50993 Public Policy Text 25/7/07 1:47 PM Page 44 PUBLIC POLICY VOLUME 2 NUMBER 1 2007 44 – 57 Deregulating Australia's Wheat Trade: from the Australian Wheat Board to AWB Limited Geoff Cockfield University of Southern Queensland Linda Courtenay Botterill The Australian National University In 2006 in Australia there was an inquiry into allegations of kickbacks being paid to the former Iraqi regime by the grain trading company AWB Limited. The inquiry and its aftermath provided an opportunity for proponents of unregulated trade in wheat to press for the removal of the AWB’s control of export sales. This article is a review of the history of the development and dismantling of wheat marketing regulation in Australia, treated as a case study to illustrate two things: the shift in the prevailing values in Australian agricultural policy over the last 35 years; and the way in which legislative cycles, reviews, institutional change and particular events provide opportunities for policy advocates to press for change, in this case over at least 40 years. It is argued here that the dominant paradigm for trading agricultural commodities shifted from one based on agrarian collectivism and sectoral stabilisation to a less regulated system with the focus on the values of efficiency and competitiveness. In November 2005 the Australian Government established an inquiry with the powers of a Royal Commission headed by Terence Cole to investigate allegations that the corporation AWB Limited1 (formerly the statutory authority Australian Wheat Board) had made payments to Saddam Hussein’s regime in Iraq through a Jordanian-based transport company in order to secure wheat sales, accusations originally raised by the UN Oil-for-Food inquiry headed by Paul Volker. -

Australia and New Zealand in the Asia Pacific. Maritime Security Maritime security is of vital importance to Australia and New Zealand, as both countries depend on maritime transport for their economic survival. Since the events of 11 September 2001 serious questions have been raised as to whether Australia and New Zealand are adequately prepared for the con- sequences of a major disruption of global shipping following a terrorist attack on a leading regional port such as Hong Kong or Singapore. Considerable efforts have been undertaken to improve responses to an array of maritime security threats, such as transnational crime, environmental pollution and piracy and armed robbery. This volume identifies the issues that particularly affect Australia and New Zealand’s maritime security, evaluating the issues from legal and political perspec- tives, and proposes methods for improving the maritime security of the two coun- tries. While the focus is primarily on Australia and New Zealand, the scope extends to regional considerations, addressing matters related to Pacific island states, South East Asia and the Antarctic and sub-Antarctic regions. The book also addresses strategic partnerships, examining the influence of the United States, and analyses issues within the broad framework of international law and politics. Maritime Security: International Law and Policy Perspectives from Australia and New Zealand will be of great interest to scholars of international law, international relations and maritime affairs, maritime industry professionals, private and government lawyers, as well as diplomats, consuls and government officials. A look beyond the Cole inquiry: AWB Ltd, bribery and Australia’s obligations under international law Jürgen Kurtz University of Melbourne Law School Discussion Paper 18/06 (May 2006) Democratic Audit of Australia Australian National University Canberra, ACT 0200 Australia http://democratic.audit.anu.edu.au Introduction∗ Much of the media discussion in the on-going Cole inquiry has focussed on discerning the facts of AWB Ltd’s alleged use of bribes as part of the United Nation’s ‘oil-for-food’ program. There is also the secondary concern of the level of knowledge within the Australian government of AWB Ltd’s activities within Iraq. This discussion paper examines a hidden dimension of the public debate surrounding the Cole inquiry. It will evaluate the various claims made by AWB Ltd and members of the Australian government (revealed publicly during the Cole inquiry) largely against Australia’s general international legal obligations. To aid in this analysis, one might paraphrase the main public claims in the following - albeit broad and descriptive - manner: Claim 1: Australia had no obligation to supervise the conduct of Australian companies like AWB Ltd participating in the ‘oil-for-food’ program in Iraq as the United Nations was exclusively responsible for the administration of that program. Claim 2: AWB Ltd has historically operated to benefit Australian wheat farmers and therefore there was no objective basis for the Australian government to be concerned about its activities in Iraq. Claim 3: AWB Ltd – like any foreign investor or trader operating in a weakly governed state – was forced to pay bribes as a cost of doing business in Iraq. -

Chapter 2 Background 2.1 Following the 1990 Iraqi invasion of Kuwait, the United Nations Security Council (UNSC) imposed sanctions on Iraq. The sanctions, under Resolution 661, required all states to prevent their nationals from trading with, or making funds available to, the government of Iraq or persons or bodies within Iraq, except in relation to the provision of materials for medical or humanitarian purposes and foodstuffs, in humanitarian circumstances.1 2.2 As a consequence of Resolution 661, Iraq was deprived of hard currency limiting its capacity to purchase food. By 1995, the Iraqi population were faced with a serious nutritional and health situation. In response, the Security Council passed Resolution 986, establishing the Oil-for-Food Programme (OFF program). The OFF program allowed for the limited importation of petroleum and petroleum products originating from Iraq, at market rates. The resolution required that payment for these products be made into an escrow account, which could then be used to pay for medicine, health supplies, foodstuffs, and other materials and supplies to satisfy essential civilian needs.2 2.3 In 2004, in response to concerns about fraud and corruption in the administration and management of the OFF program, the UNSC passed Resolution 1538, welcoming the decision of the UN Secretary-General to establish an independent high-level inquiry chaired by Mr Paul Volcker to investigate the administration and management of the OFF program, the Independent Inquiry Committee into the United Nations Oil-for-Food -

He said: “With the last British combat troops about to return home from Iraq, now is the right time to ensure that we have a proper process in place to enable us to learn the lessons of the complex and often controversial events of the last six years. I am today announcing the establishment of an independent Privy Counsellor committee of inquiry which will consider the period from summer 2001, before military operations began in March 2003, and our subsequent involvement in Iraq right up to the end of July this year. The inquiry is essential because it will ensure that, by learning lessons, we strengthen the health of our democracy, our diplomacy and our military. The inquiry will, I stress, be fully independent of Government. Its scope is unprecedented. It covers an eight-year period, including the run-up to the conflict and the full period of conflict and reconstruction. The committee of inquiry will have access to the fullest range of information, including secret information. In other words, its investigation can range across all papers, all documents and all material. It can ask for any British document to be brought before it, and for any British citizen to appear. No British document and no British witness will be beyond the scope of the inquiry.
