Introduction This report presents the 2019 – 2020 annual reports for two former portfolio committees of the 56th Legislative Assembly:  Innovation, Tourism Development and Environment Committee, and  State Development, Natural Resources and Agricultural Industry Development Committee. These committees ceased to exist on 21 May 2020 when the Legislative Assembly, in accordance with s 88 of the Parliament of Queensland Act 2001, amended Schedule 6 of the Standing Rules and Orders of the Legislative Assembly. Under these amendments the committees ceased to exist. Due to their cessation, the two former portfolio committees, detailed above, have not reported on their activities for the 2019/2020 year. The financial figures provided in the reports that follow reflect costs to 21 May 2020. Portfolio committees are established by Standing Orders, as required by section 88 of the Parliament of Queensland Act 2001. Standing Orders also set out the areas of responsibility for each portfolio committee (its portfolio area). Each committee has the following roles in relation to its portfolio area:  examine Bills and consider the policies to be enacted  examine the Appropriation Bill estimates for the portfolios within its responsibility  examine Bills’ compliance with the fundamental legislative principles set out in section 4 of the Legislative Standards Act 1992 (Qld)  consider the lawfulness of, and the application of the fundamental legislative principles to, subordinate legislation  assess the public accounts of each portfolio unit in relation to the integrity, economy, efficiency and effectiveness of financial management by examining government financial documents and considering the annual and other reports of the Auditor-General, and  consider portfolio public works in light of matters including, but not limited to, the: o suitability of the works for the purpose o necessity for the works o value for money of the works o revenue produced by, and recurrent costs of, the works, or estimates of revenue and costs o present and prospective public value of the works o procurement methods used for the works o actual suitability of the works in meeting the needs in and achieving the stated purpose of the works.

Portfolio committees may also initiate an inquiry into any other matter it considers appropriate, in relation to its portfolio area. As well, portfolio committees are required to investigate any issue referred to them by the Legislative Assembly or under an Act, whether or not the issue is within their areas of responsibility. Innovation, Tourism Development and Environment Committee Annual Report 2019 – 2020

Committee Responsibilities The Innovation, Tourism Development and Environment Committee (committee) is a former portfolio committee of the Legislative Assembly which commenced on 15 February 2018 under s.88 of the Parliament of Queensland Act 2001 and the Standing Rules and Orders of the Legislative Assembly.1 The committee ceased to exist on 21 May 2020. The former committee’s primary areas of responsibility included innovation and tourism industry development, and cross river rail; and environment and the Great Barrier Reef, sciences and the arts.

Bills examined

Biodiscovery and Other Legislation Amendment Bill 2019 Date referred: 26 November 2019 Reporting deadline: 21 February 2020 Status: Complete For its inquiry, the committee received four submissions, was briefed by the Department of Environment and Science (29 January 2020), and conducted a public hearing in Brisbane (29 January 2020). The committee made one recommendation, that the Bill be passed. The Bill passed on 11 August 2020.

Inquiries

Queensland Audit Office Report to Parliament No. 7: 2018-19 Conserving threatened species Date referred: 15 November 2018 Reporting deadline: n/a Status: Complete For its inquiry, the committee received a public briefing from the Queensland Audit Office (13 May 2019) and sought responses from the Department of Environment and Science (5 July 2019) relating to progress made in implementing the Audit Office recommendations. The committee tabled its report on 19 September 2019, making one recommendation, that the Legislative Assembly note the content of the committee report.

2019-20 Budget Estimates Date referred: 11 June 2019 Reporting deadline: 16 August 2019 Status: Complete For its inquiry, the committee held a public hearing (31 July 2019) at which it questioned the Minister for Innovation and Tourism Industry Development and Minister for the Commonwealth Games; and the Minister for Environment and the Great Barrier Reef, Minister for Science and Minister for the Arts; and other witnesses, regarding the committee’s portfolio areas. The committee also sought and published written answers to 20 questions on notice from each Minister prior to the hearing. The committee tabled its report and a volume of additional information on 16 August 2019 and made one recommendation; that the proposed expenditure, as detailed in the Appropriation Bill 2019 for the committee’s area of responsibility, be agreed to by the Legislative Assembly without amendment. The Bill was passed on 21 August 2019.

2 Annual reports of former committees 2019 – 2020 Public works inquiry into the redevelopment of the Mon Repos Turtle Centre Self-referred: 16 September 2020 Reporting deadline: 29 February 2020 Status: Complete For its inquiry, the committee considered eight submissions, including a detailed response from the Department of Environment and Science addressing specific questions relating to the terms of reference. The committee received a public briefing from the Department of Environment and Science and the Department of Housing and Public Works (3 February 2020), and undertook a site inspection of the Mon Repos centre (10 February 2020). The committee also conducted a public hearing in Bundaberg on 11 February 2020. The committee tabled its report on 21 February 2020. The committee concluded that it was satisfied with each of the matters outlined in the terms of reference and recommend that the Legislative Assembly note the contents of the report.

Subordinate legislation examined As part of its examination of subordinate legislation, the committee tabled the following reports:  Report No. 19 - Subordinate legislation tabled between 1 May 2019 and 11 June 2019  Report No. 21 – Subordinate legislation tabled between 12 June 2019 and 20 August 2019  Report No. 23 – Subordinate legislation tabled between 21 August 2019 and 3 September 2019  Report No. 24 – Subordinate legislation tabled between 4 September 2019 and 15 October 2019  Report No. 27 – Subordinate legislation tabled between 16 October 2019 and 26 November 2019  Report No. 28 – Subordinate legislation tabled between 27 November 2020 and 4 February 2020  Report No. 29 – Subordinate legislation tabled between 5 February 2020 and 17 March 2020 In examining the subordinate legislation, the committee sought and published further explanations from departments and Ministers, discussed additional fundamental legislative principle and human rights issues to those raised in supporting documentation, and identified errors and omissions within explanatory notes. The committee recommended that the Legislative Assembly note the contents of the reports.

State Development, Natural Resources and Agricultural Industry Development Committee Annual Report 2019 – 2020

Committee Responsibilities The State Development, Natural Resources and Agricultural Industry Development Committee was a committee of the 55th Parliament. The committee’s portfolio areas of responsibility were: state development, manufacturing, infrastructure and planning; natural resources, mines and energy; and agricultural industry development and fisheries.

Bills examined

Report No. 31 – Therapeutic Goods Bill 2019 Date referred: 16 May 2019 Reporting deadline: 11 July 2019 Status: tabled 11 July 2019 The Therapeutic Goods Bill 2019 was referred to the committee for examination and report in the previous financial year. The Bill was originally referred to the Health, Communities, Disability Services and Domestic and Family Violence Prevention Committee on 14 May 2019, but was re-referred to the committee for consideration on 16 May 2019. The Bill proposed to adopt the Therapeutic Goods Act 1989 (Cwth) as Queensland law. The explanatory notes state the Bill will enhance national consistency, reduce regulatory burdens and ensure appropriate safeguards are implemented to protect the health and safety of the community. The committee received one submission to the inquiry, and held a public briefing with the Department of Health in the previous financial year. The committee made one recommendation, that the Bill be passed. The Bill was passed by the Legislative Assembly on 17 September 2019.

Report No. 32 – Medicines and Poisons Bill 2019 Date referred: 16 May 2019 Reporting deadline: 11 July 2019 Status: tabled 11 July 2019 The Medicines and Poisons Bill 2019 was referred to the committee for examination and report in the previous financial year. The Bill was originally referred to the Health, Communities, Disability Services and Domestic and Family Violence Prevention Committee on 14 May 2019, but was re-referred to the committee for consideration on 16 May 2019. The Bill sought to repeal and replace the existing legislation with a new regulatory framework which would: • provide greater assurance to the community that medicines, poisons and therapeutic goods are regulated by a modern, outcomes-focused framework that enhances public safety; • ensure Queensland Health is better able to monitor and respond to health risks associated with inappropriate access to and use of medicines and poisons • simplify licensing requirements • streamline requirements for prescribing medicinal cannabis in Queensland • improve national uniformity • provide certainty for medicines manufacturers by applying the Commonwealth Therapeutic Goods Act, ensuring that all therapeutic goods are manufactured to the same high standard • include no new or increased fees.

The committee received 25 submissions to the inquiry, and held a public briefing with the Department of Health and a public hearing in the previous financial year. The committee made ten recommendations, including that the Bill be passed. The government supported, or supported in principle, all of the recommendations. The Bill was passed, with amendments, on 17 September 2019.

Report No. 33 – 2019-20 Budget Estimates Date referred: 12 June 2019 Reporting deadline: 15 August 2019 Status: tabled 15 August 2019 The committee held a public hearing on 24 July 2019 to examine the proposed expenditures contained in Appropriation Bill 2019. The committee asked questions of the Minister for State Development, Manufacturing, Infrastructure and Planning, the Minister for Natural Resources, Mines and Energy and the Minister for Agricultural Industry Development and Fisheries, as well as senior departmental officials and representatives of government owned corporations, regarding the proposed expenditures for their portfolio areas. The committee made one recommendation that the proposed expenditure, as detailed in the Appropriation Bill 2019 for the committee’s areas of responsibility, be agreed to by the Legislative Assembly without amendment.

Report No. 37 – Agriculture and Other Legislation Amendment Bill 2019 Date referred: 22 August 2019 Reporting deadline: 9 October 2019 Status: tabled 9 October 2019 The Bill was an omnibus Bill which sought to amend various Acts to address a number of matters in the agriculture; animal management and welfare; forestry; and fisheries sectors. The committee examined a number of aspects of the Bill, including those related to addressing protest actions; the use of body worn cameras; animal welfare investigations and offences; and the movement of wild goats. The committee received 19 submissions to their inquiry. The committee held a public briefing with the Department of Agriculture and Fisheries, the Department of Environment and Science, the Queensland Police Service, and the Department of Local Government, Racing and Multicultural Affairs; and a public hearing with a number of stakeholders on 13 September 2019. The committee made five recommendations, including that the Bill be passed. The government agreed, or agreed in principle, with all of the recommendations. The Bill was passed, with amendments, on 6 February 2020.

Report No. 40 – Resources Safety and Health Queensland Bill 2019 Date referred: 4 September 2019 Reporting deadline: 18 October 2019 Status: tabled 18 October 2019 The objective of the Bill was to establish a revised regulatory framework for resources safety and health in Queensland with the aim of engendering workers’ trust, ensuring appropriate independence and transparency, and enhancing independent oversight of the performance of the resources safety and health regulator. The committee received 13 submissions to its inquiry. The committee held a public briefing with the Department of Natural Resources, Mines and Energy on 16 September 2019, and a public hearing on 25 September 2019. The committee also held a site visit to Jeebropilly Mine, Amberley on 25 September 2020. The committee made four recommendations, including that the Bill be passed. The government accepted all the recommendations. The Bill was passed, with government amendments, on 17 March 2020.

7 Annual reports of former committees 2019 – 2020 Report No. 44 – Natural Resources and Other Legislation (GDA2020) Amendment Bill 2019 Date referred: 23 October 2019 Reporting deadline: 6 December 2019 Status: tabled 6 December 2019 The Bill sought to implement the national standard of measurement of position, Geocentric Datum Australia 2020 (GDA2020) for the future collection and provision of location data to ensure Queensland is responsive to national measurements standards, as well as other amendments to land titling processes, including giving effect to Indigenous Land Use Agreements to grant unallocated state land as freehold to Traditional Owners, and extend the boundary of the Cape York Peninsula region. The committee received three submissions to the inquiry, and held a public briefing with the Department of Natural Resources, Mines and Energy and the Department of Aboriginal and Torres Strait Islander Partnerships on 6 November 2019. The committee made one recommendation, that the Bill be passed. The Bill was passed by the Legislative Assembly on 20 February 2020. Report No. 45 – Implementation of The Spit Master Plan Bill 2019 Date referred: 26 November 2019 Reporting deadline: 7 February 2020 Status: tabled 7 February 2020 The primary objective of the Bill was to facilitate the implementation of The Spit Master Plan, which was released by the State Government in May 2019. The committee examined a number of matters including: • Granting of unallocated state land outside the processes under the Land Act 1994; • Roads and roads closures; • Proposed amendment of the Gold Coast Waterways Authority Act 2012; • Other matters associated with the implementation of The Spit Master Plan; and • Proposed amendment of the Planning Act 2016. The committee received 18 submissions to the inquiry, and held a public hearing at The Spit on 18 December 2019. The committee also conducted a site visit with the Gold Coast Waterways Authority on 18 December 2019 to gain further insight into both the master plan and how the Bill would assist in the implementation of aspects of the master plan. The committee made four recommendations, including that the Bill be passed. The Government supported two of the committee’s recommendations, and supported in principle one recommendation. The Bill was passed with amendments on 19 February 2020.

Report No. 46 – Mineral and Energy Resources and Other Legislation Amendment Bill 2020 Date referred: 4 February 2020 Reporting deadline: 27 March 2020 Status: tabled 27 March 2020 The explanatory notes for the Bill stated that the policy objectives related to three priorities of the Queensland Government: resources safety and health; financial assurance; and regulatory efficiency. In their consideration of the Bill, the committee examined these three areas as well as industrial manslaughter provisions and appointment requirements for statutory office holders. There was significant community interest in the Bill. The committee received 80 submissions, and held public hearings in Brisbane and Moranbah on 3 March 2020. To better appreciate the objectives of the Bill, the committee conducted a site visit to BMA’s Broadmeadow Mine on 4 March 2020 to experience the underground mining environment and discuss safety and health in the resources industry with those at the site. The committee made nine recommendations, including that the Bill be passed. The government supported all of the committee’s recommendations. The Bill was passed with amendments on 20 May 2020.

8 Annual reports of former committees 2019 – 2020 Other reports and inquiries Report No. 36 – Annual Report 2018-19 Status: tabled 20 September 2019 The committee tabled its Annual Report which outlined the work of the committee during the 2018-2019 financial year.

Report No. 42 – Inquiry into the impacts of invasive plants (weeds) and their control in Queensland Resolved to inquire: 1 April 2019 Status: tabled 6 December 2019 The committee’s examination of the impacts of invasive plants (weeds) and their control in Queensland continued the inquiry commenced in the 55th Parliament by the former Agriculture and Environment Committee (AEC). The AEC was unable to complete its inquiry prior to the 55th Parliament being dissolved in October 2017. On 1 April 2019, the committee resolved to finalise the AEC inquiry into invasive plants (weeds) and their control in Queensland. The committee used the evidence of the AEC inquiry, as well as evidence taken at a departmental briefing held in the 2018-2019 financial year. As it was not possible to examine government programs for all weeds, the AEC resolved to examine the impact of three invasive plant species and their control as case studies for the inquiry:  prickly acacia (Vachellia nilotica)  giant rat’s tail grass (GRT) (Sporobolus pyramidalis and Sporobolus natalensis)  fireweed (Senecio madagascariensis) The report made one recommendation that the Legislative Assembly note the contents of the report.

Consideration of Queensland Audit Office Reports to Parliament

Report No. 47 – Queensland Audit Office Report to Parliament No. 4: 2019-20—Water: 2018-19 results of financial audits Report tabled and referred to committee: 24 October 2019 Status: tabled 30 March 2020 As part of its consideration of the Auditor-General report, the committee received a public briefing from the Queensland Audit Office on 17 February 2020. The committee considered the Auditor-General’s findings in relation to its financial audits of five Queensland water entities: Seqwater, Sunwater, Queensland Urban Utilities, Unitywater and Mount Isa Water Board. The committee made one recommendation, that the Legislative Assembly note the contents of the report.

9 Annual reports of former committees 2019 – 2020 Report No. 48 – Queensland Audit Office Report to Parliament No. 6: 2019-20—Energy: 2018-19 results of financial audits Report tabled: 21 November 2019 Referred to committee: 28 November 2019 Status: tabled 30 March 2020 As part of its consideration of the Auditor-General report, the committee received a public briefing from the Queensland Audit Office on 17 February 2020. The committee considered the Auditor-General’s findings in relation to its financial audits of the government’s main energy entities – CleanCo Queensland Limited, CS Energy Limited, Energy Queensland Limited (including the results of Ergon Energy Queensland), Queensland Electricity Transmission Corporation (trading as Powerlink Queensland), and Stanwell Corporation Limited. The committee made one recommendation, that the Legislative Assembly note the contents of the report.

Queensland Audit Office Report to Parliament No. 9: 2019-20—Addressing mine dust lung disease Report tabled: 5 December 2019 Referred to committee: 6 February 2020 Status: Lapsed As part of its consideration of the Auditor-General report, the committee received a public briefing from the Queensland Audit Office on 27 April 2020, and a public hearing with witnesses from the Office of Industrial Relations and the Department of Natural Resources, Mines and Energy on 11 May 2020. As a result of changes to Schedule 6 of the Standing Rules and Orders of the Legislative Assembly, the committee ceased to exist before the completion of its consideration of the Auditor-General report. The Auditor-General report was then re-referred to the Natural Resources, Agricultural Industry Development and Environment Committee on 21 May 2020.

Queensland Audit Office Report to Parliament No. 12: 2019-20—Managing coal seam gas activities Report tabled: 18 February 2020 Referred to committee: 20 February 2020 Status: Lapsed As part of its consideration of the Auditor-General report, the committee received a public briefing from the Queensland Audit Office on 27 April 2020, and a public hearing with witnesses from the GasField Commission Queensland; Department of Agriculture and Fisheries; Department of Environment and Science; and Department of Natural Resources, Mines and Energy on 11 May 2020. As a result of changes to Schedule 6 of the Standing Rules and Orders of the Legislative Assembly, the committee ceased to exist before the completion of its consideration of the Auditor-General report. The Auditor-General report was then re-referred to the Natural Resources, Agricultural Industry Development and Environment Committee on 21 May 2020.

Non-inquiry related activities Throughout the 2019-20 financial year, the committee held a number of public and private briefings and meetings with relevant departments and stakeholders in regard to its portfolio responsibilities.

Seqwater site visit On 6 November 2019, the committee undertook site visits to Seqwater’s Luggage Point Advanced Water Treatment Plant in Pinkeba, and the Gold Coast Desalination Plant in Tugun. The committee saw the process of purifying recycled water from treated wastewater at the Luggage Point Advanced Water Treatment Plant, and the process of purifying seawater to drinking water at the Gold Coast Desalination Plant.
