The By-law 2005-073 is to remain in effect for a period of one year from the date of passing. However, Subsection 38 (2) of the Plan- ning Act allows Council to amend the By-law to extend the period of time during which it will be in effect, provided the total period of time does not exceed two years from the date of passing. The Purpose & Effect of the Interim Control By-law No. 2005-073 is to restrict new development within 200 metres of all water bodies in The Township of Seguin subject to certain standards related to lot coverage, retention of natural vegetative areas, height restrictions, gross floor areas, extension of legal non-conforming use, cumulative width of docks and boathouses and restrictions on boathouses. The Bylaw applies to all lands within 200 metres of water bodies in all of the Township of Seguin. No key map provided since Sched- ule ‘A’ to By-law No. 2005-073 lists all of the water bodies that the By-law applies to. AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board, with respect to the By-law, by filing with the Clerk of The Corporation of the Township of Seguin, on or before 4:30 p.m. on the 2nd day of September, 2005, a Notice of Appeal, setting out the objections to the By-law and the reasons in support of the objection; accompanied by a fee of $125.00 (made payable to the Minister of Finance) prescribed under the Ontario Municipal Board Act. Only individuals, corporations, and public bodies may appeal an Interim Control By-law to the Ontario Municipal Board. A notice of appeal filed by an unincorporated association or group is liable to be dismissed as an invalid appeal. However a notice of appeal may be filed on behalf of an association by and in the name of an individual who is a member of the association. Additional information on By-law 2005-073 is available in the Planning Department of the Township of Seguin between the hours of 8:30 a.m. and 4:30 p.m., Monday through Friday exclusive of weekends and statutory holidays.
