These Writ Petitions are filed under Articles 226 and 227 of the Constitution of India praying to direct the respondents to grant service weightage and age relaxation in terms of the order passed by the director of survey settlement and land records dated 31.01.2009 letter/circulars issued by the commissioner of survey settlement and land records dated 22.01.2010, 23.01.2010 vide Annexure-C,D and E.

These Writ Petitions coming for preliminary hearing this day, N.K.PATIL J., made the following:-

O R D E R

Though these matters are posted for Preliminary

Hearing, the same is taken up for final disposal with consent of the learned Counsel appearing for both the parties on the ground that the relief sought for in these writ petitions are directly covered by the order passed by this Court on 17 th January 2013 in W.P. Nos.51923-

52149/2012 and connected matters filed by Sri. Ravi

Kumara C and others against State of Karnataka and others.

2. These 106 petitioners herein have sought for a mandamus directing the respondents to grant service weightage and age relaxation in terms of the order passed by the Director of Survey Settlement and Land Records dated 31.1.2009, letters/Circulars issued by the

Commissioner of Survey Settlement and Land Records dated 22.1.2010, 23.1.2010 vide Annexures C, D and E respectively and further they sought for a direction to the respondents to absorb the services of the petitioners by granting service weightage and age relaxation in terms of the order passed by the Hon’ble Supreme Court and this

Hon’ble Court in W.P. No.240/90 D.D. 10.7.1991

(Annexure ‘F’), adhoc/temporary teachers in W.P.

No.20165/92 D.D. 28.9.1994 (Annexure ‘G’), Part-time teachers in S.L.P. No.42391/92 DD 3.9.1992 (Annexure

(Annexure ‘K’); and further sought to declare that denial of absorption by granting service weightage and age relaxation is totally arbitrary and violative of Articles 14 and 16 of the Constitution of India; direct the respondents to extend the relief in terms of the order passed by this

Hon’ble Court in the order dated 17.1.2013 in W.P.

Nos.51923-52149/2012 & 52150-52207/2012 (S-KAT) vide Annexure ‘M’ and further sought a direction to the respondents to consider the case of the petitioners for absorption in view of the representation submitted by the petitioners on 1.2.2013 vide Annexure ‘N’, in the interest of justice and equity.

3. Learned Counsel appearing for both the parties submitted that these writ petitions may be disposed of by following the order passed by this Court dated 17 th

January 2013 in W.P. Nos.51923-52149/2012 and connected matters filed by Sri. Ravi Kumar C and others against State of Karnataka and others and for the reasons stated therein.

4. The submission of the learned Counsel for both the parties as stated supra is placed on record.

5. All these writ petitions filed by the petitioners stand disposed of following the order dated 17 th January 2013 passed in W.P. Nos.51923-52149/2012 and connected matters filed by Sri. Ravi Kumar C and others against

State of Karnataka and others, reserving liberty to the petitioners to submit detailed representations to the

Commissioner for Survey, Settlement and Land Records within a period of 15 (Fifteen) days from the date of receipt of copy of this order.

6. If such representation is submitted by these petitioners, the Commissioner for Survey, Settlement and

Land Records, within 15 (Fifteen) days as stipulated, the said authority shall examine it and submit a report to the

Government within two (2) months and the Government in turn, shall take a decision thereafter as expeditiously as possible within six months from the date of receipt of such report from the Commissioner for Survey, Settlement and

Land Records.

7. With these observations, all these writ petitions stand disposed off.

Learned Government Pleader is permitted to file

Memo of Appearance for the respondents within four weeks from today.

In view of the disposal of main matters, I.A.s 1/2013 and 2/2013 are dismissed as having become infructuous.
