3. 4. 5. 10. There was submitted a report (docketed) dated 16 January 2013 by the Head of Planning and Development (1) advising of an unauthorised garden ground extension to the rear of the property at 102 South Dumbreck Road, Kilsyth, as shown on the plan attached to the report; (2) outlining the background relative thereto; (3) containing her observations thereon, and (4) recommending that an Enforcement Notice under Section 33A of the Town and Country Planning (Scotland) Act 1997, as amended by the Planning Etc. (Scotland) Act 2006, be served on the owner of 102 South Dumbreck Road requiring them to submit a planning application for the unauthorised garden ground extension.

UNAUTHORISED STORAGE AND SALE OF MOTOR VEHICLES AT 93A CAMPBELL STREET, WISHAW

11. With reference to paragraph 2 of the Minute of the meeting of this Committee held on IMarch 201 I whereby authorisation was given to take formal enforcement action in respect of the unauthorised storage and sale of motor vehicles at 93A Campbell Street, Wishaw, there was submitted a report dated 7 February 2013 by the Head of Planning and Development (1) advising that the enforcement case relating to the unauthorised storage and sale of motor vehicles at 93A Campbell Street, Wishaw had been heard at Hamilton Sheriff Court on 22 December 2012; (2) reminding Members of the background relative thereto; (3) intimating that following a plea guilty the owner of the property had been fined f250 for the non-compliance of the Enforcement Notice, and (4) indicating that, following a subsequent visit to the property, it had been found that the breach was no longer continuing and no further action be required to be taken.

Decided: that the report be noted.

REMOVAL OF TREES, EXTENSION TO GARDEN AND ERECTION OF BOUNDARY FENCE ADJACENT TO 6 BLANTYRE GARDENS, CUMBERNAULD

12. There was submitted a report (docketed) dated 15 January 2013 by the Head of Planning and Development (1) advising of the unauthorised erection of a section of fencing, the removal of trees and the extension to garden ground at 6 Blantyre Gardens, Cumbernauld, the location of which is outlined on the plan attached as an Appendix to the report; (2) outlining the background relative thereto; (3) containing her observations and considerations thereon, and (4) recommending, for the reasons detailed therein, that no enforcement action be taken in respect of the erection of unauthorised fencing, the removal of trees and the extension to garden ground at 6 Blantyre Gardens, Cumbernauld

ROADS ASSET MANAGEMENT PLAN (RAMP) 2013-2018

13. With reference to paragraph 13 of the Minute of the meeting of this Committee held on 18 August 201 1, there was submitted a report (docketed) dated 21 February 2013 by the Head of Roads and Transportation (1) reminding Members that a revised Road Asset Management Plan (RAMP) was being developed, with a target date of adoption of 31 March 2013; (2) intimating that the Roads Service had worked with other authorities to develop a shared service arrangement with other Scottish Roads Authorities for an asset management model and to identify best practice; (3) advising that the Society of Chief Officers for Transport in Scotland (SCOTS) proposed to continue to manage a shared service approach with Scottish Roads Authorities over the next four years to further develop asset planning, with the estimated cost to the Council being f9,000 in 2013114, which would be funded from the Roads Revenue Budget, with further year costs subject to development and further approval; (4) pointing out that Glasgow City Council would act as the lead authority in the shared service agreement; (5) indicating that the Council’s proposed RAMP had been prepared to coincide with and support the five year capital bid process and extended over the period 201 3/18; (6) stating that a copy of the proposed RAMP, an Executive Summary, and Appendices had been placed in the Members’ Library, and, subject to Committee approval, the RAMP would be published on the Council’s website; (7) summarising the main road asset types contained within the RAMP; (8) setting out a number of financial and corporate considerations, and (9) containing his recommendations thereon.

Thereon, the Convener proposed that the Head of Roads and Transportation give a presentation on the Road Asset Management Plan 2013118 to all Members of the Council immediately prior to the commencement of a future meeting of this Committee.

Decided:

(1) that the Road Asset Management Plan 2013/18 be approved and published on the Council’s website;

(2) that the Head of Legal Services, in consultation with the Head of Roads and Transportation, be authorised to enter into a further four year shared service agreement with other authorities, managed by SCOTS and led by Glasgow City Council, which would be given authority to act on behalf of the Council, to improve asset planning, at the estimated cost of f9,000 for 201 3/14;

(3) that the Head of Roads and Transportation give a presentation to all Members of the Council on the Road Asset Management Plan 2013/18 immediately prior to the commencement of a future meeting of this Committee, and

(4) that the Head of Roads and Transportation submit further reports on future asset planning costs and the development of the RAMP to future meetings of this Committee.

COMMONWEALTH GAMES, GLASGOW 2014 - NORTH LANARKSHIRE’S INVOLVEMENT IN DELIVERING THE GAMES CYCLING TIME TRIAL

14. There was submitted a report (docketed) dated January 2013 by the Head of Roads and Transportation (1) advising that the organisers of the 2014 Commonwealth Games had invited the Council to co-host with Glasgow City and East Dunbartonshire Councils the Cycling Time Trial Race, to be held on Thursday, 31 July 2014; (2) providing details of the proposed route of the race which would take cyclists into the area of North Lanarkshire north of the A80 before returning to Glasgow along the A80 corridor; (3) intimating that, to accommodate the race, the roads forming the route would require to be closed to all traffic from early morning until 4 pm on the race day, with some parts of the route being required to be closed from around 6 am; (4) explaining that the extended period of road closures was required on the grounds of safety and to allow the necessary installation of barriers and controls to facilitate the events; (5) reporting that the road closure would have a significant impact on residents and businesses, which would not be afforded any vehicular access to, or across the

route, during the period of the closures with some areas having no alternate access routes; (6) notifying that, in addition, the provision of public transports would be affected, as would access to and from nearby motorways, and (7) stating that early engagement between the Council, the public and local businesses would be crucial to securing a successful event.

Decided:

(1) that the Council’s involvement in co-hosting the 2014 Commonwealth Games’ Cycling Time Trial Race be noted;

(2) that it be noted that while the route had not been finalised there could be significant disruption to communities in the north of the Council area, and

(3) that the need for early engagement between the Council, the public and businesses in securing a successful event be noted.

THE NORTH LANARKSHIRE COUNCIL (VARIOUS STREETS, RAVENSCRAIG, MOTHERWELL) (40 MPH SPEED LIMIT) ORDER

15. There was submitted a report (docketed) dated 21 February 2013 by the Head of Roads and Transportation (1) seeking approval for the introduction of a Traffic Regulation Order to introduce a 40 mph speed limit order on New Craig Road and Robberhall Road, Ravenscraig, Motherwell as detailed within the report, and (2) outlining the background relative to the proposal.

Decided: that the North Lanarkshire Council (Various Streets, Ravenscraig, Motherwell) (40 mph Speed Limit) Order be approved.

PETITION - REQUEST FOR ROAD MARKINGS OUTSIDE WISHAW NURSERY CENTRE, WISHAW

16. With reference to paragraph 11 of the Minute of the meeting of this Committee held on 13 April 201 1, there was submitted a report dated 9 January 2013 by the Head of Roads and Transportation (1) advising of a petition which had been received from Wishaw Nursery Centre requesting the provision of road markings outside the Nursery Centre to prevent vehicles parking adjacent to the nursery on Greenside Road, Wishaw; (2) intimating that, following a visit to the Nursery by an Officer from his Section, it was agreed (a) that “School Keep Clear” and zig zag markings be provided over an approximate 35 metres length of Greenside Road outside the Nursery, and (b) that a six metre length of pedestrian guardrail be installed on the footway, in line with pedestrian access to the Nursery, and (3) indicating these works had subsequently been carried out.

Decided:

(1) that it be noted that the works had already been carried out;

(2) that the Head of Central Services advise the petitioners accordingly, and

(3) that the report be otherwise noted.

REQUEST FOR THE PROVISION OF TRAFFIC CALMING MEASURES ON DALSHANNON VIEW, DALSHANNON ROAD AND BAIRD CRESCENT, CONDORRAT, CUMBERNAULD

17. With reference to paragraph 11 of the Minute of the meeting of this Committee held on 26 May 201 1, there was submitted a report (docketed) dated 21 February 2013 by the Head of Roads and Transportation (1) referring to the petition received from Condorrat Community Council requesting the

provision of traffic calming measures on Dalshannon View, Dalshannon Road and Baird Crescent, Condorrat, Cumbernauld; (2) advising that a review of Strathclyde Police accident records indicated that there were no injury accidents on Dalshannon View, Dalshannon Road and Baird Crescent, Condorrat, Cumbernauld recorded between 3 December 2009 and 2 December 2012; (3) reminding Members that, on 26 May 201 1, a priority list of sites with more than five injury accidents had been approved by this Committee for use as the basis for tackling problems associated with road accidents within North Lanarkshire, and (4) recommending accordingly that no action be taken to introduce traffic calming on Dalshannon View, Dalshannon Road and Baird Crescent.

Decided:

(1) that no action be taken to introduce traffic calming on Dalshannon View, Dalshannon Road and Baird Crescent, Condorrat, Cumbernauld;

(2) that the Head of Central Services advise the petitioners accordingly, and

(3) that the report be otherwise noted.

PLANNING APPLICATION 12/00985/FUL - CHANGE OF USE OF SHOP TO HOT FOOD TAKEAWAY - 6 CENTRE STREET, GLENBOIG

20. With reference to paragraph 2 of the meeting of this Committee held on 13 December 2012 in so far as it related to planning application 12/00985/FUL for the change of use of a shop to a hot food takeaway at 6 Centre Street, Glenboig, the Committee considered a report by the Executive Director of Environmental Service and thereafter proceeded to hold a hearing.

Consideration was also given to oral representations made by the applicant who was in attendance for this item.

Councillor Taggart, seconded by Councillor Stocks, moved that the application be granted in accordance with the conditions contained within the report by the Executive Director of Environmental Services.

Councillor McKenna, seconded by Councillor Sullivan, moved, as an amendment, that the application be refused on the grounds of insufficient parking provision.

On a vote being taken, 12 Members voted for the amendment and 7 Members voted for the motion. The amendment was accordingly declared carried.

Decided: that the application be refused for the undernoted reasons:-

(1) that the proposed hot food takeaway would be contrary to the terms of Policy DSP 48 of the adopted North Lanarkshire Local Plan 2012 in that the site could not provide sufficient off-street parking to serve the development, and

(2) that the proposed hot food takeaway would be contrary to the terms of Policy HCF 1A of the adopted North Lanarkshire Local Plan 2012 in that it would be detrimental to the amenity of the surrounding residential area, as it would result in additional on-street parking in an area where there was already a high level of on-street parking, to the detriment of road safety.

PLANNING APPLICATION 12/01002/FUL - CONSTRUCTION OF THREE RETAIL UNITS WITH ASSOCIATED CAR PARKING (DEMOLITION OF FORMER POLICE STATION) - FORMER POLICE STATION, PARKFOOT STREET, KILSYTH

21. With reference to paragraph 2 of the Minute of the meeting of this Committee held on 13 December 2012 in so far as it related to planning application 12/01002/FUL for the construction of three retail units with associated parking (demolition of former Police Station) Parkfoot Street, Kilsyth, the Committee considered a report by the Executive Director of Environmental Services and thereafter proceeded to hold a hearing.

Consideration was also given to oral representations made by Councillors Jones and Stevenson, local Members, the applicant, agent and objectors who were in attendance for this item.

Decided: that the application be refused for the undernoted reasons:-

(1) that the proposed retail development would be contrary to the terms of Policy RTC 1 of the adopted North Lanarkshire Local Plan 2012 in that it would adversely affect the designated town centre by providing further retail floorspace on a site not allocated for that use, outwith the town centre;

(2) that the proposed retail development would be contrary to the terms of Policy DSP 4a of the adopted North Lanarkshire Local Plan in that its design and proposed finishes did not recognise the site’s prominent and sensitive location, at a major junction of two primary routes through Kilsyth, and

(3) that the proposed retail development would be contrary to the terms of Policy SDP 4b of the adopted North Lanarkshire Local Plan 2012 in that the site could not provide sufficient off-street parking to serve the development.
