via the Council’s monitoring programme indicated that there have been no significant impacts to the groundwater system from the authorised abstraction.

There were no unauthorised incidents recording non-compliance in respect of this consent holder during the period under review.

During the year, TTR demonstrated a high level of environmental performance with the resource consent. For reference, in the 2015-2016 year, 71% of consent holders in Taranaki monitored through tailored compliance monitoring programmes achieved a high level of environmental performance and compliance with their consents, while another 24% demonstrated a good level of environmental performance and compliance with their consents.

Executive summary There are 151 incidents reported.

64 of the incidents were found to be compliant and 70 were found to be non-compliant. 17 of the incidents reported relate to non-compliance from previous periods (updates). The action taken is set out for Members information.

There were 46 non-compliant incidents reported as a result of the 2016/2017 annual dairy inspection round, from 362 monitoring inspections. Arising from the oxidation pond system non-compliance some farms are moving to land based discharge systems before their resource consents expire.

Background The Council receives and responds to pollution events and public complaints throughout the year. Compliance monitoring undertaken can also identify non-compliance. This information is recorded in the Incident Register together with the results of investigations and any follow-up actions. Incidents are publicly reported to the Council through the Consents and Regulatory Committee via the Incident Register or the Annual Compliance Monitoring Reports.

Attached is the summary of the Incident Register for the period from 1 November 2016 to 12 January 2017.

Disclosure Restrictions The incident register information presentation was reviewed in 2014-2015 to increase reader understanding. The first section addresses compliant incidents and can be publically discussed. The second section provides an update on non-complaint incidents from previous meetings and where an incident has been resolved it can be publically discussed. The third section provides information on non-compliant incidents during the period that are still under investigation and staff are limited in terms of public disclosure of information while the investigation is ongoing and enforcement responses have not been determined. The incident register flow chart and definition of terms provide further detail.

Discussion Council responds to all complaints received with most complaints responded to within four hours. Responses to complaints and non-compliances with rules in the Council’s regional plans, resource consents and the Resource Management Act 1991 are recorded in the Incident Register. Where necessary, appropriate advisory or enforcement actions are implemented. The latter may include issuing an inspection, abatement or infringement notice, or initiating a prosecution. Where an infringement notice or prosecution is possible, details of the incident in the Incident Register and staff comment will be restricted for legal reasons. Further information will be provided at a later date to the Council and for prosecutions a detailed report will be provided, in the confidential section of the agenda.

A summary of incidents for the period 1 November 2016 to 12 January 2017 is attached. The ‘compliant’ incidents are presented first in a table and the ‘non-compliant’ incidents are presented after in a more detailed summary.

Generally incidents in the ‘compliant’ table have a recommendation of ‘no further action’. However, an incident is considered ‘compliant’ until such time as a non-compliance is found. Therefore occasionally an incident in the ‘compliant’ table will have a recommendation of ‘investigation continuing’, if an ongoing investigation is still underway to confirm compliance.

A series of graphs are also attached comparing the number of incidents between 2015-2016 and 2016-2017, and also showing how the incidents are tracking in 2016-2017 in relation to environment type and compliance status. The Company have spent a significant amount of time and money on avoiding further non-compliance through the implementation of a cleaning programme for the yard and roof and re-stabilisation of unsealed areas. Further monitoring will occur during routine monitoring.

Both the location of the pit and dumping of stock were in breach of Rule 30 of the Regional Fresh Water Plan for Taranaki. Analysis of samples found no effects in the stream. Works were undertaken to relocate and bury the contents of the pit. The pit was filled in to avoid reuse. Comments: During the annual dairy inspection round it was found that the farm dairy effluent disposal system was not operating within resource consent conditions at Mangaotea Road, Tariki. Inspection found that effluent from the underpass was discharging directly to land and was likely to enter surface water. Abatement Notice EAC-21455 was issued requiring work to be undertaken to the farm dairy effluent treatment and disposal system to ensure compliance with resource consent conditions. Reinspection to be undertaken after 20 March 2017.

Significant works have been undertaken at the site to control sediment discharge. The Company was informed of the non-compliance and have agreed to increase the frequency of maintenance of the sediment control methods. Compliance will be checked during routine monitoring.

Comments: Notification was received from Department of Conservation regarding the dumping of glass in the vicinity of and in the Waiwhakaiho River at the Meeting of the Waters Reserve near New Plymouth. Investigation found that glass had been dumped on the Reserve and in the river. The responsible party could not be traced and Department of Conservation took responsibility for the clean up.

Comments: A complaint was received concerning possum carcasses that had been dumped on the banks of the Waingongoro Stream, along the Cardiff walkway at Opunake Road, Stratford. Investigation found that the possum carcasses were likely to discharge into the stream. No responsible party could be traced. The carcasses were removed and disposed of in an approved manner at the time of inspection.

When informed of the effects, the responsible party immediately undertook works to stop the discharge. The farmer was formally informed of Rule 59 of the RFWP and warned that any further contraventions may result in enforcement action be taken against him.
