Mission in Armenia 29 March to 3 April 2008 June 2008 - N°499/2 Mission in Armenia, 29 March to 3 April 2008 FOREWORD Alerted by both the "Democracy in Armenia" group and the Civil Society Institute (an FIDH affiliate) to the violent repression that followed the presidential elections in this country in February 2008, the undersigned lawyers and jurist were mandated by the President of the Paris Bar Association (M. le Bâtonnier de l’Ordre des Avocats de Paris) and the International Union of Lawyers (l’Union Internationale des Avocats) on one hand and, on the other hand, the FIDH (International Federation of Human Rights). The mission visited Yerevan from 29 March to 3 April to report on the situation of the right to defend oneself and the right to freedoms in the Republic of ARMENIA following the events that took place in February and March 2008. INTRODUCTION Before considering the legal and juridical context of the mission's work, it is appropriate to recall some chronological milestones to put into perspective the current situation in Armenia and its evolution, seventeen years after the independence of the Republic of Armenia was proclaimed in the Southern Caucasus. - 21 September, 1991: the Republic of Armenia becomes independent following a referendum. - October 1991: Election by universal suffrage of Mr. Levon TER-PETROSIAN, who becomes the first President of the Republic of Armenia. - 1992-1994: Fighting in the autonomous region of Nagorno-Karabakh between the opposing Armenian self- defence forces and the Azerbaijan armed forces. A cease-fire comes into force on 14 May 1994. -

Methodology and quality control of the survey 3 Methodology • A multi-stage, random (probability) sampling design was used. In the first stage, primary sampling units (PSU) were selected from each of the administrative regional units. This was agreed as best methodology between TNS opinion and IPSC . • 1,607 interviews conducted face to face between 15 January – 20 January 2013. • Interviews were conducted in all 10 regions (marzes) of Armenia and in all Yerevan communities. The sample was distributed proportionally to reflect the population distribution in Armenia, with 34.1% of interviews conducted in Yerevan and 65.9 % in the marzes. • Interviewers selected households using the random walking method to ensure that there is no selection bias. To ensure a random selection, the person interviewed in each household was the adult whose birthday was closest to the day of the interview. • If a respondent was not immediately available, 1 to 2 call-back visits were done to conduct the interview later. If a call-back visit was not successful or if a respondent could not take part for other reasons, the interviewer approached the next randomly selected household according to the random walking method. • The sampling procedure was monitored by using a detailed contact sheet for each interviewer. The data base was analysed by TNS opinion in order to ensure that interviewers followed the instructions. -

COMPREHENSIVE REPORT ON THE ACTIVITIES OF THE PRESIDENT OF THE OSCE PARLIAMENTARY ASSEMBLY H.E. Mr. George Tsereteli (November 2017 – December 2020) February 2021 Upon assuming the office of President of the OSCE Parliamentary Assembly in November 2017, I have strived to highlight several priorities, which include redoubling our conflict resolution efforts, ensuring that the OSCE is fully equipped to address new challenges, and promoting our common values and principles. Throughout my presidency, I have greatly appreciated the level of support I have received from Members of the Assembly and the Secretariat in both Copenhagen and Vienna. This has been crucial to pursue an ambitious agenda to meet our most pressing challenges such as addressing conflicts, radicalization and terrorism, and migration, implementing our human right commitments, striving to achieve gender equality, fostering economic co-operation, expanding our international partnerships, and reforming the OSCE PA to make our work more impactful. Detailed information on my work as President between November 2017 and December 2020 is listed in this report. In addition to these primary activities, I have also made numerous statements when the PA voice needed to be heard. In addition, I have met on several occasions with Heads of OSCE institutions to improve co-ordination at headquarters and in the field and ensure that our activities complement each other. I have also met with numerous PA delegations on the margins of my travels – and online – to ensure that all voices are heard and reflected in the work of our Parliamentary Assembly. I want to thank parliaments that have hosted my visits, but also particularly applaud and thank OSCE staff. -

“Honorable National Assembly President, Distinguished Vice-Presidents, Dear National Assembly Members, Dear People, Proud Citizens of the Republic of Armenia, The applicable Constitution of the Republic of Armenia provides for a model of the Constitutional Court that is widely regarded by international experts as balanced. The essence of this model is as follows: Candidates for three Constitutional Court judges are nominated by the President of the Republic, the Government, the General Assembly of Judges, the election is made by the National Assembly, and the Constitutional Court becomes the upper instance for balancing between the three branches of power. At the same time, the new constitution has two important nuances. Unlike the former Constitution, the RA President in office cannot be a member of any party, judges cannot be partisans either, and given the fact that the Speaker of the National Assembly has been deprived of the right or is not entitled to nominate a judge for the Constitutional Court, we can state that the risks of politicization of the Constitutional Court are mitigated as much as possible in the applicable Constitution. The risks for the Constitutional Court Chairman to exercise pressure on the Constitutional Court are also mitigated, because unlike the previous one, the Constitutional Court Chairman is elected for a six-year term, not for life. In addition, a CC judge may be elected president of the court only once. In addition, unlike the previous Constitution, the President of the Constitutional Court is elected by the judges of the Constitutional Court and not by the National Assembly. In addition, the abnormal practice where the same person could be a member of the Constitutional Court for 40 years has also been eliminated. -

The social fabric is torn. Sectarianism has raised its head and institutions lack authority. The Hayastantsi-Karabaghtsi conflict is out in the open again. Pashinyan's failure has been a huge blow to everyone--young and old--who had begun seeing a future for themselves here. The coming 20 years will either shape Armenia into a new, modern democracy or lead to gradual destruction. Unfortunately, Pashinyan failed sooner than critics had predicted. Now, it is difficult to persuade people to be positive. Migration has once again become a viable option. Some of our martyrs were highly-educated and were going to shape Armenia's future. Entrepreneurship was taking shape, thanks to them. Now, with many of them killed and the survivors dejected, we have no idea what the future will be. The threat to our borders, Syunik in particular, is the most worrying. Geopolitical developments are also highly concerning. More than a month since Pashinyan broke the news of our defeat so many things still remain unknown. With so much secrecy surrounding the deal, we don't know what Azerbaijan will lay claims to next. -
